1) "Renaissance Residences", Residential Apartment at Sy.No. 68/2A, Portion of

70/1 and 71/1, Aallasandra village, Yelahanka Hobli, Bangalore North Taluk, Bangalore by M/s Renaissance Real asset Developers India LLP (SEIAA 2 CON 2012)
It is a proposal for construction of Residential Apartments of 285 Units with 3 Basement + Ground floor + 14 Upper floors + Terrace and a Club House with Basement + Ground floor + 3 Upper floors on an area of 22,662.34 Sq.m (5 Acres 24 Guntas) and the total built up area is 95,809.85 Sq.m. The total water requirement is 308 KLD and the investment is of Rs. 174.15 crores. The total parking provided is for 679 cars. Project Details: (a) Land: Total plot area: 22,662.34 Sqm; Total built up area: 95,809.85 Sqm. The project consists of 285 residential units with 3 Basement + G + 14 UF and Club House with B+G+3UF. (b) Greenery: Landscape area: 6061.27 Sqm (35.60% of plot area). The project site has 26 trees out of which 14 trees will be cut after obtaining permission from BBMP/Forest Department and 12 trees will be transplanted. (c) Water Requirement: Total water requirement is 308 KLD; Source of water: BWSSB. (d) Soil: Total excavated soil: 12,500Cum; Backfilling Quantity: 4,000 Cum, landscaping quantity: 5,000 Cum within the project site and about 3,500 cum will be used for hardscaping within the project. (e) Sewage: Total quantity generated: 247 KLD, treated in proposed STP of design capacity 275 KLD; Sludge generated: - 99 Kg/day used as manure. (f) Solid Waste: Total generated: 911 Kg/day; Organic waste: 545Kg/day treated in organic converter and product used as manure. Inorganic waste: 364Kg/day will be sent for recycling. (g) Power Requirement: Total Requirement: 1138 kW from BESCOM; Power Backup: 2X500 KVA DG sets (h) Parking: 679 Numbers. Project Surrounding Details: Bannerughatta National Park 30 Kms, Water Bodies: Allalasandra 0.75Kms, Jakkur Lake 2Kms, Amruthahalli Lake 2.5Kms, Yelahanka Lake -3Kms and Hebbal Lake 4Kms.Other Details: Rain Water Harvesting is proposed.

The subject was discussed in the SEAC meeting held on 10 th February 2012. The proponent present explained the project. The proponent informed that a nallah drain runs outside the boundary of the project site and 15 m buffer is left. The Committee advised the proponent to develop a buffer zone for greenery and also plant fruit bearing trees in the landscape proposed. The proponent also informed that the source of water is BWS&SB and UGD facilities are existing. There are 2 borewells in the site. The proponent informed that the project site is well connected to BIAL road (BIAL Hebbal) and Yelahanka road (Yelahanka BIAL road). The existing projected & modified LoS of BIAL road is B-D-C and the same for Yelahanka road is B-D-C. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the social commitment plan for Rs. 12 Lakhs, as committed by the proponent. The proponent has submitted the information vide letter dated 01.03.2012. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC during the meeting held on 05.04.2012. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC. The Authority observed that width of the road (ROW) in relation to the height of the building is not forthcoming with details. The Authority after discussion, decided to get the following information for further consideration: (a) Information with regard to maximum height of the building in relation to width of the road as per O.M. dated 7th February 2012 issued by the Ministry of Environment and Forests. (b) NOC from Fire and Emergency Services Department. (c) Distance from the nearest fire station duly depicting it on the map. (d) Plan for increasing the greenbelt to at least 33%. (e) Details of existing drain abutting to project site and offset/greenery proposed towards drain. (f) Revised social commitment plan with activity, budget and time frame. The Authority also decided to invite the proponent. The proponent has submitted the information vide letter dated 02.05.2012, received on 22.05.2012. The proponent has been invited to the meeting. The Authority perused the information furnished by the proponent. The proponent appeared before the Authority and briefly explained about the project. The proponent submitted that the total height of the building is 45 meter and the existing road which is 12 meters wide is going to be widened to 18 meters as approved in the RMP 2015. The proponent further submitted that an area of 5640.23 sq. m is being relinquished for the proposed road widening.

The proponent submitted a copy of NOC issued by BWS & SB for supply of water and NOC issued by the Fire and Emergency Service Department. The proponent informed the Authority that the company is committed for environment safety and they have proposed to adopt the best practices for energy conservation, water conservation, and waste management. They have availed precertification for Gold rating from LEED for the proposed project.

While replying with regard to measures proposed for abatement of noise pollution on the project due to vicinity to the railway track, the proponent submitted that the proposed apartments will be at a total distance of 35 meters from the railway track, a buffer of 15 meters is provided from the compound which is going to be developed with thick tree growth.

The Authority suggested that the natural hydrology of the area should be maintained unaltered and all the necessary actions should be ensured to prevent possible pollution of Allalasandra Lake. The Authority while noting that the modified traffic scenario in the area is C&D opined that care should be taken to reduce impact on traffic due to the project. The Authority suggested left in left out to be strictly followed.

The Authority after discussion, decided to clear the proposal for issue of environmental clearance subject to submission of the following information. a. Documentary evidences with regard to relinquishment of land for the proposed road widening. b. Copy of official correspondence for LEED Certification.

c. Commitment with regard to providing in house facility for convenient shopping to meet the daily requirement of the residents. d. Commitment with regard to reserving the clubhouse facility only for the residents.

2) Bagmane Phoenix and Taurus, Office Building (Commercial Complex) at Sy. No.

39/6, 42/1, 42/2 and 42/3 Doddenekundi village, K.R. Puram Hobli, Bangalore East Taluk by M/s Bagmane Estates Pvt. Ltd. (SEIAA 5 CON 2012)

Lower Basement + Upper Basement + Lower Ground + Ground Floor + First Floor + 12 Upper Floors on an area of 24,865.27 Sq. m and the total built up area is 1,29,642.04 Sq. m. The total water requirement is 500 KLD and the investment is of Rs. 191.55 crores. The total parking provided is for 1594 cars. Project Details: (a) Land: Total plot area: 27,305.77 Sqm; Total built up area: 1,32,540.49 Sqm. The project consists of 2 blocks with 2B+LG+G+12 UF. (b) Greenery: Landscape area: 9,067.13 Sqm (6298.21 Sqm on land & 2,768.92 Sqm on podium) (33% of plot area). (c) Water Requirement: Total water requirement is 500 KLD; Source of water: BWS&SB. (d) Soil: Total excavated soil: 197450 Cum; (e) Sewage: Total quantity generated: 400 KLD, treated in proposed STP of design capacity 400 KLD; Sludge generated: 20 Kg/day used as manure. (f) Solid Waste: Total generated: 1580 Kg/day; Organic waste: 632 Kg/day treated in bio converter and product used as manure. Inorganic waste: 948 Kg/day will be sent for recycling. (g) Power Requirement: Total Requirement: 8971.414 KVA from BESCOM; Power Backup: 6X 1500 KVA DG sets (h) Parking: 1594 Numbers. Project Surrounding Details: Bannerghatta National Park 25 km. Other Details: Rain Water Harvesting is proposed. NOC from BWS&SB not submitted. Land conversion letter from DC submitted. The subject was discussed in the SEAC meeting held on 10 th February 2012. The proponent present explained the project. The proponent informed that the Mahadevapura Lake is 700 m and Doddanekundi Lake is 800 m away from the project site. The proponent informed that there is an external drain of BBMP outside the property. The project site is connected by ORR which connects KR Puram on one site and Marathahalli on the other side. The project is also connected to Ferns City road which is connected to ORR. The existing, projected and modified LoS for ORR is C-D-D (road towards KR Puram) and D->F->F (road towards Marathahalli). The same for road towards Ferns City is A-A-C. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent with a condition to leave appropriate buffer for the external drain as per the MoEF norms. 1. Revised land-use pattern showing percentage of greenery on natural ground. 2. Drainage pattern details with contour plan. 3. Dated peak hour traffic density photographs. 4. Social commitment plan for Rs. 19 Lakhs, as committed by the proponent. The proponent has submitted the information vide letter dated 25.02.2012. The Authority during the meeting held on 05.04.2012, perused the information submitted by the proponent and took note of the recommendation of the SEAC. The Authority noted that NOC from the BWS&SB and in respect of fire safety is not submitted. The traffic scenario reveals that it is CDD and DFF. Mahadevapura and Doddanekkundi lakes are located at a distance of 700 meters and 800 meters respectively. The information with regard to compliance of the O.M. dated 7th February 2012 also is not forthcoming. The Authority therefore decided to get the following information for further consideration of the proposal: (a) Copy of NOC from the Fire and Emergency Services Department

(b) Copy of NOC from the BWS&SB. (c) Proposal to ensure that the nearest lakes are not polluted due to project activity. (d) Information with regard to maximum height of the building in relation to width of the road as per O.M. dated 7th February 2012 issued by the Ministry of Environment and Forests. The Authority also decided to invite the proponent to the meeting. The proponent has submitted the information vide letter dated 30.05.2012. The proponent has been invited to the meeting. The Authority perused the information furnished by the proponent. The proponent appeared before the Authority and briefly explained about the project.

The proponent submitted a copy of the NOC issued by the BWS&SB. He submitted that application has been submitted to Fire and Emergency Service department for the NOC and it is being pursued. While responding to the impact on Lakes, the proponent submitted that Mahadevapura Lake is at a distance of 700 meters from the project site in the upstream and therefore no impact is anticipated. The Doddanekkundi Lake is at the down stream at a distance of 800 meters and is separated by outer ring road. The proponent further submitted that lot of development have already taken place in between these two Lakes and the project site. Therefore not much of impact is anticipated on the Lakes due to this project activities. While replying to the ROW of the road, the proponent submitted that the project site is at a distance of 53 meters from the outer ring road on the cross road, and emphasized that ring road meets the RoW criteria.

The proponent further submitted that they have planned to avail Gold Certification from LEED.

The Authority after discussion, decided to clear the proposal for issue of environmental clearance subject to submission of the following information. a. Details of the High Flood Level (HFL) of the near by Lakes and the level basement to ensure that the basement is above the HFL of the Lakes. b. Water balance for the non-rainy season. c. Details of Green Belt Development with tree cover.

d. CSR with time frame, budget and activities. 3) Construction of New Laboratory Complex (NLC) at NCBS Campus, GKVK,

Bellary Road, Bangalore by M/s National Centre for Biological Sciences (SEIAA 124 CON 2011)
It is a proposal for construction of New Laboratory Complex with Basement + Ground floor + 3 upper floors (built up area-21,270 Sq.m.) and sport cum dinning complex with basement + ground floor + 1 upper floor (1445 Sqm Built up area) on an area of 80967 Sq.m and the total built up area of 22,715 Sq.m The total water requirement is 150 KLD and the investment is Rs.80 crores. NCBS, TIFR comes under the aegis of Department of Atomic Energy, Government of India. Project Details: (a) Land: Total plot area: 80,967 Sqm; Total built up area: 21,270 Sqm; The project consists of new laboratory complex with basement + ground floor + 3 upper floors and sport cum dinning complex with basement + ground floor + 1 upper floor. (b) Landscape area: 68,988 Sqm. (c) Water Requirement: Total water requirement is 253 KLD for existing and proposed facilities. Sourced from BWSSB. (d) Soil: Total excavated soil: 39,964 Cum. 4,000 Cum will be used for backfilling and landscape development. The balance 35,964 Cum will be used for filling up low laying areas in the GKVK campus (e) Sewage: Total quantity generated: 135 KLD treated in the existing STP of design capacity of 200 KLD. (f) Solid waste: Total generated: 400 Kg/day; organic waste will be treated in organic converter. Inorganic waste of will be sent for recycling; sludge- 20 Kg/day will be used as manure. (g) Power Requirement: Total Requirement: 41 KW from BESCOM; Power Backup 2X500 KVA DG sets. Other details: Rain Water Harvesting proposed. CFE for expansion issued by KSPCB on 4.01.2011. Authorization for hazardous waste and biomedical waste handling is also obtained from KSPCB on 22.09.2011 and 30.01.2010 respectively. The subject was placed in the 75 th SEAC meeting held on 14/15.10.2011 and the subject was deferred since the circulation material was not received by some of the members and also the project proponent remained absent without prior intimation in response to the meeting notice sent. The subject was discussed in the SEAC meeting held on 6 th January 2012. The proponent present explained the project. The proponent informed that the laboratory complex is in advanced stage of construction and they have come for environmental clearance after KSPCB served notice to them. Out of 21,270 Sqm built up area 19,864 Sqm is taken up already. The Committee observed that this as a case of violation of the provision of EIA Notification, 2006. The proponent informed that the radiation exposure in R&D will be taken care of by BARC. The proponent informed that human biological research such as stemcell and brain cell and no clinical activities are done in the R&D facility. He informed that no additional water from BWS&SB is required as the existing stored water is sufficient for meeting expansion requirement. The SEAC considered this proposal as a construction project only and observed that the project proponent has to obtain the necessary approvals from the competent authorities for R&D activities.

After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent with a condition that the project proponents shall obtain necessary clearances from the competent authorities. 1. NOC from BWS&SB. 2. Plan for disposal of excess excavated earth along with MoU. 3. Calculation for energy savings. The proponent has submitted the information vide letter dated 06.02.2012. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC during the meeting held on 08.03.2012. The Authority observed that it is a case of violation of the provisions of EIA Notification, 2006. An area of 19,864 Sqm is already reported to have been built. The Authority therefore decided to get the following information, for further consideration of the proposal: (a) Explanation as to why action should not be initiated for starting the construction activity without Environmental Clearance required as per EIA Notification, 2006 (b) Submission of resolution of the Board of Directors as required under the Official Memorandum No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by Ministry of Environment and Forests, Government of India. (c) Plan for disposal of excess excavated earth with details and present land use of the site proposed to be used for disposal of the excess excavated earth. (d) NOC / sanction letter from the BWS&SB for supply of 3 lakh litres of required water. (e) Clarification as to whether the proposed site falls in the GKVK Biodiversity Heritage Site. (f) Quantification and characteristics of wastes that would be generated in the proposed activity. (g) Proposal for safe disposal of waste including plan to contain radioactive contamination. The proponent has submitted the information on 10.04.2012. The Authority perused the information submitted by the proponent during the meeting held on 09.05.2012. The Authority noted that the project has already been taken up and is in completion stage and the reason provided for taking the work without prior Environmental Clearance is unacceptable. The Authority after discussion, decided to consider the proposal after the receipt of information with regard to whether the construction activity started with plan sanctioned for an area of less than 20,000 Sqm if any. The Authority also decided to invite the proponent to the meeting. The proponent has submitted the information. The proponent has been invited to the meeting. The Authority perused the information furnished by the proponent.

The proponent remained absent. The Authority observed that the resolution of the board of directors does not spell out the reason for undertaking the construction activity without prior Environment Clearance (EC).

The Authority opined that the concern expressed by the Authority vide letter dated 16/5/2012 has not been satisfactorily addressed. The Authority after discussion decided to provide one more opportunity to the proponent for furnishing the required information for further consideration. The Authority also decided to invite the proponent to the next meeting. 4) "Sobha Classic & Classic Premium" (Earlier Classic & Signature), Residential

Apartment at Sy.No.3/1B, 3/2, 7 & 162, Haralur Village, Varthur Hobli, Bangalore South Taluk by M/s Sobha Developers Ltd. (SEIAA 36 CON 2012)
It is a proposal for Modification of Residential Apartments from 234 units to 363 units with 2 blocks A & B. Block A consists Basement, Ground floor and 13 upper floors and Block B consists Basement, Ground floor and 17 upper floors on an area of 28,110.4 Sq.m and with the total built up area of 75997.74 Sq.m. The total water requirement is 384.03 KLD and the investment is of Rs.114.56 crores. Total parking provided is for 420 cars. The project proponent had obtained Environmental Clearance from SEIAA vide file No. SEIAA 39 CON 2010 dated: 19.11.2010 for Modification and expansion of residential apartment from 234 units to 281 units in the name of Sobha Classic & Signature on a plot area of 28,110.42 Sqm and built up area of 76,078.47 Sqm. The proposed building consists of 281 units in 2 blocks A & B. Block A consists Basement, Ground floor and 13 upper floors and Block B consists Basement, Ground floor and 16 upper floors. Now the PP has again applied for Environmental Clearance with following further modification: Present Project Details: (a) Land: Total plot area: 28,110.42 Sqm; Total built up area: 75,997.74 Sqm. The proposed residential building consists of 363 units in 2 blocks (Sobha Classic & Classic Premium). Sobha Classic consists of Basement, Ground floor and 13 upper floors (with 243 units) and Classic Premium consists of Basement, Ground floor and 17 upper floors (with 120 units). (b) Greenery: Landscape area: 6493.35 Sqm (23.09% of plot area). (c) Water Requirement: Total water requirement is 384.03 KLD; Source of water: BWSSB. (d) Soil: Total excavated soil: 47547 Cum; Backfilling Quantity: 29004.72 Cum, and landscaping quantity: 1948 Cum within the project site (entire soil shall be reused within the site). (e) Sewage: Total quantity generated: 345.62 KLD, treated in proposed STP of design capacity 350 KLD; Sludge generated: 75 Kg/day used as manure. (f) Solid Waste: Total generated: 1016.55 Kg/day; Organic waste: 609.93Kg/day treated in organic waste converter and product used as manure. Inorganic waste: 406.62 Kg/day will be sent for recycling. (g) Power Requirement: Total Requirement: 3191 KVA from BESCOM; Power Backup: 2X500 KVA & 2X 750 KVA DG sets (h) Parking: 420 Numbers. Project Surrounding Details: Haralur Lake 0.1Kms, Other Details: Rain Water Harvesting is proposed.

The subject was discussed in the SEAC meeting held on 17.03.2012. The proponent and environmental consultant present explained the project. The proponent informed that the height of the building is 55 m and the road width (RoW) is 12.1 m. The Committee observed that the revised proposal does not comply with the provisions of the O.M. issued by MoEF, GoI on 7.2.2012 stipulating guidelines on high-rise building. The Committee noted that the proponent had already been issued environmental clearance to his earlier revised proposal and the change with respect to the present modified proposal is only internal. Of the 2 blocks, one block is already constructed (Block A). The other block is increased by one floor. The total built up area is decreased from 76,078.47 Sqm to 75,997.74 Sqm. The number of units is increased by 82. In view of the above fact the Committee considered the present modified proposal and decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following from the project proponent: 1. Road width (RoW) in front of the project site, height of the building, distance to the nearest fire station and NOC from Disaster Management Authority. The proponent has submitted the information vide letter dated 05.04.2012. The Authority in the meeting held on 09.05.2012, perused the information submitted by the proponent and took note of the recommendation of the SEAC. The Authority noted that the proposed modification involves increasing the height of the building that has already been cleared by the Authority by adding one more floor. But the proposal does not meet the requirement of the height criteria provided in the guidelines issued by the Ministry of Environment and Forests, Government of India vide O.M. dated 7th February 2012. The Authority after discussion decided to get the following information for further consideration: (a) Conformity to the guidelines issued by the Ministry of Environment and Forests, Government of India vide O.M. dated 7 th February 2012 in respect of height of the building, road width (Row) and distance from the nearest fire station. (b) Revised specific social commitment plan with budget, activity and time frame. The Authority also decided to invite the proponent to the meeting. The proponent has submitted the information vide letter dated 02.06.2012. proponent has been invited to the meeting. The

The Authority perused the information furnished by the proponent. The proponent appeared before the Authority and briefly explained about the project. The proponent informed the Authority that it is a proposal seeking revised Environment Clearance for expansion of the project that has been given Environment Clearance by this Authority vide letter No. SEIAA 39 CON 2010 dated 19/11/2010. The project was earlier cleared for 281 units in two blocks of 13 & 16 Upper floors with a maximum height of 61.25 meters. Now it is proposed to construct 363 units in two blocks of 13 & 17 upper floors with a maximum height of 56.25 meters. Even though an additional floor is added in the B block there is decrease in overall height as the height of individual unit have been reduced from 3.4 meters to 2.95 meters. The proponent further added that the modification is warranted due to change in the market demand.

The proponent submitted that the OM dated 7/2/2012 should not be made applicable to this project, as it has been cleared much earlier to the issuance of OM.

The Authority after discussion, decided to clear the proposal for issue of environmental clearance subject to submission of the revised social commitment plan with activity and time frame. 5) Expansion of St. John's Medical College Hospital Campus, C.B.C.I. Society for

Medical Education, St. Johns National Academy of Health Sciences at Koramangala Ward No. 67, Bangalore East Taluk, Bangalore by C.B.C.I. Society for Medical Education (SEIAA 21 CON 2011)
It is a proposal for expansion of St. John's Medical College Hospital with 5 building namely 1) College of Nursing with Ground + 1 Floors 2) Nursing residences with Ground + 4 Floors 3) Seminar Hall with Ground + 2 Floors 4) PG, Paramedics and Ladies residences with Ground + 4 Floors 5) Unit of hope with Ground+4 Floors on an area of 6,976.79 Sq.m and with the total built up area of 22,536.47 Sq.m. The total existing site area of the hospital is 2,52,575.13 Sqm and total built up area of the hospital after expansion will be 1,32,829.73 Sqm. The total water requirement is 800 KLD and the investment is of Rs.22.54 crores. Project details: Total site area: 6,976.79 Sq.m; Total Built up area: 22,536.47 Sqm; The proposed expansion involves construction of 5 building namely 1) College of Nursing, 2) Nursing residences, 3) Seminar Hall, 4) PG, Paramedics and Ladies residences, 5) Unit of hope; Water Requirement: 100 KLD from BWSSB; Sewage: proposed 500 KLD capacity STP; Power Requirement: 100 KVA; Solid Waste: 250 Kg/day collected and given to BBMP for disposal; Biomedical waste of 10 Kg/day approx) shall be collected and sent to M/s. Maradi Ecotherm for disposal; Other details: Rain water harvesting plan not submitted; the project is in construction stage. The subject was appraised in the SEAC meeting held on 20.08.2011.The proponent and environmental consultant present explained the project. The proponent informed that the expansion is coming up in the existing campus and out of 5 buildings proposed, 3 buildings are already completed and the construction of remaining 2 buildings is under progress. The Committee observed that this as a violation of the EIA Notification, 2006. The proponent informed that it is proposed to install one more 500 KLD capacity STP in addition to the existing 500 KLD STP. UGD for the project exists. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent with a condition that the proponent should pre-treat the laboratory and operation theatre waste. 1. Existing and proposed land use details. 2. MoU from the M/s. Maradi Ecotherm for disposal of biomedical waste. 3. Water balance chart for both rainy season and non rainy season.

The proponent has submitted the above information on19.10..2011. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC during the meeting held on 05.11.2011. The Authority after discussion, decided to get the following information for further consideration of the proposal: a) Clarification as to why the construction was undertaken without the EC. b) Present status of construction with latest photograph with date. c) MOU entered for disposal of Biomedical Waste. d) Clarification within 15 days as to why the file should not be closed and delisted till as a clear source of water is not established. e) Plan for scientific disposal of solid waste insitu duly marking the solid waste management area on the layout plan to ensure that no negative externality is created on the environment due to project activities. The Authority also decided to invite the proponent to the Authority meeting with all the relevant information. The proponent has submitted the information vide letter dated 18.06.2012. The proponent has been invited to the meeting. The Authority perused the information furnished by the proponent. The proponent appeared before the Authority and briefly explained about the project.

The proponent submitted that construction of five buildings each of less than 20,000 Sqm have been undertaken with the plan approved by BBMP on different dates. The proponent submitted copy of the approved plans for perusal of the Authority. The Authority noted the following details:

While replying to the query as to why the construction was undertaken without prior Environmental Clearance, the proponent submitted that they were given to understand that the Environmental Clearance is essential only when the building exceeds 20,000 Sqm Built up area. Application has been submitted to the Authority when they were advised that environment clearance is essential for total Built up area and not for individual buildings. Therefore, the commencement of the work was due to misunderstanding of the provision and not a willful violation.

The proponent informed that the project require a total of 225.6 lakh liters water of which 150 lakh liter is met from BWS&SB and 75.6 lakh liters is from existing 12 bore wells. The Authority opined that abstraction of ground water should be undertaken only with the Central Ground Water Authority and after a scientific assessment of judicious abstraction. The proponent informed that the institute got a study conducted by the Indian Institute of Science for undertaking scientific rain water harvesting.

The Authority opined that the proponent should increase the percentage of recycle and reuse of water for non potable purposes. The proponent informed that no treated waste water is let out from the premises as they have a total area of around 100 Acres with more than 3000 trees in the campus. Therefore, the excess treated water is being used for maintenance of greenery. The Authority opined to reuse the treated water as tree growth does not require daily watering.

The Authority after discussion opined that the reply furnished with regard to reason for undertaking construction without prior Environmental Clearance is at variance from that which has already been submitted.

After discussion, the Authority decided to get the following information for further consideration: a) Revised reply and written justification/ clarification with regard to the reasons for undertaking construction without prior Environmental Clearance with copies of approved plan for all the structures. b) Resolution of the Board of Directors as required under the Official Memorandum No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by Ministry of Environment and Forests, Government of India. c) Brief note with salient aspects of the study conducted by the IISc for effective rain water harvesting and improved ground water recharge. d) Present status of construction with latest photographs of each of the building. e) Permission for ground water abstraction from Central Ground Water Authority. The Authority also decided to invite the proponent to the meeting.

It is a proposal for construction of Data Centre with Ground floor (Stilt) + 6 Upper floors on an area of 16,371 Sq.m and the total built up area is 57,166.02 Sq.m The total water requirement is 90 KLD and the investment is of Rs. 100 crores. The total parking provided is for 316 cars. Project Details: (a) Land: Total plot area: 16,371.0 Sqm; Total built up area: 57,166.02 Sqm. The project consists of Ground Floor (Stilt) + Ground + 6 Upper Floors (b) Greenery: Landscape area: 2,652.10 Sqm (16.1 % of plot area). (c) Water Requirement: Total water requirement is 90 KLD; Source of water: KIADB. (d) Soil: Total excavated soil: 14,940.30 cum; Backfilling Quantity: 5,229.0 Cum and landscaping quantity: 2,241.01 Cum within the project site. Roads formation: 4482.03 cum. Other Details: Rain Water Harvesting is proposed. Level difference: 2.383 m. The subject was discussed in the SEAC meeting held on 27th & 28th April 2012. The proponent and environmental consultant present explained the project. The proponent informed that the height of the building is 28 m and the RoW in front of the project site is 15 m. The nearest fire station is 8 km away from the project site. The proponent informed that the project site is allotted to him from KIADB. The earlier owner of the project site before the allotment had already constructed the existing building without obtaining clearance as per EIA Notification, 2006. The Committee observed that this is a violation of the provisions of the EIA Notification, 2006. The Committee suggested the proponent to increase the landscape area. The proponent informed that there is no space to develop green belt and hence he may be allowed to take up compensatory afforestation in the nearby schools/parks/civic amenities area etc. The project proponent informed that the project is located along approach which connects Whitefield road. The Whitefield road connects ITPL on one side and Hoodi on the other side. The existing, projected and modified LoS of Whitefield road is B-D-D (road towards ITPL road) and B-C-C (road towards Hoodi) and the same for approach road is A-B-B. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent. 1. Letter from KIADB for water supply to the project. 2. Social commitment plan for Rs. 20 Lakhs, as committed during the meeting (letter not given)

The proponent has furnished the information. 22.05.2012. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC during the meeting held on 01.06.2012. The Authority observed that SEAC has made a note that the construction activity has started in this case and this is a case of violation of the provisions of EIA Notification, 2006. The Authority also observed that the proponent have produced a copy of the plan approved by KIADB on 15.01.2006 for a built up area of 18,554.81 Sqm. The Authority after discussion decided to get the following information for further consideration of the proposal: (a) Present status of construction with area built up and latest photographs of the project site. (b) Clarification as to why the action should not be initiated for the violation in case the area already built is more than 20,000 Sqm. The proponent informed that construction was undertaken as per the plan approved by KIADB for a built up area of 18,543.81 Sqm on 05.11.2005. The proponent submitted a copy of the approved plan for perusal of the Authority. The proponent further informed that the plan has been revised for a built up area of 57,166.02 Sqm and the revised plan has been approved by KIADB on 15.01.2006. However, due to administrative reasons the expansion programme is undertaken now and since the total built up area exceeds 20,000 Sqm they have submitted application to the Authority for Environmental Clearance. The proponent clarified that the present construction does not exceed 20,000 Sqm and therefore it should not be construed as a violation.

The Authority after discussion, decided to clear the proposal for issue of Environmental Clearance subject to submission of the following information: (a) Submission of resolution of the Board of Directors as required under the Official Memorandum No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by Ministry of Environment and Forests, Government of India delineating the reasons for undertaking the construction work without the prior Environmental Clearance. (b) Commitment made by KIADB for supply of water and present status of water supply. (c) Revised specific social commitment plan with budget, time frame and activity.

The total water requirement is 110 KLD and the investment is of Rs. 58.81 crores. The total parking provided is for 251 cars. Project Details: (a) Land: Total plot area: 11,432.27 Sqm; Total built up area: 39,826.56 Sqm. The subject was discussed in the SEAC meeting held on 10 th February 2012. The proponent present explained the project. The proponent informed that the UGD facilities are existing and NOC is obtained from BWS&SB. The proposed site is located off Sarjapur Electronic City road (Kudlu main road). The existing, projected and modified LoS for Kudlu Main road is A-A-B. However, the Committee requested the proponent to submit revised traffic management studies based on the realistic growth rate of vehicles. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent and with a condition that the excess treated water should be left to the UGD only. 1. Enhanced power savings. 2. Revised traffic management studies. 3. Social commitment plan for Rs. 5 Lakhs, as committed. The proponent has submitted the information vide letter dated 01.03.2012. (SEIAA 9 MIN 2011) The above proposals seeking Environmental Clearance for silica sand mining were considered by SEAC during the meeting held on 27.04.2012. Abstract of the proceedings of the said meeting is as below: "The subject was placed in the 74th SEAC meeting held on 16th and 17th September 2011. The Secretary, SEAC informed the committee that the above 5 proposals have been placed before the committee for discussion and explained in detail the process of silica sand mining in coastal/river areas. He informed the Committee that the silica sand mining is banned in CRZ

areas as per the CRZ Notification but may be allowed in non- CRZ areas provided the mining lease area is clearly demarcated by one of the identified agency by the Government of India. The Regional Director (Environment), Udupi, who was invited to attend this meeting to give his opinion explained the silica sand mining pertaining to ML 2203,2460,2461,2437 and 2485. He submitted to the Committee that the mining boundaries of the lease area have not been demarcated on the field; the IBM map prepared and got sanctioned by the Mines and Geology Department during 1990 is inconsistent and has not taken HTL in consideration as per the approved CZMP map; survey numbers shown in IBM plan and CZMP maps are inconsistent; the cadastral maps survey numbers do not tally with the IBM survey numbers; unless the boundaries are demarcated in the field, it is difficult to ascertain the exact mining area on the basis of IBM maps. Further, he informed that there is no silica sand in the mining lease area. The Committee was surprised to know that there is no silica sand in the mining area leased out by Department of Mines and Geology. The Committee observed that the ground reality situation needs to be verified thoroughly and get the mining area jointly inspected by the officials from Mines & Geology Dept and Regional Director (Environment), Udupi. Dr. Sriniketan, Member, SEAC, was also requested to accompany the joint inspection team. The committee also felt the need for periodical monitoring of silica sand mining in coastal areas by the concerned Regional Director (Environment). After deliberation, the Committee decided to consider these subjects in the SEAC along with the site inspection report as above and also decided to call the officials from Mines and Geology Department for the SEAC for discussion. Accordingly the proponent was informed to make arrangements for the field visit of the subcommittee vide this office letter dated 29.09.2011. The subject was placed in the 76th SEAC meeting held on 11th November 2011. The Chairman, SEAC informed that during the 74th SEAC meeting while discussing similar cases the Committee had observed that the ground reality situation of the silica sand mining area needs to be verified thoroughly and get the mining area jointly inspected by the officials from Mines & Geology Dept, Dr. Sriniketan, Member, SEAC and Regional Director (Environment), Udupi. After deliberation, the Committee decided to consider the above project also (SEIAA 8 MIN 2011) in the SEAC meeting along with the site inspection report and also to call the officials from Mines and Geology Department for the SEAC for discussion based on the report of Regional Director (Env), Udupi dated: 02.11.2011. The Committee also decided to write to all the concerned project proponents to get their project site boundary demarcated by one of the authorized agency as per the MoEF, GoI Notification. It was also decided to write to the Director, Mines & Geology Department to cooperate and send a representative for joint inspection as well as for SEAC for discussion. Accordingly the proponent was requested to get the project site boundary demarcated by one of the authorized agency identified by the MoEF, GoI Notification. The proponent was also requested to get the project jointly inspected by the subcommittee vide this office letter dated 24. 11.2011.

The subject was placed again in the 80 th SEAC meeting held on 17.03.2012. The Committee discussed in detail the above listed files (including SEIAA 1 MIN 2011 & SEIAA 2 MIN 2011) that were appraised in the previous SEAC meetings and the project proponents have been requested to get their mining area demarcated by an authorized agency identified by the MoEF, Govt. of India. The Committee noted that the project proponents have not so far submitted the demarcated maps of their area proposed for mining in spite of reminders. The Committee decided that these files may be recommended for closure to SEIAA since the project proponents have failed to submit the required information. The committee perused the proceedings of the 50th SEIAA meeting held on 05.04.2012 which was circulated to the members and the same is reproduced below: Request made by M/s Mangalore Mineral Traders and M/s Bharat Minerals and Trading Corporation dated 2nd April 2012: The Authority perused the request letters submitted by M/s Mangalore Mineral Traders and M/s Bharat Minerals and Trading Corporation dated 2nd April 2012 and noted that the State Level Expert Appraisal Committee (SEAC) has decided to get the mining area jointly inspected by the officials from Mines and Geology Department, Dr. G. Srinikethan, Member, SEAC and Regional Director (Env), Udupi in the following proposals: In the meanwhile the Committee also has decided to close the above files during the meeting held on 17th March 2012 for the reason that the proponent have not submitted the demarcated maps of the area proposed for mining and recommended to the Authority for closure. Whereas, the representation of M/s Bharat Minerals and Trading Corporation and M/s Mangalore Mineral Traders reveals that the site inspection has been done on 17 th February 2012, the details submitted by the proponent have been verified by the Regional Director (Env) and the same has been forwarded to the Special Director, Department of Ecology and Environment. The Authority observed that, when such being the case the proposals need to be appraised by the SEAC considering the information submitted as above and recommendation deemed fit needs to be submitted to the Authority. The Authority therefore decided to send the above said proposals back to SEAC for appraising these proposals in the light of the aforesaid observation and sending recommendation as deemed fit. The Secretary, SEAC informed the members that the joint inspection report from the Regional Director (Environment), Udupi dated 22.03.2012 was received by SEAC & SEIAA in April 2012 after the 80th SEAC meeting held on 17.03.2012 wherein the proposals were recommended for closure for want of required documents. He also informed the Committee that the joint inspection report is a letter signed by the Regional Director (Env), Udupi only. The proponents have submitted action taken report during the first week of March 2012 to this office and details pertaining to each of the leases were circulated vide mail to Dr. G. Srinikethan and Senior geologist, department of mines and geology, Udupi. They have agreed upon the below given report and the same is sent for further needful action at your end:1) Mining lease no: 2437: Thekkatte village: Kundapura Taluk, Udupi District. The proponent has submitted the Mining lease area superimposed on CRZ map and has indicated that out of total M.L. area sanctioned i.e. 12.34 Ha net Mining area of 7.92 Ha is available for subsequent mining. They also indicate in the letter presented to this office the modus operandi about calculating the area and mineral deposit there under. Further the proponent has given an undertaking through affidavit that an extent of area of 0.79Ha.in Sy.no.354 which is CRZ-I zone will not be disturbed for mining operation and the same will be protected by barbed wire fencing. The village accountant, Thekkatte village, Kundapura Taluk has indicated the boundaries of the said mining lease area, photographs pertaining to the M.L. boundary towards CRZ area which were fixed in the presence of village accountant are submitted for reference. They have also submitted Google map of the mining lease area. Hence with above said facts are placed for further needful action. 2) Mining lease no:2485: Kumbashi Village: Kundapura Taluk, Udupi District The proponent has submitted the Mining lease area superimposed on CRZ map and has indicated that out of total M.L. area sanctioned i.e. 10.15 Ha, net Mining area of 3.24 Ha is available for subsequent mining. They also indicate in the letter presented to this office the modus operandi about calculating the area and mineral deposit there under. Further the proponent has given an undertaking through affidavit that an extent of area of 0.25Ha.in Sy.no.247 which is in CRZ-III zone will not be disturbed for mining operation and the same will be protected by barbed wire fencing. The village accountant, Kumbhashi village, Kundapura Taluk has indicated the boundaries of the said mining lease area, photographs pertaining to the M.L. boundary towards CRZ, area which were fixed in the presence of village accountant are submitted for reference. They have also submitted Google map of the mining lease area. Hence the above said facts are placed for further needful action. 4) Mining lease no: 2461: Hejamadi Village: Udupi Taluk, Udupi District The proponent has submitted the Mining lease area superimposed on CRZ map and has indicated that out of total M.L. area sanctioned i.e. 42.57 Ha net Mining area of 6.6Ha is available for subsequent mining. They also indicate in the letter presented to this office the modus operandi about calculating the area and mineral deposits there under. Further the proponent has given an undertaking through affidavit that an extent of area of 0.17Ha, 0.78Ha, 1.38Ha and 0.78Ha respectively in sy.no 49, 151, 152 and 154 which are in CRZ-III zone and will not be disturbed for mining operations and the same will be protected by barbed wire fencing. The village accountant, Hejamadi village, Udupi Taluk has indicated the boundaries of the said mining lease area. Photographs pertaining to the M.L boundary towards CRZ area which were fixed in the presence of village accountant are submitted for reference. They have also submitted Google map of the mining lease area. They also indicate in the letter presented to this office the modus operandi about calculating the area and deposit there under. Further the proponent has given an undertaking through affidavit that an extent of area of 0.04 Ha in sy.no 13 and 14, 0.16Ha in sy.nos. 22, 23 and 24, 1.04Ha in sy.nos. 135, 137, 138 and 139, 0.06Ha in sy. nos. 146 and 147, 0.04 Ha in sy.no. 151, which are in CRZ-III zone will not be disturbed for mining operations and the same will be protected by barbed wire fencing. The village accountant, Kotathattu, Udupi Taluk has indicated the boundaries of the said mining lease area. Photographs pertaining to the M.L. boundary towards CRZ area which were fixed in the presence of village accountant are submitted for reference. They have also submitted Google map of the mining lease area. Hence the above said facts are placed for further needful action. The Committee in the meeting held on 27.04.2012, discussed in detail the joint inspection report as well as the information submitted by the project proponent to the Regional Director (Env), Udupi. The Secretary, SEAC informed the committee that the project proponent have not submitted the project site boundaries identified by an authorized agency identified by the MoEF, GoI as per the decision taken in the 80th SEAC meeting held on 17.03.2012 but they have submitted the report of M/s. Metamorphosis consultants based on the superimposition of the CRZ map and the village map of the project area (M.L. area) along with GPS reading. The committee noted that the proponent have submitted an affidavit stating that the area falling within the CRZ zone will not be disturbed by mining operation and will be protected with proper fencing by barbed wire. The Secretary, SEAC informed the Committee that the proponents have submitted the photographs of the boundary pillars/survey numbers signed by the village accountant only.

The Committee after deliberation decided to recommend the above listed files for SEIAA for environmental clearance with the condition that the project proponents have to confine their mining activities only in the non-CRZ area." The Authority perused the proposals and took note of the recommendation of the SEAC during the meeting held on 01.06.2012. The Authority opined that in view of the fact that some of the area falling in CRZ have been suggested to be deleted from the mining plan. It is therefore necessary to have a revised mining plan with estimate of reserve in the non CRZ area available for mining without affecting the local environment. The Authority therefore decided to get the following information for further consideration of the proposals: (a) Leasewise map / mining sketch of the non CRZ area available for mining duly marking it on the local level CRZ map. (b) Revised estimate carried out by a technical person in accordance with the law of mineral deposit in the non CRZ area. (c) Revised mining plan for the non CRZ area available for mining. The Authority also decided to invite the proponents. The proponents have furnished the information vide letter dated 30.06.2012. The proponents have been invited to the meeting. The Authority perused the information furnished by the proponent. The proponents appeared before the Authority and briefly explained about the project. The proponents submitted that the sub-committee of the SEAC visited the spot and after verifying the details of the lease area and super imposing the same on the local level CRZ map suggested that the area falling in CRZ should be excluded from the mining area as mining of sand is a prohibited activity as per CRZ Notification, 1991/2011. The proponents submitted M.L.wise lease area excluding the CRZ area. The proponents also submitted that they do not undertake mining in the areas in and around hutments, agriculture/ horticulture fields, even though it contains sand availability.

The Authority perused the information with regard to ore reserve as per the IBM approved plan, balance ore available, available mining lease period, the proposed production rate and decided the sustainable quantity of sand that can be extracted in each of the mining lease. The proponent informed that height of the building is 27m and the RoW of the existing road in front of the project site is 12.99m. The fire station is 3 km away from the project site. The committee observed that the project does not comply with the provisions of the O.M. dated 07.02.2012 decided to give 30 days time to the project proponent to submit revised proposal (if he is willing, otherwise the proposal can be recommended to SEIAA for closure) in Form 1 & 1A.

KIADB/15869/2030 / 2012-13 dated 16.05.2012 has informed that the existing 13m road will be widened to 15m, out of the land allotted in their favour , the adjacent land allotted in favour of Sri. Munireddy, and the land which has been acquired & held by the Board. Further the proponent has submitted revised proposal in Form 1 & 1A along with EMP and STP report on 24.05.2012. The proponent informed that the nearest water body is bellandur Lake and is 1 km from the project site. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent: 1. Enhanced landscape plan with more number of local flower and fruit bearing trees. 2. Enhanced energy saving. 3. Dated peak hour traffic density photographs. 4. The Committee did not further appraise the project because of this non compliance of the O.M. The total water requirement is 150 KLD and the investment is of Rs. 30 crores. The total parking provided is for 272 cars. Project details: Total site area: 5,819.50 Sqm. The project consists of commercial building with retails, shops, business, mall and hotel with 146 rooms in 3 basement + ground floor + 12 upper floors + terrace floor. Solid Waste: Total 348.6 Kgs/day generate out of which 139.44 KG/day of organic waste will be converted to organic manure; 209.16 Kg/day of inorganic waste will be disposed to authorized recyclers and BBMP; STP sludge will be used as manure within the premises; Excess earth: The quantity of excavated earth material as estimated around 60,000 cum will be reused/recycled for back filling/fill-up the low lying areas/ sub base work for roads & pavements within the project site. The proponent and environmental consultant present explained the project. The proponent informed the following points before the Committee. Greenbelt coverage is only 26% which is less than 33 % suggested. The excess water of 26 KLD is used for HVAC as it is commercial complex. The excess earth is utilized on their own land.

The traffic expert informed that the existing LoS for the T.Mariyappa Road is C & the same for modified & projected is D - D.

The Committee suggested to enhancing the landscape coverage on earth by reducing surface parking and re-submit the landscape plan. After deliberation, the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent. 1. Rework on enhancement of landscape area. 2. Rework on the water balance chart with calculation. 3. Social commitment plan for Rs. 5 Lakhs, as committed. The proponent has furnished the information on 11.08.2011. The Authority perused the information submitted by the proponent and took note of the recommendation of the SEAC during the meeting held on 26.08.2011. The Authority observed that the proposed project site is located in fully developed area. However the details of existing structures in the proposed site are not forthcoming from the proposal. The Authority further noted that the proposal involves excavation for three basements which requires abundant precaution and safety measures to the adjacent/abutting buildings and the same is not forthcoming from the proposal. After discussion the Authority decided to get the following information for further consideration: (a) Details of the existing structures in the proposed project site. (b) Details of demolition if any and proposal of safe disposal of debris along with details of the land proposed to be used for such disposal. (c) Plan for safety of the structures in the adjacent plot as it involves excavation upto three basements. (d) Measures proposed to ensure normal air circulation and cross ventilation in 3 basements proposed. (e) Emergency Evacuation plan based on National norms. (f) Impact on traffic and internal circulation due to proposed mall activities is in already congested areas. The Authority also decided to invite the proponent to the meeting of the Authority. The proponent has furnished the information on 30.01.2012. The proponent was invited to the Authority meeting. The Authority perused the information furnished by the proponent in its meeting dated 08.03.2012. The proponent appeared before the Authority and explained briefly about the project. The Authority observed that the proponent have taken almost five months time to furnish the reply and sought to know the reason for this inordinate delay. While replying the proponent submitted that there was slump in the market and therefore it was not actively considered. He

further submitted that now they want to pursue the matter with regard to Environmental Clearance. While examining the proposal the Authority observed that the reply furnished to the queries raised by the Authority is very sketchy and have not answered basic questions. In reply to safety norms the details of the measures proposed by the proponent are not furnished. The proponent while responding with regard to the safety aspects of the neighbouring structures in view of the excavation for the proposed three basements, informed that they have planned sheet piling to ensure safety of the adjacent buildings. The proponent further stated that neighbouring structures are far of and have a least distance of 500 meters from the area proposed to be excavated and therefore not much of impact is anticipated. The Authority opined that no information on angle of repose of soil is provided and the reply is vague without details on distance on each building. As the project site is located amidst a fully developed area and the structures are quite old this needs a scientific and technical assessment. After discussion, the Authority decided to send the proposal back to SEAC to appraise the proposal in the light of O.M. No. 21-270/2008- IA.III dated 7th February 2012 issued by the Ministry of Environment and Forests, Government of India with the following additional information: i) Adequacy of safety measures proposed for excavation with angle of repose of soil. ii) Emergency evacuation plan proposed including the details of facilities and action plan. iii) Details of parking facility worked out based on MoEF guidelines along with facility for parking of buses and trucks. iv) Proposal for service road is a must as direct entry from the proposed commercial complex would affect the traffic on the public road. v) Modification of the layout plan incorporating the criteria laid down by the Ministry of Environment and Forests, Government of India vide Official Memorandum No. 21-270/2008- IA.III dated 7th February 2012 and with internal roads of appropriate width. vi) Proposal for in-house scientific management and disposal of solid waste including adoption of bio-converter, as handing over the waste to the BBMP would create an additional negative externality on the environment. vii) Details of land proposed to be used for disposal of demolition debris and excess excavated earth with the present land use and ownership. viii) Proposal for increasing the greenbelt to at least 33%. ix) Distance from the nearest fire station. The subject was placed in the 82 nd SEAC meeting held on 27/28.04.2012 and the Committee discussed the decision of the SEIAA proceedings dated 08.03.2012 and decided to obtain details as per O. M. dated 07.02.2012 and the additional information sought by the SEIAA from the project proponent.

Accordingly the proponent has submitted his replies on 18.05.2012 in response to this office letter dated 14.05.2012. The height of the proposed building is 27.3 m and the RoW of the existing road in front of the project site is 15.10 m and the nearest Fire Station is at a distance of 3.5 km away from the project site (also submitted vide letter dated 24.05.2012) The Committee perused the replies furnished by the project proponent and accepted the same in the meeting held on 26th May 2012. After deliberations decided to recommend the proposal to SEIAA for issue of environmental clearance. The Authority perused the proposal and took note of the recommendation of the SEAC. The Authority opined that the critical issues that have been raised by the Authority have not been addressed / commented by the SEAC. No critical analysis of the information submitted by the proponent is forthcoming from the proceedings. The Authority opined that the replies submitted by the proponent are not acceptable and convincing, considering the location of the project. The Authority after discussion, decided to get the following information for further consideration: (a) Site specific safety measures proposed for excavation for three basements. (b) Safety and ventilation in the basement area. (c) Provision for service road without which the project would create traffic problem in the public road as it is a project of multiple activities and is proposed already in congested area. (d) Emergency evacuation plan proposed including the details of facilities and action plan. (e) Plan for increasing the greenery to at least 33%. The Authority also decided to invite the proponent to the meeting.

The proponent and environmental consultant present explained the project during the SEAC meeting held on 22/23.06.2012. The proponent informed that the height of the proposed building is 44.98 m and RoW of 18.10 m in front of the project site; the nearest Fire Station is at a distance of 5 km. The level difference in the project site is 2.23 m. The UGD is existing. The proponent informed that a nallah passes adjoining the project site and a buffer of 15 m width is left. The project is located along Bellandur road which connects to ORR. The ORR connects Bellandur on one side and Sarjapur on the other side. It is a proposal for construction of IT Blocks and Hotel (115 rooms) with Lower Basement+ Upper Basement + Ground + 7 Upper floors +Terrace & Club house with Ground floor on an area of 11027 Sq.m and with the total built up area of 43775.18 Sq.m. The total water requirement is 181 KLD and the investment is of Rs. 52.11 crores. The total parking provided is for 420 cars. The subject was placed in the 50th SEIAA meeting held on 05.04.2012 and the representation of Submitted by Sai Srushti Developers Pvt. Ltd. dated 21st March 2012 was placed before the Authority. The Authority noted that the proponent have requested the proposal in File No. SEIAA 238 CON 2008. The Authority further noted that the said proposal was recommended by the SEAC for issue of EC subject to submission of certain information during the meeting held on 30.5.2009. Subsequently as the proponent submitted vide letter dated 15th December 2010 that due to market conditions the project is being revised and considering this letter, the SEAC during the meeting held on 8th April 2011 has recommended for closure of the file. The Authority subsequently has closed the file and an intimation to the proponent vide letter dated 30.6.2011. Considering request made by the proponent to reconsider the issue as the project is not being modified, the authority decided to refer it to SEAC for appraisal & making necessary recommendation. The subject was placed in the 82 nd SEAC meeting held on 27/28.04.2012 and the Committee discussed the above decision of the SEIAA proceedings. The Committee observed that the earlier proposal for IT & Hotel project was recommend to SEIAA for environmental clearance in the 35th SEAC meeting held on 30.05.2009 subject to submission of certain documents/details. However, the proponent vide letter dated 21.03.2012 has informed the Authority that there is no change in his original proposal from IT & hotel project to IT & Residential Project (74 Apartments) and the same is to be reconsidered for environmental clearance. The Committee observed that the noise level test report submitted in more than 2 years old and the borewell water analysis report submitted is 3 years old (vide letter dated 02.02.2010 of the project proponent). Further the social commitment plan submitted does not indicate the environmental cause. The Committee after deliberation decided to recall the proponent for presentation after obtaining the latest test reports and revised social commitment plan on environmental cause from the proponent. The proponent has submitted the information on 25.05.2012 with response to this office letter dated: 14.05.2012.

The total water requirement is 156 KLD and the investment is of Rs. 24 crores. The total parking provided is for 250 cars. The Authority noted that the proposal in File No. SEIAA 10 CON 2011 pertaining to Environment Clearance for construction of Residential Apartments at Devarachikkanahalli stands recommended by SEAC for issue of Environment Clearance during meeting held on 17th & 18th June 2011 subject to submission of certain information. Subsequently the committee during meeting held on 9th & 10th February 2012 have recommended for closure of the said file as the required information has not been furnished. Pursuant to their recommendation of SEAC the Authority have closed the file and the proponent have been intimated vide letter dated 16.3.2012. The Authority noted that the proponent vide letter addressed to the Secretary SEAC on 24.11.2011 have submitted the details. Considering the request made by the proponent to consider the proposal for issue of EC as the delay in submitting NOC from BWS&SB is due to financial constraints, the Authority decided to refer the file back to SEAC along with the representation for appraisal & making necessary recommendation. The subject was placed in the 82nd SEAC meeting held on 27/28.04.2012 and the Committee discussed the above decision of the SEIAA proceedings. The Committee observed that the proponent in response to this office letter dated 16.11.2011 has not submitted (i) the Landscape details showing greenery marked on the site plan and the local names of the trees proposed. (ii) the NOC from BWS&SB and is only a correspondence letter between the Additional Chief Engineer (CMC) and Executive Engineer, BWS&SB dated 17.03.2010. (iii) the social commitment plan with commitment towards environmental cause and he has submitted a commitment for donation to a village school/orphanage. Ltd., have applied for EC for their newly proposed development of barge/vessel loading facility at Coastal Sand Spit (25 Hectares) (without RS No.) Kasarakod Tonka, Honnavar Taluk, Uttarakannada District under activity 7 (e) of EIA Notification, 2006 schedule under category B (General condition apply) requiring EC from SEIAA. Proposed Barge/Vessel loading facility at Honnavar will handle 4.5 MTPA of cargo volume in which 3.0 MTPA of iron ore and 1.5 MTPA of thermal coal. It is proposed to develop straight berth with length of 440 m with the backup area of 25 Hectares. The proposed project attracts CRZ Notification, 2011 for their foreshore facilities. The project involves construction activities namely: breakwaters (southern break water: 880 m and Northern break water: 755 m), berths (440 m long, 16m wide), dredging, approach channel [length of approach channel :1345m, width of the channel -75 m and depth of the channel : (-) 4.6 m CD], Turning circle (diameter of the turning circle -200 m, dredged to a depth of 4.6m), reclamation, internal road/rail network, external road/rail network, cargo storage and handling facilities, utilities, amenities and services. The project also involves reclamation works carried out in the backup area for providing landslide facilities about 0.5 million cum of material will be used for reclamation. Dredging will be carried out at berthing area, turning circle, approach channel. The estimated dredging quantity is about 0.55 million m3. Stockyard will be provided for storage of coal and iron ore. New rail and road will be proposed to transport the cargo from the

Water requirement: construction phase: 15 KLD; operation phase: 7 KLD (raw water requirement will be sourced from Karnataka Rural Water Supply and Sanitation Agency which includes supply to Barge/vessels, port staff and users. In addition to that the water required for dust suppression system and fire fighting will be sourced from Sharavathi River. Power Requirement: 1 MVA sourced from Honnavar Substations (KSEB); Sewage: Treated in STP proposed. Sewage sludge from the STP shall be utilized in the green belt area. Sludge generated from oil water separator will be disposed off as per Karnataka Pollution Control Board/CPCB guidelines or norms. Project Surrounding details: Reserve Forest-14 Km, Minor Forest-10 Km, Ecology (mangroves) 2 Km; Arabian Sea adjoining west. Hospital and educational institutions are located within 1.5 Kms of the project site. The project site falls in seismic zone III (moderate risk); Other Details: the proponent has submitted proposed ToRs. The subject was placed in the 73rd SEAC meeting held on 20.08.2011 and the project proponent and environmental consultant present explained the proposed ToRs for EIA as per the EIA Notification. He informed that Directorate of P&IWTD has signed lease agreement with HPPL. Alternative analysis done with the present proposal found viable to develop barge/vessel facility. Barth of length 440 m is proposed to handle 4 barge/vessels of 5,000 T simultaneously. The consultant informed that erosion and accredition on the sea side is there along with spit formation. Bathymetry studies done for 10 years, 5 years and recent. The project is connected to sea port at Karwar 60 Km away. The proponent informed that the dredged material is used for reclamation purpose. The Committee observed that the project attracts provision of CRZ Notification, January 2011 of MoEF for its foreshore facilities. After deliberation, the Committee decided to categorize the project under B1 and to issue additional ToRs along with the model ToRs for the preparation of EIA along with the public consultation by the proponent addressing the following issues. 1. 2. 3. 4. The proponent informed that the proposed facility was planned earlier to handle 4.5 MTPA (3 MTPA of iron ore and 1.5 MTPA of coal). In the later stages due to prohibition on export of iron ore, the handling capacity is enhanced to 4.9 MTPA (2.7 MTPA of coal, 1 MTPA of iron ore and 1.2 MTPA of General Cargos) and accordingly EIA report has been submitted vide letter dated 29.02.2012 in continuation of letter dated 15.02.2012. was held on 27.01.2012. They have applied for CRZ clearance before KSCZMA and seek environmental clearance from SEIAA first. The Committee observed that the EIA study submitted does not address points (2) to (5) of the additional ToRs proposed by the Committee. River quality studies have not been done since project is located near the estuary and dissolved oxygen depends on the salinity. Salinity intrusion at the nearest intake in Sharavathi River is to be given. The list of plants provided in the landscape plan is not specific as the entire project is located in mangrove area. The Committee decided to get the site inspected on 31.03.2012 by a sub committee consisting of the SEAC members namely Dr. G. Srinikethan, Dr. Manoj Kumar, Dr. C. G. Kushalappa, Dr. Bela Zutshi and Dr. Usha. N. Murthy as the project is first of its kind in the state. The site inspection will mainly focus on the (1) Location of the project with respect to salinity and its impact on flora and fauna (2) Identification of mangroves in backwaters and the impact of the project on the flora and fauna in the mangroves (3) Impact of the project on marine life. After deliberation, the Committee decided to recall the proponent for presentation after obtaining the following information from the proponent with site inspection report from the subcommittee. 1. Details of materials proposed to be imported. 2. Breeding season of fish and their abundance. 3. Identification of mangroves in backwaters and the impact of the project on the flora and fauna in the mangroves. 4. Impact of dredging on fish breeding and the juveniles. 5. River quality studies. 6. Salinity intrusion at the nearest intake in Sharavathi River. 7. Social commitment plan for Rs. 1.5 Crores/year for 5 years (letter not given). The project proponent has submitted his replies on 03.04.2012 in response to this office letter dated: 29.03.2012. The subject was placed in the 81st SEAC meeting held on 07.04.2012 and the subcommittee members submitted the site inspection report and the same is reproduced as below: Report of site inspection to Honnavar Port by SEAC team members on 31-3-2012. During site visit the experts present from consultant side did not give convincing response for the queries made by subcommittee members. Following are the observations made during the visit for which an elaborative study needs to be done before the project is considered for appraisal. 1. Basis for selection of the site port need to be clarified and if any alternative sites were considered is not clear. The proposed site is in the sea and does not have a survey number. Proponent informed that revenue department will provide the survey number soon and this issue is crucial since clearance cannot be provided to a site without survey number. 2. Since the area is under CRZ examination needs to be undertaken to see if the proposal has to be presented for CRZ review committee and get clearance for the proposed activity. 3. For any accidental spills model studies needs to be undertaken for river and sea. 4. Consultant present did not give satisfactory answer for the values and parameters selection reported in water quality results and hence to be reworked. 5. Consultant did not provide justification for site selection for monitoring of air, noise and water quality- It was also found that critical and sensitive areas like islands with habitation were not considered for monitoring. Give the details of tidal wave studies. 6. Typical input data and output result for all models used in EIA needs to be reported Data used for the model need to be elaborated and any assumptions and limitations made to be provided in the report. 7. Water intake location for use by the workers for proposed project and existing water quality & changes expected near the intake due to the proposed activity along with details of other competitive users near the location to be provided. 8. Salinity measurements in the estuarine/ river portion to be studied in detail and impact of proposed activities on salinity intrusions towards river/ estuarine side needs to be predicted. 9. Water quality studies in critical areas of Sharavathi and other river need to be undertaken. 10. For air modeling studies impact of line sources (road/ rail/ ship movement) needs to be included. 11. Impact studies for proposed road and railway line on local environment needs to be undertaken. 12. Since the dredged material will be dumped into sea its impact on marine ecology needs to be undertaken. 13. For wastewater generated in the proposed activity a sewage treatment system to be proposed. 14. Some of the critical and sensitive areas were identified during site visit (island of Mavinkurve, Mangroves near road bridge, inland travel) for which impact studies need to be undertaken. 15. The report submitted by experts and forest officers to the Deputy Commissioner on coastal erosion in Pavinkurve area which is within the project area has to be taken into consideration before issuing clearance. Comments on ecological issues: 1. The ToR was approved during September 2011 but baseline marine and terrestrial studies were undertaken from March to May 2011 and the three month study is too short a period to assess the impact of a project on this magnitude on the ecology, environment and livelihood of communities. Post monsoon data is not included in the report. As indicated

by some of the participants in the public hearing local resource persons were not involved in undertaking studies and hence many critical issues have not been addressed properly. 2. Under environmentally sensitive areas within 10 km from site boundary which are used by protected, important or sensitive species of flora or fauna for breeding, nesting, foraging, nesting, overwintering, migration there is no mention about the following : i. Mangrove formations in the estuary, which are protected under CRZ Notificationunder Zone-1, as inviolable areas not mentioned. The report mentions considerable area under mangroves in the land use details within the project impact area but no details are provided regarding the number and extent of mangroves upstream the two rivers. ii. Over 100 species of birds are associated with the estuary, of which at least 40% are migrants from northern latitudes that arrive for over-wintering. The details of resident birds breeding in the estuary and surroundings is not mentioned. The estuary and mudflats and marshy islands provide abundant feeding grounds for the birds and numerous fishes and other organisms and impact on these habitats is not provide. Hence impact of the proposed project on avifauna needs to be redone involving local experts. iii. Sharavathi River has 64 species fresh water fishes including the newly described Batasio Sharavatiensis an endangered fish and additionally there are many rare, endangered and threatened fishes from the project impact area. Fishes reported from study area largely ignores the estuarine fish of Sharavathi, which are very unique and is important source of livelihoods of many and a good trade of which is carried out. The list given is just a general list of marine fishes. Hence detailed study of the fish resources, impacts of the project on their population and livelihood of locals need to be undertaken involving local experts. 3. The floristic inventory provided is based on secondary data which lists 286 plants from the district but the district has close to 2000 plants of which around 1200 could be present in Honnavar Taluk. Rather than providing general check list for the entire district detailed plant inventory from the project impact area needs to be provided by local experts focusing on plant diversity in the different forest types mentioned in the land use especially mangroves and estuarial plants. 4. Under areas containing important high quality or scarce resources only reserved forest 14 km away mentioned but there is reserve forests within 1km in Kasarkod and a forest nursery . Basavadurga Island is also located located within the project core area with good vegetation cover. Sharavathi estuary is a near pristine ecosystem of largely fresh water that is present from Mavinkurve island towards inteior and also along Badagani river. Such unique habitats of low salinity to fresh water conditons do not exist in other coastal estuarine areas. Studies undertaken is too short and hence the studies realted to impact of the project on the unique marine flora and fauna is not exhaustive. Hence a detailed study needs to be undertaken invloving local experts to address these issues. The proponent and consultants have agreed to undertake studies based on the suggestions provided by the committee during the site visit. The subcommittee informed the Committee that the project is coming up in reclaimed land formed due to accretion in water. The survey numbers of the port land is required for environmental clearance appraisal. The proponent has informed that survey is going on in the

project area. The proponent needs to submit the survey numbers officially. There are several lacunas in the project proposal such as: Salinity not measured. Basis for fixing air sampling stations. Model studies have to be done by CWPRS for tidal influence. Flora/fauna and mangrove have not been done. ToR issued in September 2011 and EIA submitted in March 2012. There is no post monsoon study. Environmental clearance can be considered based on CRZ clearance by KCZMA. The Committee noted that the ToRs for the preparation of the EIA by the proponent were issued based on the model ToRs published by M/s. ASCI assigned by MoEF, GoI for preparation of EIA guidelines/manual. The Secretary, SEAC informed the Committee that proponent has made application for CRZ clearance before KCZMA and the same will be placed in the next meeting of KCZMA wherein the Regional Director (Environmental) will be present. The Committee after deliberations decided to obtain the details/documents as per the inspection report submitted by the subcommittee from the project proponent and recall the proponent for presentation in the SEAC meeting. The proponent has submitted the information on 10.05.2012 in response to this office letter dated: 10.04.2012. The proponent and environmental consultant present explained the queries raised by the Committee during the SEAC meeting held on 25/26.05.2012. The proponent informed that survey of the project site is already completed and the list of survey numbers will be submitted to the Committee. The proponent informed further that the subject is placed before the KSCZMA on 28.05.2012 for consideration for CRZ clearance. After deliberation the Committee decided to recommend the proposal to SEIAA for issue of environmental clearance after obtaining the following information from the proponent and subject to the condition that the project proponent obtains CRZ clearance. 1. Copy of the Revenue Department letter regarding survey numbers. . 2. Traffic impact on the landward side from the project. 3. Impact of the project on the riverine habited Island. 4. Incorporation of the already published data on the project area (if available). The proponent has submitted the above information on 19.06.2012 . The Authority perused the reply submitted by the proponent and took note of the recommendation of the SEAC. The Authority also noted that the project has been recommended by the Karnataka State Coastal Zone Management Authority during the meeting held on 28.05.2012. The Authority further observed that the establishment of the project is linked to the measures to be proposed by Central Water and Power Research Station (CWPRS), Pune. The Authority also opined that this being a harbour project certain issues pertaining to impact of breakwater, disposal of dredged material, etc require clarity. The Authority therefore decided to get the following information for further consideration of the project.

It is a project proposal for Pink Granite Quarrying with the production of 2275 cum/annum. Total land area 1.62 Ha in patta land. The investment of Rs. 485 lakhs. M/s. Sree Rahavendra Enterprises have applied for EC for their proposed new Pink Granite Quarry in 1.214 Ha extent (Quarry Lease No.604) at Sy. No. 28/2, Purtigeri Village, Kushtagi Taluk, Koppal District under Sl.No 1(a) of schedule of EIA Notification, 2006 under category-B read with OM dated 18.5.2012. Land conversion from agricultural to non agricultural purpose (Mining) is obtained from DC. The envisaged capacity of quarry is 2275 cum/annum. Total Geological Reserve: 1,60,375 cum; Total Mineable Reserve: 47,549 cum. Quarry Lease is under renewal process with Department of Mines and Geology since the earlier Lease validity has expired on 13.03.2012 . The proponent has submitted Pre Feasibility Report and Environmental Management Plan (EMP). The NOC from revenue department for grant of renewal dated 02.01.2012 and conversion for non-agricultural purpose is furnished and other documents as required are also submitted. Project details: Land: Mining Lease area; 1.214 Ha Patta Land (Non agricultural-Barren). Excavation area: 0.950 acres; Green Belt: 0.030 Acres; Water: Total water requirement: 5 KLD, sourced from Borewells. Solid Waste: Total generated during the plan period: 975 cum/annum. Purtigeri is 0.60 km away from the project site. The subject was discussed in the SEAC meeting held on 22 nd & 23rd June 2012. The proponent and environmental consultant present explained the project and environmental management plan. The proponent informed that quarrying lease will be considered for renewal only after environmental clearance is obtained for the project. He also informed that environmental protection fee of Rs. 84,000/ Ha has been paid. The proponent requested for B2 category for the following justification: 1. The proposed quarrying is a small scale open cast quarrying without deep hole drilling and blasting with very less over burden. The granite production is only 2275 cum/year. 2. It is a project proposal for Multi Colour Granite Quarrying with the production of 3100 cum/annum. Total land area 1.62 Ha in Government Revenue land. The investment of Rs. 100 lakhs. M/s. Prabhat Granite Private Limited has applied for environmental clearance for expansion from SEIAA for Quarrying Multi-color Granite of production 3100cum/year at Quarry Lease No.282 over an extent of 1.62 Ha (4.00 Acres), Sy. No. 53 of Achalu Village, Kanakapura Taluk, Ramanagara district. The project comes under (Category-B/Semimechanized/Non-Forest/Revenue. The quarrying is by open cast method. The cost of the project is Rs. 1.00 Crore. The proposal has been referred to SEIAA by Honble Supreme Court of India in its order dated 16.04.2012 followed by MoEF Office Memorandum (O.M) dated 18.05.2012. The project requires EC under Schedule 1 (a) of EIA Notification, 2006 read with the said O.M. It is proposed to extract granite using drilling and wire saw cutting. The validity of the lease has expired on 11.01.2009. The renewal of lease is presently under process subject to submission of quarrying plan & Environment Clearance. Quarrying plan prepared under the provisions of Rule 18(3) of Karnataka Minor Mineral Concession Rules, 1994 is submitted to Director, Department of Mines & Geology for approval. Abstract of the proceedings of the SEAC meeting dated 25.05.2012 is as follows: "The Committee noted that the proponent has remained absent without pre-information in spite of the meeting notice clearly mentioning that his proposal would be recommended for closure if he absented for the third time. Accordingly the Committee decided to recommend the proposal to SEIAA for closure." It is a proposal for establishment of iron ore beneficiation plant of capacity 90,000 TPA at Sy. No. 121/1B, 18-Hulikunte, Sandur Taluk, Bellary District by M/s. Zest Enterprises. The issue was considered by the Authority in File No. SEIAA 52 IND 2010 and EC has been issued on 10th October 2011. The proponent vide letter dated 8th June 2012 and 14th June 2012 have informed that the name of Zest Enterprises is now changed as a Private Limited company under the name of Zest Ferro Beneficiation Pvt. Ltd. The proponent therefore have requested for change of Environmental Clearance in the new name of the company. Para 11 of the EIA Notification, 2006 reads as follows: "11. Transferability of Environmental Clearance (EC):

A prior environmental clearance granted for a specific project or activity to an applicant may be transferred during its validity to another legal person entitled to undertake the project or activity on application by the transferor, or by the transferee with a written no objection by the transferor, to, and by the regulatory authority concerned, on the same terms and conditions under which the prior environmental clearance was initially granted, and for the same validity period. No reference to the Expert Appraisal Committee or State Level Expert Appraisal Committee concerned is necessary in such cases." The Authority after considering the request decided to issue a letter transferring the Environmental Clearance issued in favour of M/s Zest Enterprises in the name of Zest Ferro Beneficiation Pvt. Ltd. as EIA Notification, 2006 provides for the same.

Residential Apartment, Sy.No.25/4, Nayandahali, Kengeri Hobli, Bangalore South Taluk by M/s G.R.C. Infra Pvt. Ltd. (SEIAA 86 CON 2010)

It is a proposal for construction of Residential Apartment of 482 units with 4 Blocks with Basement + Ground + 15 Upper Floors on a plot area of 19,525.773 Sqm and total built up area of 63,364 Sqm. The water requirement is 360 KLD and investment is ` 113.61 crores. The parking provided is for 525 cars. Based on the recommendation of the SEAC, the proposal was considered by the Authority during the meeting held on 10.02.2011. The Authority decided to issue Environmental Clearance subject to submission of the following information: (a) NoC from the BWS&SB. (b) Details of excavated earth and disposal of excess earth duly marking the disposal site on the map. (c) Revised social commitment plan with emphasis to assist Akshaya Patra or assistance to institutions working for welfare of physically/mentally challenged children The proponent have submitted the information sought except NOC from BWS&SB. The subject was placed before the Authority for further decision. The Authority during the meeting held on 17.06.2011 perused the proposal. After discussion, the Authority decided to provide a last opportunity with a minimum of 30 days time and fixing up a last date of submission of such information sought. Action may be initiated as per the earlier decision if the information is received, if not the file may be processed and placed before the Authority for closure. The proponent have requested vide letter dated 18.07.2011 for three months time to furnish documents/details as there is some revision/changes in the joint Development Agreement. The Authority perused the letter submitted by the proponent in the meeting held on 26.08.2011 and noted the proponent have sought three months time to submit the information sought. The Authority opined that sufficient opportunity have been provided for submission of the required information, if the information is not received, there is no point in keeping such files which will add to the pendency at the Authority indefinitely. The Authority therefore decided to

close the file and intimate the proponent to apply afresh following the due procedure of law if they are interested to take the project forward. The Authority perused the letter of the proponent dated 04.07.2012 and NOC issued by the BWS&SB on 29.06.2012 for supply of water. The Authority also noted that the proponent has already submitted other information sought by the Authority. The Authority decided to re-open the file as the required information is submitted and decided to issue Environmental Clearance as per the decision taken during the meeting held on 10.02.2011.
