This updates you on our document requests and interviews based on a team review.
1. We received the PENTTBOM detainee and related programs materials from DHS. The detainee materials
are not tied to the names or A-numbers, which makes them less useful. At this stage, however, I am
disinclined to go back to them on this. Because we do have the names, we can find the 302's and related
EC's to get insight into what occurred. The materials are informative about the immigration violations and
countries involved. We may submit a few QFR's relating to these programs.
2. We have NOT received the A-files. Mitnick indicated at the Ridge interview that they anticipated that the
Commission would contact a Congressional committee. I said that we would be unlikely to consider that
appropriate, and that he needed to speak with you Dan. These are important to us.
3. CIA Morean called last week and asked for a revision in Document Request 50 for docs sought by Team 5
on terrorist travel facilitators. This was reasonable and helpful and we are providing it to Steve Dunne
today.
4. Janice is completing the inspector interviews this week.
1. Saudi flights: docs, interviews, QFRs. Tom is well on his way, but will be taking more steps.
2. Still tracking pre-9/11 record on terrorist travel - manuals, hard drives. Kelly is planning some follow
ups/fill ins.
3. Update on targeting terrorist travelers from National Targeting Center -- this is per Gorelick-PDZ colloquy
at Commr briefing on use of databases, which raised a good question we had not considered.
4. DHS budget. We need to interview David Hahn at OMB and parts of his DHS team, (have discussed with
Kevin Scheid.) (SG-JKR)
5. Some policy related interviews if we can get them in. As PDZ said, we have concentrated on history rather
than policy. Some areas:
a. National identification standards
b. Private sector role in immigration related counterterrorism measures
c. Key figures on Mexico and Canada in the State/Administration
d. Major players on immigration policy as related to terrorism
e. More senior people in CIA on terrorist travel (Jolene provided the key names)
We recognize we may not get to these, but they represent our best vision at this point.

These are documents about the travel of early 1990s terrorists contained in the files of the SONY prosecutors and
gleaned from the exhibit lists DOJ already provided to us. We believe we do not have the facts to complete our
work without them.
They are not yet part of any document request. I raised our ability to gain access to them with Faith and asked
her view on its feasibility.
Our goal was to get their agreement before we submitted any request to the FO to avoid any debate over whether
it would be too burdensome.
In order to lessen any difficulty, we also volunteered to send Walt and Kelly there to review records and seek to
copy what was relevant.
Yesterday, Faith said the SONY expressed reluctance with this approach.
I expect to hear from Faith today and will let you know what she says.

FYI. In our effort to close out some loose ends for Teams 5 and 1, we have been making an
effort to gain access to some records in New York at the SONY.
I have been working with Faith Burton on this, and yesterday encountered some resistance from
the SONY via Faith. We are continuing to try and work this out, but I wanted to alert you to this
issue in light of our conversation with the Commissioners yesterday.

We did a scrub of our outstanding document requests and have discussed them with the FBI and DoJ. I don't
think we are in the category of requiring Front Office attention yet.
In the category of remaining interviews that may be of interest to the Front Office, we recently had the thought of
talking to Admiral Poindexter about TIA and data mining.

We have two sets of docs outstanding from ICE on the post-9-11 enforcement programs.
The first, bulleted below, is the list we agreed upon with representatives from the National Security Law Unit.
Other than the FOIA materials, these were documents that were shown to us and that we identified in the group
interview. Baruch was present at that interview. This list was sent to Melissa Mehring who attended the interview
as the notetaker, and I believe also to Dan Brown, but I cannot find the email in my sent box.

Here's another stray: EOF declassified several White House docs before our March hearings. They included, as I
recall:
1. Jan. 25, 2001 Clarke memo to Rice (including Plan Delenda and Dec. 2000 strategy paper)
2. Cressey Sept. 2001 roadmap to Rice to run Sept. 4 PC
3. Final version of the draft NSPD (minus Annex A)
Jamie Gorelick told me at the time to make sure that we held onto those. My understanding is that these
documents have all been returned to the White House—even though they are no longer classified documents.
I mentioned this to Dan Marcus today, but we might want to raise again.
