1. (U) Timeliness: This motion is timely filed.
2. (U) Relief requested: The defense requests that the Commission order the prosecution
to produce unredacted records of all communications to and from United States personnel and
the filmmakers of the movie Zero Dark Thirty.
3. (U) Burden of Proof: The defense as moving party bears the burden of proof.
4. (U) Facts:
a. (U) On 1 May 2011, U.S. forces killed Osama bin Laden in Abbottabad, Pakistan.
b. (U) In early May 2011, filmmakers Kathryn Bigelow, Mark Boal, and their
associates contacted officials at the Central Intelligence Agency (CIA) and Department of
Defense (DOD) regarding their cooperation in a film about the killing of Osama bin Laden.l
c. (U) Mr. Boal, sometimes accompanied by Ms. Bigelow, met with officials at the
CIA and DOD on numerous occasions in May through July 2011.

d. (U) During the period 15 through 19 July 2011 in particular, Mr. Boal and Ms.
Bigelow met with several CIA officials with information relevant to the Zero Dark Thirty script}

These officials provided the filmmakers with their true first names.

Emails sent around the time
of the meetings provide additional information about the CIA officials who met with the
filmmakers, including full names and pseudonyms.5
e. (U) On 9 August 2011, non-governmental organization Judicial Watch sent
Freedom of Information Act (FOIA) requests to the CIA and DOD for information about
communications between those agencies and Hollywood filmmakers Kathryn Bigelow, Mark
Boal, and their associates.

f. (U) In five conference calls between 26 October and 5 December 2011, Mr. Boal
discussed the screenplay of the movie which became Zero Dark Thirty with the CIA. "From an
Agency perspective, the purpose for these discussions was for OP A officers to help promote an
appropriate portrayal of the agency and the Bin Laden operation.,,7 The CIA memorialized these
calls in a draft memorandum. &
g. (U) On 12 January 2012, Judicial Watch filed a FOIA lawsuit against DOD and
CIA for wrongfully withholding the records it sought.

h. (U) On 18 May 2012, CIA produced 67 documents and withheld 27 responsive
documents. 10
i. (U) On 24 August 2012, after discovering a stack of overlooked records, the CIA
produced 53 additional documents and withheld one document in full. 11

j. (U) On 14 September 2012, the CIA produced updated versions of four of these
documents, disclosing a limited amount of previously-withheld information.

k. (U) On 12 March 2013, in request DR-030-AAA, Mr. al Baluchi requested the
prosecution to produce unredacted records of all communications involving the government and
the filmmakers of the movie Zero Dark Thirty. 13
l. (U) On 22 April 2013, the CIA declassified a draft memorandum which revealed
that the detainee depicted in Zero Dark Thirty "is modeled after Ammar al-Baluchi.,,14
m. (U) On 23 April 2013, the prosecution denied Mr. al Baluchi's request on the
basis that the request was overbroad and not material to the preparation of the defense. IS
n. (U) On 14 June 2013, the prosecution stated that its "anticipated discovery is
nearly complete.,,16 The prosecution has not produced any discovery relating to the treatment of
Mr. al Baluchi prior to September 2006.
5. (U) Overview:
(U) The United States has provided more information to the filmmakers of Zero Dark
Thirty about Mr. al Baluchi's treatment in CIA custody than it has to his defense counsel. More
than four months after counsel for Mr. al Baluchi signed the MOU, the prosecution has provided
no information about Mr. al Baluchi's rendition, detention, and interrogation. Documents
released under FOIA, however, demonstrate that the United States provided substantial
information to filmmakers, including a meeting with and information about relevant CIA

officials. The military commission should compel the prosecution to produce the same
information to the defense, as well as information and documents withheld under FOIA.
6. (U) Argument:
(U) The military commISSIOn should compel the prosecution to produce
information about government cooperation with the filmmakers of Zero Dark
Thirty, which is likely to include information regarding treatment of Mr. al
Baluchi prior to September 2006.
(U) Although the United States has revealed no information about the treatment of
detainees prior to September 2006 to the defense, it has apparently revealed such information to
the filmmakers of Zero Dark Thirty. The military commission should compel the prosecution to
produce information relating to communications between the government and these filmmakers,
including the information it has withheld from the public under FOIA.
(U) As Time magazine describes it, Zero Dark Thirty portrays "a black site, where Maya
([Jessica] Chastain) observes her colleague Dan (Jason Clarke) as he tortures a detainee, Ammar
(Reda Kateb). The first 25 or so minutes of the film are largely taken up with torture: Ammar is
strung up, beaten, waterboarded and kept awake for 96 hours straight.,,17
(U) "Zero Dark Thirty credits its story to 'firsthand accounts of actual events,' drawing
on Boal's original reporting and meetings with CIA officials; its composite characters are based
on real people, living and dead.,,18 This claim is legitimate: The United States has released
documents under FOIA demonstrating that CIA provided the Zero Dark Thirty filmmakers
access to the CIA officials involved in the events portrayed in the film. After one meeting, Mr.

Boal described two of the CIA officials he met with as "a screenwriter's dream in terms of
compelling characters.,,19
(U) The detainee depicted in Zero Dark Thirty is clearly based in large part on Ammar al
Baluchi. "Dan" the interrogator and other characters repeatedly describe "Ammar" as Mr.
Mohammad's nephew.

"Dan" references details of the arrest of "Ammar.,,21 And "Dan"
describes the role of "Ammar" as a financial facilitator in the 9/11 attacks?2 These similarities
did not go unnoticed after the film's debut. In February 2013, former FBI Special Agent Ali
Soufan wrote in the New York Times that, "Ammar is a composite character who bears a strong
resemblance to a real-life terrorist, Ammar al-Baluchi.,,23
CU) One day before the government refused Mr. al Baluchi's discovery request as "not
material to the preparation of the defense,,,24 the CIA declassified a draft memorandum
describing conference calls between Mr. Boal and the CIA. 25 The memorandum describes

"several interrogation scenes the first of which is an interrogation of a character who is modeled
after Ammar al-Baluchi.,,26
(U) The requested discovery reveals information about at least four CIA officers who
met with the filmmakers?7 The CIA clearly revealed the names of these CIA officers to the
filmmakers, as it "advised Boal to be mindful of characters names that were very similar to the
names of real life officers.,,28 The interrogator character was originally named "Ted," but the
filmmakers changed it to "Dan.,,29 The CIA withheld the true names and pseudonyms of CIA
officers from the responsive documents as exempt from FOIA,30 a consideration not dispositive
here. There is reason to believe the CIA revealed other relevant information to the filmmakers as

information about his incarceration prior to September 2006.

Discovery regarding the
government's cooperation in the creation of Zero Dark Thirty is likely to provide such
information, and the military commission should compel the prosecution to produce it.
