RE: Michiland State University Weapons Policy.

Dear Weapons Policy Committee, As per your re uest, I have dra!ted the attached Weapons Policy in response to the recent incidents involving "eapon use on the Michiland State University campus. The goal o! this policy is to limit the use and possession o! "eapons and to increase Michiland State University community sa!ety. The Weapons Policy is designed to !it "ithin the um#rella o! the Michiland State University Community Sa!ety Policy. The Michiland State University Community Sa!ety Policy already addresses related sa!ety issues such as student alcohol consumption, use o! ha$ardous chemicals, residential security, etc. The Weapons Policy%s prohi#ition on "eapons !its under this um#rella o! policies. The Weapons policy is limited to !irearms and certain #lades. The Weapons Policy prohi#its anyone !rom possessing "eapons on any Michiland State University property. The policy #roadly de!ines "eapons to include, &certain #lades, !irearms, or other device used !or casting a pro'ectile #y e(plosion, air, gas, or mechanical means, irrespective o! "hether such !irearm or other device is loaded or other"ise ready !or use.) This de!inition is #road enough to include dangerous "eapons such as handguns, hunting ri!les, and daggers "hile allo"ing !le(i#ility !or the continuing use o! necessary items such as *itchen *nives in the dining halls. There are t"o e(ceptions to this prohi#ition+ The !irst e(ception is !or authori$ed la" en!orcement o!!icers. Authori$ed la" en!orcement o!!icers are allo"ed to possess "eapons in their o!!icial capacity. This includes o!!icers !rom Campus Security, as "ell as municipal, state and !ederal la" en!orcement. This is e(ception is designed to ensure that la" en!orcement o!!icers can continue to do their 'o# e!!ectively. This e(ception is in line "ith the community sa!ety goal o! the Weapons Policy. The second e(ception is !or any person speci!ically granted an advance e(emption #y the ,oard o! Trustees o! Michiland State University. This second e(ception is designed to allo" !or certain "eapons that may #e necessary !or the educational purpose and mission o! Michiland State University. -or e(ample, i! a pro!essor "ants to display an ancient "eapon as part o! an archeology course, he or she can see* an e(emption under this second e(ception. The Weapons Policy also provides a procedure that allo"s anyone to report a violation o! the Weapons Policy to Campus Police. This encourages mem#ers o! the University community

Team Invercargill to avoid possi#ly dangerous sel!/help measures and instead report the in!ormation to Campus Police o!!icers, "ho are trained and e uipped to handle the unauthori$ed possession and use o! "eapons.

0astly, the Weapons policy esta#lishes the Weapons Policy Dispute 1esolution Committee. This committee is designed to hear concerns regarding the Weapons Policy !rom the University Community. The goal o! this committee is to ensure that the University is continually updated on changes inherent to the evolutionary nature o! sa!ety needs and "eaponry. The committee is tas*ed "ith ensuring that Michiland State University responds to these changes in a timely manner that is in "ith the ultimate goal o! sa!ety. Campus Security and the Michiland State University administration are trained and e uipped to en!orce this policy. "eapons and e(emptions to that prohi#ition have on the University Community. The Weapons Policy Dispute 1esolution Committee is esta#lished to hear concerns regarding the Weapons Policy !rom the University Community. RATIO,ALE: In order to promote an academic environment o! support and challenge, the proposed Weapons Policy at Michiland State University has #een cra!ted to promote academic !reedom and prevent physical threats on Campus. In the development o! this policy many options "ere ta*en into consideration. The policy "ould not #e too loose in regards to Weapons on Campus as to allo" a threat to student or !aculty voice, #ut it could not #e too tight as to tread on Second Amendment rights and inhi#it scholarship in areas "here Weapons are o! interest. This policy is directed only to"ards Weapons as de!ined in the policy. There is potential !or other items, some commonly !ound on Campus 2e.g. chemicals in a la# space, to #e used as,

or in creating Weapons, #ut it is more appropriate that those issues are ta*en up "ith the deans o! those individual departments "ho have a direct relationship to this potential issue. A Campus "ide Weapons Policy must #e #road in order to allo" negotiation amongst the administration and the invested nuances o! the institution. As limited pu#lic space, Michiland State University can limit the use o! Weapons on Campus "ithout neglecting Second Amendment rights. I! an individual or group !eels that this policy or its e(ecution is in violation o! State or -ederal 0a", the University has created a Dispute 1esolution Committee to allo" dialogue on the issue. The proposed Weapons Policy has #een created as an enhancement to the nature o! the academy, in/line "ith State and -ederal 0a", promoting institutional community rights, not limiting them. MI,ORITY-ALTER,ATIVE VIE&S: As a !inal decision is made on implementing a Weapons Policy at Michiland State University the nature o! the issue is sure to "arrant a passionate response !rom mem#ers o! the institutional and ta(/paying communities. Although any policy "ould !ail to satis!y individuals in all positions the proposed Weapons Policy should help all mem#ers o! the Michiland State community meet some"here in the middle. 0imiting the use o! "eapons in any "ay, especially !irearms, is sure to dra" complaints !rom the pro/gun demographic. Challenges to the policy as a violation o! Second Amendment !reedom are sure to #e heard. Some "ill argue that concealed "eapons permits should allo" registered "eapons on campus and "ill provide added sa!ety to #oth the holder and the general pu#lic. The argument that legal gun o"ners should #e a#le to carry their "eapons in order to protect against illegal "eapons and threats o! violence is in "ays reasona#le #ut not in/line "ith the Weapons Policy and the institutional priorities o! Michiland State University. Some may argue that this policy "ill only limit "eapons in the hands o! responsi#le, la"/a#iding citi$ens, and criminals "ill have !ree/run o! the Campus. The sa!ety o! the institution and its mem#ers is paramount in the proposed Weapons Policy and a limit to Weapons on Campus "ill mean !e"er threats to that sa!ety. Campus Security "ill #e capa#le o! de!ending the institution and its mem#ers. The anti/"eapon demographic is li*ely to !ind !ault "ith the allo"ance o! "eapons upon advanced e(emption #y the ,oard o! Trustees. Complaints that the presence o! "eapons !or any reason "ill threaten sa!ety should #e e(pected. The proposed Weapons Policy !or Michiland State University is car!ul to e(clude the threat o! Weapons !rom Campus as to not chill !reedom o! speech !or all individuals. ,E.T STEPS: @ Integrate the Weapons Policy "ith the other policies under the University community sa!ety initiative, "hich include topics such as rules on student alcohol consumption, use o! ha$ardous chemicals, etc. Ma*e any changes as necessary to ensure that there are no
