Limited Indemnity Bond

This deed of Indemnity Bond executed on this the day of ___________ by ______________ Having his office/workshop at _______________ here in after called the Indemnifier which expression shall mean and include executors, administrators, heirs, successors an assign to and in favor of APCPDCL. A corporate constituted under the Electricity Supply Act, 1948 having its office at Vidyuth Soudha, Kairathabad. Hyderabad, (here in after called the APCPDCL which expression shall mean and include its successors in office and assigns. Whereas the consumer has taken to provide electricity of the _________ on Lease or is otherwise lawfully occupying the premises with out the lease or Door No.______________ situated in the F.F Owned by ________________Department for the purpose of House and has applied for a service connection in the above premises in his name for the purpose of domestic. Whereas the occupation being temporary ___________________the premises as mention above, he did not produce any document or situation evidence to show that he has the legal right to reside in the premises and there therefore the APCPDCL consider the occupation of the premises by the Executant as temporary in nature. And w hereas the Indemnifier has requested to APCPDCL a services connection in his name subject to the execution of an Indemnity Bond by the indemnifier the APCPDCL against any damage or loss to the APCPDCL in respect of his service connection in his name. And whereas in consideration of the acceptance of the above for a service connection to the house in his name, the Indemnifier hereby agrees to indemnify the APCPDCL against all proceedings, claims, demands costs, expenses which the APCPDCL may incur by reason of giving the electricity service to the said house of a fresh service connection to the indemnifier. The Indemnifier further undertakes to make any such that may be found to be and become payable to the APCPDCL with regard to all liabilities and claims personally as well as by both means of moveable or immovable properties. The Indemnifier agrees that the current consumption deposit paid by him shall be adjusted against the arrears of current consumption charges and also against any claims that may arise in the event of termination of the agreement prior to the expiry of the contract period. The indemnifier further undertakes that the APCPDCL shall be at liberty to disconnect the services connection given to him and also for leading the dues reminding unpaid by him to other services connection that may stand in his name. In view of the nature of occupation as mention in clause above the executant hereby agrees and indemnifies the APCPDCL that he shall never claim to possess legal right as owner of the premises on the ground that the APCPDCL supplied energy to the premises. Not withstanding any of the above written points such that if the indemnifier shall duly and faithfully observe and perform the above said conditions, then the above written bond shall be void, otherwise the same shall remain in full force.
