used reasonable efforts in preparing the software and in collecting and preparing material for inclusion in the database but does not warrant that the software is free from error or that the information in the database is complete or accurate, and does not assume, and hereby disclaims, any liability to any person for any loss or damage caused by errors or omissions in the Product, whether such errors or omissions result from negligence, accident, or any other cause, whether or not foreseeable, and whether or not there is an adequate alternative remedy. The publisher and developer have prepared or otherwise obtained rights in software used for indexing, searching, and retrieval of data from the CD-ROM product and in data and indexes of data concerning a wide variety of technical and other business subjects, reflecting independent creative judgment regarding such software and subjects, and have created databases containing collections of data and indexing information. The software, data, indexes and databases are protected under copyright law and treaties, and all rights are reserved. Limited Warranty and Limited Liability The publisher warrants that the software embodied in the Product will perform in substantial compliance with the documentation provided for a period of thirty (30) days from receipt, unless the performance problems are the result of hardware failure or improper use. The publisher's entire liability and your entire remedy shall be, at its discretion, replacement of the defective CD-ROM or a refund of any fee paid. The warranties and representations set out above are the only warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability and fitness for a particular purpose. Neither the publisher, any affiliate of the publisher, nor any third party who has participated in developing, marketing, or distributing the product shall have any obligation or liability to or through the user with respect to the use of the product. Grant of License ASHRAE hereby grants you a nonexclusive, nontransferable right to access documents in the electronic format provided for your individual use on one computer. You may install one copy of the CD on, and permit access to it by, a single computer owned, leased or otherwise controlled by you. In the event that computer becomes dysfunctional, such that you are unable to access the CD, you may transfer the content of the CD to another computer provided that the content is removed from the computer from which it is transferred, and the use of the content on the replacement computer otherwise complies with the terms of this Agreement. If the files are stored on your personal computer on a network, the files should be locked so as not to be accessed by other users on the network. You may copy the electronic document files only for backup purposes. Attention: If you do not accept this license please return all materials to the publisher. If you do not accept and have paid a fee for this product, the fee will be refunded to you if unused and unaccepted product is returned to the publisher.
