DEED OF ABSOLUTE SALE OF REAL PROPERTY WITH ASSUMPTION OF MORTGAGE BY BUYER

KNOW ALL MEN BY THESE PRESENTS: That this deed is made and entered this __________________ 2012 by and between LAGUNDAFLOR B. BARRAQUIO (widow), CENEM B. BATALLONES, ADOLFO B. BARRAQUIO (widower), FLORIEDA B. HEMEDES, and CRISANTA B. SANCHEZ, siblings, all of legal ages, Filipino citizens, and residents of 266 Rosario Village, Brgy. Sala, Cabuyao, Laguna; 109 San Juanico St., Ayala Alabang Village, Muntinlupa City; 1226 Brgy. Pooc, Santa Rosa City; and Limcaoco Subd., Poblacion, Cabuyao, Laguna; and hereinafter referred to as the SELLERS; and _____________________________________________________________________, likewise of legal age, Filipino and resident of _______________________________________________________________ and hereinafter referred to as the BUYER; Witnesseth, that WHEREAS, the SELLERS are exclusive owners of Lot No. A-8-A of the subd. Plan Psd-04014946 being a portion of Lot A-8 (LRC) Psd-300985, Rec. No. 8418 situated in the Brgy. of Canlubang, Sirang Lupa and Latian Calamian, Calamba City, Laguna and covered by Transfer Certificate of Title No. T-739429 of the Registry of Deeds of Calamba City; WHEREAS, the SELLERS are disposing of the said property by sale. And the BUYER is acquiring the same by absolute purchase with assumption of existing and annotated mortgage on the title of the property at the time of execution of this deed. WHEREFORE, the parties freely agree as follows: 1. Plan Psd-04-014946 being a portion of Lot A-8 (LRC) Psd-300985, Rec. No. 8418), situated in the Brgy. of Canlubang, Sirang Lupa and Latian Calamian, Calamba City, Laguna. Bounded on the SW., & NW., along line 1-2-3-4-5-6 by Lot A-9 (LRC) Psd200985 (Road 7.00 m. wide) & on the NE., along line 6-7 by Lot A-7 (LRC) Psd-300985, & on the SE., along line 7-1 by Lot A-8-B of the subd. plan. Beginning at a point marked 1 on plan being S. 66 deg. 47W., 637.27 m. from BBM 36 Cad-154, Calamba Cadastre. Thence N. 15 deg. 10W., 13.50 m. to pt. 2; N. 5 deg. 08E., 4.80 m. to pt. 3; N. 31 deg. 11E., 4.76 m. to pt. 4; N. 57 deg. 24E., 4.76 m. to pt. 5; N. 70 deg. 30E., 12.46 m. to pt.

6; Thence S. 14 deg. 18E., 23.94 m. to pt. 7; S. 75 deg. 35W., 21.71 m. to point of beginning, containing an area of 481 SQUARE METERS xxxx registered in the names of LAGUNDAFLOR B. BARRAQUIO (widow), CENEM B. BATALLONES married to ONOFRE O. BATALLONES JR., ADOLFO B. BARRAQUIO (widower), FLORIEDA B. HEMEDES married to FERDINAND A. HEMEDEZ, and CRISANTA B. SANCHEZ married to JOSUE H. SANCHEZ, xxxx xxxx 2. The SELLERS warrant that they are the owners of the above-described with only the mortgage annotated on the title serving as encumbrance thereto at the time of this sale. The SELLERS further undertake to defend the ownership hereto sold, transferred and conveyed in favor of the BUYER against third parties whomsoever. 3. The BUYER hereto accepts the above-described property from the SELLERS.
