CONEXUS International/Agreement and Release Form

I, the undersigned, am an applicant for a program sponsored by CONEXUS International (hereinafter referred to as CONEXUS) agree to the following understandings: 1) I understand that this is a group program and I agree to abide by the group leaders standards established by CONEXUS or its representatives. I agree that CONEXUS reserves the right to enforce any rule that insures the safety of the individual and the group at large and that my participation with CONEXUS program may at any time be terminated if I am to cause any damage or injury to me or to the person or property of others while participating in this program. I agree to leave the program at my own expense and waive the right to any refund of program fees. 2) I understand that I am responsible for exercising caution and common sense at all times to avoid injury. 3) I hereby waive any and all claims against CONEXUS and its agents or contractors, domestic and overseas, my local school and any staff members or counselors accompanying the group, their heirs or their estate, arising from any death, injury, loss, damage, accident, delay, irregularity, or expense to person or property incurred from the use of any vehicle or service, strikes, war, weather, sickness, quarantine, government restrictions or regulations, or arising from any act or omission of any steamship, airline, railroad, bus company, sight-seeing, hotel or any other service or transporting company, firm, individual, or agency. 4) I also shall not hold CONEXUS responsible for any loss or damage arising from any errors or omissions contained in this brochure or other CONEXUS literature, late or non-confirmation or acceptance of bookings and loss or damage caused by delays. In addition, CONEXUS shall have the right, at any time in its discretion and without liability or cost therefore, to cancel any tour or the remainder thereof, or make an alteration in route, accommodation, price and/or details in the event of any tour being rendered impossible or inadvisable by weather, strikes, war, acts of God, governmental interference or any cause whatsoever that is beyond CONEXUS control. Any and all extra expenses incurred as a result thereof shall be the responsibility of the passenger. 5) I also release CONEXUS and its agents, servants, employee officers or their assigns, my tour guide (s), or contractors from any financial obligations or liabilities that I may incur or any damage or injury to me or to the person or property of others that I may cause while participating in this program, and I agree to indemnify them against any such financial obligations or liabilities. 6) I understand that CONEXUS is not responsible for my well-being during such periods of time that I may be absent from CONEXUS supervised activities, as during free time periods, times of independent travel, visits to friends and relatives and so forth. 7) I understand that the air carrier's liability for loss or damage to baggage, or for death or injury to person or property, is limited by their tariffs and/or by the Warsaw Convention. CONEXUS is not responsible for loss, theft or damage to my belongings or to the belongings of any other person, including passports and travel documents. 8) I also grant CONEXUS, its officers or agents, to place me, at my own expense (if not paid or covered by the insurance policy), in a hospital at any point for any service and treatment, or, if no hospital is available, to place me in the hands of a local medical doctor for treatment. CONEXUS, its officers and agents are further authorized to request that I leave the program and return home at my own expense (if not paid or covered by the insurance policy) for medical treatment if this is deemed necessary by CONEXUS in consultation with local medical authorities. 9) I understand that CONEXUS and/or the airlines reserve the right to make changes in tour itineraries and departure dates, to substitute airlines and equipment or to make cancellations for insufficient participation or any other reason. 10) I understand that in the event of cancellation or changes being made, refunds will be given in accordance with the important information Terms and Conditions of CONEXUS current-year brochure. I understand that if I wish to cancel my enrollment in a CONEXUS program, I must do so in writing. 11) I understand that I must pay in full by the deadline dates stipulated in the CONEXUS current year brochure. If I fail to meet such payment deadlines, I realize that I will be assessed the late payment penalties therein described, and I agree to pay such late payment penalties. 12) I understand that CONEXUS is not responsible for any costs arising from the loss or theft of any of my personal property during the tour, including my airline ticket. I understand that each airline has its own procedures for dealing with lost tickets and that if lose my airline ticket I may be required to purchase from the airline a full fare replacement ticket. I accept that in these circumstances it is entirely my own responsibility to pursue any refund directly from the airline. 13) I understand that I am responsible for any damage I may cause while on tour to hotel property and other facilities or for misappropriation of hotel property, and I agree to pay for any such damages that I may cause; I cannot hold CONEXUS responsible for these damages. 14) I understand that this agreement includes the entire agreement between CONEXUS and me with reference to the subject matter referred to herein, and I do not rely upon any promises, inducements or agreements not herein, including but not limited to any oral statements made to me by any agents or employees of CONEXUS. 15) I certify that I am in good physical and mental health and that I have no special medical or physical conditions, nor any special needs or requirements, which would impede participation in the program, or be of any harm or inconvenience to myself or the other participants. I understand that walking long distances, climbing stairs may be required activities. 16) This agreement becomes effective when my enrollment is accepted by CONEXUS and I understand that this agreement shall be governed by the laws of the State of Florida which shall have sole jurisdiction over all claims which may be brought pursuant to this agreement or as a result of any actions or omissions by CONEXUS or representatives. The terms and conditions of this contract supersede those of any previous CONEXUS publication. This form cannot be changed or altered without the expressed written consent of CONEXUS. 17) By signing this release form, I hereby authorize CONEXUS the right to use any photo or video taken of me, in and around any event, in any printed, electronic, or moving picture format for their use, including their website, marketing, promotion, or any other purpose. I have read and understood the information set forth above in the Agreement & Release Form and the Terms and Conditions set forth in the current year CONEXUS brochure and/or website. TERMS AND CONDITIONS_____________________________________________ Prices are based on group departures. Rates based on double occupancy. Individual deviations have surcharges or participants may have to make their own travel arrangements. Departure and return dates are subject to change. If there is a remaining balance after March 1, 2014, participants may not be accepted and reservations may be canceled. Airline information will be mailed upon full payment of the program. To cancel a reservation and receive a refund, requests must be made in writing and postmark will determine effective date of cancellation. 150 days or more before departure participants, a full refund less $300 cancellation fee, 149 days to 50 days before departure participants will receive a full refund plus incur a $500 cancellation fee. 49 days to 24 hours before departure 50% refund. Less than 24 hours before departure there is no refund. No refunds for unused portions of the trip including tours and no shows. Application/Registration fee is non-refundable. Trip cancellation insurance fee (optional purchase) is non-refundable.
