peisons, piimaiily of the Egun, Ilaje, Ijaw, anu Yoiuba tiibes who coexist anu coopeiate
in theii social anu economic activities uespite ethnic anu ieligious uiveisity. The
community was founueu in its piesent location, built on the wateis anu shoies of the
Lagos Lagoon well ovei a centuiy ago anu have watcheu the Lagos metiopolis giow up
aiounu it. Its main economic activities aie fishing, fish smoking, anu a wateifiont timbei
inuustiy, so that both its subsistence anu the tiauitional way of life uepenu on watei.

2.2 0n }uly 1S, 2u12, a Notice fiom the Lagos State Commissionei of Wateifiont
Infiastiuctuie Bevelopment was ueliveieu at ianuom to a few community membeis. The
Notice was uateu }uly 12, 2u12 anu infoimeu the "0wnei0ccupiei" of the
NakokoIwaya Wateifiont of the Lagos State uoveinment's uecision to "cleai all illegal
anu unauthoiizeu uevelopments on its wateifiont anu watei bouies." It theiefoie
puipoiteu to give "notice. to vacate anu iemove all illegal anu unauthoiizeu

Bevelopment, membeis of the Lagos State Kick Against Inuiscipline (KAI) Biigaue, anu
heavily aimeu policemen stoimeu the community by boat. They useu chainsaws anu
othei equipment to uemolish homes, business places anu community stiuctuies built of
stilts ovei the Lagos Lagoon. Resiuents, who hau nowheie else to go, fell into the watei
with theii possessions anu the uebiis fiom theii houses, suffeiing injuiy anu loss of
piopeity. The uemolition continueu until }uly 21, 2u12, ultimately uisplacing thousanus
of people, incluuing chiluien, women anu elueily, who weie foiceu to live in canoes.
Nany othei community membeis weie affecteu by uisiuptions to theii livelihoous anu
way of life anu continue to feai fuithei uemolitions that have been thieateneu. Q%%'

2.4 The uemolition exeicise was accompanieu by acts of violence anu intimiuation by
membeis of the Lagos State Kick Against Inuiscipline (KAI) Biigaue anu heavily aimeu
policemen. Seveial men weie aiiesteu anu uetaineu without chaige. In the woist
inciuent, on }uly 21, 2u12, an unaimeu fisheiman anu community leauei, Ni. Timothy
Azinkpono Bunkpoyanwa, was fatally shot in the stomach by Police Coipoial Boma

2.S Buiing anu since the }uly 16-21, 2u12 uemolitions, the NakokoIwaya Wateifiont
community leaueis have tiieu to engage with the uoveinment of Lagos State, the
uoveinoi of Lagos State, anu the Lagos State Ninistiy of Wateifiont Infiastiuctuie
Bevelopment, among otheis, to finu a way of saving theii community. Thiough the
couise of negotiations, the community membeis have ieceiveu mixeu messages that
leave them feaiful foi the futuie. They weie fiist tuineu away by the Commissionei of
Wateifiont Infiastiuctuie Bevelopment when they came to his Ninistiy while
uemolitions weie ongoing. Subsequently, aftei a community-leu peaceful piotest, meuia
coveiage, anu huge inteinational outciy ovei the uemolitions, they ieceiveu an apology
fiom the uoveinoi of Lagos State anu inuications that ceitain membeis of the
uoveinment of Lagos State might be willing to collaboiate with them to unueitake $&'I$#;'

appioach the National Buman Rights Commission seeking ueteimination of the issues

4.S The 0N Committee on Economic, Social anu Cultuial Rights, the bouy of inuepenuent
expeits establisheu to inteipiet the ICESCR anu monitoi state paities compliance, has

Peoples' Rights ielieu on Aiticles 14, 16, anu 18(1) of the Afiican Chaitei in finuing
Nigeiian uoveinment in violation of the iight to sheltei oi housing of the 0goni
community. These aiticles of the Afiican Chaitei have been uomesticateu into Nigeiian
law in theii own iight anu also infoim the inteipietation of similai iights guaianteeu in
the Nigeiian Constitution. Aiticle 14, uiscusseu above, guaiantees the iight to piopeity.
Aiticle 16 guaiantees the "iight to enjoy the best attainable state of physical anu mental
health," which has been founu by the Afiican Commission to contain, by implications, the
basic socioeconomic iights to watei anu foou that aie necessaiy to achieve health.
Aiticle 18(1), meanwhile, pioviues piotections foi the family: "The family shall be the
natuial unit anu basis of society. It shall be piotecteu by the State."

4.S The Afiican Commission has founu that the combineu effect of Aiticles 14, 16, anu 18,
ieau togethei, "foibius the wanton uestiuction of sheltei because when housing is
uestioyeu, piopeity, health, anu family life aie auveisely affecteu." Baseu on this
ieasoning, the Commission founu the Nigeiian uoveinment's uemolitions in the 0goni
community to constitute a violation of the community's iights to sheltei oi housing.

4.6 The existence of a iight to sheltei oi housing also finus ample suppoit in the Nigeiian
Constitution. The Nigeiian Constitution contains the same funuamental iights fiom
which the iight to sheltei oi housing ueiives, to wit the iights to piopeity containeu in
Sections 4S anu 44 the iight to home anu piivate life in Section S7. These iights can be
ieau in light of Chaptei II, Section 14(2)(u) of the Constitution, which states that the
uoveinment shall uiiect its policies towaiu the piovision of suitable anu auequate
sheltei.

4.7 The 0N Committee on Economic, Social anu Cultuial Rights uefines a @42A06'0=$A&$48 as
"the peimanent oi tempoiaiy iemoval against theii will of inuiviuuals, families anuoi
communities fiom the homes anuoi lanu which they occupy, without the piovision of,
anu access to, appiopiiate foims of legal oi othei piotection" (0N Committee on ESCR,
ueneial Comment No. 7, paia. S (Sixteenth session, 2u Nay 1997), E199822, Annex
Iv).

4.8 The Committee has emphasizeu that evictions may only be caiiieu out as a last iesoit
anu only aftei all feasible alteinatives to eviction have been exploieu in genuine
consultation with the affecteu people. It has claiifieu that evictions can only be caiiieu
out when appiopiiate pioceuuial piotections aie in place. These incluue:

an oppoitunity foi genuine consultation with those affecteu;
auequate anu ieasonable notice foi affecteu people piioi to the eviction
infoimation on the pioposeu evictions anu, wheie applicable, on the
alteinative puipose foi which the lanu oi housing is to be useu, to be maue
available in ieasonable time to all those affecteu;
goveinment officials oi theii iepiesentatives to be piesent uuiing an eviction;
eveiyone involveu in caiiying out the eviction be piopeily iuentifieu;
evictions not to take place in paiticulaily bau weathei oi at night unless the
affecteu people consent otheiwise;
piovision of legal iemeuies;
piovision, wheie possible, of legal aiu to people who aie in neeu of it to seek
ieuiess fiom the couits;
piovision of auequate alteinative housing to those who cannot pioviue foi
themselves; anu
compensation foi all losses.

4.9 The eviction of the NakokoIwaya Wateifiont Community that took place on Naich 14-
16 2u12 constitutes a foiceu eviction because none of the above pioceuuial piotections
weie in place.
a. The Lagos State uoveinment uiu not consult with the NakokoIwaya Wateifiont
Community piioi to aiiiving with chain saws to commence the uemolition on }uly
16, 2u12. No infoimation about the uemolition was maue publicly available to the

Infiastiuctuie Bevelopment, membeis of the Lagos State Kick Against
Inuiscipline (KAI) Biigaue anu the Lagos State Task Foice on Enviionmental anu
Special 0ffences, anu heavily aimeu policemen stoimeu the community by boat.

c. The piocess of the eviction itself was fiaught with pioblems. Thousanus of
affecteu peisons weie unable to iescue theii valuable belongings befoie theii
stiuctuies weie uemolisheu, collapsing into the Lagos Lagoon. Resiuents, who
hau nowheie else to go, fell into the watei with theii possessions anu the uebiis
fiom theii houses, suffeiing injuiy anu loss of piopeity. Accoiuing to the Lagos
State Commissionei of Police, many of the police officeis assisting in the
uemolition weie acting illegally - beyonu the scope of theii official capacities, as
hiieu aimeu peisonnel abusing theii authoiity (U%%' FRS)T)*' F;). To uate, no
police officeis have been piopeily oi auequately biought to justice foi theii
actions, unueiscoiing the Lagos State uoveinment's conuoning of such extia-
legal actions.

1. That I am a resident of the Makoko/Iwaya Waterfront community and the Alashe of the
Eguns in Makoko.

2. That by virtue of my position, I am conversant with the facts deposed herein.

3. That I have the consent and authority of the Plaintiffs to depose to this affidavit.

4. That the Plaintiffs are all leaders of the Makoko/Iwaya Waterfront community and/or
persons affected by the July 16-21, 2012 demolition and related events.

and Special Offences (known popularly by a variety of similar names), allegedly a
parastatal under the control/management of the Lagos State Government, that purports to
have authority to execute the Lagos State Environmental Sanitation Law and other laws
of Lagos State.

Defendant is the Environmental Sanitation Enforcement Agency, a statutory
body with certain enumerated powers relating to environmental sanitation.

Personal Circumstances

14. That I am an Egun man and a fisherman by trade.

15. That I was born in Makoko in the year 1955 and have lived in Makoko/Iwaya Waterfront
community ever since.

16. That I presently have two wives and 18 children, all residents of the Makoko/Iwaya
Waterfront community.

17. That my family and I do not have any other home but the Makoko/Iwaya Waterfront
community.

Personal Circumstances of the Other Named Plaintiffs

18. That Baale Sodiq Yusufu Segla Hungbeme is an Egun man, a resident of the
Makoko/Iwaya Waterfront Community and a Baale of the Sogunro area. On November
21, 2012, at about 3:30pm, at the office of our legal representative, the Social and
Economic Rights Action Center (SERAC), he told me and I verily believe the following
information to be true:

a. That he was born in 1948 in Makoko-Akoka and has lived all his life in the
Makoko/Iwaya Waterfront community.

b. That he is a carpenter by trade and does his work in Makoko.

c. That he has three wives and 12 children

d. That his wives used to work in the Makoko/Iwaya Waterfront community doing
fish smoking, but their livelihood was severely affected by the destruction of
fishing and fish smoking facilities during the demolition.

e. That, as a consequence, his children have had to leave the school they were
attending because the family cannot afford the school fees.

19. That Mr. Emmanuel Hagbe J.P. is an Egun man, a resident of the Makoko/Iwaya
Waterfront community. On November 21, 2012, at about 3:30pm, at the office of our
legal representative, SERAC, he told me and I verily believe the following information to
be true:

a. That he was born on October 12, 1975 in Makoko.

b. That he has two wives and five children.

c. That he is presently the Youth Leader and the President of the Gbenokpo Society
of Fishermen and Fish Sellers in the Makoko/Iwaya Waterfront community.

d. That he was formerly a CDA Chairman in the community.

20. That Mr. Ayeseminikan Bawo is an Egun man, a resident of the Makoko/Iwaya
Waterfront community. On November 21, 2012, at about 3:30pm, at the SERAC office,
he told me and I verily believe the following information to be true:

a. That he is 53 years old and resides in the Makoko/Iwaya Waterfront community.

b. That he has one wife and eight children, also residents of the community.

c. That he is the proprietor of the Kennedy Group of Schools, a nursery, primary and
secondary school serving approximately 350 children from the Makoko/Iwaya
Waterfront and neighboring communities.

d. That the school was started in 1990 and has been operating ever since, with
international recognition for its service to the Makoko community.

e. That as a result of the July 16-21 demolitions, at least 10 children have been
withdrawn from his school due to loss of their homes in the community or the
livelihoods that enabled their families to pay school fees.

f. That he is also the secretary of the Ilaje community in Makoko.

21. That Mr. Ewajane Osowo is an Ilaje man, a resident of the Makoko/Iwaya Waterfront
community. On November 21, 2012, at the SERAC office, at about 3:30pm, he told me
and I verily believe the following information to be true:

a. That he was born on June 6, 1979.

b. That he is married and has one child.

c. That is presently the Secretary of the Ilaje Crayfish and Fishermen Association of
Nigeria in the Makoko branch.

d. That he was formerly the Youth Representative in the Baale Council.

22. That Mr. Prosper Aivoji is an Egun man, a resident of the Oko-Agbon area of the
Makoko/Iwaya Waterfront community. On November 21, 2012, at about 3:30pm, at the
SERAC office, he told me and I verily believe the following information to be true:

a. That he was born in Makoko and is now 42 years old.

b. That he is a businessman by trade.

c. That he has two wives and two children.

d. That he is the secretary to the Baale of the Oko-Agbon area of the Makoko/Iwaya
Waterfront community, comprised of at least 100 families, and also the Chairman
of the Oko-Agbon Community Development Association.

23. That Mr. Staycool Sofiyegha is an Ijaw man, of 13 Apollo Street, Waterfront, and the
secretary to the Ijaw Atorhu (Chief) of the Makoko/Iwaya Waterfront community. On
November 22, 2012, at about 9:30am, at the SERAC office, he told me and I verily
believe the following information to be true:

a. That he was born on October 10, 1960 in Arogbo in Ese Odo LGA in Ondo State.

b. That he came to live in the Makoko/Iwaya Waterfront community, where his
sister was already living, on December 7, 1985.

c. That he has lived in the Makoko/Iwaya Waterfront community ever since.

d. That he works as a timber contractor in the Okubaba waterfront sawmill industry.

e. That he has two wives and seven children and all are residing with him in the
Makoko/Iwaya Waterfront community.

f. That one of his wives works in the timber industry and the second is a trader at
the Owaya waterfront.

g. That all his children are schooling in Makoko and depend on his and his wives
incomes for their school fees and other needs.

h. That his familys home and livelihood would be gravely affected if the threatened
demolition of the Makoko/Iwaya Waterfront community were to proceed.

24. That Mrs. Abosede Hunkpoyanwa is an Egun woman, of No. 18 Raimi Street, Makoko
House of Lagoon, in the Makoko/Iwaya Waterfront community, and a widow of the late
Mr. Timothy Azinkpono Hunkpoyanwa. On November 23, 2012, at about 11:30am, at
my palace in the Makoko/Iwaya Waterfront community, she told me and I verily believe
the following information to be true:

a. That she was born in about 1962 in Badagry and is now 50 years old.

b. That she came to the Makoko/Iwaya Waterfront community in about 1982 on
business and then married her late husband and has lived there ever since.

c. That she and her husband stayed together for about thirty years until his death on
July 21, 2012 at the hands of the police.

d. That they have four children, who are about 29, 27, 24 and 15 years old.

e. That the youngest of their children still stays with her and schools in the
Makoko/Iwaya Waterfront community.

f. That she was the first of her husbands three wives and together they have 14
surviving children, most remaining in the Makoko/Iwaya Waterfront community.

g. That her late husband was a fisherman working the Makoko/Iwaya Waterfront
and the main breadwinner of the family.

h. That she works selling fresh fish, while her co-wives sell smoked fish, so that all
their incomes are tied to the economy of the Makoko/Iwaya Waterfront.

i. That her husbands death at the hands of the police in July 2012 (circumstances
described further below) has devastated her life, the lives of her co-wives, and the
lives of all of their children. Besides their grief, they are now unable to pay their
childrens school fees or go to the hospital or buy medicines when they fall ill.

j. That besides losing their breadwinner in the demolition, her family lost the
building they maintained for fishing business at the Makoko/Iwaya Waterfront.

k. That she prays that justice will be done for her husbands death and her family
will be properly compensated for their tremendous loss so they can survive and
care for themselves and their children.

Community Circumstances

25. That the Makoko/Iwaya community is home to over 200,000 (two hundred thousand)
people. The Plaintiffs stand as representatives of this community, including the 4,034
persons named and described in Exhibit A who are among those who lost property and
were displaced in the course of the demolition of their homes and business premises.

26. That Makoko/Iwaya waterfront community is situated partially on land and partially on
water, namely on the Lagos Lagoon between the shore and the Third Mainland Bridge.
Both the water and land communities are open to public thoroughfare by land or water
and do not prevent any public waterfront access or interfere with any current waterway
navigation. Shown to me and marked Exhibit B is a copy of a survey map depicting the
general area referred to as Makoko/Iwaya Waterfront communities.

27. That the residents of the Makoko/Iwaya Waterfront community are predominately Eguns,
Ilajes, Ijaws and Yorubas.

28. That the Makoko/Iwaya Waterfront community is well documented and globally
recognized as an ancestral fishing settlement that has flourished since the 1800s when our
ancestors settled in the community.

29. That the residents of the Makoko/Iwaya Waterfront community have coexisted peacefully
ever since, despite ethnic and religious diversity.

30. That the lifestyles, occupation, cultures and identity of majority of the residents are
intricately connected to access and use of open water for fishing and other fishing related
activities as well as the timber industry that involves moving logs by water.

31. That the Makoko/Iwaya Waterfront community boasts of highly developed structures of
organization that ensure the security and overall cohesiveness of the community.

32. That the local economy of the Makoko/Iwaya Waterfront Community is equally vibrant
as over 40% of all smoked fish consumed in Lagos is processed in the community and the
residents of Makoko engage in the timber industry, carpentry, trading and other business.

33. That most of the residents of the Makoko/Iwaya Waterfront Community, like me, were
born in the community and they do not have or know any other home but the community.

34. That the oldest man in the Makoko/Iwaya Waterfront community Mr. Shemede Oke
Moses is 115 years old.

35. That Mr. Shemede Oke Moses told me on July 22, 2012 at about 4:30pm at his residence
in the Makoko/Iwaya Waterfront community and I verily believe that he was 15 years old
when his father brought him to the Makoko/Iwaya Community from Vawe in Ogun State.

36. That, to the extent that the Makoko/Iwaya Waterfront community suffers from poor
public infrastructure, this is the result of the sustained failure of the Lagos State
Government and its local councils to extend social services such as potable water, roads,
hospitals, solid waste disposal facilities, schools and other infrastructure.

37. That, by contrast, the Makoko/Iwaya Waterfront community itself is engaged in
productive livelihood activities that are integral to the broader economy and food security
of Lagos State and, through its community organizations, is working to upgrade the
communitys environment and harness its economic potential with or without the
participation of the Lagos State Government, with which it has tried to engage.

July 2012 Demolition Activities and Related Events

38. That on July 13, 2012, a notice dated July 12, 2012 issued by the Lagos State Ministry of
Waterfront Infrastructure Development was sent to the Makoko/Iwaya Waterfront
Community and was randomly handed out to some residents of the community.

39. That, in the Notice, the Ministry informed the Owner/Occupier of Makoko/Iwaya
Waterfront of the Lagos State Governments decision to clear all illegal structures
along the Makoko/Iwaya Waterfront and implicitly accused the residents of developing
illegal shanties on the waterfront and impeding economic and gainful utilization of the
waterfront for navigation, entertainment, and recreation.

40. That the Notice ordered all owners and occupiers of the Makoko/Iwaya Waterfront to
vacate and remove all structures within 72 hours of receipt of the notice.

41. That a photocopy of the said Notice issued by the Lagos State Ministry for Waterfront
Infrastructure Development is hereby exhibited and marked Exhibit C.

42. That at about 10:30am on Monday July 16, 2012, officials of the Lagos State Ministry of
Waterfront Infrastructure Development accompanied by heavily armed Policemen,
officials of Kick Against Indiscipline (KAI) Brigade and the Environmental and Task
Force on Special Offences stormed the community in boats.

43. That as soon as they entered the community, they began demolishing homes and other
structures with chainsaws as residents of the community scrambled to salvage their
belongings from the falling structures.

44. That many residents, including children, fell into the water as the demolition squad
brought their homes down while they were still inside.

45. That the demolition continued from Monday July 16, 2012 to Saturday July 21, 2012.

46. That the demolition exercise left many persons in the community homeless and without
any option but to sleep in open canoes.

47. That on the night of Wednesday, July 18, 2012, three children were reported missing
after the open canoe in which they slept capsized.

48. That a search party organized to find the children discovered one of them dead while the
remaining two have not been found till date and as such are presumed dead.

49. That on Friday, July 21, 2012 leaders of the community paid a visit to the Ministry of
Waterfront Infrastructure Development to meet with the Commissioner Mr. Olusegun
Oniru and discuss the demolition exercise being carried out by his Ministry.

50. That the Commissioner refused to give us audience and instructed his security personnel
to walk us out of the premises.

51. That on Saturday, July 21, 2012, the demolition took on a more violent dimension as a
policeman attached to the demolition squad known as Police Corporal Boma Pepple shot
dead Mr. Timothy Azinkpono Hunkpoyanwa, a resident of the Makoko/Iwaya Waterfront
community, without justification.

52. That the police bullets gruesomely ripped through his stomach discharging his intestines
and other internal organs.

53. That following the shooting, Mr. Hunkpoyanwa was rushed to hospital and Mr.
Emmanuel Hagbe J.P. went to inform the bereaved family, who were unable to see their
loved one and say goodbye before he died.

54. That attached herein and marked Exhibit D1-D3 are pictures of the late Mr. Timothy
Azinkpono Hunkpoyanwa taken immediately after he was shot as well as an autopsy
report stating that Mr. Hunkpoyanwa died on July 21, 2012 at 3:20pm and the cause of
death was blood loss and related issues due to a gunshot injury to the abdomen.

55. That, during the demolition exercise, many residents of the community were harassed,
maimed, beaten, arrested and detained without any justification by officials of the
demolition squad.

56. That among those who were arrested on Saturday, July 21, 2012 and held in detention for
four days were: Afonse Lateef, Wasiu Danhuto, Sende Danhuto, Jacklyn Danhuto, Benua
Ahonlonsu, Ezekiel Hungevu, Hunge Hana, Hunge Bartholomew, Hunge Jeremy.

57. That those detained were released on Tuesday, July 24, 2012 on orders of the
Commissioner of Police for Lagos State without any charges ever filed against them.

58. That on Monday, July 23, 2012, thousands of residents of the community were led by the
Social and Economic Rights Action Center (SERAC) in a peaceful protest to the office of
the Lagos State Governor over the demolition of the community and the shooting of late
Mr. Timothy Azinkpono Hunkpoyanwa.

59. That the Lagos State Governor, Mr. Babatunde Raji Fashola received the protesters at his
office and apologized to them for the murder of Mr. Timothy Azinkpono Hunkpoyanwa
while assuring the people that the demolition will not continue and that the government
will work together with the community to provide essential social services and
infrastructure, improve living conditions and harness the communitys tourism potential
by turning it into the Venice of Africa.

60. That the demolition exercise and protest were widely covered by both local and
international news media.

61. That the National Human Rights Commission also came out publicly to condemn the
demolition exercise and vowed to conduct an investigation into what appeared to be
serious violations of fundamental human rights of the displaced residents.

62. That attached herein and marked Exhibits E1-E5 are photocopies of some newspaper
and online news articles covering the demolition exercise, protest march, and statements
from the Chairman of the National Human Rights Commission, Dr. Chidi Odinkalu.

63. That following the protest of July 23, 2012, the representatives and leaders of the
Makoko/Iwaya Waterfront community were invited to meet with the Commissioner of
Waterfront Infrastructure Development by letters addressed to them and dated.

64. That attached and marked as Exhibit F1- F2 are copies of the correspondence between
the government and the community in respect of the meeting, which ultimately took place
on July 31, 2012.

65. That the representatives and leaders of Makoko/Iwaya Waterfront community attended
the July 31, 2012 meeting together with our legal representatives from the Social and
Economic Rights Action Center (SERAC).

66. That representing the government at the meeting was Prince Adesegun Oniru, the
Commissioner for Waterfront Infrastructure Development, Mr. Aderemi Ibirogba, the
Commissioner for Information & Strategy and Mr. Bayo Suleiman, the purported
Chairman of the Lagos State Environmental and Special Offences (Enforcement) Unit
and/or the Lagos State Task Force on Environmental and Special Offences.

67. That, upon arrival at the meeting, the Commissioner for Waterfront Infrastructure
Development, Prince Adesegun Oniru, asked the lawyers from SERAC to leave because
the meeting was meant only for residents of the Makoko/Iwaya Waterfront community.

68. That the Commissioner pointed out that the aim of the meeting was simply for
Government to engage in discussions with its people and, as such, there was no need for
any legal representation.

69. That, the communitys leaders and representatives explained to the Commissioner that
they specifically invited SERAC to be a part of the meeting in its capacity as the
communitys legal representative and also made clear that SERACs presence was crucial
to the furtherance of the meeting.

70. That the team of lawyers from SERAC reminded the Commissioner that the community
has the constitutional freedom to be represented by lawyers of their own choosing in
matters of legal or administrative nature and, as such, SERAC should be welcome to stay
regardless of the nature of the meeting.

71. That, upon the Commissioners further insistence that the meeting is for the communitys
leaders and representatives alone, the team of lawyers from SERAC withdrew.

72. That, many of the communitys leaders and representatives left the meeting in protest
after SERACs withdrawal and this led to the disruption of the meeting.

73. That, by a letter dated August 22, 2012, the Makoko/Iwaya Community informed the
Lagos State Governor of their intent to undertake a community-led regeneration of the
community in line with the Governors commitment to provide essential social services
and infrastructure, improve living conditions and harness the communitys tourism
potential by turning it into the Venice of Africa.

74. That, in the letter the community members expressed their commitment to collaborate
with the government to design and implement a plan for the redevelopment of the
Makoko/Iwaya Waterfront Community for the utmost benefit of the people. Attached and
marked as Exhibit G is the said letter to the Governor.

75. That the representatives and leaders of the Makoko/Iwaya Waterfront Community were
once again invited to a meeting by the Ministry of Waterfront Infrastructure Development
on October 30, 2012.

76. That attached and marked as Exhibit H1- H3 are copies of the correspondence between
the government and the community with respect to the meeting.

77. That the community leaders and representatives were present at the meeting together with
lawyers from SERAC.

78. That, at the meeting, the Lagos State Government was represented by Mr. Bayo
Suleiman, in his purported capacity as the Chairman of the Environmental and Special
Offences (Enforcement) Unit (a.k.a. Task Force), two officers of the Kick Against
Indiscipline (KAI) Brigade and the Personal Assistant to Commissioner of Waterfront
Infrastructure Development Prince Adesegun Oniru.

79. That, at the meeting, Mr. Bayo Suleiman informed the Makoko/Iwaya Waterfront
community leaders and representatives of the Lagos State Governments decision to
continue the demolition of the Makoko/Iwaya Waterfront Community.

80. That, accordingly, the Lagos State Government seems bent on annihilating an entire
community in pursuit of mega-city status, which judging by the governments actions
and threats, can only mean a city that caters only to the needs and desires of the wealthy
and leaves evicted residents without shelter or livelihood opportunities.

81. That the July 2012 Notice from Ministry of Waterfront and Infrastructure Development
follows on several occasions on which the 7
th
and 8
th
Defendants have issued abatement
of nuisance notices and demolished houses and structures in the Makoko community,
for the purported purpose of enforcing the provision of the Environmental Management
Laws of Lagos State.

82. That, for instance, by a Notice dated 9
th
December 2010, the 7
th
Defendant, the Lagos
State Environmental and Special Offences (Enforcement) Unit, ordered The Owner of
Shanties by Adekunle Bridge (an area of the Makoko community built on land) to abate
environmental nuisance including illegal occupation of land and erection of shanties
within three days. Attached and marked Exhibit I is a copy of the said notice.

83. That the ensuing December 2010 demolition exercise was brutally carried out in the
community by the 8
th
Defendant, the body that purports to be the Task Force on
Environment and Special Offences, causing one death and many injuries.

84. That the December 2010 demolition is presently the subject of Suit No. M/198/2012 at
the Lagos High Court. That an April 2010 demolition in Makoko is the subject of Suit
No. M/757/2011 at the Lagos High Court, while an April 2005 demolition in Makoko is
the subject of Suit No. CA/L/637M/2009 pending at the Lagos State Court of Appeals.

85. That there is proliferation of bodies or persons that have threatened or been involved in
demolitions of the Makoko/Iwaya communities, including the Commissioner for
Waterfront Infrastructure Development, Kick Against Indiscipline (KAI) Brigade, Mr.
Bayo Suleiman (S.P.), the Lagos State Environmental and Special Offences
(Enforcement Unit), and the Lagos State Task Force on the Environment, the 5
th
, 6
th
, 7
th

and 8
th
Defendants respectively, so we do not know where the next threat will come from.

86. That, even while the Government repeatedly threatens us with demolitions, it makes
public promises to improve our community for the benefit of current residents.

87. That, for instance, Makoko and Iwaya are two of the nine host communities for urban
upgrade activities under the Lagos Metropolitan Development and Governance Project
(LMDGP), a US$200 million World Bank-funded project.

88. That I have been informed by Felix Morka, Esq. our legal representative, at the SERAC
office at about 12noon on 23 July 2012 and I verily believe the following to be true:

a. That, for the purposes of the Project, the Lagos State Government and the World
Bank agreed to a Resettlement Policy Framework that would apply to Bank-
funded activities or any activities necessary to the completion of the Project.

b. That under this Resettlement Policy Framework, the Lagos State Government is
mandated to avoid [involuntary resettlement] and minimize the social impacts of
the project and, where resettlement is unavoidable, to provide offsetting
mitigation measures that give the persons displaced by the project meaningful
opportunity to share in the project benefit . . . [and that] assist [them] to improve
livelihoods and standards of living or at least to restore them to levels equivalent
to those prior to the project.

c. That the Lagos State Government is further mandated to observe World Bank
Safeguard Policies that mandate prior consultation, adequate notice, grievance
procedures for Project-affected communities, as well as compensation,
resettlement and other remedies for those who are involuntarily displaced.

89. That we do not see how the demolitions that have taken place and threatened in our
communities can be in line with these policies or how they can be consistent with the
spirit and purpose of such urban upgrade projects when the very communities that are
meant to benefit would no longer exist if/when the projects are ever completed.
