This has a reference to the instructions issued by the Department from time to time re- garding proper maintenance of Staff Quarters. 2. It has come to the notice of the Department that in some Circles, condition of the Staff quar- ters alloted to postal employees are iln dilapidated conditon and maintenance work of such quarters has not been carried out in regular intervals . Attention is also drawn to the Directorate O.M. no. 30-19/2012-D dated 09.05.2012 regarding implementation of redesigned network for Second Class Mail. 2. The manner of closing of bags between mail offices as prescribed under redesigned network for First and Second class mail was under review at this Directorate and it has now been decided that all L 1 and L 2 mail offices situated within a circle would be permitted to close bags for each other with respect of First Class (unregistered and registered) and Second Class mail in addition to the pattern of bag closing prescribed earlier. Thus, the revised arrangement, the pattern of bag clos- ing would be as under: (a) All L-1 mail offices will close direct bag for each other. All L-1 and L-2 mail offices situated within a circle will close direct bag for each other. An L-1 office will also close bags for all L-2 offices as well as delivery post offices mapped /attached to it. (b) All L-2 offices attached/mapped to an L-1 of- fice can close bags for that particular L-1 office. Now an L-2 mail office will also close direct bag for all other L-1 and L-2 mail offices of the same Circle as well. An L-2 office will also close bags for all delivery post offices mapped to it. (c) In case of inter-Circle mail, any demand for exceptions in terms of closing of bags between one mail office and another, which in not prescribed under the redesigned network, would continue to be approved by the Directorate. However, as an exception, all L-1 and L-2 mail offices geographi- cally falling under Assam and NE Circle may close bags for each other as communicated earlier in J uly 2012. 3. The First Class unregistered and Registered bags to be closed between L-1 offices, between all L 1 and L 2 offices situated within a circle, between L-1 office and L-2 offices mapped to it and vice versa, and between L-1/-2 offices and post offices mapped to them and vice versa will be traded as Due Bags. These would be no due bags in case of second class mail. 4. CEPT Mysore would make necessary changes in R-Net mapping release the revised script to all circles immediately 5. The existing instructions with respect to bag closing by Business Post Centres would continue. 6. Circles may issue revise the Due Mail and Sort- ing list at the mail offices concerned immediately. ********** GRANT OF TRANSPORT ALLOWANCE TO OR- THOPEDIC ALLY HANDICAPPED CENTRAL GOVERNMENT EMPLOYEES. No. 21-1/2011-E.II (B) dated 5th August, 2013 Ministry of Finance, Department of Expenditure The undersigned is directed to refer to this Ministrys Office Memorandum No. 19029/1/78- E.IV(B) dated 3rd December,1979, as amended from time to time and to say that the criteria for orthopedically handicapped employees to draw Transport Allowance at double the normal rates has been reviewed in consultation with the Minis- try of Health & Family Welfare . It has been de- cided that in partial modification of para 1 of Office Memorandum dated 3rd December, 1979 referred above, Double Transport Allowance shall be al- lowed to an orthopedically Handicapped Govern- ment employee if he or she has a minimum of 40% permanent partial disability of either one or both upper limbs or one or both lower limbs or 50% permanent partial disability of one or both upper limbs and one or both lower limbs combined. September-2013 No. 28-8/2011-D Dated: 13-8-2013 Revised Establishment Norms for operational Activities at Speed Post Sorting Hubs, Inta- Circle Hubs and computerised Registration Centres. Attention is invited to the Directorate OM of even no. dated 17-01-2013 vide which revised norms for operational activities at Speed Post Sorting Hubs, IC Hubs and CRCs were circulated. 2. Reference were received as to whether the re- vised norms for sorting circulated vide O.M. re- ferred to above were to be considered as produc- tivity norms or establishment norms. It is clarified that the establishment norms for operational ac- tivities other than that for " Sorting of Articles" would be the same as circulated vide Directorate OM of even no. dated 17-1-2013 . Establishment norm for " Sorting of Articles' has been fixed as 0.079 minute per article ( i.e. 760 articles per hour) . However , time factor for productivity pertaining to sorting of articles would continue to be 0.063 per article (i.e. 950 articles per hour). 3. Post Offices for Women The objective for opening of all women post of- fices in the country is to lay focus on womens empowerment and to achieve Departments ob- jectives and mission to sustain its position as the largest postal network in the world. It is an effort to integrate gender equality and womens empow- erment for good governance by ensuring that women employees working at various levels in the Department have a real voice in the decision mak- ing of the Department as well as have a role in the management of post offices in the country. The all women post offices are the post office where all employees are women and they have been given the responsibility of managing the events of the post offices. This is done with a view to pro- mote leadership and managerial qualities in women employees of the Department. These post offices are opened in major cities and at present 34 all women post offices are functioning in the country.These post offices are functioning within the postal network of the Department in the coun- try and not a separate set up of post offices. Besides this, from customers perspec- tive, Post Offices offer products and services like small savings, postal life insurance and other mail related products which are used by the common man. All Women Post Office offers a secured en- vironment to our woman customers from all strata of society to transact postal business with a level of comfort and familiarity with women employees of the Department.This information was given by Dr. Smt. In the reporting session every General secretaries have reported about the membership drive, elec- tion programme of Circles and schedules of their due All India Conference. In the Circles like Punjab , U.P. Karnataka, Kerala , Rajasthan and J harkhand, the Circle conferences of BP-III, BP- IV and GDS were convened successfully. The M.P. & Orissa Circle has convened R-III and R-IV Circle conferences . The Haryana & Bihar Circle have convened BPAOEA Circle Conference. The All In- dia Conference of Administrative union and GDS Union was convened successfully. It can be con- cluded that almost all circles have updated their conferences and now it is the turn of Circles to convene their Divisional Conference in time. Regarding opening of New Divisions, it has been informed that two options are available. First one is to make authorized office bearer in that Division to submit the forms in the month of April or during re-verification process. The 2nd one is to form adhoc body and then convene regular election within three month of time. As regard to Divisions in which we could not form a Divisional Secretary or authorized office bearer, the General Secre- tary or Circle Secretary can submit the attested membership forms to the Divisional heads/ Re- gional Heads/ Circle Heads. It has also been reported that the All In- dia Conference of BP-III, BR-III & BR-IV will be completed upto December, 2013. Positively. The Secretary General has reported all the events, the PRAVASH and the conferences attended by him during the period October 2012 to J une, 2013. A Strike notice was also served on 29-01-2013. The department has issued advisory to postpone the programme and informed that in- formal meeting will be arranged in March, 2013. The Strike was postpone on this communication. In the meeting it has been decided to choose ap- propriate time to give the notice for Dharna do not Pradarshan or Strike in the event of Department not giving any informal meeting or look over the issues urgently. The DDG (Estt.) has informed that the meeting will be arranged shortly in the last week of the J uly. I am sorry to disclose that General Sec- retaries have reported about membership drive in vague manner without any proof of it. This tradi- tion has become a custom of BPEF affiliated unions to act casually over the important and stra- tegic issues. For these reasons they took no cog- nizance of the decisions taken in such type high level meetings. The decisions taken at Hyderabad meeting, New Delhi Meetings have not been con- veyed to lower office bearers even through circulars. For these reasons the pity financial and Organisational situation of BPEF arises. Report- ing without any proof and without any real action is deplorable on the ground that lot of expenditure RMS BHARATI

September-2013 becomes waisted. The Bharatiya unions become element of mockery at the eyes of others who read these circulars. The Treasurer report placed in the meet- ing very well depicts the story of reluctance and irresponsibility from the part of unions as they are getting membership subscription by way of sal- ary deduction . It is sorry to state that we are not able to pay even petty Honoruium and licnece fee of about two thousand per month. Water & Elect bill of Rs. 3500/- per month and News paper tele- phone bill of about two thousand per month . Hav- ing no option left to the Federation it has decided to impose levy over the unions as below so that expenditure to be incurred up to October, 2013 may be met. GDS Union 20000/-, BP-III, 20000/ - , BP-IV, 8000/-, BR-III, 4000/- BR-IV, 3000/- BPAOEA Rs. 4000/- BP Civil Wing Rs. 1000/- Administrative Union 1000/- of Rs. 60000/-This levy must be paid before Federal Council so that the Federation could not feel pity in meeting out ex- penses. Matter of Election dispute in Kerala Circle BP-IV union has been reported by convenor Kerala circle Shri C.M. Pillai the same has been handed over to General Secretary, BP-IV for resolving the issue amicably. It has been advised that in all matters of election dispute, the decision of BPEF will be final. In the last Shri B.K. Rai, Vice present Central BMS and Prabhari Industrial units have taken note of all the discussions and told that the unions are not hospitals were every ill comes and later on goes away when treatment is over. It is a family and a developed system having well de- fined constitution and ethics to follow exists. He advised that as per the BMS directions , The Fed- eration , the All India Union and the Circle unions must have core group to decide the issues . For the All India Unions President , Secretary, Org. Secretary , Secretary General & Treasurer will form the core group. Similarly for Circle unions Presi- dent , Secretary, Treasurer, AGS of All India Union and convener of BPEF will form the core group. At the Federation level President/ Working Presi- dent, Secretary General, Treasurer, Org. Secre- tary, and Prabhari industrial unit of BMS will form the Core group. This core group must report to the Higher level for the activities about the Organiza- tional and Agitational programmes. In the case of laxity from the part of All India Unions, Circle Unions are Divisional Unions the action will be taken by the core groups accordingly. It is to be taken in mind that as per the constitution of unions the General Secretary of the unions is the Adminis- trative Head of that union. Similarly Secretary General is the administrative Head for all the mat- ter of affiliated unions. Similarly every unions are advised to give full charge to the AGS of the union of the adjoining Circles to Circle in which he re- sides, in All India conference itself for the pur- pose of easily administering the membership / union activities and election process. Since the Govt. is deducting the union subscription and remitting it to office bearers, therefore, the financial irregularity is not simple one but it is a financial fraud towards organisaiton which attrach disciplinary action against the faulty office bearers. If the core group of All India unions and its CWC find it fit to amend its constitution so that the union subscription deducted at Division/ Branches may be remitted to the CHQ directly by the Administration then they are free to make such amendment in constitution. The General Secre- tary, BP Civil Wing Shri Balram Pandey has given has consent to do so in his constitution. As regarding Special Donation by unions / Federation, Receipt Book must contain three least. One should be handed over to the donor. Second one should be retained by the collector and third one should be retained by the BPEF or All India Union as the case may be. He strongly supported that if the BPEF is short of fund for carrying out its daily union activ- ity then it must raise the Special Fund with the help of Federation office bearers / CHQ office Bear- ers of the union. This issue was supported by Shri R.N. Navghar and others and has advised that Receipt book of Rs. 1100/- per Head may be printed for collecting Donation to BPEF and be distributed to all active office bearers. Similarly during All India Conference of unions Rs. 1100/- per office bearers may be collected at the confer- ence place itself. It is necessary for All Delegates to attend all five sessions of Federal council. Three session will be held on First day and two on second day. 5.The Federal council will end before 5-00 P.M of 2nd October positively,. 6. If anyone wants to adopt Resolution at Federal Council he must send a copy of that to Federation 15 days before so that it can be included. Every Resolution must be sent after having working committee meeting. The Federation will load its Resolution in the Website: www.bpefsg.blogspot.in one month before the Federal Council for your comments. 7. The Maharashtra is going to publish a Souvenir on the occasion you can give advertisement/ Article for that. 8. The Federation will publish August issue of Postal Mahasangh in August and will also publish Special issue in October, 2013. You may give valuable Articles for publication well n time. Kindly follow the discipline and ethics of the organization and take oath in the Federal Council to correct the actions of union so that full support to Mission 2015 with regards recognition during re-verification process can be made. In future General Secretary must bring the list of membership subscription deducted in the Divisions in meetings. For the purpose, the General Secretary should necessarily ask his Circle Secretaries to provide this information with paper support. September-2013 Probation period of PA/SA Directorate vide memo No. 60-3/2013-SPB-I dated 8/7/2013 has clarified that s per revised Recruit- ment Rules for the post of Postal Assistant / Sort- ing Assitant notified on 3rd November 2011, the period of probation is the same i.e. two years but the provision of Examination for confirmation has been discontinued and clearance of probation pe- riod is to be decided by the Departmental Promo- tion Committee (DPC). It is also clarified that who have not yet cleared the confirmation test may not be subjected to confirmation examination but may be assessed for clearing their probation after taking into consideration their performance during the induction training, the special report /ACRs and any other relevant input. If they are not found up to the mark, their probation period may be ex- tended as per the Government's instructions. In such cases, PAs/SAs shall be considered for clear- ance of probation period from a prospective date and not with retrospective effect. September-2013 ernment employee covered under CS(MA) Rules, 1944 on availing medical treatment for himself and his dependent family members in emergency con- ditions, would be allowed as per the prevailing non NABH CGHS rates as applicable to a CGHS covered city and non-NABH rates applicable to the nearest CGHS covered city in case of non- CGHS city, as the case may be, or the actuals, whichever is less. 3. For the medical treatment in such cases where package rates are prescribed under CGHS, the non-NABH rates of the CGHS covered city and non-NABH rates of the nearest CGHS city (in case of non-CGHS covered city) or the actuals, which- ever is less, will be applicable. 4. This OM supersedes all earlier orders issued from time to time under CS (MA) Rules, 1944 on this subject for allowing reimbursement of medi- cal expenses in emergency conditions when treat- ment is taken in a non-empanelled private hospi- tal. 5. This OM will come into effect from the date of issue. 6. This issue with the concurrence of the Integrated Finance Division vide their Dy. No. C-282, dated 22.05.2013. GOVERNMENT ALLOTS RS 1,300 CR TO POST BANK NEW DELHI: The expenditure department has de- cided to sanction Rs 1,300 crore to the proposed Post Bank of India to meet its capital requirements even as the department of financial services (DFS) - the wing in the finance ministry that deals with state- run banks and their poliiies - chose to stay away from the issue. The proposal's backing by the expenditure fi- nance commission and its subsequent green light by finance minister P Chidambaram is seen as the official go-ahead by the finance ministry, ignoring the DFS's stance. The DFS position is seen as the first instance of the agency not backing the Post Bank's plan, which officers in the department have privately mocked at "They think they can use the postal deposit model for their banking foray. Nothing in their plan seems to be clear. Banking isn't easy," said an officer, who did not wish to be identified. In fact, a strong Post Bank is seen to be the biggest challenge to existing public sector banks, including State Bank of India, which controls 70% of the banking business in the country. SBI, the largest lender, has a little less than 15,000 branches, while there are over 1.5 lakh post offices across the country. Although Post Bank does not intend to open a bank branch in each post office, the plan is to use postmen to meet the financial inclusion goal. Secre- tary (posts) P Gopinath refused to speak to TOI de- spite several attempts. According to the plan, Post Bank will have 50 branches in the first year, which will be increased to 150 by the fifth year. The branches will be located in select Head Post Offices in Tier-1-4 centres and select Sub-Post Offices in Tier-5-6 centres. To meet RBI norms, the postal department pro- poses to set up a new entity - Post Bank of India - that will have an independent board and separate opera- tions. Apart from independent directors, the board will have representatives from the finance ministry and the postal department. Separate recruitment has been planned to have specialist bankers. While converting the entire postal network would have meant a capital requirement of over Rs 60,000 crore, by setting up a special entity, the fund require- ment has been reduced. This, officers said, will also help create a more focused strategy. But the Post- master Grade II officials with minimum five years service are only considered for PM Grade-III pro- motion as per the Postmaster Grade Recruitment Rules approved by DOP&T. This DISCRIMINATION was brought to the notice of the Directorate by BPEF earlier. It is informed that Directorate has already called for the detailed particulars, from Circles. On receipt of information the case will be submitted to DOP&T for RELAXATION of five years to three year at par with HSG II officials. UOI SLP against Pre-2006 Pension- ers dismissed by Supreme Court. The Supreme Court has dismissed the SLP (Civil) 23055/2013 filed by Union of India against Delhi High Court judgement in pre-2006 pensioners casein WP 1535/2012 upholding the CAT PB judgement and Delhi High Court judge- ment. The above SLP came up for hearing on 29/ 7/2013 and the apex court dismissed the SLP on the same day. Pensioners will now get arrears w.e.f. 1/ RMS BHARATI

JUDGEMENT : UPON hearing counsel the Court made the follow- ing order : We are not inclined to interfere with the order passed by the High Court. Consequently, the spe- cial leave petitions are dismissed. However, the petitioners are at liberty to raise all points before the Tribunal as and when the appeal. Revision of OTA Rate case filled at CAT Madras Bench dismissed One of the service Association has filled CAT case in Madras Bench in connection with the revi- sion of Overtime Allowance . Hon'ble CAT Madras Bench in their judgement dated 9th April, 2013 stated that "prior to 5th CPC all Non Gazetted employees in receipt of monthly Basic pay of upto Rs. 2200/- were entitled to OTA for performing duties beyond the des- ignated working hours. The 5th CPC had recom- mended abolition of OTA for all categories except the Staff Car Driver , Operational Staff and Insustrial em- ployees . But, it recommended that the staff deployed on weekly off days should be given a compensatory leave rather than any cash compensation in the form of OTA or otherwise . However, the said recommen- dations were not accepted and status-quo was main- tained as per the recommendations of the 4th CPC. It is also seen that the rate of OTA fixed and the ceiling by the Nodal Ministry viz. Department of Personnel and Training, consequent on the recommendation of 4th CPC have not been revised by the said Ministry . As rightly contended by the respondents, unless the said Nodal Ministry approves the proposal sent by the Department of Posts for revision of OTA rate, they are not in position to revise the OTA rates on its own and it is a policy decision of the Government. In other words, the Department posts cannot take an inde- pendent decision on the issue raised by the respon- dents". CENTRAL TRADE UNIONS HELD NA- TIONAL WORKERS CONVENTION AT NEW DELHI ON 06TH AUGUST 2013 A massive National convention of all Central Trade Unions, Central and State Government Employ- ees and ; Teachers Federations and Public Sec- tor employees Unions etc was held at Mavlankar Hall New Delhi on 6th August 2013. The conven tion was addressed by the leaders of BMS, INTUC, AITUC, CITU, HMS, AIUTUC, TUCC, SEWA, AICCTU, UTUC, LPF. Presidium consisted of the leaders of all the above Central Trade Unions. The resolution adopted by the National convention called upon the workers to organize following. 1. Demonstration/Rallies/Satyagraha at all state capitals with respective statewide mobilization on 25th September 2013 2. Massive Demonstration before Parliament with main mobilization from neighbouring states on 12th December, 2013 3. On the same day of Demonstration before Par- liament (12th December 2013), District-level Dem- onstrations at all District Headquarters all over the country. 4. Sectoral programme of joint actions for effec- tively opposing Restructuring, Outsourcing etc. and on sector-specific issues/demands and against Divestment of shares in Pubic Sector En- terprises. 5. Exclusive J oint Action Programmes on the demand of Minimum Wage and Contract Workers related other demands. GoM on Workers' Demands Government has set up a Group of four Ministers led by Shri A.K. Antony to discuss the workers' demands with the United front of trade unions. Two meetings of the Group of Ministers (GoM) were held on 18.02.2013 and 22.05.2013 in which the ten point Charter of Demand of the trade unions were discussed. The discussions remained incon- clusive and it was decided that the issues/de- mands will be considered by the Group of Minis- ters themselves before further discussions with the Central Trade Unions representatives. As such, no final recommendation has been given by the GoM. This information was given by Minister of State for Labour & Employment Shri Kodikunnil Suresh in the Lok Sabha today in reply to a written ques- tion. DA formula may going to be changed New series of Consumer Price Index (Base for calculation of D.A) under preparation : Ministry of Labour and Employment, Govern- ment of India has decided to prepare a new series of Consumer Price Index for Industrial Workers. For this purpose, Government has set up a RMS BHARATI

September-2013 Standing Tripartite Committee (STC) to advise the Government on issues pertaining to the Consumer Price Index for Industrial Workers (New Series). The STC will go into details of various parameters that are taken into consideration for updation of the base year such as the weighting diagram, consumption basket, selection of centres, sample size of establishments for price collection etc. Government has no specific information about the skilled/semi-skilled worker outsourced by the Central Government /State Governments through contractors not being paid as per the CPI. However, the Contract Labour Act, 1970 inter-alia, contains provisions for payment of wages to these category of workers. The contract workers are also entitled to receive minimum wages as notified by the appropriate Governments from time to time. This information was given by Minister of State for Labour & Employment Shri Kodikunnil Suresh in the Lok Sabha today in reply to a written ques- tion. 'The 6th Central Pay Commission had recommended not to merge Dearness Allowance with basic pay at any stage,' Minister of State Finance Minister Namo Narain Meena said in a written reply to the Lok Sabha. Government accepted this recommendation, he said, adding that the recommendations of the 6th Pay Commission were given effect from J anuary 1, 2006. Some Central Government Employees As- sociations have been demanding for the merger of 50% DA with Basic Pay and the constitution of 7th Pay Commission. Meena said the setting up of the next Pay Commission is considered normally after a gap of 10 years between two successive Pay Commission. DA to central government employees is revised twice a year, with effect from J anuary 1 and J uly 1, calcu- lated on the basis of percentage increase in all India Consumer Price Index for Industrial Workers. GDS BONUS ISSUE - INFORMATION Cabinet is likely to approve GDS bonus ceil- ing for Rs.3500- in the ensuing meeting: After clearance of the Departments pro- posal of Rs.3500- bonus ceiling to GDS by the Min- istry of Finance during 3rd week of August, the pro- cess for cabinet approval has started and a note has been submitted by the Department to the Min. of Fi- nance to submit for further approval in the Cabinet meeting. It may be expected in the ensuing meeting of the Cabinet. DA WILL CROSS 100% IN JAN 2014 EVEN IF NO RAISE IN RATES According to a press release issued today by the Labour Bureau, Ministry of Labour & Employment the All-India CPI-IW for J uly, 2013 rose by 4 points and stands at 235. The largest upward pressure to the change in current index came from Food group con- tributing 1.99 percentage points to the total change. At item level, Rice, Fish Fresh, Goat Meat, Milk, On- ions, Chillies Green, Potato, Tomato & other Veg- etables. Electricity Charges, Firewood, Bus Fare, Petrol, etc. are responsible for the rise in index. How- ever, this was compensated to some extent by Groundnut Oil, Primary and secondary School Fees putting downward pressure on the index. 100% DA hike Even if no increase for the next 5 months, the calcu- lated Dearness Allowance for Central Government Employees and Dearness Relief for CG Pensioner confirmed to be 98% from J anuary, 2014. Under nor- mal index changes, DA/DR from J an 2014 may touch or cross 100%. Considering the current inflation,, economic scenario and the reluctance of the govern- ment for tight measures as the elections are close, the DA rates will be higher. As per the sixth pay commission recommended that Whenever the DA reaches 50% level , Some allow- ances have to be increased by 25 %.
