Has the BU appointed a site representative responsible for managing each contractor or contract? Has the BU representative defined the scope of works and performance criteria before commencing discussions with any potential contractors? Has the BU undertaken a risk assessment covering the identification of hazards, assessment of risks and the accepted risk control measures relevant to the proposed works? Is the selection and management of contractors based on the potential risks from their work, the risks they may pose to the environment and the risks arising from their interaction with site operations? Has the site developed formal selection and evaluation procedures to assess the capacity of potential contractors to meet DP World Constanta standards and local regulatory requirements? Do these procedures include: Providing the potential contractor with information on the hazards and accepted risk control measures relevant to the work to be carried out. Reviewing contractor capabilities to manage risks in accordance with DP World standards. This should include reviewing information on previous performance such as fatality rates, lost time incident frequency rates, safety or environmental prosecutions and results from reference checks. Has the BU developed a contractor management systems to ensure? The contractor is provided with an opportunity to identify hazards associated with the proposed works, and to review relevant safety and environmental risk management material (such as risk assessments and site procedures). The contractors risk management processes are integrated with site processes.

The contractor has obtained permits and/or licenses necessary for the work. The equipment used by contractors is in safe working condition (whether provided by the contractor or DP World), and the personnel are competent in its use. All contractor personnel receive site induction/orientation training, or in instances where an induction is not practicable, they are accompanied by a competent DP World employee at all times. Formal and regular communication mechanisms with the contractor are defined, in particular, when there is a potential interaction between site operations and contractor activities. Contractor performance is monitored to ensure that all safety and environmental requirements are met. Monitoring should include regular inspections, observations and audits of the work. Formal, defined actions are taken where there are failures in contractor performance, including any failure to comply with site requirements. Contracts should provide for commercial consequences such as penalties, bonuses or contract termination based on safety and environmental performance criteria. Each site shall develop a contractor site induction/orientation program and the content shall be drawn from the following: The working environment and risks particular to site operations, including the fatality potential risk factors (Fatal Risk Standards), safety rules and procedures. Traffic management protocols. Requirements for the use of personal protective equipment. Management of hazardous substances, prevention of potential soil contamination and spill response. Waste disposal. Protection of waterways and other applicable environmental conditions. Access requirements including security controls, restricted access areas and site requirements for physically identifying or isolating contractor work areas. Communication mechanisms. Reporting lines. Emergency response procedures. Procedures for reporting hazards and incidents.

Works permit procedures. Fitness for work program requirements, including requirements for minimising impacts from fasting, fatigue, medication and other medical conditions such as colour blindness and epilepsy; and the action taken if under the influence of drugs or alcohol. Does the BU maintains a list of approved contractors who have demonstrated an ability to conduct their activities in accordance with DP World Constanta standards? Is the performance of contractors on this list reviewed at least annually?

Are the plant and equipment used by contractors maintained in safe working order and under a regular maintenance schedule (whether provided by the contractor or DP World Constanta)? The plant and equipment used by contractors shall be fit for purpose and comply with the relevant requirements of the DP World Fatal Risk Standards.

Do the DP World Constanta employees with responsibilities under the Contractor Management Plan receive training and are deemed competent in this areas? Are the contractors trained and hold the appropriate licenses/certificates for all plant and equipment they operate?
