called the meeting to order at approximately 8:15 a.m. in the Association Office. Alicen Dupont was excused. All other officers and directors were present. Pledge of Allegiance: The Pledge of Allegiance was said. REALTOR Pledge The REALTOR pledge was said. Agenda: Stuart Martin made a motion to approve the agenda as amended. Lisa Mueller-Cox seconded the motion, which passed unanimously. Minutes: It was noted the August 9, 2013 minutes were approved by email vote and have been distributed. Stuart Martin moved to approve the applications pending completion of all membership requirements. Bart Miller seconded the motion, which passed unanimously. Financial Report: Stuart Martin presented financial statements for August and moved to receive financials as presented. Bart Miller moved to receive financials as presented. Kris Brice seconded the motion, which passed unanimously. Unfinished Business: Affiliate Sponsorship Update: For 2014, Installation, Kids Event, RPAC, ROTY, March and September breakfast events have been confirmed. Directors were assigned Affiliate to contact for remaining sponsorship options. New Business Action of the Board of Directors MLS Hearing: A Professional Standards Hearing Panel met in August on a MLS matter. Stuart Martin moved to adopt the decision of the Hearing Panel and its recommendation. Kris Brice seconded the motion which passed unanimously Proposed Name Change for Northern/Southern Black Hills: Directors were asked to vote on whether or not BHAR would wish to object to the proposed name of Mount Rushmore Area Association of REALTORS in regard to the pending merger of the Northern Black Hills Association of REALTORS and the Southern Black Hills Association of REALTORS. Lisa Mueller-Cox moved not to object to the proposed name of Mount Rushmore Area Association of REALTORS. Shawn Wood seconded the motion which passed unanimously. Committee Reports: NAR Summit: Bart Miller and Amy Bochman reported on the NAR Leadership Summit held in Chicago the end of August. BHAR Outreach: Ed Dreyer reported the $3000.00 goal was met, noting tonight is the Run/Walk with Black Hills Works inviting everyone to participate. Executive Committee: Kelly Howie reported on the SentriLock reciprocity agreement signed between BHAR and the Northern and Southern Black Hills.

Kelly Howie reported on the Form Simplicity and copyright questions which were tabled last month. Per the motion made by the BOD on July 12, 2013, the Executive Committee has worked to clarify the use of electronic signatures. It is the opinion of the Executive Committee that a program which utilizes signature fields by overlaying those signature fields on a BHAR form is acceptable. However, it may be a violation of the Form Simplicity End User License Agreement for a member to provide forms to another service and/or to code or program forms in any way other than as provided by Form Simplicity. BHAR is not contractually required to interpret or enforce the Form Simplicity EULA. However, BHARs contract with Form Simplicity does require BHAR to notify Form Simplicity of any potential violation brought to its attention. Regarding Copyright: BHAR forms are provided for member use only and must contain the appropriate BHAR and Form Simplicity marks. Any use of the forms without these marks will be cause for BHAR to request a legal opinion from the association attorney regarding potential copyright violation.

Bart Miller moved to go in to Executive Session; Lisa Mueller-Cox seconded the motion which passed unanimously. Executive Session Lisa Mueller-Cox moved to come out of Executive Session; Lisa Dorsey seconded the motion which passed unanimously. Other: Mediation/ethics, membership numbers and meeting attendance, and under contract information were provided to the group. Lisa Mueller-Cox moved to adjourn; Ron Balster seconded the motion which passed unanimously.
