TheSTRONGERvoluntaryandindependentreviewprogramhasconductedfourotherreviews ofPennsylvaniasprogram,thismostrecentreviewwasdoneinMaybyapanelincludingindustry, governmentandenvironmentalrepresentatives. TheSTRONGERreportalsoidentifiedseveralstrengthsinPennsylvaniasProgram StaffResources:CommendedDEPforincreasingitsstaffandresourcestoaddressadditional permitting,inspectionandenforcementactivitiesaswellasnotingthepassageofnewlegislation(Act13 of2012)todistinguishregulationofMarcellusShaleandconventionaloilandgaswells. AbandonedWells:DEPwascommendedfortheirpublicparticipationactivitiesassociatedwiththe abandonedsitesprogram.Publicparticipationactivitieswithrespecttoabandonedwellshavebeen occurringformanyyearsbylocalindividualsandenvironmentalgroups.Thesegroupshavebeen especiallyproactiveinsearchingforabandonedoilandgaswells.TwosuchgroupsarethePASenior EnvironmentalCorp,whosearchedforabandonedwellsinOilCreekStateParkinVenangoCounty andSaveOurStreamsPA,whoisinvolvedinfindingabandonedwellsinPotterandMcKean Counties. RadiationStudy:ThereportnotedDEPscomprehensivestudyofradiationlevelsspecifically associatedwithMarcellusShalewelldevelopment(TENORMstudy)nowunderwayisthefirstofits kindinthenation. StormwaterManagement:CommendedDEPforitsstormwatermanagementprogramandthe adoptionofanewstormwatermanagementpolicythatreliesontheuseofBestManagementPractices forthecontroloferosionandsedimentationatdrillingandrelatedsites. HydraulicFracturingProgram:DEPwascommendedforitshydraulicfracturingprogram. Standardsforwellcasingandcementingrequirethattheoperatorconductthoseactivitiestocontrolthe wellatalltimes,preventmigrationofgasorotherfluidsintosourcesoffreshgroundwaterandprevent pollutionoffreshgroundwater.Thereportnotedthewellcompletionreportrequirementsandchemical disclosurerequirementsexceedpublicdisclosureandreportingrequirementsoftheSTRONGER Guidelines. PEChasworkedwithabroadarrayofstakeholdersincludingindustryoverthelastfour yearstounderstandandworktoaddresstheimpactsofunconventionalshaledevelopment.Whilethe proposedregulationsarenotperfect,infactwebelievetheycanbefurtherimproved,theygreatly strengthenPennsylvaniasabilitytomanagethedevelopmentoftheunconventionalshalegasindustry. Indeed,manyoftheproposedregulationshavebeenendorsedbymembersoftheMSCthroughthe recommendationsoftheGovernorsMarcellusShaleAdvisoryCommission,whosereportprovided partoftheframeworkforAct13.
