RESOLUT ION
Filed for conduct of regular preliminary investigation is the instant case which was allegedly commited on June 03, 2009 at Sisim, Peablanca, Cagayan. It was lodged through the behest of respondent Jerry Enrique's wife Janeth who claimed to have caught her husband in flagranti delicto of cohabiting with the other respondent Melody Guitu. Prior to the incident under consideration hereon the respondents had been rumored to be lovers which has reached private complainant Janeth Enrique. However, upon careful and thorough evaluation of the evidence on record, undersigned finds no cogent reason to continue with the investigation of this case. The disquisition rendered by the undersigned in its Order of June 03, 2009 is hereby adopted. Verily, there is no probable cause to indict the respondents for the crime charged, the circumstances thereof being not within the ambit of that provided by law. X-----------------X ORDER Submitted for consideration is an Affidavit of Undertaking executed by EDWARD AQUINO terminal dispatcher of GMW Tuguegarao Station, Tuguegarao City the vehicle involved in the vehicular accident that transpired on the evening of January 3, 2010 along the National Highway at Centro Norte, Alcala, Cagayan, praying that GMW Florida passenger bus bearing Plate No. BVA 417 and body No. 2267 now under custodia legis be released to the custody of the owner, Wilson U. Florida. Finding the reason set forth in the aforesaid Affidavit of Undertaking to be in order, the same is hereby granted. WHEREFORE, the Chief of Police of Alcala, Cagayan in whose custody the vehicle is being kept and impounded or any of his authorized representative is hereby diorected to release the aforesaid vehicle to the terminal dispatcher, EDWARD AQUINO, subject to the condition that said vehicle be presented in this office for evidentiary purposes when needed.
