Certified copies of all documents used herein may be necessary if used as exhibits at trial. The documents in this assessment are organized according to their appearance as they relate to the timeline in the chain of title. In all instances involving the deeds of trust reviewed in this assessment, there is one item common to all these documents: The Borrowers covenant that they are lawfully seised of the estate hereby conveyed and has the right to grant and convey the Property and that the Property is unencumbered, except for encumbrances of record. The Borrowers further warrant and will defend generally the title to the Property against all claims and demands, subject to any encumbrances of record. Due to the nature of this portion of the Deed of Trust, the Preparer asks counsel to review these specific sections as a means for the Borrowers to preserve their rights to bring a quiet title action if necessary, to comply with this portion of the contract. DOCUMENT #1: DEED OF TRUST This 4-page document was recorded in the real property records of the Clark County, Nevada Clerks office on May 15, 1979 at 8:26 a.m., duly recorded in Book #1055, Instrument #1014058. It appears a recording fee of $6.00 was paid to record this document in the land

interest he might have in the Property to any other party. Failure to do so appears to trigger what some might consider a due on sale clause. Under the Non-Uniform Covenants, Paragraph 22 (Reconveyance.), on Page 4 of 4, reserves the right of the Lender, upon payment of all sums due, to request the Trustee to reconvey the property back to the Borrower with the Borrower paying all of the recordation costs and the Trustees shall not charge for preparing the reconveyance. The Trustee shall reconvey the Property without warranty to the person or persons legally entitled to it. Paragraph 23 (Substitute Trustee.), on Page 4 of 4, cites the Lender may remove Trustee and appoint a successor trustee to any Trustee appointed hereunder. Paragraph 24 (Waiver of Homestead.), on Page 4 of 4, cites the Borrower waives all right of homestead exemption in the Property. The document appears to have been executed by the Grantor (Borrower herein) on May 11, 1979 before one Dolores T. Bucholz, a notary public in and for the State of Nevada in Clark County, whose commission appeared to be valid at the time this attestation was made. An online search for Dolores T. Bucholz, Notary Public, was performed by the Preparer at the website of Diana Alba, Clerk of Clark County, Nevada, https://aivitals.co.clark.nv.us/WebPIInternet/, which produced NO RESULTS for subject notary. PREPARERS NOTES: (1.) An online search regarding CHICAGO TITLE INSURANCE CO. found subject entity is a subsidiary wholly owned by CHICAGO TITLE & TRUST CO. which began August 30, 1961, as seen at the following link, https://www.ctic.com/history5.aspx, and screen shot below:

(2.) An online search for FIDELITY SERVICE CORPORATION was performed by the Preparer at the Nevada Secretary of State Ross Miller website and found to have been registered since April 13, 2004 and is active, as shown at the following link and as shown in the screen shot below:

without warranty to the Borrower with the Borrower paying Trustees reasonable costs incurred in so reconveying the Property. Paragraph 29 (Substitute Trustee.), on Page 15 of 18, cites that the Lender may remove Trustee and appoint a successor trustee to any Trustee appointed hereunder. The document appears to have been executed by the Trustors/Grantors (the Borrowers herein), whose address is 521 N. 10th St., Las Vegas, NV 89101, on what appears to be June 22, 2001 before what appears to be Jodi Grover, a notary public in and for the State of Nevada in Clark County, whose commission appeared to be valid at the time this attestation was made. The Grantors signatures were not delineated as to whether they were known or produced identification, nor plurality delineated by the notary public, as provided for in the form. An online search for a notary public from January 1, 1988 to October 24, 2013 with the last name of Grover was performed by the Preparer at the website of Diana Alba, County Clerk, Clark County, Nevada, which found a Jodi Grover; however, the notary term for Jodi Grover expired September 13, 1993, as seen at the following link, https://aivitals.co.clark.nv.us/WebPIInternet/results.aspx, and in the screen shot below:

Since the copy of the page containing the notary execution, Page 16 of 18, was very illegible in regards to the handwritten information and as the notary seal was also unclear, this Preparer suggests that counsel may have to effectuate discovery to prove any of this information to be factual and/or relevant.

There are issues with this Assignment of Multifamily Deed of Trust, Assignment of Rents and Security Agreement, to wit: (1.) The Assignors signature was notarized on December 16, 2005 and the effective date of the document was December 21, 2005; yet notice to the world of this assignment was not recorded until several months later on March 7, 2006. (2.) There is no record of assignment or any document in the land records to demonstrate how ANDERSON, MCCOY & ORTA, PC obtained possession of the document. If subject entity is not the Grantor/Borrower, Lender, Trustee, or Beneficiary, why were they apparently sent the document after recordation? Further discovery by counsel is suggested by this Preparer. (3.) Despite the fact the notarys commission appears to have been valid at the time of acknowledgment, the language contained in the notarial execution does not delineate as to how the Assignors representative was known to the notary public. (4.) The notarys signature is scribbled, which is a marker of suspect document manufacturing. (5.) Searches conducted by the Preparer on http://www.secinfo.com for 2005-MF1 and Wells Fargo Bank, N.A., as Trustee for the Registered Holders of LaSalle Commercial Mortgage Securities, Inc. revealed no results. Further research or discovery may need to be effectuated to prove this factual or not. (6.) Searches conducted by the Preparer in IRS Publication 938, which contains all REMIC listings, for the years 2004 through 2007 revealed no results for 2005-MF1 and/or LaSalle Commercial Mortgage Securities, Inc. UNRECORDED DOCUMENT #15: BERKADIA COMMERCIAL MORTGAGE CORRESPONDENCE This 3-page correspondence plus 4-page Hazardous Substances Certificate and Indemnity attachment is dated March 9, 2012 from Geraldine Khout, Asset Manager, (949) 622-9229, Berkadia Commercial Mortgage LLC (Berkadia), 1 Park Plaza, Suite 1200, Irvine, CA 92614 to Statz Apts, LLC, a Nevada limited liability company, Attention: Luis Rosales, 4811 Yuma Ave., Las Vegas, NV 89030, Loan #99-1074290. The letter cites that Berkadia has been designated as the Master Servicer and Special Servicer to manage a portfolio of loans and real estate on behalf of Wells Fargo Bank, N.A. as Trustee for the Registered Certificateholders of LaSalle Commercial Mortgage Securities, Inc. Commercial Mortgage Pass-Through Certificates, Series 2005-MF1 (collectively, the Lender).

IN SUMMARY This chain of title assessment (COTA) is for in-office use only (by counsel) and may not be offered as an exhibit or referred to in any evidentiary proceeding to verify any matters at law; nor does this assessment purport to rend any legal advice, draw any conclusion of law or guarantee any legal outcome. All items of concern are presented as part of a research package for consideration and use by counsel to determine issues of probative value. All issues of probative value identified in this assessment appear highlighted in red, bold-faced type and will not be restated here for brevity. Further evidentiary processes may be necessary to clarify or prove each of the points at issue to explore their probative value. Any documents submitted that were not reviewed by the Preparer and included in this assessment were deemed insignificant to this assessment. All issues of extreme relevance are discussed below: (1.) The recorded property documents of the previous owner will require legal scrutiny due to potential errors or malfeasance that disrupts clear chain of title. If any is discovered, then the legality of Document #2 of this assessment would be suspect as well. (2.) There are multiple instances of document manufacturing, suspect robosigning, suspect surrogate signing and as a result, suspect forgery, on specific documents relating to assignments and reconveyances, each described in detail throughout this assessment. (3.) Suspect deficient notarizations are signs of potential notary fraud.

(4.) There are further critical issues with the chain of title that indicate apparent proper party issues in that there is no transfer from Luis Rosales to Statz Apts, LLC found in the county land records. (5.) It is apparent counsel for Wells Fargo Bank, N.A., as trustee for the registered holders of LaSalle Commercial Mortgage Securities, Inc. 2005-MF1, Commercial Mortgage Pass-Through Certificates, Series 2005-MF1 recognizes the deficiency of Item #4 as they requested their prepared Quitclaim Deed be executed post haste (see Document #21 of this assessment).
