Attached are the Notices of the First and Second Apportionments for Title V Part AInnovative Education Program Strategies of the No Child Left Behind (NCLB) Act of 2001 (PL 107-110), Fiscal Year (FY) 2003-04. The programs purpose is to support innovative education programs. This apportionment has been made from Federal funds provided to the state under Title VI of the Elementary and Secondary Education Act (ESEA) of 1965, as amended by Title V of the NCLB Act of 2001. This grant award is subject to the provisions of Title VI of the ESEA, as applicable, and the General Education Provisions Act (PL 103-382). This grant award is also subject to the Title VI regulations in Part 200 of Title 34 of the Code of Federal Regulation (CFR), and the Education Department General Administrative Regulations in 34 CFR Parts 76 and 77, 80-82, 85, and 97-99. The funding is appropriated in Item 6110-123-0890 of the 2003 Budget Act (Chapter 157/Statutes 2003). The California suballocation (pass-through) number is Project Cost Account Code 14354. AMOUNT APPORTIONED For the First Apportionment, the statewide amount is $15,589,989. Of this, local educational agencies (LEAs) in Los Angeles County receive $5,427,488. The Second Apportionment totals $15,593,101 statewide. Los Angeles County LEAs receive $5,430,600. Each apportionment represents 40 percent of each LEAs 2003-04 entitlement. The California Department of Education (CDE) indicates that it anticipates a Third Apportionment with the remaining 20 percent of each LEAs entitlement to be released later in June 2004. Each LEAs entitlement was based on a point system with each point worth $2.58512. accumulated as follows: x Points are

SPENDING CONSTRAINTS LEAs may use the funds to design and implement innovative projects and activities chosen from one or more of the 27 program areas identified in PL 107-110, Section 5131. The purpose of these programs should be: x x x x x Support local education reform efforts that are consistent with statewide efforts. Implement promising educational reform and school improvement based on scientific research. Provide a continuing source of innovation, educational reform, and school improvement, including support of library services and instructional and media materials. Meet the educational needs of all students, including at-risk youths. Improve school, student, and teacher performance, including professional development activities and class size reduction.

Under terms of the federal Tydings Amendment, Section 421(B) of the General Education Provisions Act 20, U.S.C. 1225(b), any funds that are not obligated at the end of the federal funding period (July 1, 2003, through September 30, 2004) shall remain available for obligation for an additional period of 12 months (to September 30, 2005). LEAs are strongly encouraged to minimize the time frame between the receipt and expenditure of Federal funds. Federal guidelines discourage the release of additional funds to LEAs that have not spent dollars previously apportioned. The CDE indicates that, beginning in 2003-04, it will review the percentage of Federal carryover funds from prior fiscal years on each LEAs books, and may delay the release of additional Federal funds to LEAs with significant balances. Any interest in excess of $100 earned on Federal funds must be returned to the CDE. CHARTER SCHOOLS Direct funded charter schools are required to apply individually for this program and are identified separately on the Schedule of Apportionment. Locally funded charter schools apply through their chartering agencies and their funding is included in the district amounts shown. Districts are asked to share this information with any charter schools the district charters that are affected by this apportionment. March 19, 2004 Dear County Superintendents of Schools, Auditors, and Treasurers: NOTICE OF THE FIRST APPORTIONMENT FOR TITLE V, PART A - INNOVATIVE EDUCATION PROGRAM STRATEGIES OF THE NO CHILD LEFT BEHIND ACT OF 2001 (PL 107-110) FISCAL YEAR 2003-2004 This apportionment, in the amount of $15,589,989, is made from federal funds provided to the State under Title VI of the Elementary and Secondary Education Act (ESEA) of 1965 as amended by Title V of the No Child Left Behind (NCLB) Act of 2001 (PL 107-110). Upon receipt of this apportionment, participating local educational agencies (LEAs) will have received 40 percent of their total entitlement. It is anticipated that the second 40 percent will be paid in April, and the final 20 percent in June 2004. The purpose of these funds is to support innovative education programs. LEAs have the flexibility to design and implement innovative projects and activities within one or more of 27 innovative program areas identified in PL 107-110, Section 5131. Individual projects and activities should be designed to: (1) support local education reform efforts that are consistent with statewide education reform efforts, (2) implement promising educational reform and school improvement based on scientific research, (3) provide a continuing source of innovation, educational reform, and school improvement, including support of library services and instructional and media materials, (4) meet the educational needs of all students, including at-risk youth, and (5) improve school, student, and teacher performance, including professional development activities and class size reduction. In accordance with federal law, entitlements are calculated on a point system formula using a rate of approximately $2.58512 per point. LEAs receive one point per pupil as reported in the October 2002 California Basic Educational Data System, and one point for each private school participating enrollment. In addition, LEAs are ranked based on their percentage of students eligible for free or reduced price meals (FRPM) as of October 2002 and receive additional points per FRPM student as follows: 3.5 points for LEAs in the top quartile (total percent of 100 to 61.9597); 2 points for LEAs in the second quartile (61.9596 to 36.3757); 1 point for LEAs in the third quartile (36.3756 to 13.5349); and no points for LEAs in the fourth quartile (13.5348 to 0). Direct funded charter schools must apply individually for this program. We identify the amount for direct funded charter schools separate from the district or county amount. All other charter schools must apply through their authorizing agency, and funding associated with the charter school is included in the district or county amount. The United States Department of Education (USDE) award number is S298A030005-03A. The Catalog of Federal Domestic Assistance Subprogram number is 84.298A. This grant is subject to the provisions of Title VI of the ESEA, as applicable, and the General Education Provisions Act (PL 103-382). This grant is also subject to the Title VI regulations in Part 200 of Title 34 of the Code of Federal Regulations (CFR) and the Education Department General Administrative Regulations in 34 CFR Parts 76 and 77, 80-82, 85 and 97-99. LEAs are therefore requested to minimize the time frame between receipt and expenditure of federal program funds. Beginning in the 2003-2004 fiscal year, the California Department of Education will review the percentage of federal carry-over funds from prior fiscal years for each LEA and the release of future apportionments may be delayed for LEAs with significant balances. Federal law Title 34 CFR 80.21(i) also requires that any interest earned by LEAs on federal dollars be returned to the USDE if the amount is in excess of $100. LEAs should forward interest payments for remittance to USDE to: California Department of Education, Attention: Cashiering, 1430 N Street, Suite 2213, Sacramento, CA 95814. To ensure proper posting of payments, please include the program's PCA number and identify the payment as "Federal Interest Returned." Warrants will be mailed to each county treasurer approximately four weeks from the date of this Notice. For standardized account code structure (SACS) coding, use Resource Code 4110, NCLB: Title VI/Title V Part A: Innovative Ed. Strategies, Formula Entitlements, and Revenue Object Code 8290, All Other Federal Revenue. County superintendents of schools are requested to inform LEAs, including direct-funded charter schools, immediately of this apportionment.
