JUDICIAL AFFIDAVIT OF CRISTINE MOLETH T. CORDON

This Judicial Affidavit of Cristine Moleth Turingan Cordon, the petitioner, is executed to serve as her direct testimony in the instant case. This Judicial Affidavit is being offered to prove: A) All the allegations in the Petition including all annexes appended thereto and which were already marked as exhibits during the Pre-Trial of this case; B) All other related matters, facts and circumstances relevant and material to this case.

This Judicial Affidavit was taken at the office of Atty. Atty. Kristine D. Balagan at No. 72 A Bonifacio St. Tuguegarao City, Cagayan. Questions were propounded by her counsel, Atty. Kristine D. Balagan. These questions are numbered consecutively and each question is followed by the answer of the witness. 1. Please state your name, age, marital status, and address.

--- I am Cristine Moleth Turingan Cordon, 36 years old, married, and residing at Apple St., Pengue Ruyu, Tuguegarao City. 2. Are you the same Cristine Moleth Turingan Cordon, the petitioner in this case? ---Yes. 3. Do you know the respondent in this case, Ms. Jenevic P. Romero? ---Yes, she is a family friend and a neighbor. 4. What prompted you to file a case against Ms. Jenevic Romero? --- Atty., Ms. Jenevic Romero is indebted to me an amount of three hundred pesos (Php300, 000). Payable for two years, but she failed to pay the principal and interest. 5. Is she married? ---No, Atty. 6. When did she borrow the said amount? --- September 25, 2007. 7. What is your agreement regarding the payment? --- On the said date, I gave her three hundred pesos (Php300, 000) in cash for her placement fee because she is applying for work abroad. We agreed that said amount shall be payable within two years with 6% annual interest. 8. So the debt is due on September 25, 2009. Did she pay the amount together with the interest? ---No, Atty. She reasoned out that she cannot pay the debt yet because she was terminated from work. She begged for additional time to pay the amount. She asked for another one (1) year grace period, but still failed to pay. 9. Did you already make a demand? --- Yes. 10. How many times and when? --- Twice, Atty. One on November 30, 2010. Another on January 20, 2011 which was my final demand. 11. Is there or are there any documents to support your claim? --- There are. She signed an acknowledgement receipt when I gave her the money and she also signed our agreement as regards the payment. (Exhibit A and Exhibit B) 12. How about as regards the demand made? Is it written? --- It is written, Atty. She received it and I have the receiving copies of the two demand letters. (Exhibit C-1 and Exhibit C-2)
