DECISION AND ORDER

This case arises under the Job Training Partnership Act
(JTW t 29 U.S.C. § 1579 et seq., and the applicable regulations
issued at 20 C.F.R. Part 6.
On March 1, 1993, the Department of Labor (DOL) gave
Complainant 45 days to submit required reports to be furthur
eligible for a Native American grant designation. Thereafter,
DOL withdrew its designation because Complainant failed to submit
the required reports. On June 1, 1993 and July 27, 1993,
Complainant filed requests for hearing in this Office. After
this Office issued an Order of Consolidation on November 3, 1993,
DOL filed a response to Pre-Hearing Orders on December 20, 1993.
On March 30 1994, this Office issued an order to Complainant to
show cause why a default judgment should not be entered in this
matter. To date, Complainant has failed to file a response to
the Pre-Hearing Orders or the Order to Show Cause.
After considering Complainant's failure to participate in
this matter, it is ORDERED that judgment by default be entered
against Complainant. The Grant Officer's decision that
Complainant no longer meets the conditions to serve as grantee
is AFFIRMED.
