DEDUCTIVE REASONING: TECSON VS COMELEC ACTUAL CASE: 1.

Persons benefited from the en masse Filipinization , which effected in 1902 are deemed natural born Filipino citizen. Lorenzou poe, was born sometime in 1870 and is presumed to be benefited from the en masse Filipinization. Therefore, the son and grandson of Lourenzo are deemed to be natural born Filipino citizen.

SEPARATE OPINION Justice Puno: Persons benefited from the en masse filipinization, which took effect in 1902 are deemed Filipino citizen. Allan Poe followed the citizenship of his father who was benefited from the en masse Filipinization. Therefore, FPJ following the citizenship of his father Allan is likewise a Filipino citizen. Justice Davide: 3. Citezenship of legitimate and illegitimate child may be established by filiation or paternity. Allan poe is a Filipino citizen who had an illegitimate son named FPJ. Therefore, Fpj being the illegitimate son of Allan poe is a Filipino/ must also bear Filipino citizenship. Justice Tinga: 4. If a persons record of citizenship an2d presence in the Philippines cannot be determined, no presumption of nationality can be accorded to him. Lourenzos record in the Philippines does not bear convincing evidence that he acquired Filipino citizenship. Therefore, no presumption of nationality can be accorded to Lorenzous son Allan and grandson FPJ since their nationality was not established.
Illigitimate children follows the nationality of the mother and not of the father. Fpj is an illegitimate child Therefore, Fpj follows the nationality of his mother and not of her father.

Justice Azcuna: 5. The New Civil Code retroactively effected to the time of the birth of the child, benefiting as well those born under the old regime. FPJ was born under the old regime. Therefore, Fpj is deemed legitimated as of his birth. Justice Austria- Martinez: 6. When paternity is known or established, the child follows the fathers citizenship. Allan Poe is a father who is a Filipino Citizen. Therefore, Fpj following the nationality of his father Allan, is also a Filipino citizen.

DISSENTING OPINION Justice Carpio: 7. A child to be a natural born Filipino citizen must be acknowledged at birth through Filliation. Fpj was not shown to be acknowledged by his father Allan poe. Therefore, FPJ is not a natural born Filipino citizen. CONCURRING OPINION Justice Sandoval-Gutierez:

8. Section 3, Article IV of the 1935 Constitution states that those whose fathers are citizens of the
Philippines are Filipino Citizens. Allan Poe is a father who followed the Filipino citizenship of his father Lourenzo. Therefore, following the principle of jus sanguinis, FPJ being the son of Allan is a Filipino citizen making him a natural born citizen of the Philippines.

Justice Callejo:
Persons living in the Philippines who has admitted and established their citizenship are Filipinos. Allan Poe, who had an illegitimate son, admitted and established his Filipino citizenship,. Therefore, Allan and his illegitimate son FPJ is Filipino.
