NPD has let two framework arrangements for drug-testing services to: a) allow
for continued testing in the nine pilot Areas, b) to support delivery of drug ATTACHED:
testing PPOs on licence. Many Areas are making local arrangements for Annex A, Annex B (part of Word
testing PPOs on licence, building on what is already in place for the file)
DTTO/DRR. The two recently awarded contracts will benefit those Areas for
whom extending such arrangements is problematic.
Areas were required to monitor this initiative by making a monthly return to
Regions and Performance Unit at NPD. Areas that have not completed this
return are urgently requested to do so, even if this is a nil return. From October,
it is planned that monitoring for drug testing will be included in NSMART
returns and revised forms will be issued in due course.
A list of offence codes is provided following queries from Areas whether certain
offences were trigger offences.

1. Centrally Arranged Drug Testing Framework Agreements

NPD has let two framework arrangements with Cozart Biosciences Plc and SureScreen Diagnostics Ltd, both of
which are already involved in supplying drug-testing kits to the Probation Service, Prison Service, and others.
The placing of the two agreements will allow areas who may wish to use them the flexibility to make an informed
decision as to which to use, based on both technical and commercial grounds.

Copies of both Agreements have been sent to the lead ACO in each Area, whether or not there has been a prior
indication to NPD that the contracts will be used. This will allow Areas to determine for themselves whether the
contracts offer better value than can be obtained locally. Should you be interested in taking advantage of the
availability of these framework agreements you are encouraged to contact both companies to discuss your
requirements. The two companies will supply details of their products, training arrangements, and order

Areas will be responsible for placing and managing orders under these agreements with invoices and
payment also managed locally. If you need any further information or assistance with these
arrangements, or have an issue with an order placed that you are unable to resolve, with a supplier

2. Monitoring Arrangements

To reduce data collection burdens on areas we are currently arranging for monitoring of drug testing on
licence to be included in NSMART monitoring from October. The monthly return will therefore be
considerably shorter and collect only information required to measure performance against the NPS
target (90% of risk of harm assessments and OASys sentence plans are completed on Prolific and
Priority Offenders within five working days of commencement of the order or release into the community.)
Revised forms will be issued prior to October but in the meantime areas are asked to complete the drug
testing section of the monthly return even if this is a nil response.

3. Trigger Offences

The full list of offence codes is attached (Annex A, quick reference, Annex B, full list of offences).

ANNEX A - TRIGGER OFFENCES for DRUG TESTING with effect from 27 July
2004

Offences under the following provisions of the Theft Act 1968:

Section 1 (theft)
Section 8 (robbery)
Section 9 (burglary)
Section 10 (aggravated burglary)
Section 12 (taking a motor vehicle or other conveyance without authority)
Section 12A (aggravated vehicle taking)
Section 15 (obtaining property by deception)
Section 22 (handling stolen goods)*
Section 25 (going equipped for stealing etc)

Offences under the following provisions of the Misuse of Drugs Act 1971 are trigger
offences if committed in respect of a specified Class A drug:

Section 4 (restriction on production and supply of controlled drugs)


Section 5(2) (possession of a controlled drug)
Section 5(3) (possession of controlled drug with intent to supply)

An offence under section 1(1) of the Criminal Attempts Act 1981 is a trigger offence, if
committed in respect of an offence under any of the following provisions of the Theft
Act 1968*:

Section 1 (theft)
Section 8 (robbery)
Section 9 (burglary)
Section 15 (obtaining property by deception)
Section 22 (handling stolen goods)

Offences under the following provisions of the Vagrancy Act 1824:

Section 3 (begging)*
Section 4 (persistent begging)*
