FACTORY RUNNING IN RESIDENTIAL AREA

I, jethmal jain s/o anop chand pugalia aged 48 years., am living in old lane, daga-gali, ward
no.19,Gangashahar, Bikaner, Rajasthan. Along with my family. That Shree Kiran chand daga,
Sh. Surendra kumar daga s/o sh. Late manak chand daga and Sh.sandeep kumar daga s/o
Sh surendra kumar daga Resident of old lane, daga-gali ward no. 19, gangashahar Bikaner.
B is in occupation of two residential houses running food processing industries as DAGA DAL
MILL,SURENDRA STORE,SAPNA FOOD PRODUCTS AND ETC.They has employed more
than 30-35 labors to make rasgoola papar bhujia namkins and other food sweets and
chemical adhesives to do such business The said labor create lot of nuisance / public
nuisance and often makes filthy abuses and indulge in quarrels. The said labor keeps
commuting between these factories
(B)That makes lot of noise, smock, smell thereby making the peaceful living of the residents
disturbed and impossible.
(C) That due to effluvium emission by the said industries situated in the
residential houses in residential area. We the resident of street feel uncomfortable
due to water, noise, air pollution and nuisance.
(D) Our children are losing their studies and their health.
(E)That due to these nuisance, pollution and wrongful activity there have
been developed many disease such like allergy, bronchitis (asthma)
and skin disease etc. The people of street are facing the problem of
uncomfortness breathing because of that.

I and mohalla niwasi have made requests to above factory owners to stop the pollution and
nuisance but the said factory owners has been extending life threats to me and my family
members. He is also trying to tress pass into the common areas. His labor roams freely in
groups at the street and the residents in front of our houses and they keep peeping in the
houses thereby spoiling the atmosphere. The laborers also smoke and drink in public which
is bound to adversely affect the children and society. The houses are meant for residence
only but the commercial as well as industrial use and illegal activities in the two residential
houses mentioned above is posing a great threat to the life and security of senior citizens in
the area and especially in the night time when we are sleeping.
The said factory owners has been threatening me and my family members of false implication
in false cases so as to prevent us from complaining against the wrongful and illegal activities
and nuisance being created by him and his workers /employees. Sh. Kiran chand, surendra
kumar and sandeep kumar daga is also threatening to illegally tress pass the common area
meant for public passages and utility. The factory owners and his workers are habitually
intimidating the local residents and children by show of force and violence and there is affray.
The workers bath in open place of factory and make toileting and littering making the
environment unhealthy and polluted.
It is a serious matter concerning citizen of Bikaner,Gangashahar.
That in spite of various industrial areas developed by RICO in Bikaner,
There are still many factories/industries running in the residential areas producing
a lot of pollution, nuisance and health hazard.
These factories/ industries in resienditial area are unlawful without conversion of
land.

In spite of these ireregulatroies the municipal authority is issuing

licenses/N.O.C/permission etc to these factories. This is unlawful use of power by
municipal authority

The municipal corporation is also involving in this nuisance.

In this regards we already send to you the inspection report of pollution control board
Bikaner, jila udyog Kendra Bikaner and also inspection report of municipal corporation and
notice issued by municipal corporation Bikaner as on 24-05-08 vide s.no.(1) 5790 (2)5795
(3)5796 and order pass by ADM CITY BIKANER AS ON 29-12-2008.

You are therefore requested to take the necessary action against municipal corporation
Bikaner and factory owners and his workers in accordance with the provision of municipal
act, empowered by constitution of India article 21, and Indian Penal Code and provide safety
and security to our life and property.
