Variations in grain, color, marks, scars, texture and pattern of wood, leather and textiles occurring as a result of nature, dye lot, exposure to light, and aging; (8). Any utilization of furniture that is inconsistent with either the design of the furniture or the way the manufacturer intended the furniture to be used; (9). Cosmetic damage to all fabric, plastic, wood, metal or other decorative parts is not covered. (10). Worn fabrics, resulting from ordinary wear and tear, or any other cause, (11). Chipping, denting, scratching, marring of wood, metal or glass surfaces resulting from Your use, misuse, or abuse. 4. LIMITATION OF LIABILITY. ELGIN, ITS AGENTS, CONTRACTORS, SERVICE PROVIDER OR LICENSEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES UNDER THIS SERVICE CONTRACT, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS, PROPERTY DAMAGE, LOST TIME; NON-ECONOMIC LOSS, INCLUDING, BUT NOT LIMITED TO, PAIN AND SUFFERING, LOSS OF SOCIETY, CONSORTIUM, COMPANIONSHIP, CARE, ASSISTANCE, ATTENTION, PROTECTION, ADVICE, GUIDANCE, COUNSEL, INSTRUCTION, TRAINING, OR EDUCATION, DISFIGUREMENT, MENTAL ANGUISH, EMOTIONAL UPSET, AND ANY OTHER INTANGIBLE LOSS; LOST DATA RESULTING FROM THE BREAKDOWN OR FAILURE OF ANY EQUIPMENT, OR FROM DELAYS IN SERVICING OR THE INABILITY TO RENDER SERVICE ON ANY COVERED EQUIPMENT. SELLERS LIABILITY SHALL IN NO EVENT EXCEED ITS COST OF REPLACEMENT OF THE PROPERTY SOLD AND REFUNDING THE PURCHASE PRICE OF THIS SERVICE CONTRACT. THIS SERVICE CONTRACT IS NOT A WARRANTY OR INSURANCE POLICY. 5. CLAIMS LIMITATION. The total claims limitation under this Contract is the original purchase price of the covered product less sales tax, delivery and installation charges. During the term of the Contract We may elect at Our option, to buyout the Contract for the original purchase price of the covered product less claims paid, less sales tax, delivery and installation, or replace the product with a comparable product. In the event We reimburse You or replace the product We shall have satisfied all obligations owed under this Contract. 6. TIME FOR SERVICE. Service will be performed during normal business hours of the participating service provider Monday through Friday, excluding holidays. 7. PLACE OF SERVICE. When you contact us to request service, We open up a service call with our authorized service center, provide your contact information to our service center, and they will contact you to arrange an appointment with you to complete the repair. Our service center is located in Northeast Ohio. If you relocate outside Northeast Ohio, You will be required to carry in or ship to our service center to obtain service, or we may provide you with an authorized service provider located in your area. Otherwise, Repair service may be provided either at Your home, or You will be required to Carryln or ship to our Service Center, as specified herein and by Our Service provider. All T.V. screens size 33 (diagonal) and smaller, computers and cameras must be taken by You to the service center for repair. In-home service is provided for T.V. screens larger than 33 (diagonal). If you are entitled to On-Site service but due to environmental and/or technical requirements certain repairs can not be completed in Your residence, or if You are located more than fifty (50) miles from the nearest authorized provider, the cost to transport and/or ship the product for service will be paid by You. 8. RECOMMENDED REPAIRS, INSPECTION & COST FOR NON-COVERED REPAIRS. Repairs recommended by the service provider not necessitated by mechanical breakdown are not covered unless specifically authorized by Us. We reserve the right to inspect the items to be covered, or the items covered, as the case may be, prior to coverage or during the coverage period. An original invoice showing Model Number, original date of purchase, and purchase price of this Contract for all items to be covered, along with serial numbers of equipment covered and a copy of this Agreement must be provided to obtain service. If You request a service call for a non-covered repair You will be responsible for all costs associated with the repair. In the event You are unable to meet the service provider You must call to cancel the appointment

in advance of the agreed upon time of service or You may be responsible for paying the second trip charge for the subsequent rescheduled repair. 9. ACCESSIBILITY OF PRODUCT. If service is required You agree to make the product reasonably accessible to the service provider. If the product is not accessible the service provider will have the option of declining to provide service or assessing You an additional charge for making the product accessible, commensurate with the difficulty in working on the product. 10. PARTS. Parts used to repair equipment may either be new or rebuilt at Our sole option. 11. UNAVAILABILITY OF FUNCTIONAL PARTS or TECHNICAL INFORMATION. We, at Our option, may elect to replace the product with a comparable product or reimburse You for the original purchase price of the product (minus claims, sales tax, and delivery and installation charges) if We are unable to repair Your product due to: a. parts no longer available. b. National backorder of parts: parts production and shipment delays exceeding sixty (60) calendar days, c. unavailability of technical information. Product replacement does not include dealer/service provider delivery or installation. All contractual obligations are fulfilled upon the product replacement, reimbursement or Service Contract term expiration. 12. DEDUCTIBLE. No deductible applies to this Service Contract 13. NO LEMON GUARANTEE. When three service repairs, on three separate occasions, have been completed on the same component, and that same component requires a fourth repair, as determined by Us, We at our discretion may elect to either replace Your product with a like grade and quality, not to exceed the original product retail purchase price, or elect to buyout the Service Contract up to the original equipment purchase price. This does not include repairs necessary during the manufacturers warranty period. Product replacement does not include dealer/ service provider delivery or installation. All contractual obligations are fulfilled upon the product replacement, reimbursement or Service Contract term expiration. 14. CANCELLATION AND REFUND. You may cancel this Service Contract at any time for any reason by sending a written request to Elgin Furniture & Appliance, Inc., 26400 LAKELAND BLVD. EUCLID, OH 44132. If You cancel this Service Contract within sixty (60) days of the date purchased You will receive a refund of the full purchase price less any claims and less a cancellation fee of $25.00. If You cancel thereafter, You will be refunded the remaining days of coverage on a monthly prorated basis less cost for service performed (if applicable). 15. TERMINATION FOR OTHER CAUSE: If the serial number plate of the equipment has been removed, altered, defaced or made illegible, or if You have defaulted in Your obligation to pay for the Electronics, Appliances or Furniture and failed to pay the purchase price for this service contract, or because You have committed a fraud upon Us, We have the right to terminate this Service Contract without liability. If We exercise this right We shall refund to You the remaining pro rata unearned portion of Your Contract less any service performed (if applicable). 16. TRANSFERABILITY. This service contract is not assignable by You, and You may not transfer Your Service Contract. If you sell the product governed by this Agreement prior to the expiration of the term of this Agreement, you may obtain a refund in accordance with the cancellation and refund policy set forth herein. 17. ENTIRE CONTRACT. This is the entire Contract and no other oral modifications are valid.

SERVICE CONTRACT This document sets forth the entire Contract between the Service Contract Administrator, Elgin Furniture & Appliance, Inc. (Elgin) hereinafter referred to as Elgin, We, Us and Our, and, the Purchaser hereinafter referred to as You and Your. 1. COVERAGE AND TERM. ELGIN agrees, subject to the terms and conditions contained herein, to pay Our authorized service center for all service required to maintain such television, stereo, computer, camera or appliance (hereinafter referred to as Electronics and Appliances) purchased in conjunction with an Electronics and Appliance Service Contract for 2 years from the effective date of this Contract, for covered services. ELGIN agrees, subject to the terms and conditions contained herein, to repair or replace any of the furniture, its components or materials, purchased in conjunction with a Furniture Service Contract, if required due to mechanical breakdown or defect for 18 months from the effective date of this Contract, for covered services. The effective date of this Contract is the date on which the Electronics, Appliance, or Furniture is delivered to You or picked up by You. This is not an insurance policy. As the Service Contract Administrator, We will assist You in understanding Your service and coverage benefits from the day You purchase Your Service Contract. If Your product needs maintenance or repair for covered operational or mechanical failures or defect as further defined below, You are required to call Us at (216) 441-4500 or submit Your claim in writing to Us at Elgin Furniture & Appliance, Inc., 26400 LAKELAND BLVD. EUCLID, OH 44132. With any correspondence, please provide your daytime phone number and Contract number if applicable. There are some limitations of coverage. You should review the limitations of coverage paragraph for details. 2. WHAT IS COVERED. Coverage applies to qualifying products sold by Us, as originally configured, and purchased in conjunction with this Contract. During the manufacturers warranty period, any parts, labor, service or costs covered by that warranty are the sole responsibility of the manufacturer; Our authorized Service Provider may at its option, on Your behalf, exercise your rights directly with the manufacturer to obtain repairs, replacement, equipment, service or parts offered by the manufacturer. After the manufacturers warranty expires, this service contract will repair OPERATIONAL or MECHANICAL failures, Mechanical Breakdowns or Defects during normal usage by furnishing replacement parts and/or labor necessary to maintain your covered product. ELECTRONICS AND APPLIANCES: We will furnish labor, parts, and/or replacement equipment (or pay for same) necessary to repair OPERATIONAL or MECHANICAL failures during normal usage. The product specified and covered includes only equipment as originally configured and charged for in the Contract. Coverage begins at the same time as the term of the Plan. OPERATIONAL or MECHANICAL failures during normal usage means that due to normal wear and tear or a defect in either materials or workmanship your product has failed to perform under standard operating conditions. FURNITURE: We will service mechanical breakdown or defects in the furnitures structural framework, warping and frame breakage; breaking or bending of metal components such as recliners and sleep mechanisms, swivel rocker bases and springs; broken or loose springs, broken casters or legs, loose or popped buttons and any other trim, broken welds and loose supports, peeling of table tops, warped tops, hinges, glides, warped table tops, cracked or defective frames and all loose trim; and premature wear and seam separation, unless any of the foregoing are not covered as defined in the following paragraph. 3. WHAT IS NOT COVERED. LIMITATIONS OF COVERAGE. FOR ALL ELECTRONICS AND APPLIANCES AND FURNITURE, THIS CONTRACT DOES NOT COVER: (a). Any merchandise located outside the United States. (b). Service required as a result of any alteration of the merchandise or repairs or service made by anyone other than a participating service provider, its agents, distributors, contractors or licensees, or the use of supplies other than those recommended by the manufacturer. (c). Damage or other equipment failure due to failure to comply with manufacturers instructions for use, including but not limited to any structural or mechanical defect that is caused by you. (d). Damage due to causes beyond Our control including, but not limited to negligent, willful, or other abuse or misuse of the covered product; failure to maintain the equipment according to the owners manual instructions, vandalism, theft, fire, flood, wind, freezing, smoke, dirt, sand, lightning, moisture, humidity, water damage, power failure, inadequate or excessive power supply or power surges, earthquake, unusual atmospheric conditions, radiation, explosions, contamination, or acts of war or acts of God, criminal acts by any Purchaser or third persons, scratching, denting or chipping, however caused; weather, rust, corrosion; scorching or damage from heat sources (i.e. electric heaters, torches and soldering irons); cleansing the covered product; transit, delivery, or re-delivery; any physical force; acids, corrosives or non-approved cleaners. (e). Loss of use of the covered product transit, delivery, or re-delivery; any physical force; acids, corrosives or non-approved cleaners. (e). Loss of use of the covered product or consequential or incidental loss of any nature; (f). Formation of rust and/or corrosion due to outdoor use; (g) reasonable and necessary maintenance and customer education; (h). Merchandise used in recreational vehicles, industrial or commercial settings. An industrial or commercial setting is defined as anything other than a single family dwelling, and includes a single family dwelling where the Purchaser conducts a trade or business. Single family dwellings include: Houses, Townhouses, Modular Housing, Condominiums, Duplexes, and Individual Apartments. (i). Consequential damages or delay in rendering service under this Contract, or loss of use during the period that the product is at the authorized service center or otherwise awaiting parts. (j) Products sold -as is-; IN ADDITION TO THE FOREGOING, FOR ELECTRONICS AND APPLIANCES, THIS CONTRACT DOES NOT COVER: (1). Service necessary because of improper storage, improper ventilation, non-compliant plumbing or power supply, antenna, serial, tower, antenna connection and lead-in or signal wire to the stereo or television receiver, non-municipal water supply, loss or damage as a result of violation of exiting federal, state and municipal codes including repairs to products not complying with said codes; Inconsequential noises, reconfiguration of equipment, movement of the equipment, including the failure to place the equipment in an area that complies with the manufacturers published space or open air environments; Any utilization of equipment that is inconsistent with either the design of the equipment or the way the manufacturer intended the equipment to be used; Any and all case in which the manufacturer of the equipment would not honor any warranty regarding the equipment. (2). Nonfunctional parts, expendable items, scratches,

dents, hard water damage, walls and infrastructure, cabinetry and cabinet frames, decorative finishing, door liners, installation, hinges, glass including projection television exterior screens, handles, knobs, masks, racks, rollers, and shelves. Cosmetic damage to all plastic, wood, metal or other decorative parts is not covered. Failures due to corrosion, rust, dust, mold, animal, rodent or insect damage, wind weather, scorching or damage from heat sources, chipping, products sold -as is-, trim and/or appearance parts or accessory items such as electrical connections and venting equipment, filters, batteries, including rechargeable batteries, tapes, ribbons, incandescent or fluorescent light bulbs, data storage media, blades, fuses, replaceable fluids, vacuum cleaner belts and bags, drip pans or grates, filters, material and operating supplies which are designed to be consumed during the life of the product. Loss of or damage to data, recording media and software is not covered. (3). In-warranty parts not provided or shipped by the manufacturer. Operational or mechanical failure covered by the manufacturers warranty, manufacturers recall, improper construction or factory bulletins (regardless of whether or not the manufacturer is doing business as an ongoing enterprise). (4). Pre-existing conditions (incurred prior to the effective date of coverage) known to You or operational or mechanical failure which is not reported prior to expiration of this Service Contract (5). Refurbished products with less than an original ninety (90) days manufacturers parts and labor limited warranty. Refurbished equipment with a an original 90 day warranty must have at least 30 days remaining in that warranty to qualify for coverage. (6). Consequential damage to or spoilage of CDs, DVDs, film, hard drives or recording tapes or media as a result of the malfunctioning of or damage to an operating part, or as a result of any repairs or replacement under this Contract. (7). Television imperfections, including burn in-or burned CRT phosphor, caused by video games, prolonged display of one or more signal(s), or other abuse. Damaged or defective LCD screens when the failure is caused by abuse or is otherwise excluded herein. All display products that are used in an application that requires continuous and/or business operation. (8). Damage resulting from unauthorized repair, improper installation or setup, user facilitated minor adjustments and settings outlined in the products owners manual, external antenna or local reception problems, negligence, misuse or abuse whether willful or not, transit or delivery damage, damage caused by packing, unpacking, assembly or removal. Short circuit, loss of use, parts or labor covered under the manufacturers warranty, lack of maintenance, bodily injury, manufacturers recall, periodic checkups or maintenance. We will not pay for adjustments or repairs required because of conditions at Your location. (9). Payment for subsequent service calls which result in -no failure found-diagnosis. Non-failure problems including but not limited to noises and squeaks not requiring parts and intermittent issues are not product failures. Subsequent trip charges may need to be paid by You if a second -no failure found-diagnosis is determined based on the same problem. (10). Damage covered by manufacturers warranty, manufacturers recall or factory bulletins (regardless of whether or not the manufacturer is doing business as an ongoing enterprise). (11). Damage to or failure of computer hardware caused by viruses, spybots, trojans, worms or hacking, registry errors, operating system upgrades, system conflicts, installation of aftermarket peripherals, drives, cards, ports, plug & play devices; IRQ conflicts, application or programs failures, networking programs, upgrades, formatting of any kind, databases, files, drivers, source code, object code or proprietary data, or any support, configuration, installation or reinstallation of any software or data. Damage to or failure of software, including but not limited to, application programs, network programs, upgrades, formatting of any kind, databases, files, drivers, source code, object code or proprietary data, or any support, configuration, installation or reinstallation of any software or data. Damage to or failure of software, including but not limited to, application programs, network programs, upgrades, formatting of any kind, databases, files, drivers, source code, object code or proprietary data, or any support, configuration, installation or reinstallation of any software or data. IN ADDITION TO THE EXCLUSIONS FROM COVERAGE APPLICABLE UNDER (A)-(J) ABOVE, FOR FURNITURE, THIS CONTRACT DOES NOT COVER: (1). Damage caused by: solvents, liquids, solutions, chemicals, treatments or coatings applied by you; (2). Stains, dyes (i.e. hair, clothing and shoe dyes), all household food and beverage product stains; all stains incurred from human bodily fluids, including blood, sweat, water rings and heat marks resulting from use withina normal environment; nail polish or cosmetics; accidental punctures, tears, cigarette burns; marking from ink, pencil, paint, dust or chalk;
