This matter comes before the court for trial. The city appears by city attorney Colin McCullough. Defendant does not appear nor anyone on her behalf. Testifying on behalf of the city were officer Brian Mentzer, Carole Conger and Donald Widajewski. Based on the evidence presented the court fineds that the city has proven the defendant's guilt beyond a reasonable doubt on the charges of allowing a dog to run at large in violation of city code section 56.06 and harboring a vicious dog in violation of city code section 55.10. The court senctence defendant to pay fines of $100.00 plus $35.00 surcharge on each count and to pay the court costs. All amounts due shall be paid by no later than December 6, 2013 or defendant shall appear and show cause on December 9, 2013 at 10:00 a.m. Additionally, if the dog has not been removed from the city the officers may take possession of the dog and dispose of it.
