understand that should I no longer wish to continue my Airborne Access subscriptions, I must inform Smart Customer Care through fax, email or hotline at least
fifteen (15) days prior to the end of the month’s billing cycle otherwise I will continue to be billed ninety-nine pesos (P99) VAT-in per month for the Airborne Access
service, which is subject to change in rate as may be mandated by SBI.

TERMS AND CONDITIONS for the SMART BRO with AIRBORNE ACCESS

The provision for Smart Bro with Airborne Access wherein Smart Broadband, Inc. (herein referred to as “SBI”), together with Airborne Access Corporation
(“Airborne Access”) will provide unlimited Airborne Access WiFi service in Airborne Access hotspots at the promo rate of P99/month (VAT-in) for a limited period
(herein referred to as “AA Bundle”), shall be governed by the following Terms and Conditions. The terms and conditions (including any amendment) governing the
AA Bundle will be available at the website www.smart.com.ph/smartbro.

1. Application for the AA Bundle period will run from May 26, 2008 to December 31, 2008 (the “Promo Period”). Applications received during this period, if
approved, will be provided an AA Bundle service offer at the promo rate of P99/month (VAT-in), from date of AA Bundle account approval until the
deactivation of the Subscriber’s Smart BRO Plan 999 subscription.
2. Only active Smart Bro Plan 999 subscribers can avail of the AA Bundle. Smart Bro subscribers under a lower plan will need to upgrade to Plan 999 to
avail of the AA Bundle.
3. No lock in period is available for this offer. Subscribers can enjoy the promo price of Ninety Nine Pesos (P99) VAT-in per month until he wishes
terminate the AA Bundle or his Smart BRO service. Termination should be made fifteen (15) days prior to the end of the month’s billing cycle, otherwise
the Subscriber will be charged the full amount of Ninety Nine Pesos (P99) which is equivalent to one month service.
4. If the application is approved, the P99/month (VAT-in) promo rate will be included beginning the subscriber’s next billing cycle, reflected in the bill
pertaining to said billing cycle and shall continue to be billed at P99 (VAT-in) within the Special Price Period.
5. SBI offers the AA Bundle to its subscribers through the Smart Communications, Inc. (“Smart”) Wireless Centers, or through the Smart Bro website:
www.smart.com.ph/smartbro
6. It is the sole responsibility of the subscriber to forward his accomplished application form to SBI either through the Smart Wireless Center or through
Smart Customer Care via email or fax.
7. SBI shall have the option to approve or disapprove AA Bundle applications based on the subscriber’s credit standing, among others.
8. Discontinuance of the subscriber’s Smart Bro subscription, either through request for disconnection, payment delinquency, or for any reason
whatsoever, will also result to the deactivation of the AA Bundle.
9. Any delinquency in the payment of the subscriber’s AA Bundle shall result to a disconnection of both his Smart Bro account and the AA Bundle.
10. In case of disconnection of the Smart Bro account as a result of payment delinquency, subscriber will have to pay all outstanding balances in his Smart
Bro account to have his Smart Bro account reactivated. Clearing only either his Smart Bro or AA Bundle outstanding balances will not activate either
his Smart Bro or his AA Bundle account.
11. Smart Bro subscribers can only have one (1) AA Bundle subscription, i.e. one (1) AA Bundle account per Smart Bro account only. To preserve the
security of the subscriber’s AA Bundle account, multiple log-ins are not allowed. Subscriber cannot share his username and password to others.
13. For questions regarding the Airborne Access service, subscribers shall contact Airborne Access After Sales through the following:

14. Use of the AA Bundle shall be governed by the Terms and Conditions of Airborne Access found in the following website:

15. This AA Bundle is subject to the agreement between SBI and Airborne Access. SBI reserves the right to end the AA Bundle and terminate the AA
Bundle service at any time even prior to the end of the Promo Period upon the termination of said agreement, for any reason whatsoever.
16. By applying for the AA Bundle, the subscriber agrees to these Terms and Conditions.
