The objectives of the code are: a. to ensure that orderly and properly coordinated elections are conducted; b.

to ensure that matters pertaining to the elections are clarified; c. to prescribe the conduct of elections from the moment the certificates of candidacy are filed to the induction of the newly elected officers; d. to define the qualifications of COMELEC Members and candidates for the elective positions; e. to define the creation, composition, and functions of the !"M#$ COMELEC. THE COMMISSION ON ELECTIONS Section 1. %ame & 'E("!L)(*s Commission on Election or otherwise +nown as COMELEC is an independent commission in charge of ensuring ,ustice and equality during elections. Section 2. Composition & -he COMELEC shall be composed of one Chief Commissioner and four Commissioners appointed by the incumbent COMELEC Commissioners not applying for the positions. Section 3. .ualifications &-he Commissioners and their members must have the following qualifications/ a. )hould be a student of the !"M#$ 0rogram b. )hould have at least two 123 academic terms remaining under the program c. )hould have no failing mar+ for the two 143 preceding terms d. )hould be free from any academic or disciplinary charges e. )hould not be an incumbent officer of the )tudent Council or COMELEC Section 4 Members & Each Commissioner may have at the most 2 members chosen under their discretion. -hese members are e5pected to assist and help the commissioners with their duties and responsibilities. Section ! $pplication & -he procedure for filling for a position in the COMELEC would be as follows/ a. 'iling for Candidacy & 'ive 163 days will be allotted for the filing of candidacy unless otherwise announced by the incumbent COMELEC b. 0anel & -he incumbent COMELEC Commissioners shall be the 0anel responsible for the screening, selecting and appointing of the applicants or candidates. c. 7equirements & -he requirements consists of the following/ i. Latest 7esume ii. Certificate of 8ood Moral Character from the !iscipline Office claimed during the current term iii. -wo 143 pieces of recent 454 pictures of the applicant d. 7equirement 'ormalities & -he applicants are required to submit the necessary requirements on or before 9/:: pm of the last day of filing. -he requirements must be placed inside a sealed short brown envelope. $t the upper left hand corned of the bac+ of the envelope, the following must be written/

'E( ;! %umber iii. 0osition $pplying for e. ;ncomplete $pplication 'orm & Only completely submitted requirements will be honored by the panel. f. $nnouncement of Candidates/ -he 0anel shall submit a list of candidates three 123 days after the last day of filing of candidacy. g. )creening 0rocess & -he candidates are required to undergo interviews to be facilitated by the panel. -he 0anel may implement other necessary process as they seem fit h. $ppointment & $ppointment of the Commissioners shall be under the discretion of the 0anel provided that the candidates have satisfactorily met the qualifications and underwent the screening process. Section " 0owers, !uties and 7esponsibilities & -he following are the powers, duties and responsibilities of the COMELEC/ a. -a+e charge of the election and special elections, if necessary b. E5ercise ,urisdiction over electoral matters which includes but not limited to investigating complaints, ad,udicating and e5ecuting decisions c. ;mplement the rules and regulations regarding election laws d. 0rovide penalties or sanctions to those who violate any rules and regulations concerning the election e. 7emain a non"partisan throughout the entire election period """""""""""""or""""""""""""""""" The #$%M&' COMELEC sha(( have the fo((o)in* +o)ers, res+onsibi(ities, and f-nctions: a. to formulate rules and regulations consistent with the provisions of the !L)("'E( !" M#$ Election Code and the )tudent Council Constitution; b. to implement and enforce the provisions of the said code, and the rules and regulations it may adopt, pursuant to the above provisions; c. to supervise the conduct of elections; d. to disseminate information on the provisions of the Code, and the rules and regulations that the #oard may adopt. e. to post<distribute the Election Code and the Election Calendar; f. to hear and decide cases regarding violations of the Code and the rules and regulations it has adopted. g. to entertain and settle questions that may arise regarding the Code and the rules and regulations it has adopted. h. to accept and act on protests that may be brought to its attention during and after the election period. i. to enforce the penal clause of this Code. Section . -erm & -he term of the Commissioners shall commence thirty 12:3 days before the Election !ay and will end si5ty 19:3 days before the start of the succeeding election period.

ELECTION /0OCE$10ES Section 1. 0rocedure for 'iling of Candidacy" -he electoral procedures shall be facilitated by the COMELEC. -he procedure of filing for candidacy for the positions of 0resident, =ice 0resident for ;nternals, =ice 0resident for E5ternals, )ecretary and -reasurer will be as follows/ i. ,. 0eriod & -he filing period will start three 123 wee+s before the Election !ay and will last for five 163 school days. )ubmission & )ubmission of requirements must be made on or before 9/:: pm of the last day of the filing period.

7equirement 'ormalities & $pplicants must submit their requirements that are placed inside a sealed short brown envelope to any of the COMELEC Commissioners within the prescribed period. $t the upper left hand corner of the envelope the following must be written/ i. ii. iii. m. ;ncomplete 7equirements & 'ailure to completely submit the above requirements will not be honored and may be a ground for disqualification. Other grounds for disqualification may be provided by the COMELEC. n. $nnouncement of the Candidates & $ list of the candidates per position will be printed out by the COMLEC and posted within the campus three 123 days after the last day of the filing of candidacy. Section 2 Campaign & -he following are the rules and regulations regarding campaigns/ a. 0eriod" Campaign 0eriod will last for five 163 school days unless otherwise announced by the COMELEC and may be done within school premises and social networ+ing sites. b. 7estrictions " %o campaigning may be allowed during the Election !ay however, candidates may encourage the voters to vote provided that they do not mention or encourage the voters to vote for a specific party and<or candidate. c. =iolation & =iolations of Campaign 7ules may be considered as grounds for disqualification. Complaints must be submitted to the COMELEC and the commission owns the ,urisdiction to investigate, try and decide on the case.

Section 3 Election !ay & -he following are the rules and regulations applicable on the day of the election/ a. 0eriod & One 1>3 school day will be devoted for the day of the election unless otherwise decided by the COMELEC. b. =enue & -he venue of the booths will be decided by the COMELEC and announced two 143 days before the election day. c. $dministration & -he COMELEC is in charge of the administration of the election. -here must be at least one 1>3 commissioner or one 1>3 member of the commission present at all times inside the booth to secure the ballots. d. #allots & $ ballot bo5 will be provided by the COMELEC for the safe +eeping of the votes. Only the voter has the authority to drop its own ballot in the bo5. $t the end of the election day, the ballot bo5 will be sealed and counter"signed by all the commissioners. -he bo5 will only be re"opened when the tallying of the votes commence. e. =oting & -he following procedures are to observed by the voters unless otherwise revised by the COMELEC/ i3 =oters must sign their name in the registration form ii3 =oters must present their school ;! in e5change of the ballot iii3 =oters are to find a spot in the booth where they are to fill up the ballot iv3 $fter completing the ballot, voters may have the option to fold it into half and proceed to the commissioner or member in charge of the safe +eeping of the ballot bo5. v3 =oters must personally drop their ballot in the ballot bo5 vi3 Once all the steps are observed by the voter, the commissioner or member may return the voter*s ;! f. Candidates & Candidates are allowed to vote but they must e5it the booth once they have submitted their ballot. Candidates are not allowed to loiter around the booth*s premises during the entirety of the election day. 'ailure to observe may be a ground for disqualification.

g. 7ules and .ualifications for all Candidates for elections a. Must not have a failure in the previous term b. Must not have obtained the same position in the previous term of council c. Must receive a vote of ma,ority during election day that which is equivalent to at least 6:? @ > of the total number of voters Section 4 Canvassing of =otes & -abulation of the votes would be the following unless otherwise revised by the COMELEC/ a. 0eriod & -he canvassing of votes shall commence on the same day of the election unless circumstances would warrant the need for the event to ta+e place on another day. ;n case of such, the ballot bo5 shall be +ept in the $dministration*s Office for safe +eeping.

b. 7epresentative & -he canvassing of votes may not begin unless there is at least one 1>3 Commissioner and at least one 1>3 representative of the party or independent candidate. c. 0rocedure & -he canvassing procedure is as follows/ i3 -he sealed ballot bo5 will be opened only in the presence of the commissioner and the candidates* representatives. ii3 One ballot will be ta+en out from the bo5 at each time. $t least one 1>3 commissioner and the candidates* representative must verify the ballot before the vote would be tabulated. iii3 ;f the ballot is categoriAed as void, it will be mar+ed by the commissioner as such and counter signed by the candidate*s representatives. iv3 ;f the ballot is valid, it shall be read by the commissioner and be tabulated in the official tally sheet. v3 Once the last ballot is read, the scores will be counted and the final count shall be written beside the name of the candidate to be counter signed by at least one 1>3 commissioner and the candidate*s representatives. d. =oid #allot" ;n cases where the voter would vote two or more candidates for the same position it shall be considered void. Bowever, the other candidates voted for the remaining positions that are deemed valid may still be tabulated. e. $bstentions & -he voters* right to abstain will be respected at all times. f. Election .uota " -he election quota would be as follows/ i3 Election " 'or the election to be treated as valid, at least 6:? @ > of the program*s population must be able to vote. ;n case of the number is not met, the COMELEC may decide whether to e5tend the election day or call for a special election ii3 0ositions & -he winning candidate must be able to garner at least 6:? @ > of the total votes. ;n cases where abstentions received the ma,ority vote, the position shall remain unoccupied and a special election will be administered by the COMELEC.

Section !. $nnouncement of Cinners & $nnouncement of the winners will be done the day after the canvassing of votes. $n official letter shall be posted within the school*s premises to notify the students of the results. THE C'N$I$'TES Section 1. The /resident >. -o be the Chairperson and Chief E5ecutive Officer of the )tudent Council; 4. -o be the official spo+esperson of the Council at any function, meeting or assembly; 2. -o act as the official representative of the )tudent #ody and the official overseer of its affairs; D. -o preside over the meetings of the )tudent Council 6. -o call for meetings of the )tudent Council or any part thereof as necessary;

9. -o coordinate with the )chool #oard, !epartment Beads, 0resident of the )chool, !ean or other person of authority in both schools, 'E( and !L)(. E. -o submit trimester reports on the achievements and pro,ects of the )tudent Council. F. -o approve<disapprove pro,ects of the )tudent Council. G. -o oversee the operations of other officers. Section 2. The Interna( 2ice%/resident >. -o assume the responsibilities of the 0resident if the 0resident is absent or incapacitated; 4. -o automatically assume the 0residency in the event that such office is permanently vacated; 2. -o be the direct liaison between the students and both schools when it comes to matters of internal affairs; D. -o update the students on the status and the important dates to remember 6. -o assist students in matters of internal affairs Section 3 The E3terna( 2ice%/resident >. -o assume the responsibilities of the ;nternal =ice 0resident if the ;nternal 0resident is absent or incapacitated; 4. -o be the direct liaison between the students and other schools; 2. -o be in charge of all pro,ects and activities relating to the student body; D. -o assist students in matters of e5ternal affairs Section 4 The Secretar4 >. -o be the Chief $dministrative Officer of the )tudent Council; 4. -o ta+e charge of the daily and administrative affairs of the )tudent Council; 6. -o assist the 0resident in the implementation of the pro,ects and activities 9. -o be the official custodian of all records and papers of the )tudent Council; E. -o be in charge of official announcements of both )chools, 'E( and !L)(, and the )tudent Council Section ! The Treas-rer >. -o be the principal budgetary officer of the )tudent Council; 4. -o +eep detailed records of all e5penditures of the )tudent Council; 2. -o disburse the funds of the Council at the direction of the 0resident; D. -o deposit and withdraw money in the name of the )tudent Council; 6. -o render a financial statement of the )tudent Council every trimester to the )tudent #ody and to ma+e public monthly reports on its e5penditures;
