Guide for Student Assessment Appeals

At La Lingua all reasonable steps are taken to ensure that you are given an equal opportunity to study. You will be treated equally regardless of your sex, race, religion, impairments (physical, mental or illness), political beliefs, age, marital status, pregnancy or sexual preference. La Lingua Language School will do its best to help you achieve good academic results. If you are at risk of not passing at least 50% of your course we will contact you at around the middle of your course. We will arrange a meeting with you to help you plan your study. We will monitor your progress and inform you if your progress continues to be unsatisfactory. If you do not make a reasonable effort to follow your study plan and your academic work does not improve the Director of Studies will send you a warning letter. In that letter the DoS will ask you to come to a meeting to talk about your study plan. If you do not attend this meeting the Director of Studies will send you a letter telling you that you have made unsatisfactory progress. If you hold a student visa the school must report you to DEEWR. This is the Notice of Intention to Report for Unsatisfactory Progress letter. If you disagree with La Lingua Language Schools assessment of your academic progress you may wish to lodge an Student Appeals form. This form is available at the school office and on the website. You must return the Student Appeal form within 20 days of the assessment decision to the Director of Studies. Appeals may be made for academic decisions including those relating to:
o o o Refusal of admission to a specific course Incorrect assessment calculation Notice of intention to report student to DEEWR: exemption due to compassionate or compelling circumstances

There is no fee for the appeals process. A copy of the submitted Student Appeals Form and all following documents including the Decision on Assessment Appeal Letter will be placed your file. If you choose to appeal against your assessment mark or grade you will be allowed to attend classes as usual during the appeal process. You will have to maintain your attendance above 80% also. If your appeal is successful La Lingua Language School will change your grade and advise you of the outcome within ten working days. If the appeal shows that there was an error in calculation, and you actually made satisfactory course progress (successfully completed more than 50% of the course requirements for that study period), La Lingua Language School will not report you for unsatisfactory progress. If the appeals process shows that you have not made satisfactory progress, but there are compassionate or compelling reasons such as serious illness or stressful circumstances, La Lingua will try to help you to complete your studies successfully. In this case La Lingua will not report you to DEEWR. If you choose not to Appeal within 20 days of the assessment decision, then La Lingua Language School will have no choice but to report you to DEEWR. If you Appeal but then withdraw from the process then the decision will be in favour of La Lingua Language School. La Lingua Language School will send you a letter with a full explanation of the Appeals decision. If a decision is made supporting La Lingua Language School, the Secretary of DEEWR will be notified via PRISMS as soon as practicable that you have not achieved satisfactory course progress. If you are still unhappy with this decision you may contact the Overseas Student Ombudsman. For contact details see the Grievance Procedure information.
