Please take notice that the Court en bane issued a Resolution
dated OCTOBER 8, 2013, which reads as follows:
"G.R. No. 209136 (Manuelito R. Luna vs. Secretary Florencio B.
Abad, in his official capacity as Head of the Department of Budget and
Management, and Executive Secretary Paquito N. Ochoa, Jr., in his official
capacity as alter ego of the President).- Acting on the Petition for Certiorari
and Prohibition (with a Prayer for Injunction and/ or Temporary
Restraining Order), the Court Resolved, without giving due course to the
petition, to
(a) CONSOLIDATE this case with G.R. No. 209135
(Augusto L. Syjuco. Jr .. Ph.D. vs. Hon. Florencio B. Abad, in
his capacity as Secretary of the Department of Budget and
Management. and Hon. Franklin M. Drilon, in his capacity as
Senate President of the Republic of the Philippines);
(b) REQUIRE the respondents to COMMENT on
the consolidated petitions within a NON-EXTENDIBLE
period often (10) days from notice hereof; and
(c) SET the consolidated cases for ORAL
ARGUMENTS on October 22, 2013, Tuesday, at 2:00p.m. at
the New Session Hall, New Supreme Court Building, Padre
