Pronunciamiento de organizaciones de derechos humanos del mundo sobre el programa de vigilancia del gobierno de Estados Unidos

Maana viernes 14 de junio se realizar en Dubln, Irlanda, una reunin a nivel ministerial entre Estados Unidos y la Unin Europea, que ser presidida por el ministro de Justicia e Igualdad Alan Shatter TD, presidente del Consejo de Justicia y Asuntos del Interior de la Unin Europea.

Participarn de la reunin la secretaria de Seguridad Nacional de Estados Unidos, Janet Napolitano, el procurador general de ese pas, Eric H. Holder Jr., la vicepresidente de la Comisin Europea responsable de Justicia, Derechos Fundamentales y Ciudadana, Viviane Reding, y la comisaria europea responsable de Asuntos del Interior, Cecilia

Malmstrm. Su agenda incluye una sesin de alto nivel sobre la proteccin de datos

En este contexto y en respuesta al descubrimiento de un programa del gobierno de Estados Unidos denominado "PRISM" que otorga a la Agencia de Seguridad Nacional de ese pas un acceso sin precedentes a los servidores de las principales empresas de tecnologa, un grupo de organizaciones de derechos humanos de distintas partes del mundo emiti la siguiente declaracin conjunta:

Informes recientes indican que el gobierno de Estados Unidos tiene la capacidad de adquirir y controlar el contenido de las comunicaciones y otros datos electrnicos, como por ejemplo los datos de ubicacin, pertenecientes a los usuarios internacionales de servicios masivos de Internet en tiempo real. Esa capacidad permite el seguimiento de las comunicaciones, movimientos y reuniones de innumerables personas en todo el mundo. Dicha vigilancia estatal vasta e invasiva viola dos derechos fundamentales: el derecho a la privacidad y a la libertad de expresin.

El artculo 12 de la Declaracin Universal de Derechos Humanos

establece que "nadie ser objeto de injerencias arbitrarias en su vida privada, su familia, su domicilio o su correspondencia" y el artculo 17 del Pacto Internacional de Derechos Civiles y Polticos otorga protecciones similares. El programa PRISM controla tal enorme cantidad de informacin personal que impide el cumplimiento de esos estndares. PRISM tambin amenaza el derecho a la libertad pensamiento y expresin y el derecho a buscar, recibir y difundir informacin.

El derecho internacional tambin exige que los Estados proporcionen protecciones legales y garantas frente a las interferencias o ataques a la privacidad individual. Estados Unidos debe cumplir con estas obligaciones internacionales y poner fin a su extraordinaria intrusin en las vidas de miles de millones de personas en todo el mundo.

International Civil Liberties Organisations Statement on Dragnet U.S. Government Surveillance Program

Tomorrow Friday June 14 in Dublin, Minister for Justice and Equality Alan Shatter TD will chair an EU-US Ministerial-level meeting in his capacity as President of the Justice and Home Affairs (JHA) Council of the European Union.

Participants will include US Secretary for Homeland Security, Janet Napolitano and US Attorney General, Eric H. Holder, Jr., the VicePresident of the European Commission responsible for Justice,

Fundamental Rights and Citizenship, Viviane Reding, and the European Commissioner responsible for Home Affairs, Cecilia Malmstrm. Their agenda includes a high-level session on data protection.

In this context and in response to revelations that a U.S. government program known as PRISM gives the United States National Security Agency unprecedented access to the servers of major technology companies, an international group of Civil Liberties Organisations issued the following joint statement:

Recent reports indicate that the U.S. government has the ability to acquire and monitor the content of communications and other electronic data, including location data, from international users of popular Internet services in real-time. That capability allows for the monitoring of, the communications, movements, and associations of countless people around the world. Such vast and pervasive state surveillance violates two of the most fundamental human rights: the right to privacy and to freedom of expression . Article 12 of the Universal Declaration of Human Rights requires that no one shall be subjected to arbitrary interference with his privacy, family, home or correspondence, and Article 17 of the International Covenant on Civil and Political Rights grants similar protections. The PRISM program sweeps in such an enormous amount of personal information that it simply cannot comply with those standards. PRISM also threatens the right to freedom of expression, the right to hold opinions without interference, and the rights to seek, receive, and impart information.

International law also requires that states provide legal protections to guarantee against interference or attacks on individual privacy. The United States must comply with these international obligations and end its

extraordinary intrusion into the lives of billions around the world.
