FORMER HPD ATTORNEY FINED $1,000 FOR REVOLVING DOOR VIOLATION


In a settlement with the New York City Conflicts of Interest Board, a former Agency Attorney for the New York City Department of Housing Preservation and Development (HPD) paid a $1,000 fine for representing a landlord in a matter in Housing Court in which HPD was the petitioner and was represented by an HPD attorney; the former Agency Attorney and the HPD attorney negotiated and signed a Consent Order and Judgment to resolve the matter. Because the matter had been pending at HPD while the Agency Attorney was still employed at HPD, his post-employment appearance violated the revolving door prohibition of the Citys conflicts of interest law. The Conflicts of Interest Board took the occasion of this settlement to remind City officials and employees that, for one year after leaving City service, they may not communicate with their former agency on behalf of a private employer. Prohibited communications can be at in-person meetings or by phone, fax, mail, or e-mail and can also include court proceedings if the matter in question was pending at the former public servants City agency while the public servant was still employed by the City. Carolyn Lisa Miller, Director of Enforcement, handled this case for the Board. The Conflicts of Interest Board is the Citys ethics board and is charged with interpreting and enforcing the Citys the conflicts of interest, annual disclosure, and lobbyist gift laws.
