Monica Jackson EDIT 5370 Module 10 November 19, 2013 Copyright Scenarios Print Materials: 1. Students in Mrs.

Jacksons class are asked to create an online teaching plan for one of their chosen courses they created at the beginning of the semester. Part of the instructions require them to use supplemental resources such as articles or other printed materials within their teaching plan for their students to reference and use. Roger decides he would like to include electronic coursepacks as part of his online teaching and uses a service called XanEdu to gain permissions and compile these coursepacks for his students. He identifies the licensing and what publications he will and include in his online teaching plan to stay within the copyright laws. From what you have learned from copyright law, would the use of these printed materials be acceptable? Video: 2. In another assignment for Mrs. Jacksons class, students are asked to create a video to use as a supplemental teaching tool within their online course. Roger decides he will videotape a science experiment he will conduct to show the visual effects of chemical reactions to his students online. While searching on TeacherTube for ideas, he comes across a video that is exactly the type of science experiment he would like to conduct but adds a little more detail on the breakdown of the scientific terms and decides take a short clip of this video and add it to his video. Roger only uses :10 seconds of the video clip in his own video and believes it qualifies as fair use. From what you have learned from copyright law, and weighing the four factors in the U.S. copyright statute, would the use of this short video clip be acceptable? Photographs: 3. For the next assignment, Mrs. Jackson asked her students to create a personal website showing the work they have done over the course using the various types of communication tools one would use when developing an online course. The requirement calls for the use of photos to enhance their website and showing their personality as an online instructor so students could get a feel of who they are in a non-traditional environment. Roger decides he is going to search for photos that show his hobbies of running and cooking. He finds a site that has great pictures of running events and images and does not see any clause or information stating the images is protected by copyright. He decides to download a few and add them to his website and under each picture cites the source when he downloaded these images. From what you have learned from copyright law, would Rogers use of the images be acceptable?

Electronic Mail: 4. Students in Mrs. Jacksons class are asked to create a flyer promoting their online course that will be offered in Spring 2014 as an effort to attract students to enroll in their course during open registration. Roger receives an e-mail from a listserv he is subscribed to that shows all the university announcements for that day. One of the announcements he reads is promoting another course that is being offered in the Spring as well. Since Roger has no idea what he should add to his flyer to promote his course and likes the verbiage he reads from the listserv e-mail, he decides to copy and paste the information from the email to his flyer. From what you have learned from copyright law, would Rogers use of the information he copied and pasted from the listserv e-mail be acceptable? Course Websites: 5. Mrs. Jackson has asked her students to take all of their online teaching plans they have created and design a course using a free learning management system such as Udemy. As Roger begins to design his course, some of the content he plans on teaching will require students using outside resources to other websites and articles. He decides to install links to these external websites and articles within his modules as an effort to expand student access to these valuable resources and promote additional learning. From what you have learned from copyright law, would Rogers use of installing these external links be acceptable? Music: 6. The final assignment in Mrs. Jacksons class suggests her students implement educational music within their video they created earlier in the semester to use as a supplemental teaching tool within their online course. Roger would like to use music that enhances his visual science experiment over chemical reactions. Since he created his video using Microsoft Photo Story, he decides to choose a song from the library that is already uploaded in Microsoft Photo Story to add to his video. From what you have learned from copyright law, would Rogers use of this music clip be acceptable?

Four Factor Test In determining whether or not a particular use is fair, the law states that at least four factors should be taken into should be taken into consideration: The purpose and character of the use The nature of the work The amount and substantiality of the portion used in relation to the work as a whole The effect of the use on the market or potential market for the original work
