Red Oak Estate Plat 8 Homeowners Association Neighborhood Meeting April 1, 2013 Present: Charlie Roos, Rob Buelte, Les Stegh, George Pleshkewych, Thaddeus Denthriff, Holly Romenesko, Chuck Romenesko Meeting was called to order at 6:05pm. Members introduced themselves. There was a motion by Les Stegh and seconded by George Pleshkewych to approve the meeting minutes, as amended from the November 5, 2012 meeting. Motion passed. Under paragraph 5, budget was changed to bylaws. Charlie informed the group that we have our first foreclosure in the Association. The property at 1676 Divine has gone into foreclosure. Association dues have not been paid for 2011, 2012 and 2013. Charlie will follow up with the realtor to see if we can recover any of these costs. Holly provided an overview of the Treasurers report. Accounts that are currently in arrears are 1676 Divine which is in foreclosure ($180) and Lot 189 Schmidt Elliot Joint Ventures ($180). Two lots were transferred from McKiski to Three Hammer in 2012 were not assessed dues; therefore in 2013, these two lots were added to Three Hammers invoice. Schmidt Elliot Joint Ventures asserts that they are exempt from paying the dues. Charlie will follow up with McKiski regarding the Schmidt Elliot Joint Ventures properties. A motion was made by George Pleshkewych and seconded by Charlie Roos to amend the bylaws to include the following statement under Article 8 Duties, Section 3 Secretary/treasurer: The Secretary/treasurer is responsible for opening, closing, and maintaining all banking business for the Association. One additional Board member must accompany the Secretary/treasurer when opening and/or closing any accounts. Motion passed. Holly outlined the annual cash flow with projected expenses and revenues. Annual revenues are $2340 and expenses are estimated at $3000 (mowing $1200, taxes $1200, insurance $600). This results in an annual deficit of $660. The account has a balance of $10,839 which would absorb the annual excess expenditures. The group discussed increasing the annual dues, not paying the taxes, and proceeding with the open space/conservation land designation. Holly went through the draft open space/conservation land application with the group. Les agreed to work with Holly on the application. The first hurdle to clear is that the property is not owned by the Homeowners Association, but rather it is owned by Herb McKiski. The group discussed various items regarding Lot 193. Herb McKiski still retains ownership of Lot 193 and benefits from any tax deductions that may exist. However, the ROEHOA has paid the taxes in 2011 and 2012. The Declarations and Restrictions state that the HOA is responsible for the maintenance and repair of the drainage and water retention areas located on Lot 193 of the subdivision and to provide for liability insurance of said lot. A motion was made by Les Stegh and seconded by George Pleshkewych that the ROEHOA will not pay the real estate taxes for Lot 193. Motion passed.

The group discussed a clean-up day for Lot 193. There is a considerable amount of trash and debris in the lot. After the first mowing and the lot has time to dry out a bit, the clean-up day will be scheduled. In the meantime, Holly will meet with the City to discuss responsibilities and expectations and the outcome of the Citys annual inspection. There are several properties abutting Lot 193 that are dumping brush piles. Holly will send a letter to all abutting property owners about the upcoming inspection from the City and request their cooperation. The next meeting will be held on the first Monday of October (October 7, 2013). Rob Buelte made a motion and Charlie Roos seconded the motion to adjourn. The meeting ended at 7:10pm.
