SOLAS
In addition to the SOLAS convention, other documents provide guidance or further requirements related to SOLAS. These are IMO Codes e.g. International Safety Management (ISM) Code, Fire Safety Systems (FSS) Code, Fire Test Procedures (FTP) Code, Life-Saving Appliances (LSA) Code These are stand alone documents made mandatory under SOLAS Chapters and IMO Resolutions or Circulars. These are referred to in SOLAS and may be mandatory or guidance notes .

LEGISLATION
Chapter IX SOLAS, Management for the safe operation of ships, to prevent accidents, injuries and pollution by having safety management system.
Regulation 3- Safety management requirements: 1-Mandatory requirements of the International Safety Management Code. 2-The ship shall be operated by a company holding a Document of Compliance.

SMS FUNCTIONAL REQUIREMENTS


Safety/environment protection policy. Instruction, procedures, check lists, for all operations and regulations. Define level of authority and lines of communication, SHORE/SHIPBOARD. Reporting procedures of accident/non-conformities. Procedures for responding emergencies.

DEFINITIONS
Safety Management System means a structured and documented system enabling Company personnel to implement effectively the company safety and environmental protection policy. Document of Compliance means a document issued to a Company which complies with the requirements of this Code. Safety Management Certificate means a document issued to a ship which signifies that the Company and its shipboard management operate in accordance with the approved safety management system.

Observation means a statement of fact made during a safety management audit and substantiated by objective evidence. Non-conformity means an observed situation where objective evidence indicates the non-fulfillment of a specified requirement. Major non-conformity means an identifiable deviation that poses a serious threat to the safety of personnel or the ship or a serious risk to the environment that requires immediate corrective action and includes the lack of effective and systematic implementation of a requirement of this code.

NON CONFORMANCES # Issues where corrective action must be made to meet the ISM Code and/or ensure that the Procedures in the Safety Management System onboard are being followed correctly. ( Time limited ) MAJOR NON CONFORMANCE Issues where corrective action must be carried out immediately to meet the ISM Code, failure to do so would result in the withdrawal of the Safety Management Certificate and/or the Company Document of Compliance.

OBSERVATION - Issues where improvements in the Safety Management System and procedures are recommended. These do not have to be complied with, however they should be considered. DESIGNATED PERSON(S) -To ensure the safe operation of each ship and to provide a link between the Company and those on board, every Company, as appropriate, should designate a person or persons ashore having direct access to the highest level of management.

DPA RESPONSIBILITIES
The responsibility and authority of the designated person or persons should include monitoring the safety and pollution prevention aspects of the operation of each ship and ensuring that adequate resources and shore-based support are applied, as required.

EMERGENCY PREPAREDNESS
The Company should establish procedures to identify, describe and respond to potential emergency shipboard situations. The Company should establish programs for drills and exercises/prepare for emergency actions. The safety management system should provide for measures insuring that the Company's organization can respond at any time to hazards, accidents and emergency situations involving its ships.

CERTIFICATION / VERIFICATION
Company; Document of compliance (DOC) or Interim Document of compliance. Issued by; the Administration, by an organization recognized by the Administration or, at the request of the Administration, by another Contracting Government to the Convention. Validity; not exceeding 5 years and subject to annual verification. A copy of the Document of Compliance should be placed on board and not required to be authenticated or certified.

INTERIM CERTIFICATION; Its validity not exceeding 12 months. 1 -A Company is newly established. 2- New ship types are to be added to an existing DOC. The Safety Management Certificate (SMC) should be issued to a ship for a period which should not exceed five years. The certificate is subject to at least one intermediate and annual verification.

Internal Audits
A tool used to monitor how well the SMS system is implemented onboard. Internal Audit should be carried out prior to External Audit. This allows some corrective actions to be carried out from the findings of that audit on NC#s and Observations. Shows EVIDENCE of the SMS working and that the procedures are being followed. DPA Involvement in corrective action and feedback to the ship. Possible changes to SMS System ?

EXTERNAL AUDIT
Audit against what is required in the International Safety Management Code. Audit against the Safety Management Procedures in the SMS onboard. Looking for EVIDENCE onboard to show that it meets both ISM Code and SMS Procedures.

MASTER'S RESPONSIBILITY / AUTHORITY


Implementing the safety and environmental-protection policy of the Company; Motivating the crew in the observation of that policy; Issuing appropriate orders and instructions in a clear and simple manner; Verifying that specified requirements are observed; and Reviewing the safety management system and reporting its deficiencies to the shore-based management. The Company should establish in the safety manage-ment system that the master has the overriding authority and the responsibility to make, decisions with respect to safety and pollution prevention and to request the Company's assistance as may be necessary.

Garbage record book


Required as per regulation.9. Every ship of 400GT or more and ships carrying 15 or more passengers engaged in voyages shall carry a garbage record book. Garbage record book contains record of garbage disposals: Type of garbage disposed
off.Quantity of garbage disposed off.Date, time and position of the ship.Signature of responsible person.

Disposal of garbage Covered by regulation-3. Disposal of plastic or similar products are prohibited. Food waste, paper, crockery etc may be discharged at sea, at a distance of more than 12miles from the nearest land. Comminuted food waste to 25mm may be discharged at a distance greater than 3miles from the nearest land. Garbage record book


Special areas: Special disposal regulation in special area, as per regulation-10. In special areas, only food waste can be disposed at a distance more than 12miles from land. In wider Caribbean regions only comminuted food waste to 25mm may be disposed off at a distance more than 3miles from the nearest land. Garbage management: Covered by regulation 9. Every ship 12m or more shall display placards. Every ship 400GT or above and passenger ships carrying 15 or more passengers shall have onboard a garbage management plan. Ship's crews to follow the garbage management plan. Every ships 400GT or above an ships carrying 15 or more persons engaged in voyages shall carry a garbage record book.
