Christopher Payne was a Pennsylvania-born pioneer, who spent his life seeking a place where he could settle and make his fortune. Years later, a Milwaukee Sentinel reporter named M.M Quaife would label Payne the Daniel Boone of the northwest. Paynes rival was John Brink of New York, who turned a ninemonth surveying course into a life-long career. In 1835, Brink was a government surveyor. Government surveyors and their assistants laid down the township and quarter section lines throughout the Midwest. Those lines became the boundaries, plats and subdivisions of towns, villages and cities. Brinks assistants were John Hodgson, Jesse Eggleston and brothers Reuben T. and William Ostrander. Their jobs varied from assisting with the actual surveying to setting up camp and cooking meals. Its often stated that Brink surveyed around Geneva Lake, but documents in the state Historical Society show that the Lake Geneva area surveyor of record was Sylvester Sullivan. More likely, Brink passed by Geneva Lake on his way to Lake Winnebago, where he is known to have surveyed. That would clear Brink of later accusations that, as a government surveyor, he had no right to claim land he was surveying. However, Brink, a native of Geneva, N.Y., did admit to making an unauthorized map change. He renamed the lake from Big Foot to Geneva. That name change, although it violated government regulations, was upheld by Brinks superior in Cincinnati, who was also from Geneva, N.Y. Brink and Payne were the rst Americans to see the potential value of Geneva Lake.

Lake Geneva
Their competing claims were for a oodplain at the east end of Geneva Lake, at the mouth of the White River and the lakes natural egress. Although the water ow here was naturally slow (except during spring oods), if tamed by a dam and then sped up and directed by a mill race, the water could turn a water wheel, which would provide power. Payne and Brink were looking for power. And a forceful ow of water in the mid-19th century meant power. Skilled mill wrights built efcient mill races and water wheels, capturing the force of water. That force turned grinding wheels, spun lathes and activated presses to grind grain, shape wood and pulp fruit. And the owner of the that mill could look forward to making some considerable prot. In the early 19th Century, land ownership west of the Alleganys was established by settlers marking trees or stacking rocks to lay claim. That method wasnt always a rock-solid guarantee of ownership, however. John Brink claimed he piled several stone pyramids and bent and marked trees around the land he desired at Geneva Lake to mark his claim before leaving the area in the fall of 1835. After surveying the Lake Winnebago area, Brink personally traveled to Cincinnati to report to the government surveying ofce there. Brinks surveying partners, Hodgson, the Ostranders and Eggleston remained behind to secure Brinks claim, and their shares of it. While it was Brinks work that took him past Geneva Lake, Payne was a pure pioneer, moving his rather large family around to nd a better place to live and better prospects for making a living.
Descriptions of Payne leave the impression that he was a restless sort, always looking for the pot of gold just over the horizon. By the early 1830s, most settlers in the area knew there was a lake or lakes in what is now Walworth County, but no one knew for certain where they were. A map published as late as 1835 showed no lakes in the area at all. But Payne had a hunch. Traders passing through Illinois talked about Big Foots Lake in southern Wisconsin Territory. Thats mighty slim hearsay, but Payne was willing to take risks to nd a pristine lake where he could make rst claim on the water rights. Paynes rst attempt to nd Big Foots Lake was made in winter 1832. Setting out from Chicago, he got as far as what is now the town of Bloomeld in southern Walworth County, just short of his goal. A lack of provisions and bad weather forced him to return to Chicago. It took four years, but in February 1836, Payne nally had enough money to make another try at nding Big Foots Lake. This time, Payne traveled with two companions. Traveling in the dead of winter sounds harsh. But its easier to cross streams

when theyre frozen. And the cold meant less of a chance for an unfortunate encounter with Indians, bears or other, less congenial frontiersmen. Its almost certain that Payne did not know that Brink had already been to Big Foots Lake just six months earlier, and renamed it Geneva Lake. This time, Payne found his lake. He also found the White River and a site where he planned to build a mill. What he didnt nd, or at least what he claimed he didnt nd, was any sign of claim marks by Brink. For his part, Brink knew his claim might be challenged. Brinks assistants, Hodgson and William Ostrander, were to watch over his claim. But when Payne and his companions arrived at Geneva Lake in February 1836, no one was there to challenge them. Hodgson and Ostrander were wintering in Milwaukee. They found Milwaukee, with a trading post and tavern, much more hospitable in winter than the raw edge of a frozen lake in what was still Indian country. Payne returned in March 1836, and
this time built a cabin, its location now marked by a plaque, near the area where he wished to build a mill race. Brinks men, Hodgson and Ostrander, returned to their assigned posts in April 1836. They must have been shocked and horried when they found Payne sitting on the porch of his cabin built on their bosss claim. Words were exchanged. One can assume they were not friendly. Hodgeson and one of the Ostranders went back to Milwaukee to round up some muscle on Brinks behalf. Returning with some hired hands, they then pulled Payne from his cabin and burned it to the ground. The act of vandalism was deliberate and calculated. They pulled all of Paynes possessions out of the cabin before torching it. They then told him to leave. But, not one to be intimidated, Payne came back about a month later with his own support. And his family and friends began to outnumber Brinks hired hands. Fights broke over the counter-claims. Things were getting complicated. Meanwhile, a pair of businessmen, R.Wells Warren and Lewis Goodsell, heard about Geneva Lake and decided to check things out. Meanwhile, John Brink was nowhere to be found. And Hodgson was beginning to look for a way out. Hodgson made contact with several potential buyers, but others who had a money stake in Brinks claim did not agree to the sales. And then Hodgson approached R. Wells Warren and Lewis Goodsell. This time, apparently without consulting his partners, Hodgson sold his rights, the rights of the Ostrander brothers,

Egglestons rights and Brinks rights to the Geneva Lake claim to Warren and Goodsell for $2,000. Later, Christopher Payne would put up cash of his own to secure the rights for his mill. It was a good deal - for Hodgson. He disappeared with the money. With Hodgsons departure, Paynes claim seems to have been secured. Brinks supporters either drifted away, or peacefully stayed and settled in. Ultimately, it was a good deal for Lake Geneva, as well. Warren was involved in completing the rst mill race and a sawmill was in operation by March 1837. Goodsell owned the lease for the water power and built a grist mill that opened in October that same year. Meanwhile, Warren was involvedin platting of village of Geneva and he built the villages rst hotel in 1836, called the Geneva Hotel, at what is now the corner of Main and Center streets. (Not to be confused with the Frank Lloyd Wright hotel of the same name that came many years later.) Outwardly, peace was restored, but a lot of bitterness remained and some sts were still around to shake in either direction. Later, John Brink and Reuben Ostrander repudiated Hodgsons authority to sell their shares of the claim. They led a lawsuit againt Hodgson in Racine County Court. There is no indication that Hodgson was ever located to answer the lawsuit. Reuben Ostrander would live in the village of Lake Geneva. He was active in civic affairs, studied medicine and became a physician. But he would also occasionally make bitter comments about how he was cheated out of a fortune. Payne later also complained that he was forced to buy his own pocketbook to maintain the peace.
Meanwhile, more and more families were moving to Geneva Lake, building homes and businesses. They had no time for disputes involving John Brink and Christopher Payne. John Brink would live out his life in Crystal Lake, Ill., only 40 miles south of Lake Geneva. He died in 1904 at the age of 93. There is no evidence he so much as passed through the Geneva Lake area ever again. Payne would stay in Geneva for just a year. He moved to Duck Lake (Lake Como) where he built a mill, and lived there for four years. Then, Payne picked up stakes and moved to Columbia County, Wis., where he bought land that he thought would be his forever. A series of court ghts over possession of the land, however, left him destitute. He died at his sons home in Columbia County in 1871 at the age of 85. He is buried in Marcellon.
