RSOG nab 4 fugitives in Leyte, Samar

CAMP KANGLEON, Palo, Leyte The Police Regional Office 8 (PRO8) arrested four fugitives in separate manhunt operations in Leyte and Samar provinces, the regions top police official said Thursday. PRO8 director PCSupt. Elmer Ragadio Soria informed that the suspects are facing charges for murder, rape and cattle rustling and were arrested by the Regional Special Operations Group (RSOG). Soria said fugitive Arturo Mabag, 69, wanted for rape, was arrested on Wednesday evening by RSOG under PInsp. Constantino Jabonete, Jr. at the outskirts of Barangay Canduyucan in San Sebastian, Samar. Judge Auxencio Dacuycoy of the Regional Trial Court Branch 29 in Catbalogan City issued Mabags arrest warrant in criminal case number 4424. Army assists groups registration

ORMOC CITY The Army brigade based in this city has recently assisted in the registration of eight communitybased organizations from this province with the Department of Labor and Employment (DoLE), a military report said. Colonel Rafael Valencia, commander of the Philippine Armys 802nd Brigade based in Camp Downes, this city, told reporters in an interview at his office, here, that his brigade has been extending assistance to the communitybased organizations mostly from the third district of this province which were formerly organized, affiliated and served as the mass base support of the members of the Communist Party of the Philippines/New Peoples Army (CPP/ NPA) operating in the area. We have been helping and working closely with these organizations to attain their dreams in a peaceful manner, without armed struggle. Col. Valencia disclosed that these eight associations composed of farmers and fisher folks are: Taglawigan Farmers Organization, Taglawigan Fisher Folks Organization, Catoogan Farmers Association, all from the town of San Isidro; Sorosimbahan Farmers Association, Jubay Farmers Association, Airport Farmers Association, Cabatoan Farmers Association all from the municipality of Calubian; and Libertad Farmers Association from Kananga town. Valencia disclosed that recently almost one thousand members from these eight organizations celebrates openly their 12th anniversary under the folds of the law with the government troops, nongovernment organizations (NGOs) and civil society organizations (CSOs) in Barangay Jubay, Calubian, Leyte. Valencia pointed out that with the registration of these organizations with DoLE, these community-based associations have attained juridical personalities and made them duly government-recognized organization. Other government agencies, NGOs and CSOs have already signified to help these organizations achieve their dreams. This is Bayanihan in action, Valencia added. Valencia claims that the registration of these associations with DoLE will empower them in the mainstream of our society and will become active members in development. The registration of the orga-

nization will not only benefit the association, but will also be a significant advancement since they have already a juridical personality in dealing with the government agencies, NGOs and or CSOs, he said. Valencia informed reporters that his brigade has already supported these associations in seeking assistance from several government agencies, aside from DoLE, like the Department of Agrarian Reform, Department of Agriculture, Bureau of Fisheries and Aquatic Resources, Technological Education and Skills Development Authority, and the Visayas State University . been asked for from these government agencies in the project proposal preparations for livelihood projects to be implemented for these associations. TACLOBAN CITY-The Leyte National High School (LNHS) General Parent-Teachers Association (GPTA) held its general assembly and election of officers for the school year 2013-2014 on Saturday, July 6 at the LNHS gymnasium here. Jane Codilan, the school principal, who personally oversee the gathering, expressed her appreciation with the overwhelming attendance of parents of the biggest secondary school in the region with more than 7,000 students population. In his report, Prosecutor Higinio Yasar, the reelected GPTA president, presented to the present parents and teachers that under his leadership they were able to implement infrastructure projects inside the school campus such as drainage repair that costs P139,000; pathwalk concreting P117,000 and the acquisition of copier and resograph machines worth P109,000.

OWWA-8 search on for MOFYA 2013

TACLOBAN CITY The Overseas Workers Welfare Administration Regional Welfare Office 8 (OWWA-RWO8) continues to embody their advocacy through this years Model OFW Family of the Year Awards (MOFYA) on October 2013. For almost a decade of giving due recognition and commending the valuable efforts and hard work of the overseas Filipino workers for surpassing the challenges of time and distance due to migration, the award reveals the bigger picture for the public behind the great sacrifices and upsetting stories of maltreatment on our fellow OFWs,the fulfillment of their dreams for their families and their great contribution to our country. This OWWA initiative unveils the different success stories of model OFWs who were able to nurture strong Filipino culture by maintaining close family ties and bringing development to their society through active community involvement. The nominations for the MOFYA 2013 started last May 2 and will be open until September 24. Nominations should be made by the different organizations that will acclaim outstanding OFW families from the communities where they belong. To qualify, one should be an active OWWA member and has worked for almost four years abroad until now. He or she, either married or single, should not have an immigrant status in the foreign country and must possess valid working permit or employment documents and must have established financial stability with his/ her family. However, two regional winners, each from the land-based and sea-based category, will be chosen through a screening committee. The committee is composed of representatives from the Department of Labor and Employment (DOLE), OWWA, NGOs and Church-based organizations. The said screening will be held this September 24, 2013 and the winners will be proclaimed on October 1, 2013. CATBALOGAN CITY - The observance of the Nutrition Month this July in this city comes with a very serious mission: to get out of the top list of local government units with a very high incidence of malnutrition. The data coming from National Nutrition Council (NNC) based on the 2012 weighing activity revealed that Samar province had the highest malnutrition prevalence at 17.88% while Catbalogan and Calbayog are the two cities with the highest incidence of the same at 18.31% and 14.41%, respectively. Catbalogan has held the top spot in this ranking for the second year now. The most recent data submitted by the City Health Office to the NNC showed that out of 15,681 preschoolers aged 0-71 months old, only 13,155 participated in the Operation Timbang and out of these, 2,647 were found to be malnourished.

Catbalogan City tackles malnutrition problems

One of the initial interventions done by the City Social Welfare and Development Office (CSWDO) was a massive 2-month supplementary feeding program in every day care center which is to be augmented with constant weight monitoring. This initiative was launched this July in Barangay Silanga, where malnutrition is most prevalent. The CSWDO has selected 30 underweight and severely underweight children aged 24 35 months to take part in a milk feeding program. The same shall also go through constant weight monitoring. The City Health Office will also be administering iron supplement in aid of this initiative. For the succeeding days of the Nutrition Month, the CSWDO has also partnered with the CHO for a series of lectures and fora about proper nutrition and Infant and Young Child Feeding

(IYCF), to be held in barangays that were identified to have serious problems regarding malnutrition. As recommended by the City Nutrition Council headed by nutrition action officer Herminia Cabral, Councilor Coefredo Uy explained to the NNC in a letter dated June 23, 2013 that due to an injunction order on the citys annual budget for 2013, the Nutrition Month Celebration will be limited to advocacy and information campaign. For this same purpose, Mayor Stephany Uy-Tan had already issued a memo addressed to the city division urging all schools to conduct activities aimed at raising awareness about the importance of proper nutrition. What is hot pursuit?

Hot pursuit is when an offense has just been committed and arresting person has personal knowledge of commission. The law has not stated the specific time-lapse between the commission and actual arrest to be hot pursuit. . . . That the search disclosed a prohibited substance in appellants possession and thus confirmed the police officers initial information and suspicion, did not cure its patent illegality. An illegal search cannot be undertaken and then an arrest effected on the strength of the evidence yielded by the search. In the same opinion, Mere Suspicion of Criminal Activity Did Not Justify Search of Cuizon -People vs. Cuizon, 256 SCRA 325, April 18, 1996, Justice Panganiban wrote: Reiterating the doctrine that where a person is searched without a warrant, and under circumstances other than those justifying a warrantless arrest . . . , upon a mere suspicion that he has embarked on some criminal activity, and/or for the purpose of discovering if indeed a crime has been committed by him, then the search made of such person as well as his arrest [is] deemed illegal, this Court declared unlawful the arrest of Cuizon as well as the incidental search and seizure. The warrantless arrest and search were not justified by the rules on in flagrante delicto or hot pursuit for, at the time of his arrest, Cuizon was inside his home resting with his wife and child. No offense had just been committed or was actually being committed or attempted by him in the presence of the lawmen, nor did the latter have personal knowledge of facts indicating that Cuizon authored an offense that had just in fact been committed. Consequently, any evidence obtained during the illegal search, even if tending to confirm or actually confirming the initial suspicion, is absolutely inadmissible for any purpose and in any proceeding, the same being the fruit of the poisonous tree. We should not make a big issue about the trials and challenges that will surely come our way in this life. In the Supreme Courts decision, Sammy Malacat y Mandar vs. Court of Appeals and People of the Philippines, G.R. No. 123595, December 12, 1997, former Chief Justice Hilario David, Jr., penned: The general rule as regards arrests, searches and seizures is that a warrant is needed in order to validly effect the same. The Constitutional prohibition against unreasonable arrests, searches and seizures refers to those effected without a validly issued warrant, subject to certain exceptions. As regards valid warrantless arrests, these are found in Section 5, Rule 113 of the Rules of Court, which reads, in part: Sec. 5. Arrest, without warrant; when lawful A peace officer or a private person may, without a warrant, arrest a person: (a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense; (b) When an offense has in fact just been committed, and he has personal knowledge of facts indicating that the person to be arrested has committed it; and (c) When the person to be arrested is a prisoner who has escaped . . . A warrantless arrest under the circumstances contemplated under Section 5(a) has been denominated as one in flagrante delicto, while that under Section 5(b) has been described as a hot pursuit arrest. Turning to valid warrantless searches, they are limited to the following: (1) customs searches; (2)

search of moving vehicles; (3) seizure of evidence in plain view; (4) consent searches; (5) a search incidental to a lawful arrest; and (6) a stop and frisk. In the separate opinion of Justice Panganiban, Lawmen Had Sufficient Opportunity to Secure Warrant in Encinada -People vs. Encinada, G.R. No. 116720, October 2, 1997, he opined: Reversing the trial court, this Court stressed the following: Encinada was not committing a crime in the presence of the police; the latter did not have personal knowledge of facts indicating that he just committed an offense; and raw intelligence information was not a sufficient ground for a warrantless arrest. Furthermore, [t]he prosecutions evidence did not show any suspicious behavior when the appellant disembarked from the ship or while he rode the motorela. No act or fact demonstrating a felonious enterprise could be ascribed to appellant under such bare circumstances. Having known the identity of their suspect the previous day, the law enforcers could have secured a warrant of arrest even within such limited period (per Administrative Circular No. 13 and Circular No. 19, s. 1987). In emphasizing the importance of according respect to every persons constitutional right against illegal arrests and searches, the Court exhorted: Lawmen cannot be allowed to violate every law they are expected to enforce. [The policemans] receipt of the intelligence information regarding the culprits identity, the particular crime he allegedly committed and his exact whereabouts underscored the need to secure a warrant for his arrest. But he failed to do so. Such failure or neglect cannot excuse him from violating a constitutional right of the appellant.

Doing so would be tantamount to tempting God and to falling into mere fideism that can assume many forms such as superstition, quietism, idealism, etc. Christ told us very clearly that we need to be shrewd, clever and astute like serpents but simple, harmless and innocent like doves. Its quite a combination, possible only when one is truly with Christ. Otherwise, we open ourselves to the possibility of some psychological disorder. We should never be nave in the things of the world, but neither should we become cynical and skeptical, overly worried or too concerned. A certain sense of detachment and abandonment is always healthy. Gods providence never fails. In the story of Joseph and his brothers, we can learn how the evil intended by Josephs brothers resulted in some good in the sense that Joseph came out saving his brothers and the whole clan from hunger. Much more than that, the evil inflicted on him occasioned many virtues like forgiveness and magnanimity. Joseph finally brought about reconciliation and unity in the whole family, making his father, Jacob, who was grieving for so long after the loss of Joseph, extremely happy at the end of his life. Theres always hope no matter how ugly things may appear now. Theres always a happy ending, if not now, then later.

Palo Cathedral to hold PC Run 2013

PALO, Leyte - The Palo Cathedral holds its grand fun run 2013 this August 3, 4 am, at Palo Cathedral grounds. This activity was conceptualized by this years hermana, the Corpin family, who coordinated with the Palo Committee of Sports headed by Dr. Ciriaco Agner. In line with the celebration of the 183rd town fiesta, this fun run was organized and the proceeds of the event would go to the repair of the old Pipe Organ, which was donated to the church a few years ago by a group of Palon-on people who are now based in the United States. The fun run consists of a 5-kilometer, 10-kilometer, and 18-kilometer race, open to all running enthusiasts, associations, LGUs and various youth and parish ministries in Palo, Tacloban and nearby communities or towns as well. This is the very first grand fun run in Palo wherein different bodies, not just from the town but also from the city and nearby towns, will be joining the activity and with that, we are very much pleased and encouraged to anticipate the success of this fun run especially that it will be for a great cause, Dr. Roy Manuel Espina, co-coordinator of the said event, said in a phone interview. Early registrants will have a 25% discount for their fees, thats why we encourage everyone who are interested to join this fun run to just proceed to our registration booths before July 15, Dr. Kimberly Queen Corpin Dadizon, co-organizer, said in an interview. The 5-kilometer run will have the route going to Salvacion-New Diversion Road-BarasGuindapunan-and back to its starting point. The 10-kilometer run will follow the Salvacion-New Diversion Road-BarasNational Housing Authority (NHA)-Candahug (BIR)-Pawing-Guindapunan-and back. However, the 18-kilometer run will have the same route from Salvacion to Candahug and from there; they will travel from Manlurip-San Jose- Coca-cola-Marasbaras-Pawing-Guindapunan-and back. Each will have the Palo Cathedral grounds as the starting area. Moreover, medical and hydration stations will also be provided for the runners in every 2.5 kilometers of each route. Each booth will be assisted by marshals coming from the Bureau of Fire Protection-

Palo (BFP-Palo) and some CAT students from St. Mary of Palo (SMAP). Also, according to Espina, a promotional run participated in by volunteer-runners from Tacloban will also be conducted on July 15 at the downtown area. This will start at 6 am at the Sto. Nio Church grounds, traversing the streets of Real, Imelda Veteranos, Justice Romualdez and back to its point of origin. This aims to encourage more participants to the said event. DepEd-Smart introduce mobile app in support of alternative learning

The Department of Educations Bureau of Alternative Learning System (BALS) and Smart Communications, Inc. (Smart) have partnered in pioneering mobile technologies to aid teachers across the country. BALS handles nonformal education, providing a venue for individuals of all ages that were not able to and cannot go through the formal classroom learning to still get education and secure their elementary and high school diplomas. The method by which education is delivered is through 6,000 mobile teachers all over the country who go where the students arein the mountains, isolated sitios, markets or barangay centers. Smart, thru application partner Orange Fix, has developed a mobile application that will allow these educators to access teaching materials anytime, anywhere, online or offline from their mobile devices like tablets. Smart is offering the ALS mobile app freeof-charge and has bundled the app with lowcost tablets powered by Smart Bro. Teachers will have the option to go prepaid or postpaid, depending on their preference and requirements. Smart is pleased to partner with BALS in introducing mobile technology in teaching.
