WEATHER
TACLOBAN CITY The Federation of Sanguniang Kabataan in Leyte and of Tacloban City support the call for SK reform rather than abolishing it as what some legislators are pushing through a bill to be filed in the present Congress before the SK elections this October. Leyte SK Federation president Kim Roger Serdoncillo and Tacloban Sangunian Kabataan Federation president Edmund Edward Chua said that instead of abolishing,

a reform should be made for the youth organization in the barangay. Both officials stressed the importance of SK among youth as this serves as their voice in the government and their training ground to become a good leader. Among the reforms that needs to be done for the SK, according to Serdoncillo, are to increase the SK membership age bracket from 15 to 17 year old to 15 to 21 year old; allow SK to manage its own funds by allowing them to have their own account separate from the barangay to page 7

Army assists groups registration

ORMOC CITY The Army brigade based in this city has recently assisted in the registration of eight communitybased organizations from this province with the Department of Labor and Employment (DoLE), a military report said. Colonel Rafael Valencia, commander of the Philippine Armys 802nd Brigade based in Camp Downes, this city, told reporters in an interview at his office, here, that his brigade has been extending assistance to the communitybased organizations mostly from the third district of this province which were formerly organized, affiliated and served as the mass base support of the members of the Communist Party of the Philippines/New Peoples Army (CPP/ NPA) operating in the area. We have been helping and working closely with these organizations to attain their dreams in a peaceful manner, without armed struggle. Col. Valencia disclosed that these eight associations composed of farmers and fisher folks are: Taglawigan Farmers Organization, Taglawigan Fisher Folks Organization, Catoogan Farmers Association, all from the town of San Isidro; Sorosimbahan Farmers Association, Jubay Farmers Association, Airport Farmers Association, Cabatoan Farmers Association all from the municipality of Calubian; and Libertad Farmers Association from Kananga town. Valencia disclosed that recently almost one thousand members from these eight organizations celebrates openly their 12th anniversary under the folds of the law with the government troops, nongovernment organizations (NGOs) and civil society organizations (CSOs) in Barangay Jubay, Calubian, Leyte. Valencia pointed out that with the registration of these organizations with DoLE, these community-based associations have attained juridical personalities and made them duly government-recognized organization. Other government agencies, NGOs and CSOs have already signified to help these organizations achieve their dreams. This is Bayanihan in action, Valencia added. Valencia claims that the registration of these associations with DoLE will empower them in the mainstream of our society and will become active members in development. The registration of the orga-

nization will not only benefit the association, but will also be a significant advancement since they have already a juridical personality in dealing with the government agencies, NGOs and or CSOs, he said. Valencia informed reporters that his brigade has already supported these associations in seeking assistance from several government agencies, aside from DoLE, like the Department of Agrarian Reform, Department of Agriculture, Bureau of Fisheries and Aquatic Resources, Technological Education and Skills Development Authority, and the Visayas State University . He added that assistance has

been asked for from these government agencies in the project proposal preparations for livelihood projects to be implemented for these associations. Valencia also informed reporters that Taglawigan Farmers Organization of San Isidro is being made as the model for these organizations in the project development and implementation. He added that the success in the project implementation will be replicated in the other organizations.

CATBALOGAN CITY - The observance of the Nutrition Month this July in this city comes with a very serious mission: to get out of the top list of local government units with a very high incidence of malnutrition. The data coming from National Nutrition Council (NNC) based on the 2012 weighing activity revealed that Samar province had the highest malnutrition prevalence at 17.88% while Catbalogan and Calbayog are the two cities with the highest incidence of the same at 18.31% and 14.41%, respectively. Catbalogan has held the top spot in this ranking for the second year now. The most recent data submitted by the City Health Office to the NNC showed that out of 15,681 preschoolers aged 0-71 months old, only 13,155 participated in the Operation Timbang and out of these, 2,647 were found to be malnourished.

Catbalogan City tackles malnutrition problems

One of the initial interventions done by the City Social Welfare and Development Office (CSWDO) was a massive 2-month supplementary feeding program in every day care center which is to be augmented with constant weight monitoring. This initiative was launched this July in Barangay Silanga, where malnutrition is most prevalent. The CSWDO has selected 30 underweight and severely underweight children aged 24 35 months to take part in a milk feeding program. The same shall also go through constant weight monitoring. The City Health Office will also be administering iron supplement in aid of this initiative. For the succeeding days of the Nutrition Month, the CSWDO has also partnered with the CHO for a series of lectures and fora about proper nutrition and Infant and Young Child Feeding

(IYCF), to be held in barangays that were identified to have serious problems regarding malnutrition. As recommended by the City Nutrition Council headed by nutrition action officer Herminia Cabral, Councilor Coefredo Uy explained to the NNC in a letter dated June 23, 2013 that due to an injunction order on the citys annual budget for 2013, the Nutrition Month Celebration will be limited to advocacy and information campaign. For this same purpose, Mayor Stephany Uy-Tan had already issued a memo addressed to the city division urging all schools to conduct activities aimed at raising awareness about the importance of proper nutrition. She also intends to tackle this particular problem with key offices in the meetings and consultations that she will hold in the next few days. (LAIMINH

What is hot pursuit?

Hot pursuit is when an offense has just been committed and arresting person has personal knowledge of commission. The law has not stated the specific time-lapse between the commission and actual arrest to be hot pursuit. . . . That the search disclosed a prohibited substance in appellants possession and thus confirmed the police officers initial information and suspicion, did not cure its patent illegality. An illegal search cannot be undertaken and then an arrest effected on the strength of the evidence yielded by the search. In the same opinion, Mere Suspicion of Criminal Activity Did Not Justify Search of Cuizon -People vs. Cuizon, 256 SCRA 325, April 18, 1996, Justice Panganiban wrote: Reiterating the doctrine that where a person is searched without a warrant, and under circumstances other than those justifying a warrantless arrest . . . , upon a mere suspicion that he has embarked on some criminal activity, and/or for the purpose of discovering if indeed a crime has been committed by him, then the search made of such person as well as his arrest [is] deemed illegal, this Court declared unlawful the arrest of Cuizon as well as the incidental search and seizure. The warrantless arrest and search were not justified by the rules on in flagrante delicto or hot pursuit for, at the time of his arrest, Cuizon was inside his home resting with his wife and child. No offense had just been committed or was actually being committed or attempted by him in the presence of the lawmen, nor did the latter have personal knowledge of facts indicating that Cuizon authored an offense that had just in fact been committed. Consequently, any evidence obtained during the illegal search, even if tending to confirm or actually confirming the initial suspicion, is absolutely inadmissible for any purpose and in any proceeding, the same being the fruit of the poisonous tree. How about the forced entry into the compound and search in the house of Marilou Malot Galenzoga, can the hot pursuit defense justify the search and arrest conducted by the law enforcers? The picture of Rex Llaga, photographer of Malot, with contusions on his face, will hot pursuit justify the injuries inflicted? How about the armalites pointed

Theres always a happy ending

WE need to be reassured of this promise, given by no less than Christ himself. In the world you shall have distress. But have confidence, I have overcome the world. (Jn 16,32) These words should be indelible in our consciousness. We have to learn to look beyond the present trials and challenges with the accompanying ups and downs, so that we can go through them, not escape from them, without being swallowed up by their logic that would simply pass away anyway. What matters is what remains in the heart after going through these experiences. Are we still with God through them and after them? Is our faith strengthened? Our hope and charity as well? For as long as we are with God, our life will always have a happy ending regardless of what we may go through. Christ has more than amply warned us about what to expect in the world if we are to follow him faithfully. Behold I am sending you like sheep in the midst of wolves, he said, already giving us a vivid idea of the contrast between a Christian life consistently lived and the world environment that still needs to be redeemed. Lets remember that our freedom either can catapult us to the acme of goodness or plunge us into the depth of evil and malice. We should try to be ready to face the possible worst scenario even as we strive to achieve the best of what we can be. We should not make a big issue about the trials and challenges that will surely come our way in this life. Without denying their seriousness, of course, let us also realize more deeply to the persons on prone position inside the house near the stair? Yes, how about it? If one of the dirty fingers accidentally squeezed the trigger will hot pursuit justify the deaths? How about the rights of the women and children? Were they given protection or is it trampled like the rest of those arrested? Former City Mayor Eric C. Codilla faced the same situation on 2010 election; however, he merely shrugged his shoulder saying: That is their constitutional right. They can shout on top of their voices their

The article Fear hounds supporters of Malot Galenzoga in Baybay by Fred Padernos published in Leyte Samar Daily Express, moves me to look on the jurisprudence to know what is hot pursuit. In the Supreme Courts decision, Sammy Malacat y Mandar vs. Court of Appeals and People of the Philippines, G.R. No. 123595, December 12, 1997, former Chief Justice Hilario David, Jr., penned: The general rule as regards arrests, searches and seizures is that a warrant is needed in order to validly effect the same. The Constitutional prohibition against unreasonable arrests, searches and seizures refers to those effected without a validly issued warrant, subject to certain exceptions. As regards valid warrantless arrests, these are found in Section 5, Rule 113 of the Rules of Court, which reads, in part: Sec. 5. Arrest, without warrant; when lawful A peace officer or a private person may, without a warrant, arrest a person: (a) When, in his presence, the person to be arrested has committed, is actually committing, or is attempting to commit an offense; (b) When an offense has in fact just been committed, and he has personal knowledge of facts indicating that the person to be arrested has committed it; and (c) When the person to be arrested is a prisoner who has escaped . . . A warrantless arrest under the circumstances contemplated under Section 5(a) has been denominated as one in flagrante delicto, while that under Section 5(b) has been described as a hot pursuit arrest. Turning to valid warrantless searches, they are limited to the following: (1) customs searches; (2)

search of moving vehicles; (3) seizure of evidence in plain view; (4) consent searches; (5) a search incidental to a lawful arrest; and (6) a stop and frisk. In the separate opinion of Justice Panganiban, Lawmen Had Sufficient Opportunity to Secure Warrant in Encinada -People vs. Encinada, G.R. No. 116720, October 2, 1997, he opined: Reversing the trial court, this Court stressed the following: Encinada was not committing a crime in the presence of the police; the latter did not have personal knowledge of facts indicating that he just committed an offense; and raw intelligence information was not a sufficient ground for a warrantless arrest. Furthermore, [t]he prosecutions evidence did not show any suspicious behavior when the appellant disembarked from the ship or while he rode the motorela. No act or fact demonstrating a felonious enterprise could be ascribed to appellant under such bare circumstances. Having known the identity of their suspect the previous day, the law enforcers could have secured a warrant of arrest even within such limited period (per Administrative Circular No. 13 and Circular No. 19, s. 1987). In emphasizing the importance of according respect to every persons constitutional right against illegal arrests and searches, the Court exhorted: Lawmen cannot be allowed to violate every law they are expected to enforce. [The policemans] receipt of the intelligence information regarding the culprits identity, the particular crime he allegedly committed and his exact whereabouts underscored the need to secure a warrant for his arrest. But he failed to do so. Such failure or neglect cannot excuse him from violating a constitutional right of the appellant.

that these trials and challenges cannot actually destroy our soul if we dont allow them. In fact, the proper attitude to have and to cultivate is that of fearlessness. Christ himself said so many times. Be not afraid, was a constant reassurance he told his disciples. Do not be afraid of those who kill the body but cannot kill the soul, (Mt 10,28) he said once, practically telling us that we can always shield the soul from anything that can happen in our body, if we want to. And so, together with fearlessness, another trait we should try to develop is that of sportsmanship in the many and even formidable and complicated struggles we have to wage in our present life. And I would add, also a certain degree of elegance and poise, if we can still manage it especially when the going gets rough. Its faith and trust in God, its hope and a burning love for God that would enable us to do all this. Its these theological virtues that would enable us to transcend the limits of human endurance. If we would just rely on our common sense, our human cleverness and our sciences and arts without the support of faith, hope and charity, then for sure we would not go the distance. We would fail to share in the victory of Christ expressed in his very resurrection after a painful death of crucifixion. Of course, neither should we abandon our common sense and all the other human powers and faculties in

living out our human condition in the world. Doing so would be tantamount to tempting God and to falling into mere fideism that can assume many forms such as superstition, quietism, idealism, etc. Christ told us very clearly that we need to be shrewd, clever and astute like serpents but simple, harmless and innocent like doves. Its quite a combination, possible only when one is truly with Christ. Otherwise, we open ourselves to the possibility of some psychological disorder. We should never be nave in the things of the world, but neither should we become cynical and skeptical, overly worried or too concerned. A certain sense of detachment and abandonment is always healthy. Gods providence never fails. In the story of Joseph and his brothers, we can learn how the evil intended by Josephs brothers resulted in some good in the sense that Joseph came out saving his brothers and the whole clan from hunger. Much more than that, the evil inflicted on him occasioned many virtues like forgiveness and magnanimity. Joseph finally brought about reconciliation and unity in the whole family, making his father, Jacob, who was grieving for so long after the loss of Joseph, extremely happy at the end of his life. Theres always hope no matter how ugly things may appear now. Theres always a happy ending, if not now, then later.

perceived grievances. We are still in a democratic country. That was despite advices he received to disperse the rallyist in front of the New City Hall building. Granting the rallyist became unruly and destroyed government properties, it would not justify the hot pursuit defense. The gate was closed and rammed by a government vehicle. The policemen and soldiers could have secured the area, simultaneously applying for a search and arrest warrant from the court, instead of forcing entry. In the article Several wounded in Baybay rally by Restituto A. Cayubit, reported: The police officer said that at past 6:00 oclock in the evening, the rallyists were dispersed by the police after negotiation. There could not be hot pursuit because from the same story states: The police officer said that his men stormed the house of Galenzoga at about 2:15 early in the morning, Monday and arrested all those who were in the Galenzoga compound with the presumponce the Senate resumes. I intend to keep a watchful eye on all monopolies that, given their market dominance, have a natural tendency to abuse and take advantage of their consumers, Escudero said. The Water for the People Network said the expenses above had been passed on the consumers by the Maynilad Water Services Inc. and Manila Water Company from 20082012. The senator said water concession has become a natural monopoly since it was left on its own to fix prices due to the lack or absence of competition. In any part of the country, water districts are natural monopolies. There is no free enterprise and fair competition. It is but right that this industry must be placed under strict monitoring by an institution to balance the equilibrium between our consumers and these industry players. Unfortunately, Escudero said, there is no regulatory body over water utilities but he said the Senate can scrutinize this gray area to put in place a mechanism that would task water utilities to serve the interest of the consumer vis-a-vis its profit margins. We cant just leave monopolies on their own device

tion that all those who were in the compound participated in the violent rally. Eight hours had already passed. Within that period the law enforcers could have secured a warrant to avoid facing administrative and criminal suits. The unarmed civilians rights had been trampled upon because of lack of empathy. I had been in the military and police service, but I never experienced arresting unarmed person using force. On the other hand, Galenzoga should had held her followers not to stage a rally. Rally is useless. In a democratic form of government, grievances should be brought to the court for arbitration. She claimed there are evidences to prove irregularities in the recent election, well, the court is the ultimate place, if not the Comelec. I hope she will extend all legal support to her people. Likewise, Mayor Cari should give the same support to the men in uniform who followed her order for the hot pursuit. Both parties will be having a difficult situation helping their people facing the blindfolded Lady Justice. May the best man wins, as the usual maxim goes. and allow them to steadily earn while we consumers carry the burden, Escudero ended. *** Greater and Deeper Commitment to the Social Contract This Administration stands by the Social Contract we forged with the Filipino People back in 2010. The proposed Budget for 2013 proves our solid commitment to fulfill the Social Contract. This Social Contract has been fleshed out in the Philippine Development Plan for 2011 to 2016 and has been operationalized by Executive Order No. 43, which defines the five Key Result Areas (KRAs) of the Social Contract: 1. Transparent, Accountable, and Participatory Governance; 2. Poverty Reduction and Empowerment of the Poor and Vulnerable; 3. Rapid, Inclusive, and Sustained Economic Growth; 4. Just and Lasting Peace and the Rule of Law; and 5. Integrity of the Environment and Climate Change Adaptation and Mitigation. - His Excellency Benigno S. Escudero said one of the first legislative agenda Congress should look into when it opens is the monopoly of private water concessionaires in the country. This after two private water concessionaires came under fire for passing on to consumers its P15 billion income taxes plus expenses for gifts, trips, entertainment and other company miscellaneous. We will investigate that

The three components include benchmarking assessment of the state and local universities and colleges in the region, social marketing to enhance acceptability of the EVUS concept and stakeholders perceptions of the amalgamation concept for government-run higher learning institutions. In a presentation at the Regional Development Council, Rotacio Gravoso, professor of VSUs department of development communication, said higher education institutions are quietly protecting and expanding their respective turfs and competing with each other. There is a minimal complementation among state universities and colleges (SUCs) in instruction and extension. However, there is closer complementation in research but local universities and colleges are outside of the SUCs loop and are struggling in adherence to standards, Gravoso said. The VSU also noted the regions high poverty incidence despite the presence of 13 higher learning institutions run by the national and local government with huge amounts of budget support from the to design programs. Given the status of SUCs, poverty situation in the region and in response to the national call for educational reforms, leaders of educational institutions intend to re-engineer operation of higher education institutions in Eastern Visayas, said VSU board secretary Daniel Tudtud. Tudtud emphasized the need for shools to integrate programs in the bid to identify the niche that each school will occupy in the EVUS

I am expecting for the President to certify a bill that would improve the SK as an institution where leadership skills among the youth will be developed. A bill that would make the SK as training ground for future effective, efficient and incorruptible leaders of the country, Serdoncillo stressed. For Chua, whose elder

is an elected councilor but once headed the city SK federation, the age of SK members should be increased from 15 to 17 year old to 18 to 21 year old. The idea of increasing the age of SK membership, according to him, is for the officials of the youth organization to have full discretion of their own in making decisions to any binding contract that they will enter into. At the age of 18, you are legally allowed to enter into any contract without any supervision from adult and you can already make decision of your own without being dictated. So if this will be applied to SK, the reform which we are pushing and not abolishing, this would make our organization stronger and better, Chua stressed. But even at their very young age as official of the youth organization, they are capable to make decision of their own for the betterment of their fellow youth provided that no adult will interfere and dictate them on what they will do, added Chua. The youth official also stressed that their organization should also be given the chance to manage their own fund separate from the account of the barangay council. SK should never be abolished because it is our only avenue to be heard in our society and to have participation in the government that has the biggest population in our present time, Chua added. Palo Cathedral to hold PC Run 2013

PALO, Leyte - The Palo Cathedral holds its grand fun run 2013 this August 3, 4 am, at Palo Cathedral grounds. This activity was conceptualized by this years hermana, the Corpin family, who coordinated with the Palo Committee of Sports headed by Dr. Ciriaco Agner. In line with the celebration of the 183rd town fiesta, this fun run was organized and the proceeds of the event would go to the repair of the old Pipe Organ, which was donated to the church a few years ago by a group of Palon-on people who are now based in the United States. The fun run consists of a 5-kilometer, 10-kilometer, and 18-kilometer race, open to all running enthusiasts, associations, LGUs and various youth and parish ministries in Palo, Tacloban and nearby communities or towns as well. This is the very first grand fun run in Palo wherein different bodies, not just from the town but also from the city and nearby towns, will be joining the activity and with that, we are very much pleased and encouraged to anticipate the success of this fun run especially that it will be for a great cause, Dr. Roy Manuel Espina, co-coordinator of the said event, said in a phone interview. Early registrants will have a 25% discount for their fees, thats why we encourage everyone who are interested to join this fun run to just proceed to our registration booths before July 15, Dr. Kimberly Queen Corpin Dadizon, co-organizer, said in an interview. The 5-kilometer run will have the route going to Salvacion-New Diversion Road-BarasGuindapunan-and back to its starting point. The 10-kilometer run will follow the Salvacion-New Diversion Road-BarasNational Housing Authority (NHA)-Candahug (BIR)-Pawing-Guindapunan-and back. However, the 18-kilometer run will have the same route from Salvacion to Candahug and from there; they will travel from Manlurip-San Jose- Coca-cola-Marasbaras-Pawing-Guindapunan-and back. Each will have the Palo Cathedral grounds as the starting area. Moreover, medical and hydration stations will also be provided for the runners in every 2.5 kilometers of each route. Each booth will be assisted by marshals coming from the Bureau of Fire Protection-

Palo (BFP-Palo) and some CAT students from St. Mary of Palo (SMAP). Also, according to Espina, a promotional run participated in by volunteer-runners from Tacloban will also be conducted on July 15 at the downtown area. This will start at 6 am at the Sto. Nio Church grounds, traversing the streets of Real, Imelda Veteranos, Justice Romualdez and back to its point of origin. This aims to encourage more participants to the said event. For further inquiries, you can call 323-4050 or 832-0330 or proceed to the Palo Cathedral Parish.

Dilao added by 2015, they aim to bring down half the number of underweightfor-age-under-five from 27.3 percent in 1990 to 13.7 percent as our commitment to the MDG. Aside from the three towns, the media caravan went to Taft, Maydolong and Borongan City. By the middle of this month, there is another media caravan in the towns of Leyte to assess the nutrition programs of the local government units. DepEd-Smart introduce mobile app in support of alternative learning

The Department of Educations Bureau of Alternative Learning System (BALS) and Smart Communications, Inc. (Smart) have partnered in pioneering mobile technologies to aid teachers across the country. BALS handles nonformal education, providing a venue for individuals of all ages that were not able to and cannot go through the formal classroom learning to still get education and secure their elementary and high school diplomas. The method by which education is delivered is through 6,000 mobile teachers all over the country who go where the students arein the mountains, isolated sitios, markets or barangay centers. Smart, thru application partner Orange Fix, has developed a mobile application that will allow these educators to access teaching materials anytime, anywhere, online or offline from their mobile devices like tablets. Smart is offering the ALS mobile app freeof-charge and has bundled the app with lowcost tablets powered by Smart Bro. Teachers will have the option to go prepaid or postpaid, depending on their preference and requirements. Smart is pleased to partner with BALS in introducing mobile technology in teaching. Through this collaboration, we hope to democratize access to devices, connectivity and content, said Darwin Flores, Smart department head for community partnerships. This is just the start. Smart will soon be introducing mobile learning for students as well, added Flores. This would make the jobs of our mobile teachers a little easier. Because they are mobile, having all their teaching materials in a tablet would be more convenient than them having to carry around all those books and other teaching paraphernalia when they go to their students, said BALS director Dr. Carolina Guerrero. This project is part of Smarts efforts to promote mEducation in the country, or the use of mobile technologies to enable learning, especially to those students that do not have access to formal classroom learning. The tablets that are pre-loaded with the ALS mobile app can be ordered online via www. smart.com.ph/Bro/ DepEdBALS<http:// w w w. s m a r t . c o m . p h / Bro/DepEdBALS. (PR)

the P500 cash pay-out will be given to 4Ps beneficiaries, Alvarez said. Right now, not only the 4Ps beneficiaries are having vegetable gardens, the rest are now planting vegetables. For those who lack spaces, they plant in coconut shells like in Barangay Sabang. Our very successful livelihood programs are 3-piglets dispersal and sari-sari stores worth P10,000, Alvarez added. As the whole nation celebrates the Nutrition Month pursuant to Section 7 of Presidential Decree 491, known as the Nutrition Act of the Philippines, Dilao said the celebration is a call to action to address hunger and for all government agencies to work together for hunger reduction and for Filipinos to have easy access to nutritious and safe
