This Belize flagged LSTLV was crudely marked and did not appear in the list of LSTLVs on the observers database. The LSTLV Tay Sheng Fwu was supplied with cargo. The vessel was marked with a registration number (CT4-1653) consistent with the Taiwan, province of China registration format. The name Tay Sheng Fu was visible on the life raft mounted on the wheelhouse roof. A vessel named Tai Sheng Fu is authorised by Taiwan, Province of China. The Mook Andaman 018 (IOTC 156) provided a letter from the Kasetsart University, department of fisheries, Bangkok stating that the vessel was licensed and that the license number was 431000401, but provided no fishing license as such. The observer was shown a VMS she was not familiar with: Sun Warm 8 produced an expired fishing license (expired 2005). When questioned, the captain indicated their new fishing license was waiting for them on Mauritius and they were going to pick it up before their next transhipment. No internal VMS could be located. When questioned, the captain repeatedly indicated the external satellite as seen in the picture. The vessel did not have a Fishing Authorization. They had a letter which stated that their Fishing Authorization was current. Ping Shin 201 produced a poor quality photocopy of the licence, although it appeared to be of the valid document with dates and identification correct Ping Shin 201 did not offer any sort of logbook that looked official in nature but simply used a ruled A4 pad Sinaw 16 also produced a photocopy of a licence but this was in Arabic and the observer was unable to verify its validity 11

The vessel named displayed differed from the IOTC record The LSTLV MOOK ANDAMAN 018 had no ATF on board, but had a letter from the "department of fisheries" in Thailand. The letter states, among others, the following: the "license No:431000401" ,its owners as "Siam tuna fishery company limited" and "authorized by the department of fisheries in Thailand, as a contracting party to the Indian Ocean Tuna Commission(IOTC), to operate in the Indian Ocean. Its fishing license is valid from 1st January 2012 to the 31st December 2012". Dear Mr. Giroux, This has reference to your e-mail dated May 28, 2012. Based on the Observer Report for Trip Number: 170/12 fishing vessel/carrier Lady Tuna [IOTC Ref. No. 8448] by Observer (Observer IOTC Ref. No). Lindsay Jones (024) Cruise Dates from 01/03/2012 to 05/05/2012, the following observation was made on a Philippine flagged fishing vessel, namely: The Jetmark 101 (IOTC 110) had to have its new license faxed to the vessel during transhipment when its previous license was seen during inspection to be out of date. It also appeared to have an on/off switch attached to its VMS unit (Figure 6) . Please be informed that the International Fishing Permit [IFP] of Jetmark 101 was faxed to the said fishing vessel as it had not yet been in port at the time the IFP was renewed till the time it was boarded by the Observer for transhipment. Faxing the document was the most convenient and cost effective manner by which the said IFP could be transmitted to the said Philippine flagged vessel. Requiring the same to come to a port for purposes of accepting/receiving a hard copy of the IFP is economically prohibitive. Attached is a copy of the said IFP. Secondly, the alleged on/off switch is actually an electrical breaker which is equivalent to a fuse box, a safety device required to be installed as a safety measure against over voltage. This device is easily viewable and is not hidden. Also, all electrical units on board vessels have this safety device as this is a safety at sea requirement. In addition, this fishing vessel had been boarded and inspected on previous occasions by other observer who had seen this set up yet did not mention it in their reports as this was most likely known or understood by them. Lastly, all VMS units have on/off switches of one form or another as these need to be turned off when at port. I trust that this explains the situation. Regarding the call sign of the Naham 4 and the confusion with the Naham 3, we already investigated this matter with the owner. The company accepted and agreed that there was a mistake occurred from the people who were mixed the printing on the vessel. According to owner company that they have altered this mistake and promised not to repeat such kind of errors I hope this can be taken as our clarification on this matter and I appreciated if you take the necessary action to close this issue. The LSTLV Tay Sheng Fwu was supplied with cargo. The vessel was marked with a registration number (CT41653) consistent with the Taiwan, province of China registration format. The name Tay Sheng Fu was visible on the life raft mounted on the wheelhouse roof. A vessel named Tai Sheng Fu is authorised by Taiwan, Province of China.
