AN ORDER CREATING A GRIEVANCE COMMITTEE TO HEAR ADMINISTRATIVE CASES AGAINST APPOINTED OFFICIALS AND EMPLOYEES OF THE CITY GOVERNMENT, DEFINING ITS DUTIES AND FUNCTIONS WHEREAS, the Revised Policies on the settlement of grievance in the Public Sector contained in CSC Resolution No. 010113 and implemented through CSC Memorandum Circular No.02, series of 2001 provides that A grievance shall be resolved expeditiously at all times at the lowest level possible in the agency. However, if not settled at the lowest level possible, an aggrieved party shall present his or her grievance step by step following the hierarchy of positions; WHEREAS, in the above-cited CSC Resolution, it mandates that all agencies shall establish grievance machinery to address grievance between or among government officials and employees; WHEREAS, Section 455 paragraph (1) of R.A. 7160 otherwise known as the Local Government Code of 1991, provides among others, the powers of the City Mayor, to wit: Ensure that all executive officials and employees of the city faithfully discharge their duties and functions as provided by law and this Code, and cause to be instituted administrative or judicial proceedings against any official or employee of the city who may have committed an offense in the performance of his official duties; WHEREAS, Section 86 of the Local Government Code states that Administrative investigation may be conducted by a person or a committee duly authorized by the local chief executive. Said person or committee shall conduct and submit their findings and recommendations to the local chief executive concerned within fifteen (15) days from the conclusion of the hearings. The administrative cases herein mentioned shall be decided within ninety (90) days from the time the respondent is formally notified of the charges; WHEREAS, to address some complaints regarding malfeasance, misfeasance and nonfeasance of City officials and employees and to afford the parties particularly the respondent(s), protection of his/their constitutional rights, a grievance committee to hear administrative cases shall be constituted;

NOW, THEREFORE, I, BELEN T. FERNANDEZ, City Mayor of Dagupan, by virtue of the powers vested in my by law, do hereby ordain: Section 1. ADOPTION OF GRIEVANCE MACHINERY. In line with the Revised Policies on the settlement of grievance in the Public Sector contained in CSC Resolution No. 010113 and implemented through CSC Memorandum Circular No.02, series of 2001, the Dagupan City Local Government hereby adopts the grievance machinery provided by the above-cited Resolution. Section 2. CREATION. A Grievance Committee or hereinafter referred to as the Committee, is hereby created to hear all administrative cases against appointed City officials and employees. Section 3. COMPOSITION. The Committee, whose integrity, probity, sincerity and credibility are considered, shall be composed of the following: Chairman Members : : Atty. George Mejia City Legal Officer Atty. Farah Marie Decano City Administrator Atty. Jocelyn Ibaan Executive Assistant IV Head of the Office of the Department Concerned It is hereby provided that in the event that a department head or any one of the committee members is the respondent in the administrative case thus filed, he/she shall be disqualified to sit as a member of this committee, and the Administrative Officer V ,Ms. Jocelyn Z. Siapno will take his/her place instead. Section 4. DUTIES AND FUNCTIONS. The Committee shall perform the following functions: 1. Conduct hearings on the cases brought against appointive local officials and employees in accordance with the Civil Service Law, rules and regulations and other pertinent laws;

2. Submit their findings and recommendation/s to the local chief executive concerned ( City Mayor) within fifteen ( 15) days from the conclusion of the hearing; and 3. The Committee Chairman is hereby authorized to : a. Issue notices to the parties and the witnesses to call for their appearance during the investigation; b. Administer oath to anyone of the parties and their witnesses; c. Conduct a formal investigation on the complaint thus filed; d. Secure documents, papers and pertinent data from any department/office of the City Government and other agencies of the national government; e. Make reports on the conduct and progress of the investigation; f. Make recommendation/s on the disciplinary action to be taken against the respondent/s; g. Perform such other tasks as may necessarily be required in the implementation of his duties and functions; and h. Perform such other tasks/functions as may be delegated or authorized by the City Mayor. Section 5. SECRETARIAT. The Human Resource Management Division ( HRMD) shall be the Secretariat of this Committee. Section 6.EFFECTIVITY. This Executive Order shall take effect immediately upon signing hereof, and shall remain in full force and effect until revoked in writing by the undersigned.
