General
1. Following a Home Office tendering process last year, new EM contracts were awarded to Securicor Justice
Services Ltd and Premier Monitoring Services Ltd. These contracts come into force on 1 April 2005 and will last for five
years, with a possible extension of up to a further two years. The contracts change the area structure for EM with five
areas in place of the current four. The table at Annex A provides details of the contract areas and the relevant supplier. A
list of contact details for the suppliers is at Annex B.
2. Please note that, since the announcement of the new contracts, Securicor Justice Services have changed
their name to Group4Securicor. This should now be used in all communications with and documents sent to
them.
Transition period
3. Although the new contracts commence on 1 April 2005, the current EM contracts will continue to operate until
30 April 2005. The one-month overlap is to allow time to transfer EM cases and the EM suppliers’ staff, in those criminal
justice areas where there is a change of supplier. Staff should be aware that:
• All new orders with EM during the transition period of April 2005 will be dealt with by the new suppliers, and under
the new contracts.
• Orders which began before 1 April 2005, and will expire no later than 30 April 2005, will continue to be monitored
by the supplier who was responsible for the offender under the current contracts.
• Orders which began before 1 April 2005, and are not due to expire until after 30 April 2005, will transfer from the
current to the new supplier during April 2005 (in criminal justice areas where there is a change of supplier).
• Reliance Monitoring Services, who currently operate in the South of England, were not successful in the
tendering process and will not provide an EM service to the Home Office under the new contracts.
4. A full EM service will be provided during April 2005. The suppliers have been working closely to ensure a smooth
transition to the new service.
Communications
5. The new contract arrangements will render certain local communication documents (leaflets, videos etc) out of
date from 1 April. EM suppliers have produced a new set of documents which have been approved by the Home Office. If
you do not receive a copy of these shortly, please contact the relevant supplier listed in Annex B.
6. Work is also under way to produce a joint Home Office / EM supplier video and DVD for the main criminal justice
agencies involved in EM work. This will replace the videos issued to courts at the start of the old contracts to explain the
EM service, and will also be aimed at providing relevant information for offenders. The new material will be available later
this year.

Protocols
8. These have been finalised in consultation with the relevant agencies for the community order and HDC, and are
attached with this circular at Annexes C and D.
9. As part of their work on implementing new sentencing provisions from the Criminal Justice Act 2003, and the
unification of the criminal courts under Her Majesty’s Courts Service (HMCS), DCA will supply all criminal courts with a
standardised form to be sent to EM suppliers. The Prison Service has also notified its staff of the relevant changes.
10. Any court orders given for offences committed before 4 April 2005 will be subject to existing legislation, and the
Home Office and DCA are also preparing a standard form to be used for these cases. These will be issued shortly and,
on receipt, all old forms and literature should be destroyed to avoid any confusion over the contract changes.
11. The new contracts for EM commence three days before the implementation of the new community order and
suspended sentence contained in the CJA 2003 on 4 April 2005. There are some specific issues to be aware of in relation
to electronic monitoring.
12. Any requirement of the new community order or suspended sentence may be subject to electronic monitoring, but
where the court imposes either a curfew or exclusion requirement, the legislation creates a presumption that both these
requirements will be electronically monitored unless there are exceptional reasons why this should not be done. At
present, exclusion with electronic monitoring is only available in the three satellite tracking pilot areas – Greater
Manchester, West Midlands and Hampshire.
Responsible Officers
13. The change to EM suppliers and the implementation of some of the sentencing provisions of the CJA 2003
require new Orders to be made specifying the officer responsible for electronic monitoring. The SI numbers are not yet
available, but the SIs will be posted on the HMSO website. The address is: www.legislation.hmso.gov.uk. For ease of

action depends on which requirements are imposed, as follows:
Sentence Implementation
14. Probation staff should note the content of SS7.6 in the Draft National Standards 2005, recently issued as Probation
Circular 7/2005. This states:
“Where electronic Monitoring has been imposed in addition to any other requirement, Probation Service staff shall
instruct the offender at Court or upon release what the requirement means and that this requirement will
commence at the time stated in the requirement.”
Enforcement of Breach
15. Probation Circular 13/05 set out new joint (NPD and DCA) processes to improve the listing and notification of
hearings for community order breach cases. These are intended to speed up the time taken from the second
unacceptable absence to resolution of the case. The circular that was issued about these processes did not include EM,
but DCA will shortly be producing an Effective Practice Guide for agencies involved in court enforcement, and this will
include processes involving EM suppliers.
16. In cases where an offender manager is the responsible officer, he or she must initiate and take forward any
breach action relating to the offender, even if the breach relates exclusively to an electronically monitored requirement.
The EM supplier will provide the necessary breach information to the offender manager, but will not act as the responsible
officer in court. EM suppliers are contractually obliged to appear in court in these cases only “where necessary” and this
will usually be where a technical explanation of EM is required by the court. In all other cases the breach pack provided
by the supplier should suffice.
17. Schedule 8, Part 1 of the CJA 2003 makes it clear that an electronically monitored requirement which is
breached should be enforced by the responsible officer in the same way that any other requirement would be. This
18. In order to ensure effective liaison between probation staff and EM suppliers on breach enforcement issues, each
probation area should nominate a single contact point for dealing with such issues. This will be particularly important if,
as expected under CJA 2003 enforcement provisions, offender managers take on an increased breach caseload where
EM is part of a community penalty.
19. Youth Offending Teams have been contacted separately by the Youth Justice Board to clarify arrangements for this
age group. In short the implementation of some of the sentencing provisions of the CJA 2003 on 4 April will not include
16–17 year old offenders. This age group will continue to be sentenced under existing legislation and will not be subject
to adult community orders. Further information can be obtained from Mary Wyman at the Youth Justice Board on 020

20. From 1 April 2005, the Electronic Monitoring Team (EMT) will become part of the NOMS HQ structure reporting to the
Director of Commerce and Finance. The team has been working within the Interventions Unit in NPD for 2 years and will
continue to work closely with probation stakeholders. The EMT will remain in its current location at Horseferry House for
the foreseeable future and the same contact details will apply.

1. Introduction
The purpose of this protocol is to provide the basis for the exchange of information between
all organisations involved in the imposition and management of Community Orders.
Effective working relationships between courts, the Crown Prosecution Service, the Probation
Service and Youth Offending Teams, local police forces and the electronic monitoring service
providers are essential to ensure that the orders operate successfully. This protocol describes
the processes for the exchange of information to ensure that each organisation understands its
roles and responsibilities and adopts consistent practices.
The protocol deals mainly with orders made to adults and some juveniles aged between 16-17
years. Provisions under the Criminal Justice Act 2003 are not being implemented for 16-17
year olds from 4th April 2005 until a later date (expected in 2007) but there will be those
Subjects under existing legislation and Subjects aged 17 who pass their 18th birthday in the
period of the order who will continue to be supervised on orders by the Youth Offending
Teams. The protocol does not cover arrangements for electronic monitoring of individuals
sentenced under previous legislation which will continue to apply for offences committed
before 4 April 2005.
The rules and processes for Community Orders apply nationally - while most communication
between agencies takes place locally, the standard procedures will be developed at a national
level. These may require configuration at a local level to define the detail of the interactions
between the agencies in each area.
The Community Order protocol includes cases where a Subject receives a Community Order
or a Suspended Sentence Order, sometimes referred to as a Custody Minus Order. The
protocols are identical for both types of order other than Suspended Sentence Orders may
require periodic Court Reviews. These are discussed within the protocol.
A Community Order may require one or more of the five forms of electronic monitoring:
curfew, attendance, exclusion, continuous location and retrospective location monitoring. The
protocol covers curfew and attendance monitoring only, as the other forms of monitoring are
not expected to become national schemes in 2005. Processes for these forms of monitoring
will be included in this document when it is decided to implement them nationally.
The protocol sets out the mechanisms for completing business processes at each stage in the
management of a Community Order. There are nine stages overall which are described in the
protocol in terms of the detailed business processes. A flowchart is provided for each stage to
summarise the business processes within the stage and each business process is denoted by its
stage reference number. By using this reference number the Protocol user can navigate
through the document to find the detailed process details.
The process details are described in a tabular form. Contact names for each organisation are
included in the annexes.
The protocol provides a comprehensive description of the processes that will be used
throughout the period of an order, however, it is unlikely that every action listed in the
protocol will need to be undertaken for every offender who is subject to a Community Order
or Suspended Sentence Order. The objective of the protocol is to set out the way that
information will be exchanged as and when necessary and therefore lists all the possible
information exchanges that might occur in managing the order.
The protocol does not cover how information should be handled within each organisation.
This is a matter for each organisation, which needs to ensure that it meets its statutory
responsibilities.
The Home Office is responsible for maintaining this protocol and issuing changes to protocols
when they are revised. The Home Office should be contacted with details of the new process
if any processes change and an update to the Protocol will be issued.
Revised versions of the Protocol will be issued from time to time when processes have been
materially changed. Each version of the Protocol will be identified by a version number and
issue date. The Electronic Monitoring Team will maintain a register of version numbers of the
Protocol and the dates of issue.
The Protocol is available in electronic format and in general will be issued to users
electronically. Hard copy formats of the document will be issued only when users are unable
to receive electronic copies of the document.

The protocol allows for local practices to be developed and for the protocol to be amended in
other aspects at a local level, in agreement with the Home Office. The nature of information
exchanged should not differ locally from this protocol (although it can be of broader scope
than this protocol with local agreement), but it is possible for the format in which the
information is provided to be varied from this protocol if it relates to communication between
Suppliers and local police and probation services and where there is not a need for a
consistent national format. However, variations to the protocol should only be proposed
following agreement by all organisations in the area concerned.
If an offender is aged 16 years or over he/she may be sentenced to a Community Order where
the offence is serious enough to merit a community sentence but is not serious enough to
require a custodial sentence. The Community Order imposes one or more requirements on the
individual from the following list:
• Unpaid work
• Participation on specific activities
• Programmes aimed at changing offending behaviour
• Prohibition from certain activities
• Curfew
• Exclusion from certain areas
• Residence requirement
• Mental health treatment (with the offender’s consent)
• Drug rehabilitation (with the offender’s consent)
• Alcohol treatment (with the offender’s consent)
• Supervision and
• Attendance Centre (for offenders aged under 25 only).
The Courts will be responsible for determining the requirements to make up a bespoke
Community Order for an offender and this may involve the use of electronic monitoring to
monitor the offender’s compliance with one or more of the requirements.
The single Community Order was introduced by the Criminal Justice Act 2003 and from 4
April 2005 replaces all existing adult community orders including Curfew Orders,
Community Rehabilitation Orders, Community Punishment Orders and Attendance Centre
Orders. In addition, community programmes under existing schemes such as ICCP will be
replaced by Community Orders. However the new Community Order does not apply
retrospectively and offenders currently subject to an adult community order will complete the
sentence imposed. Existing protocol arrangements for orders which continue under old
legislation will continue to apply. Where processes can sensibly be updated for new
legislation this protocol updates previous protocols. Where processes are unchanged from
those of previous legislation this is indicated by an asterisk in the process descriptions.
The new Community Order and Suspended Sentence Order will apply if the date of the
offence is on or after 4 April 2005.
The legislation for the use of Electronic Monitoring with Community Orders
Where the Court imposes a curfew requirement or an exclusion requirement the Court must
also impose an electronic monitoring requirement unless:
• There is a person (other than the offender) without whose co-operation it will not be
practicable to secure electronic monitoring and that person does not consent to its use;
or
• Electronic monitoring arrangements are not available in the relevant area for the
order; or
• In the particular circumstances of the case, the Court considers it inappropriate to do
so.
Where the Court makes a Community Order which imposes any of the other requirements on
the offender the Court may also impose an electronic monitoring requirement to monitor
compliance with the order unless any of the above conditions apply.
The minimum and maximum time periods that the Court can impose for each requirement are:
Where the entry in the table is blank there is no specified minimum time period.
A Community Order may be imposed on an offender for a maximum period of three years. If
a Community Order imposes two or more different requirements then the Court may impose a
shorter period for one or more of the requirements to be completed.
What happens if the Subject does not comply with the Community Order?
Failure to comply with a Community Order may result in the Subject being returned to Court
and given an alternative sentence, which may be a custodial sentence.
If a Subject commits any of the following less serious kinds of violation a warning will be
issued in writing:
• One or more curfew violations whose total length amounts to a period of two hours
• Failure by the Subject to call in or respond to a call from the Supplier within 15
minutes to confirm attendance at an attendance monitoring location
• Any tamper violation apart from removal of equipment fitted to the Subject or
damage causing the non-functioning of any part of the equipment
• Each instance where a Subject has not provided notice or sufficient notice in respect
of any authorised absences.
If a Subject commits a more serious violation (as set out below) or a second less serious
violation the Subject will be deemed to be in breach of the Order and must be returned to
court. The following are more serious violations:
• One or more curfew violations whose total length amounts to the lesser of an entire
curfew period or a period of four hours
• Physical assault on or a threat of violence to any of the Supplier’s staff;
• Fails to co-operate at any time with a Community Order.
A second less serious violation may involve a second tamper violation, or any removal of
equipment fitted to the Subject, or damage causing the non-functioning of any part of the
equipment.
The Offender Manager is responsible for overseeing compliance and taking enforcement
action where required for an order. Where the order imposes curfew and electronic monitoring
of the Subject to check compliance but no other requirements the Offender Manager will be
the Supplier. The Offender Manager for Community Orders that include more than one
Requirement or Requirements that do not involve electronic monitoring will be an officer of
the local probation board or a member of the YOT.
The Court will determine whether there has been a breach of the order and will either revoke
the Order and re-sentence the Subject, or make the existing order more onerous, for example
by extending the duration of an existing Requirement within the overall statutory maximum
for the order.
The relevant legislation for the new Community Order is the Criminal Justice Act 2003 (The
CJA 2003). Chapter 1 of Part 12 of the Act sets out the general provisions for sentencing.
Chapter 2 sets out specific provisions relating to Community Orders. Sections 199 to 215 in
Chapter 4 set out provisions relating to each of the requirements and prescribe the conditions
for the use of electronic monitoring in connection with the requirements.
References to MAPPA cases throughout the document refer to legislation set out in sections
325-327 of the Criminal Justice Act 2003. References to prolific and priority offenders relate
to the Priority and Prolific Offenders scheme rolled out by the Home Office in 2004. Specific
guidance for the Probation Service is set out in Probation Circular reference 49/2004.
Specific Guidance on pre-sentencing activities within the Court Service is provided in the
form of training notes for each type of Order. These are issued directly by HM Court Service
to the Courts.
Specific guidance within the Probation Service on the management of Community Orders is
set out in the National Standards for the Supervision of Offenders 2005. National Standards
also apply to Curfew Orders and enforcement action will be the same with the responsible
officer being the Supplier as they are stand alone orders. The only exception to this will be
when the YOT or Probation Service hold a separate Community Order and it is agreed that
they will enforce breach action.
5. The Stages of the Community Order with Requirements process and the
Responsibilities of each Organisation
Process Stages
There are nine possible stages in the imposition and management of a Community Order with
Requirements. These are described below:
Stage 1: Sentencing
The CPS prosecutes the case, and if the offender is convicted the Court decides whether a
Community Order with Requirements is appropriate and which of the Requirements to
include in the Order. The Court requests an assessment from the Probation Service / YOT of
the suitability of the Subject for a Community Order and any proposed electronic monitoring
requirements. The Probation Service / YOT may request the Supplier to conduct a site survey
of the proposed address for electronic monitoring to support the risk assessment. If the Court
is satisfied with the risk assessment provided by the Probation Service / YOT a Community
Order will be imposed. This will be issued to the offender, the Probation Service / YOT , the
Police and the Supplier.
Stage 2 Induction
On receipt of the Community Order the Police update PNC records with the details of the
Order. If a voice verification schedule is required the Probation Service / YOT develops the
details of the schedule and sends this to the Supplier.
The Supplier visits the Subject to install any electronic monitoring equipment required and
provides the subject with instructions and rules regarding monitoring. If it proves impossible
to install the equipment, where the Supplier is the Offender Manager he will take any action
to return the Subject to Court to request re-sentencing. In all other cases the Supplier will
inform the Probation Service / YOT Offender Manager who will take any necessary action.
Stage 3 Monitoring
The Supplier will monitor the Subject’s compliance with the monitoring conditions and
ensure that the electronic monitoring equipment continues to operate successfully. They will
also respond to requests from the Probation Service / YOT and the Police about a Subject’s
compliance history. Where the Supplier is the Offender Manager they will authorise absences
for limited one-off absences. If the Probation Service / YOT provides the Offender Manager
the Supplier will pass requests for one-off absences to the Offender Manager for approval.
The local Police Force will inform the Supplier and, where appropriate the Probation Service
or YOT Offender Manager, if the Subject is arrested for an offence that is not related to the
order. Monitoring will be suspended during any periods when the Subject is in police custody.
Requests for variations to orders may be raised by the Subject or by the Offender Manager
directly and a Court Hearing will be arranged. If appropriate, the Court may request the
Probation Service / YOT to provide guidance on whether an alternative address proposed by
the Subject is acceptable. The Court may also request details of the Subject’s history of
compliance with the Order from the Supplier.
If the Court does not agree a variation to the Order the Subject will continue to be monitored
under the conditions of the existing Order. If the Court agrees a variation to the Order it will
issue copies of the amended Order to the Subject and the Offender Manager, who will inform
other involved parties. The Supplier will make any changes that are required to the monitoring
equipment. If the Subject’s new curfew address is in an area managed by a different Supplier
the Subject’s monitoring records will be transferred.
Stage 5 – Violations
The Supplier will investigate any suspected violation of the monitoring schedule and where
the Subject is under supervision inform the Offender Manager who will issue a warning letter
to the Subject where a less severe violation has occurred. If the Supplier is the Offender
Manager he will issue a warning letter to the Subject directly. If violations are more severe or
if a second less severe violation occurs the Supplier will either report the breach to the
Offender Manager or initiate breach action himself, as appropriate.
Stage 6 – Breach of Community Order where the Supplier is the Offender Manager
Where the Supplier is the Offender Manager and the Subject has breached a Community
Order the Supplier will apply for a summons to return the Subject to Court to deal with the
breach. The Supplier will request that CPS provide prosecution papers to include details of
any court appearances that the Subject may have made during the period of the Order.
The Supplier will provide a Case Summary to the Court to describe the breach and where
necessary provide Section 9 Statements as evidence. If the Court finds the Subject in breach
of the order, it must either revoke the Order and re-sentence the Subject or vary the Order to
make it more onerous. The Probation Service / YOT may be asked to conduct a risk
assessment of the proposed variation, taking account of any views of the Supplier regarding
the suitability of alternative monitoring locations. If the Court is content that the variation to
the Order is acceptable an amended Order will be issued with the new sentence details.
The Supplier will report a breach of the Order to the Offender Manager where this role is the
responsibility of the Probation Service / YOT. The Offender Manager will deal directly with
the Court to set a hearing date to return the Subject to Court.
The Offender Manager may request details of the Subject’s compliance history from the
Supplier and the Supplier may be asked to attend the Court Hearing to provide evidence. If
the Court decides to revoke the Order the Supplier will cease monitoring the Subject. If the
Court decides that a variation to the Order is appropriate an amended Order will be issued
with the new sentence details.
If the Subject fails to attend the Court Hearing to consider the breach of a Community Order
the Offender Manager will apply to the court for a warrant to arrest the Subject. The Court
issues the warrant and this is executed by the Court Enforcement Officer. When the Subject
has been taken into custody the Court will conduct a hearing to consider the breach and will
either revoke or amend the Order.
The Supplier will remove all monitoring equipment at the end of the monitoring period and
prepare a Curfew Completion Report for all Subjects where the Probation Service / YOT
provides the Offender Manager. A Curfew Completion Report will be provided to the Court
for all orders (whether the Offender Manager is the Supplier, YOT or the Probation Service).
The Courts, Probation Service / YOT, Crown Prosecution Service, Police and Suppliers all
have roles in managing Subjects who are on Community Orders. Two private sector
Suppliers, Group4Securicor and Premier Monitoring Services Limited work with the
Government agencies to manage the electronic monitoring component of the Community
Order. The key responsibilities of each organisation are as follows:
• The Courts are responsible for determining the Requirements that will comprise a
Community Order and will issue copies of the Community Order to other parties. The
Courts will hear any request for a variation to a Community Order and decide what
action to take in the event of a breach of a Community Order.
• The Probation Service / YOT will conduct any risk assessments to inform Court
decisions to impose a Community Order. Where the Probation Service / YOT
provides the Offender Manager he will take any action to enforce the order and
process requests for variations to an order.
• The Crown Prosecution Service will present prosecution papers to the Courts which
set out details of the Subject’s original offence and details of any previous
convictions. If the Subject is returned to Court the Crown Prosecution Service will
provide details of any other Court appearances that the Subject has made during the
term of the Order.
• The Police will update the PNC database with the details of the Subject’s Community
Order at the beginning of the Order. Also the Police may be requested to arrest the
Subject if he/she fails to appear at a Court Hearing. The Police may request
information regarding a Subject’s compliance with a Community Order if they are
investigating criminal activities that they believe may involve the Subject.
• The Suppliers are responsible for installing and removing electronic monitoring
equipment, monitoring compliance with the conditions of an order and investigating
suspected violations of order conditions. Where the Supplier is the Offender Manager
they are responsible for taking any necessary enforcement action and for processing
requests for variations to an order. Where there is a Probation Service / YOT
Offender Manager the Supplier will report violations and breaches to the Probation
Service / YOT who will take responsibility for arranging and managing Court
proceedings.
The responsibilities of each organisation are described in detail in Section 7 of this protocol.
All organisations should comply with their responsibilities under data protection legislation
and have regard to the data protection principles. These principles require that personal
information is obtained and processed fairly and lawfully; is only disclosed in appropriate
circumstances; is accurate, relevant and not held longer than necessary; and is kept securely.
Most exchanges of information will be in written format. In all cases, the organisation should
confirm that the information requested or sent complies with this information protocol and
that it is being sent to a correct address. Where it is acceptable to provide information orally,
this should only be provided after verifying the validity of the request (perhaps by making a
return phone call to a previously agreed phone number) and where appropriate will be
followed up in writing.
This section sets out the processes that will completed for each stage in the Community Order
programme. Each stage is described by a flowchart of processes and each process is described
in terms of:

Process Description The Crown Prosecution Service attend the Court Hearing and manage the case
for prosecution of the Subject
Timing The prosecution papers will be presented to the Court by a Crown Prosecutor
of the day of the Court Hearing.
Prosecution papers will include details of the offender’s previous convictions and the file of evidence
that justifies prosecution of the offender.
Guidelines to Crown Prosecutors regarding procedures and the criteria for prosecuting an offender are

Responsibility Court
Process Description If the Court finds the defendant guilty of an offence the Court will consider
whether the seriousness of the offence justifies a Community Order. Before
sentencing the defendant the Court may request a Pre-Sentence Report to
assess the Subject’s suitability for a Community Order. The Community Order
may include Requirements which involve electronic monitoring and the Court
may request evaluation of addresses that may be used for management of the
Order.
Normally the request for a Pre-Sentence Report will be made orally to the Probation Service / YOT
Officer who attends the court hearing. The Court will adjourn whilst the Pre-Sentence Report is
produced. The Court may request either a full Pre-Sentence Report which will require the Court to be
adjourned for up to 15 working days or an Expedited Report which may be provided within 2 working
days.
Timing Full Pre-Sentence Reports must be delivered within 15 working days of the
date of the request for a report. Expedited Reports are generally completed at
the Court and should be delivered in the timescales requested by the Court
(normally within 2 working days).
Specific guidance and rules for the completion of Pre-Sentence Reports are set out in the National
Standards 2005 (GS2). The national format and required content for Pre-Sentence Reports is defined
in Probation Circular 18/2005.
Risk assessments conducted by the Probation Service use the guidelines set out in the OASYS
(Offender Assessment System) procedure. Risk assessments conducted by YOT officers use the
ASSET procedure. Further guidance on the use of OASYS in developing Pre-Sentence Reports is
provided in Probation Circular 18/2005.
The Pre-Sentence Report may include recommendations for curfew periods and voice verification
schedules. This advice will be based on the risk that the Subject may re-offend in these periods, and
will take into account the rehabilitation needs and other Requirements that may be imposed on the
Subject.
If the Probation Service / YOT does not request the Supplier to conduct a site survey before
installation the Probation Service / YOT may notify the Supplier in advance that the Subject is being
considered for Community Order and the addresses that may be involved. This will allow the Supplier
to make provisional arrangements for the installation of equipment.
Timing The Site Survey report must be sent to the Offender Manager or Court within
24 hours of receipt of the request for a survey for expedited reports, and within
72 hours of the request for a survey for Pre-Sentence Reports.
If the Supplier conducts a site survey and concludes that the Relevant Area is acceptable a report
signed by the Area Manager (Premier) or Branch Manager (Group4Securicor) will be provided. If the
Relevant Area is considered to be unsuitable a senior manager should countersign the report. The
senior manager will be the Assistant Director for Monitoring (Premier) or Chief Operations Officer
(Group4Securicor).
The Supplier will restrict comments on the suitability of the Relevant Area to whether it will be
possible to operate monitoring equipment successfully. This may include an assessment of whether it
is possible to establish physical boundaries for monitoring, for example in the event that a curfew
address is a hostel.
The Supplier will not commence work on preparing the Relevant Area for monitoring until the
Community Order is received.
• If the requirement can be met without the installation of any electronic monitoring
equipment the Offender Manager will confirm acceptance of the location by telephone or
other electronic media with the Supplier and a site visit will not be required
• If the requirement can only be met by installing electronic monitoring equipment the
Offender Manager will request the Supplier to visit the location and make an assessment
of its suitability. The Supplier’s report will provide details of the work that needs to be
done to make the location ready for monitoring.
The Court Order will provide details of whether the Subject is a MAPPA case or a Priority and / or
Prolific Offender.
A critical factor to the success of the Community Order process is the recording and
communication of accurate information regarding the sentence imposed on the offender. It is
good practice for Community Orders to be produced in typed format not in a handwritten form
to prevent inaccuracies in the procedure due to illegible data. The standard Community Order
forms are issued to the Courts by the Department for Constitutional Affairs in electronic format
and included text boxes that expand depending on the amount to text that is required to provide
clarity.
If the Community Order involves attendance monitoring the Order might not set out details of the date
and time conditions as these may vary over the term of the Order. If this is the case the Order will
state that the conditions for monitoring by voice verification will be as directed by the Probation
Service / YOT.
If the Court has been informed by the Probation Service / YOT that it has concerns that the Subject or
some other person living at an electronic monitoring address has a history of violence it will inform
the Supplier of the potential risk.

Process Description CPS receives the Community Order and records details of the offence and the
sentence issued by the Court on the CPS offender database “Compass”. If the
Court has not issued a copy of the Order to the Police, CPS send a copy of the
Order to the Criminal Justice Department at the local Police Force.
As a CPS officer attends the Court Hearings details of the Community Order will have been recorded
by the CPS officer at the Court. The CPS officer will check the details of the Community Order
against those recorded at the Court and clarify any discrepancies with the Court Clerk. It is important
to recognise that the sentence stated on the Court Order must be implemented therefore if this differs
from the Order handed down by the Court any discrepancies must be resolved immediately. If
necessary the Court Clerk will re-issue the Community Order with any corrections.
The CPS Officer will note whether the Police Liaison Officer has attended the Court Hearing. If a
Police Liaison Officer has not attended the Court Hearing CPS will send a copy of the Community
Order to the Criminal Justice Department at the local Police Force.
CPS will retain a database record of the Subject’s case for the period of the sentence. The case details
will be retained in the CPS Area where the Subject was convicted and the details will be made
available if required by the Courts for consideration of variations or breach of the Order.
Police will enter the Order details onto either the Interim Custody Order page or the Community
Order page of the Subject’s PNC record. It is important that the details are entered onto one of these
pages to enable an officer who takes a person into custody to identify whether the person who has
been arrested is currently on a Community Order, in which case the Offender Manager should be
contacted to initiate breach proceedings.
Timing To be provided at least 24 hours before the start of the monitoring period
The Voice Verification Schedule will include details of the schedule for each monitored location
including:
• details of the location including confirmation that consent for monitoring at that location has
been obtained by the Authority;
• random schedule details (days of the week and start and end dates for monitoring of the
Subject at that location);
• fixed schedule details (days of the week and start and end dates for monitoring of the Subject
at that location);
• the random schedule details will contain the start time and end time of random monitoring on
each day and how many calls are to be made within this period
• the fixed schedule details will contain the number of times that attendance is to be monitored
each day, whether the calls are incoming or outgoing and the time the calls are to be made.
Specifically the Offender Manager will contact the owner of any premises that
will be used for voice verification purposes to confirm consent for use of those
premises if this has not been obtained at the pre-sentencing stage.
The National Standards 2005 (GS3) provide guidance on the timescales for appointing the Probation
Service / YOT Offender Manager for a Subject. GS5 provides guidance on the requirements for
development and management of the Sentence Plan.
Timing Order information must be entered onto the Central System within 24 hours of
receipt of the Order.
The Supplier’s Central System is their centralised database of Subject information. This includes
details of a Subject’s order and records any requests for temporary absences or variations to the order,
violations and breaches and any request for information related to Subject performance.
The Supplier will email the Court officer to acknowledge receipt of emailed Orders within 15 minutes
of their receipt. The Supplier will acknowledge faxed Orders within 2 hours of receipt.
If a telephone line installation is required at either the curfew address or any address that will be used
for attendance monitoring the Supplier will contact BT and request the scheduling of a line
installation. A new telephone line which will only be used for electronic monitoring will be required if
the premises do not have a telephone line whose security is guaranteed. It may take up to 6 working
days to obtain an installation appointment and appointments may be made before the issue of the
Order by the Court.
The Supplier will contact the Court to clarify any details that are not provided on the Order.
If the Supplier has not previously conducted a survey of the Subject’s address a Site Survey may be
completed at this time. The Offender Manager will be invited to attend this survey.
Responsibility Supplier
Process Description The Supplier schedules an induction visit and attends any Relevant Area
where it is necessary to install equipment. With the Offender Manager, if
required, the Supplier inducts the Subject to inform him / her of the
monitoring schedule, the consequences of failing to comply with the schedule
and provides a booklet which sets out monitoring rules and procedures.
• Within 24 hours of the start of the first monitoring period, where daily
monitoring is not a statutory requirement but the monitoring
Requirement begins on the day it is imposed.
Installation of equipment by the Supplier can be a difficult and confrontational time. If possible in
difficult cases, induction should take place jointly with the Offender Manager. This enables the
Offender Manager to reinforce how electronic monitoring fits with the overall Requirement and
avoids problems later on.
Specific guidance to the Probation Service on procedures during induction is set out in the National
Standards 2005 (GS4).
If the Subject is female the Supplier will ensure that a female officer is present for the whole of the
visit. The timing of visits should take into consideration the Subject’s living circumstance (e.g. the
sleeping times of young children).
The Supplier will not install any equipment until the Order is received and has been validated. In
addition the Supplier will install all monitoring equipment required within a single visit.
• The Supplier will visit the Subject’s address within curfew hours unless the Subject agrees in
advance to a visiting time outside these hours
• The Supplier will manage any visits required by BT to install telephone lines. All visits by BT
staff must be conducted in daytime hours and require an appointment with the Subject as
these normally occur outside curfew hours. The visit by BT to install telephone equipment is
independent of the Supplier’s visit to install monitoring equipment
• If the Supplier’s staff are subject to or threatened with violence at the specified place they
must leave immediately. Violence on the part of the subject must be treated as a violation of
curfew. Violence by any person resident at the specified place must be treated as a violation.
• If the Supplier’s staff are refused permission to enter the premises the Supplier will report the
action as a breach of the Order.
• Confirm the date of the induction visit with the Manager of the location to be used for
attendance monitoring if induction is to be conducted there
• Offer the Offender Manager the opportunity to be present during the induction process and to
explain his or her role, alternatively, the Supplier may invite the Probation Service / YOT
Area staff to perform the induction in a probation office
• Confirm that installation of a BT line has been completed before inducting the Subject, if
required
• Take a voice recording for the Subject that will be used to verify the Subject’s identity during
monitoring procedures
• Explain the system for reporting and validating attendance and provide the voice verification
schedule to the Subject.

Process Description If the Supplier is unable to install any of the equipment required to monitor the
Subject or is unable to induct the Subject an Installation Failure report will be
prepared and submitted to the Offender Manager if the Subject is under
supervision or the Court if the Subject is not under supervision.
If the Subject is absent at the first installation attempt a contact letter is left informing the Subject to
contact the Supplier on his/her return. The Supplier will report the installation failure and the reasons
for the failure to the Offender Manager or the Court if the Subject is not under supervision. One
further attempt must be made to complete installation within 24 hours of the start of the first
monitoring period. Any absence in the monitoring period (not counting the time when the curfew is
not operating) must be reported as a violation.
If the second installation attempt is unsuccessful the Supplier must report the failure as a breach of the
Order to the Offender Manager or the Court if the Subject is not under supervision.
If for any reason, the Supplier is unable to complete induction within the required timescale, the
Supplier must inform the Offender Manager / Court. The Supplier must give reasons for the delay
and an estimate of when induction will be completed.

The New Subjects Report is issued to Police Forces each week providing details of all new Subjects
included in the previous week. The report is sorted by Police Force Area and each Police Force will
identify the Subjects for their own area.
A daily report is sent by the Suppliers confirming all occasions where the Supplier could not monitor
a Subject. If a Subject commits a violation which classifies as a less serious or more serious violation
the relevant Offender Manager is informed immediately (see 5.1).
• Identify whether the telephone calls have been made or received from a location other than
the required attendance location
• Verify that the Subject is the speaker by comparison of the voice record with the record
created during induction to within 95% of certainty
• If the first verification attempt is unsuccessful the Supplier will make two further attempts.
After three unsuccessful attempts the Supplier will attempt to confirm the Subject is attending
the required location using Remote Alternative Monitoring equipment. If the Subject’s
location cannot be verified a violation is reported
• Record all telephone calls.
Timing Except for emergency absences all requests for absence must be made by the
Subject at least 24 hours before the absence is due to occur. Written approval
of absence must be provided before the absence is taken and must be provided
within 24 hours of the request.
A request for an Authorised Absence may be approved for periods no longer than 24 hours provided
the Subject remains in England or Wales. If the Subject requests an absence of longer than 24 hours
the Offender Manager will inform him / her that a Variation to the Order must be requested from the
Court. This includes prolonged stays in hospital.
In all cases, other than emergency cases, the duration of absence must not be more than the length of
the event plus 1.5 hours travelling each way.
Timing Except for emergency absences all requests for absence must be made by the
Subject at least 24 hours before the absence is due to occur. Approval of
absence must be provided before the absence is taken
The criteria for an Authorised Absence are the same as for 3.2.
If the Subject is high profile the Supplier will contact the Electronic Monitoring Team in the Home
Office to approve the absence. The Electronic Monitoring Team will respond to refuse or approve the
absence and the Supplier will inform the Subject of the decision.

Process Description If the Supplier’s Central System reports an equipment failure the Supplier will
visit the Subject to determine the cause of the failure and replace any
equipment where this is required.
Timing The report is produced monthly within 10 working days of the end of the
previous month and covers all incidents of equipment damage and failure in

The Supplier will investigate all equipment failures where they involve:
• Damage to any part of the monitoring equipment of any kind including tamper and strap
tamper caused by the Subject. Damage caused by official action by the Police, Probation
Service / YOT, the Supplier, medical staff or any other official body will not be investigated
and the equipment will be replaced or repaired only
• Internal equipment failures of any kind including battery failure, short-circuits, transmitter
failure or component deterioration or failure.

Process Description The Supplier will check that monitoring equipment installed at the Subject’s
monitoring address is functioning correctly. This will include monthly visits to
any Relevant Areas to check that equipment is functioning correctly. Any
malfunctions will be dealt with as at Table 3.4.

For curfew monitoring the Supplier will have an alternative form of monitoring to verify that the
Subject is complying with the curfew if electronic monitoring equipment fails.
Visits to the Subject’s home to check equipment must be conducted during a monitoring period. The
Supplier is not required to notify the Subject in advance of the visit.
Subjects who are sentenced to Suspended Sentence Orders will normally have a Probation Service /
YOT Offender Manager. Under normal circumstances the Supplier will not be the Offender Manager
for Subjects on these orders.
The External Agency Information Request form must identify whether the Subject is a MAPPA case
or a Priority or Prolific Offender. If a Subject is a MAPPA case or a Priority or Prolific Offender the
police may request details of the Subject’s compliance history and this may be issued directly to the
police without prior Home Office approval.
Requests for Compliance Reports from local Police Forces are raised and signed by the investigating
officer. These must be countersigned by a Police Inspector. The Supplier is not authorised to provide
information unless the request has the Police Inspector’s countersignature.
Requests for Compliance Reports from the local Police Force must identify whether the Subject is in
custody or not. If the Subject is in custody the local Police Force require information about a
Subject’s compliance record more urgently than for a Subject not in custody.
Timing The timing for the provision of reports for each type of monitoring is set out
below
If the Subject is a MAPPA case or a Priority or Prolific Offender the Supplier is permitted to issue
information directly to the requesting Police Force. If the Subject is not classified as a Prolific
Offender the Supplier will send the information to the Home Office Electronic Monitoring Team who
will confirm acceptance to the Supplier that the information can be sent to the Police Force.
Specifically for curfew and attendance monitoring the Supplier will provide reports within 24 hours of
receipt of the request for information. If the information is required for a Subject that has been taken
into custody the Supplier should provide the information as soon as possible.
As soon as the Supplier receives Notification that the Subject is in Police custody the Supplier will
cease monitoring the Subject. The Supplier will re-commence monitoring when the Police inform the
Supplier that the Subject has been released from custody.

who must attend. At the Court Hearing the Court will consider the evidence to
support the request for a variation. If the Subject has applied directly to the
Court then the hearing may be adjourned while the Offender Manager
investigates whether the variation is acceptable and should be offered to the
Subject.
The Supplier will provide a Court Co-ordinator / Enforcement Officer to attend Court Hearings to
provide details of the Subject’s Compliance History if requested

Process Description If the Subject has made an application for a variation to the Community Order
directly to the Court then the Court may request advice from the Offender
Manager of the acceptability of the request. If the Supplier is the Offender
Manager the Court will request the Probation Service to provide an officer to
conduct the risk assessment.
Under normal circumstances the Offender Manager will attend the Court Hearing to consider the
request to change the conditions of the Community Order. In this situation the request to the Offender
Manager for consideration of the variation will be made in the Court Hearing. However if the
Offender Manager has not attended the Court Hearing a request for consideration of the variation
setting out the details of the change requested will be faxed to the Offender Manager.
Responsibility Offender Manager in the Probation Service /YOT or Probation Service officer
if the Supplier is the Offender Manager for the Subject
Process Description If the Subject has made an application for a variation to the Community Order
directly to the Court and the Court has requested consideration by the
Offender Manager then the Offender Manager will conduct a risk assessment
of the change. Where the Supplier is the Offender Manager the risk assessment
will be conducted by the Probation Service officer appointed by the Court.
Probation Service officers will refer to the risk assessment guidelines in the OASYS (Offender
Assessment System) procedure and the guidance and rules set out for Pre-Sentence Reports in the
National Standards 2005 (GS2) when conducting the risk assessment of the requested change. YOT
Offender Managers will refer to the ASSET procedures.
Responsibility Court
Process Description The Court may request details of the Subject compliance history with the
current Community Order to support an assessment of whether the variation
should be agreed. This will normally be provided to the Supplier before the
Court Hearing.
Under normal circumstances the Offender Manager will be responsible for collating all details
required before a Court Hearing. The Court will request details directly from the Supplier only in
exceptional circumstances e.g. where the Offender Manager has not appeared at the Court Hearing.
Timing The Supplier may be requested to attend Court within 24 hours of the Request
The content of the Supplier’s compliance report will be determined by the Court. The Court is
permitted to request any details of the Subject’s compliance record including details of compliance
with curfew dates and times, records of telephone calls to check attendances, violations, requests for
variations, equipment tamper alerts, inability to monitor dates and dates of telephone communications
with the Subject.
The Court Clerk will follow the rules set out in 1.7 to issue the amended Order.
The Probation Service / YOT has the discretionary rights to provide details to other interested parties
e.g. the Public Protection Panel.

Process Description If the amended Order involves the transfer of a Subject’s monitoring address
to an area covered by another EM supplier the Subject records will need to be
transferred between the suppliers. The Supplier for the address that the Subject
has vacated will visit the Subject’s address and remove all equipment. The
Supplier for the Subject’s new address will visit the Subject at the new address
and induct the Subject and install any equipment required.
Timing The new Supplier must induct the Subject to meet the timescales set out for

If responsibility for managing a Subject is transferred between Suppliers continuous monitoring of the
Subject throughout the monitoring periods of an Order must be maintained. The Suppliers involved
are jointly responsible for ensure that the Subject is continuously monitored.

Process Description When the Central System alerts the Supplier that the Subject has committed a
violation the Supplier must investigate and confirm the violation
The Supplier will investigate all violations in the first instance and will then telephone the Subject to
confirm the violation. A visit will be conducted for equipment violations.
If a visit is required to confirm that a female Subject is at the curfew address the visit may be
conducted by a male officer if the officer is not required to enter the premises. If the Subject is unable
to come to the door of the premises a female officer must accompany the male officer throughout the
visit.
15 minutes to attempt to ascertain the whereabouts of the Subject. If the person responding
claims to be the subject, the identity of the Subject must be confirmed
• If the Subject cannot be contacted the Supplier will attempt to make contact with the Subject
every 30 minutes until the earlier of the end of the curfew period or the threshold before a

• If there is no answer to either of these telephone calls or if the person answering the telephone
states that the subject is present but cannot answer the telephone, a violation must be assumed
• If a violation is caused by any damage or failure to monitoring equipment located at the
Subject’s address the Supplier will visit the Subject to check the equipment
• If the Supplier identifies a violation of the monitoring requirement, where they are the
Offender Manager, the Supplier will either issue a warning to the Subject or initiate Breach
proceedings depending on the seriousness and number of violations
• If the Probation Service / YOT provide the Offender Manager the Supplier will inform the
Offender Manager of the violation.

Process Description Where an investigation into an apparent violation identifies a violation that is
insufficient to require a warning or breach the Supplier shall record the
violation details.
The Supplier will record on Central System any violation of curfew requirements. If the violation is
below the threshold for a Warning Letter the Subject will be contacted to confirm the violation but no
further action will be taken and the Subject will continue to be monitored.
The Supplier is not required to contact the Subject to investigate the violation if the violation is for a
period of less than 5 minutes. However the violation will be recorded on Central System.
If the Subject is classified as a MAPPA case or a Priority or Prolific Offender the Supplier will
include on the Violation Intelligence Report all violations of curfew lasting more than 15 minutes in
the current week or any confirmed violations of attendance monitoring requirements.

If the Order has been imposed by the Crown Court the Supplier will need to establish whether the
breach proceedings will be heard at the Crown Court or the Magistrates Court and send the paperwork
to the appropriate court. Schedule 8 of the Criminal Justice Act 2003 permits the Crown Court to
reserve the case to itself and in these circumstances it will issue its own summonses and warrants.
The Supplier will continue to monitor the Subject until the earlier of the receipt of confirmation of an
amendment to the Order or the expiry date of the monitoring requirement. The Supplier will cease
monitoring if the Subject is no longer resident at the home address.
If a Subject has been evicted from the curfew address breach proceedings will be withdrawn if a
variation to the Order is received within 5 days of a reported violation.
Timing The first hearing date should not be any later than 20 days after the date of the
reported breach.
Courts are now encouraged to reserve specific days in the week for hearing breach cases. These will
be used by the Supplier and the Probation Service / YOT Offender Managers. The Probation Service /
YOT Offender Managers have access to the court hearing dates to reserve hearing dates without
requesting a summons from the Court. The Supplier will need to co-ordinate hearing requests with the
Court and Probation Service / YOT Offender Managers if there is a need for an urgent Court Hearing.
Responsibility Supplier
Process Description On receipt of the date of the Court Hearing the Supplier will draft the
summons and issue this to the Court for signature before the summons can be
issued to the Subject. The Supplier will also prepare the Breach Pack with
information detailing the breach
Timing As soon as possible to meet the date for presenting all paperwork before the
Court Hearing
The breach pack will include any information the Court requires regarding the Subject’s compliance
with the monitoring requirement. This includes details of the original Order, breach reports and an
event summary of the Subject’s compliance record to include requests for variations to the Order and
amended Orders, the installation report, copies of any warning letters issued, incident and violation
reports, telephone logs, and visit reports.
Responsibility Supplier
Process Description When the Supplier receives the signed summons from the Court this is issued
to the Subject to instruct him / her to attend Court on the hearing date
The Summons will be sent to the Subject using first class post. The Summons will be sent to the
Subject’s last known address.
Responsibility Court
Process Description If the Subject’s whereabouts are unknown or if the Offender Manager believes
there is a risk that the Subject may not attend the Court Hearing or if there is a
risk of serious harm to staff or members of the Subject’s household (or risk of
self-harm by the Subject) the Offender Manager will request a Community
Penalty Breach Warrant from the Court who will issue this to the Subject to
enforce attendance
Manager
The warrant will be executed by the Court Enforcement Officer or the Police. See section 8.3.
Timing The request will need to be processed in the timescales for preparing
prosecution papers for the Court Hearing. Normally the CPS Area Office
will require 24 hours notice to obtain prosecution papers.
The Supplier will request details of the original offence from the CPS Area office where the Subject
was sentenced and not the office where the Breach Hearing is to be heard. The Supplier will obtain
the details from the Community Order of the CPS Area Office and the CPS Officer who attended the
Court when the Subject was sentenced.
Requests for prosecution papers must be signed by the Court Team Leader of the office that is
managing the breach.
It is important that the Supplier requests the original offence papers from the CPS Area Office
where the Subject was originally sentenced and not from the CPS Area Office where the breach
has occurred. Requests to the wrong office may result in delays in the Court Hearings or the
need for an adjournment of the Hearing to obtain the CPS papers before the Court can re-
sentence the Subject.
Responsibility CPS Area Office where the Subject was originally sentenced
Process Description An officer from the CPS Area Office will attend the Court Hearing and
provide the prosecution papers from the original sentence. The CPS Officer
will deliver evidence to the Court to provide details of the original offence and
sentence if requested.
CPS will also provide details of any previous convictions to the Court if required.
For cases heard at the Crown Court a solicitor or barrister will present the case evidence on behalf of
the Supplier.
Responsibility Courts
Process Description The Court Hearing will determine whether the Subject is in breach and decide
on the penalty, either revocation and re-sentencing or a variation to the
existing Community Order
If all the papers required for the case are not available for the case the Court may adjourn and request
that the papers are provided for a later hearing. In particular if the Subject contests the breach, the
Court will adjourn and set a new date for the breach hearing. In the period between the first and
second hearing, the Supplier will obtain any Section 9 Witness Statements required.
Responsibility Court
Process Description The Court decides to revoke the Community Order and re-sentence the
Subject. The Revocation Order will be issued to the Subject and the Supplier
to terminate the Order. The Revocation Order will be authority for the
Supplier to remove monitoring equipment from the Subject and the Subject’s
address.
The Supplier will cease monitoring the Subject as soon as the Revocation Notice is received.
Responsibility Court
Process Description The Court may adjourn the hearing and request consider of variations to the
Order by the Probation Service / YOT.
Timing The request will be made to a Probation Service / YOT Officer available at the
Court during the Court Hearing
The Probation Service officer will refer to the risk assessment guidelines in the OASYS (Offender
Assessment System) procedure and the guidance and rules set out for Pre-Sentence Reports in the
National Standards 2005 (GS2) when conducting the risk assessment of the requested change.
Responsibility Supplier
Process Description If required and requested by the Probation Service, the Supplier will conduct a
site survey to consider an alternative location that may be used for a variation
to the Order. A report will be submitted to the Probation Service / YOT
Timing The Site Survey report must be sent to the Probation Service / YOT within 72
hours of receipt of the request for a survey
Responsibility Court
Process Description If the Court decides not to revoke the Order it must issue an amended Order
setting out revised conditions. Under the Criminal Justice Act 2003 the Court
must either make the existing Order more onerous or revoke it and re-sentence
the Subject for the original offence.
The Supplier will commence monitoring the Subject in accordance with the new Requirements as
soon as the amended Order is received.

The procedures covered in stage 7 cover Community Orders which involve a number of
Requirements. For these Orders the Offender Manager will be provided by the Probation Service /
YOT.
The detailed processes within Stage 7 – Breach of Community Order where there is a Probation
Service / YOT Offender Manager are:
The Offender Manager prepares the case for breach which includes compiling
details of the Subject’s compliance with all of the Requirements of the
Community Order.
For cases to be heard at Magistrates Courts the Offender Manager sets the
Hearing Date for the next available weekly time that breaches of Community
Orders will be heard. The Offender Manager contacts the Subject to confirm
that breach action is to be pursued and requests the Subject and other parties
attendance at the Court on the Hearing Date. The Offender Manager will
prepare a summons for the Court to issue if it considers that it is required. If
the Offender Manager considers that a warrant is required this may be
prepared for issue by the Court.
For cases to be heard at the Crown Court the Offender Manager issues a
Notification of the Breach to the Court. The Listing Officer at the Court
informs the Offender Manager of the Hearing Date and the Offender Manager
contacts the Subject to confirm that breach action is to be pursued and requests
the attendance of the Subject and other parties at the Court on the Hearing
Date.
Timing See 7.5. In standard cases the Notification must be made within 2 working
days of the violation being reported unless further investigation into the cause
of the violation is required, in which case the Notification must be made
within 5 working days. The Probation Service has a target of 10 working days
for adults and 5 working days for youths to initiate breach proceedings and 25
working days from the date of the breach to resolve breach actions. In all cases
the first breach hearing must be within 20 working days of the date of he
breach
For fast track cases the Subject must be notified of breach proceeding within 3
working days of the breach being reported. The Court Hearing should be heard
ideally on the 6th working day after the breach and all activities to prepare the
papers should be completed within 5 working days.
The Offender Manager will attempt to arrange the Court Hearing at the next available breach hearing
date subject to at least 3 Working Days being allowed to prepare the case for prosecution.
Specific guidance to Offender Managers in the Probation Service covering breach action is set out in
the National Standards 2005 (GS9).
Timing The request will need to be processed in the timescales for preparing the
papers for the Court Hearing. These will be a maximum of 5 working days for
fast track cases. Normally the CPS Area Office will require 24 hours notice to
obtain prosecution papers.

Subject to enforce attendance
Timing For standard cases the summons or warrant should be issued within 2 days of
receipt of the request for the warrant. For fast track cases warrants must be
issued within 1 working day.
The warrant will be executed by the Court Enforcement Officer or the Police. See section 8.3.
At least 3 Working Days are required to prepare the case for breach. The Supplier will be given at
least 2 Working Days notice to prepare a Compliance History Report for the Subject.
Specific guidance to Offender Managers in the Probation Service covering breach action is set out in
the National Standards 2005 (GS9).
Under normal circumstances the Supplier will have prepared the Monitoring Compliance Report prior
to the Court Hearing. The Offender Manager presents the case and may ask for an adjournment if the
Court requires evidence that the Offender Manager has not received. If the Offender Manager
requires more information regarding the Subject’s compliance history the Offender Manager will
contact the Supplier.
Under the Criminal Justice Act 2003 the Court may revoke or amend the Order only. The amended
Order may extend the timescales for monitoring under existing Order Requirements or may add new
requirements to the Order.
Responsibility Court
Process Description The Court decides to revoke the Community Order and re-sentence the
Subject. The Revocation Order will be issued to the Subject, the Offender
Manager and the Supplier to terminate the Order. The Revocation Order will
be authority for the Supplier to remove monitoring equipment from the
Subject and the Subject’s address.
The Court may only revoke the Order whilst the Order is current.
For standard cases the Court may be adjourned and the Probation Service / YOT may be asked to
consider the impact of variations to the Order. A risk assessment will be completed and advised to the
Court at the next hearing. For fast track cases the Court will expect the Offender Manager to have
conducted a risk assessment of the Subject before the Court Hearing and this assessment will be used
in consideration of any amendment to the Order.
Responsibility Supplier
Process Description If the Court Hearing requests an amendment to monitoring conditions or the
revocation of an Order the Supplier will take any action required to install new
equipment and remove equipment not required.
Timing The timings for changes to equipment will be as set out in section 2.6
The Supplier will install any new equipment in accordance with the rules and processes set out in
section 2.6

Subsequent Arrest are:
Responsibility The Probation Service / YOT Offender Manager or the Supplier’s Court Co-
ordinator / Enforcement Officer depending on which of them has Offender
Manager responsibility
Process Description If the Subject fails to appear in Court the Offender Manager / Supplier
Enforcement Officer will apply for a Community Penalty Breach Warrant to
arrest the Subject and enforce his / her appearance in Court. The Offender
Manager / Supplier Enforcement Officer will monitor the status of warrants to
ensure that they are aware that they have been executed and they obtain the
data of the court hearing.
Timing The Offender Manager must wait 30 minutes from the time stipulated on the
summons for the Subject to attend before applying for a Community Penalty
Breach Warrant.
In some cases the Subject may have other proceedings still pending. The Court will only issue one
warrant and the Offender Manager will be requested not to make a separate warrant application. The
Supplier’s papers will be included in the Subject’s criminal file.
Any failure to appear in Court will be reported as a Breach of the Community Order.
Responsibility Court
Process Description If the Subject fails to appear in Court the Court will approve the request from
the Offender Manager / Supplier Enforcement Officer to issue a Community
Penalty Breach Warrant and return him / her to Court.
Timing For standard cases the warrant should be passed to the Enforcement Teams
within 48 hours of the Court Hearing decision to issue the warrant. For fast
track cases the warrant must be passed to the Enforcement Team with 24 hours
of the Court Hearing.
The Court Enforcement Officer may execute the warrant himself or he may request the local Police
Force to execute an Arrest Warrant (the Court Enforcement Officer may arrest the Subject himself). If
the Police arrest and detain the Subject they will detain him / her in custody until the case can be
heard. In these circumstances the Arresting Police Officer will arrange for the Prison Escort
Contractor to present the Subject in Court with the warrant. If the Subject is arrested on a Non-Bail
Warrant he/she will be presented in Court by the Court Enforcement Officer.
If the Subject is placed in Police custody the Police will arrange for a Prison
Escort Contractor to present the Subject in Court with the warrant for arrest at
the next Hearing.
Timing For standard cases Enforcement Teams have 20 working days to execute
warrants for adults and 10 working days to execute warrants for youths. The
Subject is arrested as soon as possible and presented to the Court at the next
scheduled Hearing.
For fast track cases all warrants for adults should be executed within 10
working days. Warrants for youths should be executed with 5 working days.
If the Probation Service / YOT receives information regarding the whereabouts of the Subject the
Offender Manager should inform the Court Enforcement Officer of these details to support the
execution of the warrant.
The Department for Constitutional Affairs has issued Best Practice Guidance for the arrest of Subjects
who fail to attend Court in the document Effective Practice Guide - Community Penalty Breach
Warrants dated March 2005.

remove all monitoring equipment.
Timing All equipment will be removed during the Subject’s last curfew period unless
the Subject agrees that removal can be completed outside the curfew period
Invite the Subject to claim for any running costs of monitoring equipment.
If the Subject is not present for the decommissioning visit the Supplier may contact the key holder at
the address to request assistance to recover the equipment. No attempt should be made to contact the
key holder in any other circumstances.
If the last monitoring period occurs between midnight and 6am the Supplier will remove the
equipment before noon on the first day after the monitoring period ends.

Process Description The Supplier prepares a Completed Curfew Report to summarise the Subject’s
record.
The Completed Curfew Report will be sent to the Offender Manager using secure email or fax.
Specific guidance on the Final Review of the Subject on completion of the Community Order is set

The purpose of this protocol is to provide the basis for the exchange of information between
all organisations involved in the Home Detention Curfew (HDC) programme. Effective
working relationships between prisons, the probation service, YOT, Early Release & Recall
Service (ERRS), police forces and the Suppliers are essential to ensure that the programme
operates successfully. This protocol describes the processes for the exchange of information
to ensure that each organisation understands its roles and responsibilities and adopts
consistent practices.
HDC is a national scheme - while most communication between agencies takes place locally,
there is often a need for prisons to interact with police forces, probation/YOT areas and
Suppliers throughout England and Wales. It is important therefore to establish national
practice although there is some scope for changes to be made at a local level. These may
require configuration at a local level to define the detail of the interactions between prisons,
the probation service, YOTs, police forces and the Suppliers in each area.
The protocol sets out the mechanisms for completing business processes at each stage in the
HDC programme. The HDC programme is defined in ten stages which are then described
further in terms of the detailed business processes. A flowchart is provided for each stage to
summarise the business processes within the stage, which displays each business process
denoted by its stage reference number. By using this reference number the Protocol user can
navigate through the document to find the detailed process details.
The process details for each business process are described in a tabular form. Contact names
for each organisation are included in the annexes.
The protocol provides a comprehensive description of the processes that will be used
throughout the programme, however, it is unlikely that every action listed in the protocol will
need to be undertaken for every subject who is released under Home Detention Curfew. The
objective of the protocol is to set out the way that information will be exchanged as and when
necessary and therefore lists all the possible information exchanges that might occur under the
HDC programme.
The protocol does not cover how information should be handled within each organisation.
This is a matter for each organisation, which needs to ensure that it meets its statutory
responsibilities.
The Home Office is responsible for maintaining this protocol and issuing changes to protocols
when they are revised. The Home Office should be contacted if any processes change with
details of the new process and an update to the Protocol will be issued.
Revised versions of the Protocol will be issued from time to time when processes have been
materially changed. Each version of the Protocol will be identified by a version number and
issue date. The Electronic Monitoring Team will maintain a register of version numbers of the
Protocol and the dates of issue.
The Protocol is available in electronic format and in general will be issued to users
electronically. Hard copy formats of the document will be issued only when users are unable
to receive electronic copies of the document.

The protocol allows for local practices to be developed and for the protocol to be amended in
other aspects at a local level, in agreement with the Home Office. The nature of information
exchanged should not differ locally from this protocol (although it can be of broader scope
than this protocol with local agreement), but it is possible for the format in which the
information is provided to be varied from this protocol if it relates to communication between
Suppliers and local police and probation service/YOT and where there is not a need for a
consistent national format. However, variations to the protocol should only be proposed
following agreement by all organisations in the area concerned.
The HDC scheme allows prisoners serving determinate sentences who are not subject to any
of the statutory exclusions and who pass a risk assessment to be released early under an
electronically monitored curfew.
From 4 April 2005, two HDC schemes will operate. The first is the existing scheme based on
the provisions of the Criminal Justice Act 1991. Under the 1991 Act, HDC is available to
eligible prisoners serving sentences of between three months and under four years. The
scheme applies to prisoners convicted of offences committed before 4 April 2005, and also to
prisoners convicted of offences committed on or after 4 April 2005 and serving a sentence of
less than 12 months (this scheme will continue until Custody Plus sentencing is introduced).
The second scheme will operate under the provisions of the Criminal Justice Act 2003. This
applies to determinate sentence prisoners serving 12 months or longer who have been
convicted of offences committed on or after 4th April 2005. However, it is likely that
prisoners sentenced to 4 years or more under the Criminal Justice Act 2003 will be presumed
unsuitable for HDC unless exceptional circumstances exist.
Prisoners must be curfewed for a minimum of 9 hours per day, although most curfews run
overnight for 12 hours. The maximum curfew length is 135 days depending on the length of
sentence. Prisoners must serve a quarter of the sentence, subject to a minimum period, in
custody before they can be released on HDC. The scheme is available to individuals aged
under 18 years serving sentences of detention under section 91 of the Powers of Criminal
Courts (Sentencing) Act 2000 in addition to adults.
The Governor of the prison in which the person is being held is responsible for deciding
suitability for HDC, on the basis of a risk assessment.
Prisoners serving sentences for certain offences are “presumed unsuitable” for HDC, and will
not be released unless the Governor agrees to their exceptional circumstances. This rule also
applies to prisoners with any history of sexual offending who are not already statutorily
excluded from the scheme. HDC is not an entitlement and can only be granted subject to
prisoners meeting the eligibility criteria and passing a risk assessment, including a home
circumstances check.
What happens if the prisoner does not comply with the curfew?
Unauthorised absences from the place of curfew during the curfew period, tampering with the
equipment and violence directed at the Supplier’s staff count as violations. There are
different levels of violations. The most serious violations, or an accumulation of less serious
violations, will result in a breach of the curfew. Following a breach, the Suppliers are
required to submit a breach report to ERRS, which decides whether to amend or revoke the
HDC licence.
A breach will normally lead to the revocation of the HDC licence and the prisoner will be
immediately liable to be returned to custody. The prisoner will be required to serve the
remaining period of their sentence in custody until the automatic release date. If the prisoner
is recalled for breaching the HDC curfew conditions, he/she may not be eligible for release
again on HDC either for the rest of that sentence or on any future custodial sentences
received. This will depend on which Act the prisoner was released under.
The HDC licence can also be amended or revoked if it is no longer possible to monitor the
whereabouts of the subject or if the subject is charged with an offence committed whilst
breaking their curfew conditions.
In addition, those on HDC can be recalled by ERRS, on behalf of the Secretary of State, under
section 39 of the Criminal Justice Act 1991 or section 254 of the Criminal Justice Act 2003 if
they breach any other conditions of their licence. This could include being charged with an
offence committed whilst on HDC. Only those on HDC who were on licence for an offence
committed after 1 January 1999 can be recalled under these powers. This protocol does not
cover recalls under this section of those who are not on HDC.
Sometimes prisoners are recalled for reasons beyond their control (for example if they are
unable to stay at the curfew address any longer). If this is the case they may be eligible to
apply for re-release immediately upon their return to custody subject to another suitable
address being located.
The statutory basis for the HDC scheme for prisoners convicted of offences committed before
4 April 2005 and prisoners who are sentenced to a term of imprisonment of less than 12
months for offences committed on or after 4th April 2005 is sections 34A and 37A of the
Criminal Justice Act 1991, inserted by sections 99 and 100 of the Crime and Disorder Act
1998. The Release of Short-Term Prisoners on Licence (Repeal of Age Restriction) Order
2003 (S.I. 2003 No. 1691) extends the availability of HDC to prisoners aged under 18.
For prisoners serving 12 months or longer who have been convicted of offences committed on
or after 4th April 2005 the statutory instrument for the HDC scheme is section 246 of the
Criminal Justice Act 2003
Specific guidance relating to conditions for release of prisoners and for the recall and return to
custody under Home Detention Curfew is set out in Prison Order Number 6700, which is
managed by the Prison Administration Group (PAG). These cover processes that are the
responsibility of the Prisons and the Early Release and Recall Section (ERRS). Where
processes are governed by rules within Prison Order Number 6700 they are referenced in this
document.
Specific guidance within the Probation service/YOT is set out in the National Standards 2002,
as amended by 2005 Standards SS5.11 issued 4/3/05. This is supplemented by Probation
Circular 33/2003 which provides more detailed guidance.
There are currently no specific guideline documents covering detailed procedures within
Police Forces. A new protocol between the police and the Probation Service/YOT, the Joint
National Protocol, was introduced in January 2005 effective from 1 February. The details of
this protocol are set out in Probation Circular (3/2005).
5. The Stages of the HDC Process and the Responsibilities of each Organisation
Process Stages
There are ten stages in the HDC process. These are described below:
Stage 2: Induction
The prison governor will set the curfew conditions as part of the licence. The prison will
provide advance notification of all those being released onto HDC to electronic monitoring
Suppliers, the police, and the probation service/YOT. The releasing prison will send a copy
of the licence to these organisations on the day that HDC starts.
The Supplier will install the electronic monitoring equipment and provide the subject with
instructions and rules regarding monitoring in the curfew period. If it proves impossible to
install the electronic monitoring equipment the Supplier will inform ERRS who will decide
whether to amend or revoke the licence.
If the Supplier is unable to install equipment at the curfew address an alternative address may
be approved by the Prison Governor.
The local Police Force will inform the Supplier and the Offender Manager if the Subject is
arrested and will inform ERRS if the Subject is charged with an offence that is not related to
the curfew. ERRS will be responsible for deciding whether breach action should be taken.
Monitoring will be suspended during any periods when the Subject is in police custody.
The Prison Service is responsible for deciding, through a risk assessment, which prisoners are
suitable for HDC, issuing licences and setting and varying curfew conditions. Further
guidance on the Prison Service’s responsibilities is set out in Prison Service Order 6700 and
Prison Service Instructions which are available on the Prison Service website.
The Probation Service is responsible for contributing to the risk assessment, particularly in
regards to the suitability of the proposed curfew address and for providing advice if a
variation to the Licence is requested.
The YOT has a similar role to Probation Service for 16-17 year olds.
The Police are responsible for locating and arresting prisoners who have been recalled to
prison for breach of HDC and for informing relevant agencies when someone has been
arrested and charged with an offence committed whilst on HDC.
ERRS is responsible for deciding whether to amend or revoke the curfew licence and recall
offenders to custody following a breach of curfew conditions or a failure to monitor. A
separate section of the Unit deals with representations against recall decisions.
The Parole Board are required to review any decision taken by ERRS on behalf of the
Secretary of State to recall an offender to prison. The review takes place after the offender has
been returned to prison.
The Suppliers are responsible for installing and removing the electronic monitoring
equipment, monitoring curfew compliance, following up curfew violations and informing
ERRS and the Home Office when a curfew is breached or when a subject cannot be
monitored.
The responsibilities for each organisation are described in detail in Section 7 of this protocol.
All organisations should comply with their responsibilities under data protection legislation
and have regard to the data protection principles. These principles require that personal
information is obtained and processed fairly and lawfully; is only disclosed in appropriate
circumstances; is accurate, relevant and not held longer than necessary; and is kept securely.
Most exchanges of information will be in written format. Where secure email mechanisms
exist these can be used to transfer documents in electronic format. In all cases, the
organisation should confirm that the information requested or sent complies with this
information protocol and that it is being sent to a correct address. Where it is acceptable to
provide information orally, this should only be provided after verifying the validity of the
request (perhaps by making a return phone call to a previously agreed phone number or
through confirmation of pre-determined passwords) and should be followed up in writing.
This section sets out the processes that will need to be completed for each stage in the HDC
programme. Each stage is described by a flowchart of processes and each process is described
in terms of:

For offenders serving a sentence less than 12 months a similar request will be
made under the Presumptive HDC scheme.
The rules regarding the suitability of a subject for inclusion on HDC are set out in Chapter 2 of Prison
Service Order number 6700.
The request for a technical survey will normally originate from the Probation service/YOT. However,
the Prison Governor in exceptional circumstances may request an assessment by the Supplier directly.
The Supplier will respond to whoever requested the survey.
The Supplier will restrict comments on the suitability of a proposed address to whether it will be
possible to operate monitoring equipment successfully from the address.
This may include an assessment of whether it is possible to establish physical boundaries for
monitoring, for example if the curfew address is a hostel.
Timing The request for an assessment is sent to the Probation service/YOT 8 weeks
before the Subject may be released on HDC. The Probation service/YOT
should respond within 10 days of receipt of the request from the prison.
Guidelines covering what should be included in risk assessments and how they should be conducted is
set out in Section C of the National Standards 2002, as amended by 2005 Standards SS5.11 issued
4/3/05.
Timing As soon as the decision is made. The HDC (1) and HDC (4) should be
completed at least 3 weeks before the Subject is due to be released on HDC

The HDC (7) will be sent to the Supplier by secure email or fax.

If the Supplier has not previously conducted an inspection of the Subject’s curfew address a site
survey may be conducted at this time.
There are no specific guidelines for prison staff to determine whether or not to revoke the Licence.
This procedure will normally be adopted if the Subject’s behaviour in custody is unacceptable after
the HDC (11) has been issued or if there is a change in circumstances regarding the Subject’s
arrangements after release, for example, an individual living at the address selected for curfew refuses
to allow the Subject to live at that address.
The rules and procedures regarding revocations are set out in Chapter 8 of Prison Service Order
number 6700.

the fitting of the PID and can only be carried out with the prison governor’s permission. Monitoring
Units may be installed at the curfew address prior to release, however, installation must be with the
consent of other residents at the address or the designated key holder if the subject lives alone.
If the Supplier’s staff are subject to or threatened with violence at the specified place they must leave
immediately. Violence on the part of the subject must be treated as a violation of curfew. Violence by
any person resident at the specified place must be treated as a violation.
If the Supplier’s staff are refused permission to enter the premises the Supplier will report the action
as a breach of the Licence.
If installation is not possible at the second attempt the Supplier informs ERRS
who may revoke the Licence or if the failure is due to inability to monitor the
Subject request that the Offender Manager considers an alternative address for
curfew.
If the Subject is absent when the Supplier visits to install equipment a contact letter is left informing
the Subject to contact the Supplier on his/her return. The Supplier will produce an Installation Failure
Report and issue the report to ERRS. One further attempt must be made to complete installation
within 24 hours of elapsed time after the first attempt. Any absence in the curfew period must be
reported as a violation.
If the second attempt to install equipment is unsuccessful the Supplier produces a second Installation
Failure Report, reports the failure as a breach of the Licence and requests the Subject’s return to
custody.
If for any reason, the Supplier is unable to complete the installation within the required timescale, the
Supplier must inform the Sentence Enforcement Unit in ERRS. The Supplier must give reasons for
the delay and an estimate of when the installation will be completed. The Supplier must provide a
further report if the estimated installation time is not met, providing a revised estimated time of
installation. If it proves impossible to undertake the required installation, or if it becomes impossible
to undertake monitoring of the subject at the specified place, the Supplier must notify the Sentence
Enforcement Unit in ERRS who may decide to amend or revoke the Licence.
Responsibility ERRS
Process Description ERRS verifies the reasons for the failed installation with the Supplier and if
failure is due the Subject’s behaviour problems with the Offender Manager
and Prison HDC Clerk. If the curfew address cannot be used or if the Subject
prevents installation ERRS issues a warrant to arrest the Subject and liaises
with the releasing prison to arrange the Subject’s return to custody.
1) All prisoners sentenced to under 12 months (regardless of whether the offence was committed
before or after 4 April 05) will be considered under the HDC criteria of the CJA91 and recall will be
under S.38A or 39 of CJA91. So, if recalled they will be released at the halfway point and be at risk
until the Sentence Expiry Date (SED). Arrangements will change when Custody Plus is introduced.
2) Prisoners sentenced to 12 months or more, and convicted of offences committed before 4 April 05,
will be considered under the HDC criteria of the CJA91. Recall for breach of the curfew conditions/
inability to monitor will be under S38A of CJA91 but recall for bad behaviour/ new offences
committed will be under S254 CJA03.
If recalled under 38A of CJA91(which can only happen before the halfway point of sentence) re-
release will be at the halfway point and the licence will run until the Licence Expiry Date (LED which
is at the ¾ point of sentence) and they will continue to be at risk until the SED.
Prisoners recalled at any time before the LED under S254 of the CJA03 will be re-released at the
direction of the Parole Board, not later than the LED, and on licence until the SED.
3) Offences committed on or after the 4 April 05 (where the prisoner is given a determinate sentence
of 12 months or longer) will be considered under the HDC criteria of s246 CJA03 and recall will be
under 254 or 255. Prisoners will automatically be on licence until the SED.

Process Description If the Supplier reports an installation failure due to an inability to monitor the
Subject at the curfew address using monitoring equipment ERRS considers
variations to Licence conditions such as the suitability of an alternative
address. ERRS liaise with the Probation service/YOT and the releasing prison
HDC Desk Clerk to confirm the suitability of the proposed alternative address.
ERRS will provide the following information to the prison HDC Clerk and the Offender Manager:
• Name and address of the Subject
• Conditions of the Licence
• Details of the failure to install or breach
• Details of the proposed address including details of residents at the address.
In exceptional circumstances the Offender Manager may contact the Supplier to request advice on the
suitability of the proposed alternative address.
Guidelines for Offender Manager covering what should be included in risk assessments and how they
should be conducted are set out in Section C of the National Standards 2002, as amended by 2005
Standards SS5.11 issued 4/3/05..

length of the event plus 1.5 hours travelling each way.

Visits to the Subject’s home to check equipment must be conducted during a curfew period. The
Supplier is not required to notify the Subject in advance of the visit.
Where appropriate, the person requesting the report will identify on the External Agency Information
Request Form whether the Subject is a Prolific Offender, Priority Offender, or MAPPA case. The
definition of a Prolific Offender is determined at area level by the police. The Request may also
identify that the Subject is in Custody. Where a Subject is identified as a Prolific Offender, Priority
Offender, MAPPA case or in Custody the Supplier is authorised to provide details of the Subject’s
curfew history directly to the Probation service/YOT / Police without Home Office approval.
Requests for Curfew Compliance Reports from local Police Forces are raised and signed by the
investigating officer. These must be countersigned by a Police Inspector. The Supplier is not
authorised to provide information unless the request has the Police Inspector’s countersignature.

• Date and details of any violations.

conditions of the amended Licence within 24 hours of receipt of the Licence

• Ensure that the Subject receives a copy of the amended Licence and understands changes to
the Licence conditions from the original Licence
• Ensure that the Subject understands the implications of the changes to the Licence and his
responsibilities for complying with the curfew
• Ensure that the Subject is able and capable of complying with the amended Licence
• Obtain the Subject’s signature on the Licence to confirm acceptance of the amended terms
• Fax a copy of the signed Licence to the releasing prison
• Update the Central System to confirm acceptance of the amended Licence
• Retain and store the signed amended Licence.
If the Subject’s change of address leads to a transfer of responsibility for managing the Subject from
one Supplier to another the transferring Supplier will:
• Remove all equipment from the original curfew address using the procedure set out in section
10.1
• Transfer Subject records to the new Supplier.
The Suppliers will comply with the visit rules in Section 2.2 whilst conducting any visit.

Process Description When the Central System alerts the Supplier that the Subject has moved
outside the curfew boundary within the curfew period or there is an apparent
equipment violation the Supplier must investigate to confirm the violation
The Supplier will investigate all violations in the first instance and will then telephone the Subject to
confirm presence. A visit will be conducted if required by the violation rules.

Process Description Where an investigation into an apparent violation identifies a violation that is
insufficient to require a warning the Supplier will record the violation details.
The Supplier will record on Central System any violation that persists for less than two hours.
The Supplier is not required to contact the Subject to investigate the violation if the violation is for a
period of less than 5 minutes. However the violation will be recorded on the Central System.
If the Police have indicated to the Supplier that they are investigating the Subject the Supplier is
permitted to contact the local Police Force by telephone to report confirmed violations. This will
happen in exceptional cases where an agreement has been made at a local level between the Supplier
and local Police Force for such an arrangement involving a named Subject.

Process Description For breaches of the curfew conditions under section 38 of the Criminal
Justice Act 1991 or section 255 of the Criminal Justice Act 2003 the Supplier
provides a breach report or a failure to monitor report to inform ERRS of the
breach. The breach report should be produced when the Subject’s violation is
a serious violation.
The Supplier also provides details of the subject’s history of compliance with
the curfew conditions. This information will be used to assess the action to be
taken as the outcome of the breach
Timing The Breach Report must be delivered by 5pm of the day of the breach or
10am the next morning if the breach occurs after 4pm.
The Supplier will provide all details of the Subject curfew record. This includes details of compliance,
violations, requests for variations, equipment tamper alerts, inability to monitor dates and dates of
telephone communications with the Subject.
The Supplier will continue to monitor the Subject until the earlier of an amendment to the sentence or
Licence is confirmed or the Subject is confirmed as returned to custody or the expiry date of the
Licence.
Responsibility ERRS
Process Description ERRS verifies details of the breach with the Supplier and liaises with the
Offender Manager and prison HDC Clerk to discuss the Subject’s compliance
The Revocation Order is issued for failure to comply with Licence orders only. A Revocation Notice
will not be issued if the Supplier is unable to monitor the subject due to difficulties operating the
monitoring equipment at the curfew address.
The Revocation Order must include details of the Subject’s Licence and must set out reasons for the
breach.

Process Description ERRS verifies details of the breach with the Supplier and liaises with the
Offender Manager and prison HDC Clerk to discuss the Subject’s compliance
history. ERRS may decide that the Licence should continue under present
conditions, normally when the Subject has provided an acceptable reason for
the breach. Alternatively ERRS may decide to look for an amendment to the
Licence, usually to change the Subject’s curfew address to allow the Subject
to remain out of custody
ERRS will provide the following information to the prison HDC Desk Clerk and the Offender
Manager:
• Name and address of the Subject
• Conditions of the Licence
• Details of the failure to install or breach.
The rules and procedures regarding revocations are set out in Chapter 9 of Prison Service Order
number 6700.
In exceptional circumstances the Offender Manager may contact the Supplier to request advice on the
suitability of the proposed alternative address.
Guidelines covering what should be included in risk assessments and how they should be conducted is
set out in Section C of the National Standards 2002 supplemented by guidelines set out in Probation
Circular 33/2003.
If the Subject is transferred from an area managed by one Supplier to an area managed by another
Supplier the Prison HDC Clerk must issue the amended Licence to the Suppliers in both the old and
new area.
Responsibility Supplier
Process Description The Supplier ensures that the Subject understands the conditions of the
amended Licence, installs any new equipment required at a new curfew
address if required, confirms that the Subject is willing and capable of
complying with the new conditions and obtains the Subject’s signature to
confirm the amended terms
The Supplier will follow the rules set out in section 4.8 to confirm the amended Licence
The Supplier will begin monitoring the Subject under the conditions of the amended Licence with
immediate effect on receipt of the amended Licence.

The detailed processes within Stage 7 – Breach of Other Conditions of Licence are:
Responsibility Local Police Force Arresting Officer or Custody Officer, depending on local
arrangements
Process Description For curfew breaches under section 39 of the Criminal Justice Act 1991 or
section 254 of the Criminal Justice Act 2003 the local Police Force inform the
Supplier that the Subject has been charged. The term “Further Charges”
describes a charge for offences that are not related to the curfew conditions.
The Arresting Officer or Custody Officer will inform the Supplier that the Subject has been charged
and of any action taken i.e. to retain the Subject in custody or release on bail. The Charge Sheet will
provide reasons for the charge.
If the Subject is released on bail the Arresting Officer or Custody Officer will inform the Supplier to
enable monitoring to continue.
Responsibility Supplier
Process Description The Supplier stops monitoring the Subject while the Subject is in police
custody and informs ERRS that the Subject has been charged
The Supplier’s activity report will contain all details of the Subject’s curfew record including details
of compliance, violations, requests for variations, equipment tamper alerts, inability to monitor dates
and dates of telephone communications with the Subject.
In some circumstances the Offender Manager may inform ERRS that the Subject has been taken into
custody. In this situation ERRS will telephone the Supplier and request an Activity Report.
Timing The verbal request to recall the prisoner should be made as soon as
considered necessary. This must be followed by fax / email confirmation
within 24 hours of the verbal request
The local Police Force may request a revocation of the Licence based on their own intelligence
relating to the Subject but also if they receive information from other agencies e.g. social workers
with an interest in individuals at the Subject address for child protection or domestic violence reasons.
The circumstances under which the local Police Force may request a revocation of the Licence are not
defined but can include a risk that the Subject may commit a serious offence, risk that the Subject may
cause serious harm to themselves or to others or if the Subject is interfering with witnesses in other
cases being investigated.
Responsibility ERRS
Process Description ERRS verifies details of the breach with the Supplier and liaises with the
Offender Manager and Prison HDC Clerk to discuss the Subject’s compliance
history. If the violation is agreed to be a breach ERRS issue a Revocation
Order. ERRS fax the Revocation Order to National Identification Service to
update PNC and copy the Revocation Order to other agencies.
Timing The Revocation Order must be issued within 24 hours (or 2 hours if the
breach is reported as an emergency).
If the request for breach comes from the Probation Service/YOT because the Subject has breached
other Licence conditions ERRS will request an Activity Report from the Supplier for the Subject after
the request for breach has been received. ERRS prepare the recall dossier and send this to the Parole
Board before drawing up the Revocation Order.
For Subjects charged with Further Charges the local Police Force will fax a copy of the custody
record to ERRS after the Subject has been charged. Normally this is after a request from ERRS.
Responsibility ERRS
Process Description ERRS verifies details of the breach with the Supplier and liaises with the
Offender Manager and prison HDC Clerk to discuss the Subject’s compliance
history. If ERRS decide not to revoke the Licence they will inform the
Supplier that monitoring should continue under existing Licence conditions.

Depending on local arrangements the local Police Force may arrange for both parties to attend the
Subject’s address to remove monitoring equipment at the time of arrest or the local Police Force will
inform the Supplier when the Subject has been taken back into custody to arrange for the Supplier to
visit and remove the monitoring equipment.
Responsibility Supplier
Process Description Normally, the Supplier attends the Subject’s address when the Police take the
Subject into custody and recovers all equipment from the curfew address.
The Supplier will stop monitoring the Subject immediately the revocation notice is received.
The Supplier will remove equipment in accordance with the procedure set out in Section 10.1.
Process Description The local Police Force will arrest the Subject and arrange for his/her return to
the local prison. The local Police Force will arrange with Prison Escort
Contractors to return the Subject to prison together with the Prison Escort
Record and a copy of the Revocation Order to the prison. (In some cases
Police may return Subject to the local prison themselves)
The National Identification Service will remove the Revocation Order from PNC on receipt of the
Detained Report from the Arresting Officer that confirms that the Subject has been returned to
custody.
Responsibility ERRS
Process Description ERRS will prepare a recall dossier for the Subject on receipt of confirmation
that the Subject has been returned to custody. The detailed process differs for
recalls under section 38 of the Criminal Justice Act 1991 or section 255 of the
Criminal Justice Act 2003 and recalls under section 39 of the Criminal Justice
Act 1991 or section 254 of the Criminal Justice Act 2003.
For recalls under section 38 of the Criminal Justice Act 1991 or section 255 of the Criminal Justice
Act 2003 ERRS will prepare the following standard forms and create a recall dossier that will be sent
to the prison that is holding the Subject
• PUHDC (7), PUHDC (8) and PUHDC (9) – these are Appeal Papers to be handed to the
Subject if he / she wants to lodge an appeal
• Monitoring report from the Supplier that sets out details of the breach.
Section 38 of the Criminal Justice Act 1991 and Section 255 of the Criminal Justice Act 2003 cover
recalls for breach of curfew conditions or inability to monitor the Subject. Section 38 of the Criminal
Justice Act 1991 also allows for recall if it is necessary to do so to protect the public from serious
harm from the Subject.
If a Subject has been recalled due to a breach of other Licence conditions under section 38 CJA 1991
or section 255 CJA 2003 the recall dossier is produced by ERRS when the Revocation Order is raised
(see 7.5 above)
For recalls under section 39 of the Criminal Justice Act 1991 or section 254 of the Criminal Justice
Act 2003 ERRS will prepare the following standard forms and create a recall dossier that will be sent
to the prison that is holding the Subject.
• Cover memorandum setting out procedures to provide the prisoner with appeal papers
• Confirmation of Disclosure or Recall Dossier / Representations against Recall
• An acknowledgement letter for completion to signify that the Subject has received the recall
dossier
• Details of the prisoners court hearing dates
Section 39 of the Criminal Justice Act 1991 and Section 254 of the Criminal Justice Act 2003 cover
recalls where the Subject breaches non-curfew related licence conditions.
Details of these documents are set out in the document “Home Detention Curfew – Administrative
Officer Desknotes” The document can be obtained from the Early Release and Recall Section.
Timing PUHDC (8) must be returned to ERRS within 1 working day of receipt from
the prisoner

the appeal is considered by the ERRS (HDC Appeals Team)
ERRS send a letter setting out the outcome of the successful appeal to the
prison in both cases

accepting the appeal to the prison
