Temporary Restraining Order
GREETINGS:
WHEREAS, the Supreme Court, on July 22, 2013, adopted a
resolution in the above-entitled case, to wit:
"G.R. No. 207333 (Republic of the Philippines, represented by the
Philippine Reclamation Authority [PRA] vs. Julita P. Tan).- The Office
of the Solicitor General's motion for an extension of thirty (30) days
within which to file a petition for review on certiorari is GRANTED,
counted from the expiration of the reglementary period.
Acting on this Petition for Review on Certiorari, the Court
resolved, without giving due course to this Petition, to:
(a) REQUIRE the respondent to COMMENT on the Petition
within ten ( 1 0) days from notice; and
(b) ISSUE a TEMPORARY RESTRAINING ORDER
effective immediately to enjoin the implementation of the
Decision dated May 24, 2013 ofthe Court of Appeals inCA-
G.R. SP No. 126879 and to restrain the Regional Trial Court,
Branch 198, Las Pifias City, from rendering a summary
judgment in Civil Case No. LP-03-0220 so as not tb render
the instant Petition moot and academic.
SO ORDERED."
NQW THEREFORE, You, your agents, representatives and/or
any person or persons acting upon your orders or in your place or stead,
are hereby ENJOINED from implementing the Decision dated May 24,
2013 of the Court of Appeals in CA-G.R. SP No. 126879 and the
Regional Trial Court, Branch 198, Las Pifias City, is RESTRAINED
from rendering a summary judgment in Civil Case No. LP-03-0220 so as
not to render the instant Petition moot and academic, effective
immediately and continuing until further orders from the Court.
