2010 Estt Rule No 02/2010 To All concerned A copy of Railway Boards letter No. E(NG)I/2009/TR/30 dated 23.12.2009 is published for information, guidance and necessary action. Vide this office letter mentioned therein, clarification was sought that whether on request transfer on bottom seniority in initial recruitment grade is permissible where the employee seeking such transfer has not been recruited to the post through direct recruitment but occupied the post through promotion. Boards clarification in the matter has been received and is published hereby. The copy of this office letter dated 03.11.2009 is also being published herewith for reference. Ref:- South East Central Railways letter No. P/SECR/Ruling /Transfer/4480 dated 03.11.2009. Please refer to your Railways letter under reference and it is clarified that, with a view to mitigate hardships of the employees, there is a provision for inter-divisional and inter Railway transfers at employees requests, only in initial recruitment grade or in such intermediate grades in which there is an element of direct recruitment. The employee seeking transfer against DR quota should possess direct recruitment qualification to the relevant post. Hence it is not considered to be appropriate to deny request transfer against direct recruitment quota post, wherever it exists. Sd/- (M. K. Meena) Dy. Director Estt. ( N) Railway Board. Ref.:- (i) Boards letter No. E(NG)I-99/TR/15 dated 08.02.2000 (RBE No. 24/2000). (ii) Para 312 of Indian Railway Establishment Manual, Vol.-I. As per the provisions of Railway Board regarding on request transfers on bottom seniority, transfer on request from railway employees working in such grades where there is an element of direct recruitment may be accepted provided they fulfill the educational qualifications laid down for direct recruitment to the post. The direct recruitment of graduates in the categories of Traffic Inspector/Station Master/Yard Master/Controller is through Traffic Apprentices. 15% quota in these categories is filled through RRB with minimum qualification of graduate. A training of two years is common for all these

categories and no specific category-wise training is imparted. The allotment of post is done only at the time of completion of training. The employees, who are not direct recruitee and have been promoted to these categories as per AVC and who fulfill the educational qualification prescribed for direct recruitment for these categories, also seek Inter Railway transfer on request on bottom seniority. This Railways view is that such request transfers should not be permissible as such posts are earmarked for Traffic Apprentices and should be filled up only after completing training prescribed for Traffic Apprentices. The intention of the direct recruitments through RRBs is to provide a lateral entry of fresh and talented blood. Filling up of this small percentage of direct recruitment quota by transferring a promote on request will thus defeat the purpose for which the direct recruitment is intended for. Board are, therefore, requested to clarify whether such request transfers are permissible where the employee has not been recruited to the post through DR quota and occupied the post through promotion in which he is seeking request transfer on bottom seniority.
