As discussed yesterday morning, we continue to review our


document searches to identify and rectify any unintentional gaps
that may exist due to the scope and complexity of the searches.
As part of our review, we recently applied a new technique
for systematically searching certain electronic databases. This
search retrieved electronic versions of some documents that may
be responsive to certain of the "litmus test* requests
identified in your 26 August 2003 memorandum, Although these
documents pertain to matters addressed in the Commission's
requests, we are uncertain whether these documents are actually
responsive to Commission requests because in many cases we are
unable to determine whether the documents are final versions or
were actually used for the purpose for which they were prepared.
Similarly, even when the document itself identifies for whom it
was prepared, we cannot easily determine whether thf> document
was ever given to that person. All we currently kntjw is that
the documents were prepared electronically and saved in these
databases. In addition, some of these documents maj^ duplicate
hard copy documents the Agency has already produced!.

Dear Mr. Marcus:

This responds to DCI Document Request No. 8 ("DR #8"),


dated 3 July 2003, issued by The National Commission on
Terrorist Attacks Upon the United States (the "Commission"). By
agreement, this response is part of a "rolling" production in
which the Central Intelligence Agency is providing documents to
the Commission as soon as they are identified as responsive.

The first page of each enclosed document has been


sequentially bates-stamped. In this, and all future document
productions, the first two digits of the bates-stamp identifies

I will be couriering today docs responsive to items 1&2 of doc request 7—its
approximately 120 documents.

Item 3 will be harder for us to locate & we think there might only be a couple
of items (3 at the most—as people try to recall) there this will require the
people who are working current intel requirements looking through their desk
drawers to see what we can come up with--its just going to take time.|~ I

the material provided thus far "the best and most recent as requested in
numbers lc., 2 & 3". If there is something the Comm'n feels it doesn't
have and you can be as specific as you can about what that might be, we
can try to look further, otherwise, we believe we have completed DCI

It is our understanding from the Department of Justice that we are to provide in response
to DCI Document Request #3 only disseminated intelligence product.

This packet contains all disseminated intelligence responsive to document request #3,
item#l, letters a-s.

We have no disseminated intelligence product responsive to items 2,3 or 5.

We have already provided Item number 4.

This packet includes:

1. Documents responsive to subsection (b) of DCI Document request #4 as defined


by 9/11 Comm'n staffer Doug MacEachin.
2. Monthly update of documents responsive to subsection (a) of DCI Document
request #4
3. 3 pieces of finished intelligence inadvertently miscopied when originally
produced in response to Document Request #4. This material is provided in
response to a communication received by me via the secure CWE system by
Melissa Coffey on 15 July 2003. (a copy is attached).

The material responsive to items 1 & 2 above is grouped according to the number
assigned to that individual in the document request. Any updated information on the
subject responsive to subsection (a) is grouped with any reporting responsive to
subsection (b). Additionally, any reporting that contains information about Zacarias
Moussaoui is marked with the letters "Mous" and banded together where it occurs
throughout the collection. The Commission should take particular care with the
Moussaoui collection of reporting as these documents are not only classified, but are also
subject to the Moussaoui Non-Disclosure agreement.
