Notice is hereby given that a Special Meeting of the Governing Body of the City of Pelican
Bay will be held on Wednesday, the 19th day of November, 2003 at 6:30 P.M. in the City
Hall at 1300 Pelican Circle, Pelican Bay, Texas, at which time the following subjects will be
discussed,to wit:

1. CALL TO ORDER.

3. WORKSHOP CONCERNING EMPLOYMENT POLICIES AND


PROCEDURES.

Governing Body of the City OF Pelican Bay is a true and correct copy of said Notice and

PROVIDING REQUIREMENTS F'OR POLICE OFFICERS;
ESTABLISHING A POLICE RESERVE FORCE; ESTABLISHING
REQUIREMENTS, REGULATIONS AND LIMITATIONS FOR
RESERVE OFFICERS AND REPDALING PREVIOUS ORDINANCES
ON THE SUBJECT.

WHEREAS, the City Councildesiresto provideregulationsfor appointmentand

BE IT ORDAINED BY TIIE CITY COUNCIL OF THE CITY OF PELICAN
16 BAY, TEXAS:

20 Section1. Police ReserveForce Established; Purpose.

22 (a) There is hereby establisheda reserve police force to function in


addition to the regularly constitutedpolice departmentof the City.

(b) The purposeand necessityfor the reservepolice force is to assistin the
26 creation of an active and efficient civil defenseprogram in the City and
as an aid to the regularly constituted police department in the
28 performanceof assignedduties as set forth in this Ordinance andlor
directedby the City Council.

Section2: Appointment, Removal, and Command of ReserveOfficers.

(a) The membersof the police reserveshall be appointedby and under the
34 control and command of the Police Chief, who shall exercise
supervision over training and utilization of the reserve police force
36 membership.An appointmentto the reserveforce must be approvedby
the City Council before the appointedperson may carry a weapon or
38 otherwiseact as a peaceofficer.

(b) Members may be suspendedby the Police Chief or the Mayor for
any
causedeemedsufficient by either. Any member may resign from
the
police reserve at any time by notifying the police
Clief of his
resignation.

(c) The Chief of Police may terminatereservepolice officers and


the City
Council may terminatereservepolice officers in the same manner

other police officers.

t2 Section3. Maximum Number of ReserveOfficers.

18 section 4. Qualifications and Minimum standards for
Reserveofficers.
20 (a) Members of the reservepolice force must at all times
conform to the
rules and regulationsof the police department,as approved
22 by the City
Council.

24 (b) Reserve police officers must comply with the


minimum training
standards_established
by the Texas Commission on Law Enforcement
26 officers Standardsand Education for all reserve
law enforcement
officers which must be fulfilred before a person is
28 appointed as a
reservelaw enforcementofficer. All applicants
for porition, in the
Police Reservemust also meetthe following basic qualifications:

(1) Over 2l yearsof age;
JZ (2) United States citizen;
(3) High schoolgraduate,or equivalent;
34 (4) Good moral character;andlor
(5) Never have been convicted of a felony.

(c) All applicantsshall be subjectedto the following prior
38 to appointment:
(1) Backgroundinvestigationincluding criminal history;
40 (2) Fingerprint check and consent/req"uest
signed uv irr" applicant
for criminal history;
42 (3) Driver's licenserecord check:
(4) Good credit rating;and
(s) Physicalexamination.

Failure to receivea favorablereport on any of the five referenced
investigationsshallresultin rejectionof the applicant. Appointment
andapprovalto carrya weaponandact as a peaceoffrceris subjectto
the discretionof the policechiefandcity councilandan applicantmay
be rejectedwithout cause. The city councilshallbe providedall the
informationrequiredfor appointment in orderto exercise
their approval
of the appointeeto carrya weaponandact asa peaceofficer.

Section5: Oath.

All applicantsbefore appointmentto the reservepolice force shall subscribeto
t4 the sameoath as given to regularlyappointedofficers of the police department.

16 Section6.: Identification.

18 An identification card or other insignia or evidenceof identity, as the Police


Chief may prescribe,shall be issuedto eachnew memberof the ReservePolice
20 Force, who must carry the card and other identificationat all times while on
duty. The card and other identification must be surrenderedupon termination
22 of membership.

24 Section7: Uniforms and Badges.

26 Members of the reserve force, when on duty, shall wear the uniform and
equipment prescribed by the Police Chief. Uniform and equipment will
28 normally be furnished by the individual reservemember at his own expense
but useduniforms and equipmentbelongingto the City may be utilized by the
30 reserveforce with approval of the Police Chief. Budgeted public funds in
approvedamountswill be utilized for necessarytraining, supplies,equipment
maintenance,and replacementthereofto the reservepolice force.

34 Section8: Compensation;Other Benefits.

36 Members of the reservepolice force shall serve on a volunteer pay basis and
shall not receivemonetarycompensationunless specifically authorizedby the
38 City Council.

40 Section9: Carrying of Weapons.

42 A reservepolice officer may carry a weapononly when authorizedto do so by


the Police Chief and only when dischargingofficial dutiesas a peaceofficer.
