Plaintiff, Nathan Gibson, is an individual having an address of 42051 Bay Ct, Sterling Heights, MI 48313. 2. Plaintiff, Raymond Siegmann, is an individual having a business address of 4897 West Waters Avenue, Suite C, Tampa, FL 33634. 3. On information and belief ShakeN' Share, LLC is a business having a place of business at 1521 Eastpointe Drive, Mount Pleasant, MI 48858. This is a civil action for patent infringement arising under the patent laws of the United States of America, 35 U.S.C. 1, et seq. 5. This Court has original jurisdiction over the subject matter by virtue of 28 U.S.C. 1331 and 1338(a). 6. This Court has personal jurisdiction over Shake N' Share, LLC and venue is proper in this judicial district pursuar1t to 28 U.S.C. 1391(b), (c) and 28 U.S.C. 1400(b). Shake N' Share, LLC is actively doing business in this judicial district, and has committed certain acts of patent infringement in this judicial district. COUNTl INFRINGEMENT OF U.S. PATENT NO. D626,790 S 7. Plaintiffs restate and incorporate by reference paragraphs 1 through 6. 8. On November 9, 2010, the United States Patent and Trademark Office duly issued U.S. Design Patent No. 626,790 S (the '790 patent) entitled "Popcorn Bucket Lid" to Plaintiffs. A true and accurate copy is attached as Exhibit A. 9. The '790 patent has been in force and effect since its issuance. Plaintiffs have been at all times, and still are, the owners of the all right, title and interest into the'790 patent. 10. ShakeN' Share, LLC makes or has made, uses, offers to sell and/or sells popcorn bucket lids which infringe one or more claims of the '790 patent, in at least this judicial district in violation of35 U.S.C. 271. 11. Shake N' Share, LLC's infringement of the '790 patient has caused and will continue to cause Plaintiffs to suffer damages, including, but not limited to, lost sales, lost profits, lost royalties and price erosion in an amount to be determined by the trier of fact. 2 Case 1:13-cv-01020 Doc #1 Filed 09/18/13 Page 3 of 4 Page ID#3 12. Unless restrained and enjoined by this Court, ShakeN' Share, LLC will continue to infringe the '790 patent, resulting in substantial, continuing and irreparable damages to Plaintiffs. 13. ShakeN' Share, LLC has willfully and deliberately infringed the '790 patent in disregard of Plaintiffs' rights. 14. The actions Shake N' Share, LLC are "exceptional" within the meaning of 35 u.s.c. 285. PRAYER FOR RELIEF WHEREFORE, Plaintiffs respectfully demand judgment against Shake N' Share, LLC as follows: A. Declaring that ShakeN' Share, LLC has infringed the '790 patent. B. Pursuant to 35 U.S.C. 283, permanently enjoining and restraining Shake N' Share, LLC and its officers, agents, servants, employees, and those persons in active concert or participation with them, from further acts of infringement of the '790 patent. C. Pursuant to 35 U.S.C. 284, awarding to Plaintiffs damages, including lost profits, together with prejudgment interest, post judgment interest, and costs, adequate to compensate Plaintiffs for ShakeN' Share, LLC's acts of infringement ofthe '790 patent. D. Declaring that ShakeN' Share, LLC's infringement has been willful and that this is an exceptional case pursuant to 35 U.S.C. 285 and awarding Plaintiffs treble damages and reasonable attorney fees against ShakeN' Share, LLC for its infringement of the '790 patent; and E.
