Please noted, the Treasurer's Office within about 60 days of the lease's effective date assigns the Fiduciary Liability Policy from RC Knox, City's contracted Insurance Broker, to Hybrid, with no change in coverage terms, cost or insurer, in brief, there was no valid reason to change. Also, Hybrid was not a Minority contractor for the City at that time. Knox did not have the opportunity to compete on this policy and protested the move. On the application to the City, Hybrid lists "Blaque Rock Capital LLC" (page 7, #6) as a business he is managing and according to ID; this company is a PO Box and is a fake company. The last page of the application, O'Garro verifies the facts are true under penalty of law. O'Garro did submit what appeared to be limited tax returns but I did not copy them. When you add the above to the facts of the Treasure's wire instructions to Hybrid, far outside accounting and insurance standards, his personal recommendation of Hybrid and the connection to lobbying efforts, it is hard to see this as anything other than a blatant conflict of interest at a minimum. I think from the comments shared with me by IAC staff....they may just think this is no big deal. I disagree if that is there final conclusion. Comments like.... "we aren't out any funds" and "we have insurance" and "the payment would have went to Hybrid anyway" is disconcerting if this is their final conclusion to this investigation. As a CFO who has an ethical and fiduciary responsibility to the fine citizens of Hartford....to have the treasurer send a wire of almost 900k to a vendor without any authority to do so and at the request of the CEO of Hybrid is extremely troubling. Further that no one in City Finance knew he sent the funding to Hybrid and the transaction gets posted in MUNIS as having gone to Segur is also extremely troubling. While this is not a BOE matter, I stay very concerned and will be closely watching the outcome of this "investigation". I will keep you posted. We have a connection and a conflict of interest with our City Treasurer, Adam Cloud, and Hybrid. Hybrid's office is located at 30 Lewis Street, Hartford. This location is owned by Adam Cloud's father, see attached. Also, in recent communication, I provided documentation where: 1) Mr. Cloud stated "Hybrid should be given strong consideration" by HD Segur. 2) Mr. Cloud provided wire instruction to send fund to Hybrid opposed the HD Segur who first invoiced the City 3) Mr. Cloud moved the Fiduciary Liability policy from the City's Insurance broker RC Knox in February 2012 to Hybrid with no change in premium and to my knowledge no substantial change in terms and conditions. 4) Mr. Cloud is on record telling HD Segur, current Insurance Broker, that the umbrella coverage was in danger of being cancelled and that Hybrid needed to be paid ASAP when in fact the policies were not in danger of being cancelled. The City is very concerned regarding Hybrid's nonpayment to Starr and National and the City Treasurer's involvement with Hybrid. An interesting side note that may be connected to Adam's influence with the matter related to Hybrid. About two years ago, Adam cancelled the Fiduciary Liability insurance policy that was part of the City insurance program and turned around and purchased it direct from a "local broker". I objected to this practice several times in writing to CC, COO and Finance Director all to no avail. I understand both insurers are taking legal action against Hybrid and will also be filing a complaint with the CT Insurance Department.
