DECLARATION OF THE 1
ESTABLISHMENT OF A FREE CHURCH 2
1 PURPOSE 3
The purpose of this document is to establish a free church for the purpose of worshipping, serving, loving, and glorifying 4
J esus Christ as our Lawgiver, J udge, and King, pursuant to the following. 5
"For God is the King of all the earth; Sing praises with understanding." 6

"For the LORD is our Judge, the LORD is our Lawgiver, the LORD is our King; He will save [and protect] us." 8

We hold these truths self-evident, that we may establish said church an record the documents which establish it within any 10
place where its buildings and officers may be found and yet not seek any form of government enumeration, registration, or 11
recognition. We also hold it self-evident that any efforts to seek registration, enumeration, or recognition from the 12
government of said entity within the jurisdiction of any government law shall render said Church no longer a Church whose 13
sole head is Jesus Christ, but instead a church that is serving TWO masters in violation of the Bible upon which is it 14
founded: 15
"You shall have no other gods [including governments or earthly laws] before me [or my commandments]." 16

"Do not walk in the statutes of your fathers, nor observe their judgments, nor defile yourselves with their idols. I 18
am the LORD your God: Walk in My statutes, keep My judgments, and do them; hallow My Sabbaths, and they 19
will be a sign between Me and you, that you may know that I am the LORD your God." 20

The association and church established by the sovereign authority of Gods Holy laws found in the Holy Bible, which is a 22
covenant, a contract, and a trust indenture that makes all those believers who are party to into stewards, trustees, and 23
fiduciaries of the Heavenly Father. 24
"And we have known and believed the love that God has for us. God is love, and he who abides in love 25
[obedience to God's Laws] abides in [and is a FIDUCIARY of] God, and God in him." 26

"Now by this we know that we know Him [God], if we keep His commandments. He who says, "I know Him," 28
and does not keep His commandments, is a liar, and the truth is not in him. But whoever keeps His word, truly 29
the love of God is perfected in him. By this we know that we are in Him [His fiduciaries].

3 DEFINITIONS 1
Church and Congregation: 2
The word Church in this document and other Governing Documents is defined as it is used in the Bible and also as 3
defined at law, below, to designate the body of Christ, which is the diverse body of all believers doing the work of Christ 4
throughout the world. 5
Who now rejoice in my sufferings for you, and fill up that which is behind of the affections of Christ in my flesh 6
for His bodys sake, which is the Church. 7

we are members of His body, of His flesh, and of His bones. 10

In its most general sense, the religious society founded and established by Jesus Christ, to receive, preserve, 17
and propagate His doctrines and ordinances 18

Congregation: 20
The word congregation as used in this document is used synonymously to designate an assembly of two or more believers 21
who follow the teachings of J esus Christ. _________________(church name) Church is a local congregation of the One 22
True Church, of many congregations; headed by J esus Christ. (Matt 18:20) 23
19Again I say unto you, That if two of you shall agree on earth as touching any thing that they shall ask, it 24

4 LEGAL STATUS OF CHURCH FORMED 28
4.1 Church is an Establishment of Religion in terms of the Constitution of the United States of America. 29
_________________(church name) and all of the members individually shall have the legal status described below: 30
1. We are fiduciaries of God, who is a "nontaxpayer", and therefore we are "nontaxpayers". Our legal status takes on the 31
character of the sovereign who we represent. Therefore, we become "foreign diplomats" . 32

2. The laws which apply to all civil litigation relating to us are from the domicile of the Heavenly sovereign we represent, 37
which are the Holy Bible pursuant to: 38

3. Our "domicile" is the Kingdom of God on Earth, and not within the jurisdiction of any man-made government. We can 1
have a domicile on earth and yet not be in the jurisdiction of any government because the Bible says that God, and not 2
man, owns the WHOLE earth and all of Creation. We are therefore "transient foreigners" and "stateless persons" in 3
respect to every man-made government on earth. See the following for details: 4

4. We are "Nonresident aliens" and "nationals" but not "citizens" under federal law. The reason this must be so is that a 5
"citizens of the United States" (who are all born in and resident within exclusive federal jurisdiction under 8 U.S.C. 6
1401) may not be classified as an instrumentality of a foreign state under 28 U.S.C. 1332(c) and (d) and 28 U.S.C. 7
1603(b). 8
5. We are not and cannot be "residents" of any earthly jurisdiction without having a conflict of interest and violating the 9
first four Commandments of the Ten Commandments found in Exodus 20. Heaven is our exclusive legal "domicile", 10
and our "permanent place of abode", and the source of ALL of our permanent protection and security. We cannot and 11
should not rely upon man's vain earthly laws as an idolatrous substitute for Gods sovereign laws found in the Bible. 12
Instead, only God's laws and the Common law, which is derived from God's law, are suitable protection for our God- 13
given rights. 14
For I was ashamed to request of the king an escort of soldiers and horsemen to help us against the enemy on 15
the road, because we had spoken to the king, saying The hand of our God is upon all those for good who seek 16
Him, but His power and His wrath are against all those who forsake Him. So we fasted and entreated our God 17
for this, and He answered our prayer. 18

6. We are "Foreign Ambassadors" and "Ministers of a Foreign State" called Heaven. The U.S. Supreme Court said in 20
U.S. v. Wong Kim Ark below that "ministers of a foreign state" may not be statutory "citizens of the United States". 21
"For our citizenship is in heaven [and not earth], from which we also eagerly wait for the Savior, the Lord 22
Jesus Christ" 23

"And Mr. Justice Miller, delivering the opinion of the court [legislating from the bench, in this case], in 30
analyzing the first clause [of the Fourteenth Amendment], observed that the phrase subject to the 31
jurisdiction thereof was intended to exclude from its operation children of ministers, consuls, and citizens or 32
subjects of foreign states, born within the United States." 33

7. Our dwelling is a "Foreign Embassy". Notice we didn't say "residence", because only "residents" can have a 35

8. We are protected from federal government persecution by 18 U.S.C. 112 and the Foreign Sovereign Immunities Act 37
of 1976 . 38
9. We are a "stateless person" within the meaning of 28 U.S.C. 1332(a) immune from the jurisdiction of the federal 39
courts, which are all Article IV, legislative, territorial courts. We are "stateless" because we do not maintain a domicile 40
within the "state" defined in 28 U.S.C. 1332(d), which is a federal territory and excludes states of the Union. 41
10. We are not allowed under God's law to conduct "commerce" or "intercourse" with the government by sending to it our 42
money or receiving benefits we did not earn. Blacks Law Dictionary defines "commerce" as "intercourse". The Bible 43
defines "the Beast" as the "kings of the earth"/political rulers in Rev. 19:19: 44
And I saw the beast, the kings [heathen political rulers and the unbelieving democratic majorities who control 45
them] of the earth [controlled by Satan], and their armies, gathered together to make war against Him [God] 46
who sat on the horse and against His army. 47

This is consistent with the Foreign Sovereign Immunities Act found in 28 U.S.C. 1605(a)(2) , which says that those 1
who conduct "commerce" with the "United States" federal corporation within its legislative jurisdiction thereby 2
surrender their sovereignty. See: 3

Our Lord agreed with the above conclusions when he said: 5
"Adulterers and adulteresses! Do you now know that friendship [and "citizenship"] with the world [or the 6
governments of the world] is enmity with God? Whoever therefore wants to be a friend ["citizen" or 7
"taxpayer" or "resident" or "inhabitant"] of the world makes himself an enemy of God." 8

Go to the link below to listen to a message from Pastor Mike Macintosh of Horizon Christian Fellowship given on 10
5/14/2006 confirming the above. In this message, he mentions that Christians are "aliens" when in fact, what we believe he 11
really means is "foreigners". We also note that a "national" but not "citizen" is a "foreigner" and a "foreign person" in 12
respect to every subject matter of federal legislation. 13

Any other status imputed or assumed by the government other than "foreign" and "sovereign" and "alien" amounts to 15
"compelled association" in violation of the First Amendment (see section 6 later for explanation). We must surrender our 16
sovereignty to Him and become His fiduciaries in order to be granted sovereignty over our government and our own affairs, 17
because ALL SOVEREIGNTY ultimately comes from Him: 18

My statutes [violated God's laws], which I have commanded you, I will surely tear the kingdom [and all your 20

4.2 Church is an Establishment of Religion in terms of the Constitution of the United States of America. 35

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or 37
abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to 38
petition the government for a redress of grievances. 39

4.3 Church is a FREE CHURCH 41
A free church is a Christian church that is intrinsically separated from any government (as opposed to a theocracy, or an 42
"established" or state church). A free church does not define government policy, nor have governments define church 43
policy or theology, nor seeks or receives government endorsement or funding for its general mission. 44

This is historically what the Christian church was before Emperor Constantine, and did not appear again until the Protestant 1
Reformation. 2
This Church shall not seek nor accept government registration under I.R.C. 501(c )(3). 3
This Church shall not seek nor accept government enumeration, including Taxpayer Identification Numbers (TINs), 4
Employer Identification Numbers (EINs). 5
Any real estate held by the Church shall be held in a trust using an un-enumerated, unregistered foreign trust. 6
5 LORDSHIP OF JESUS CHRIST 7
J esus Christ is the Head of ALL aspects of the Church, having sole and Sovereign Authority over it: 8
... Christ is the head of the Church, His body, of which he is the Savior. 9

And He is the Head of the body, the Church; He is the beginning and the first born from among the dead, so 11
that in everything He might have supremacy. 12

So in Christ we who are many form one body, and each member belongs to all the others. (Rom. 12:5) 14
Which He [God] exerted in Christ when he raised him from the dead and seated Him at His right hand in the 15
heavenly realms, far above all rule and authority, power and dominion, and every title that can be given, not 16
only in the present age but also in the one to come. And God placed all things under His feet and appointed 17
Him to be head over everything for the Church. 18

6 NON SECTARIAN AND NON DENOMINATIONAL 20
The _________________(church name) name was chosen as a name of reference only - not to create a sect or 21
denomination in any way. _________________(church name) is not affiliated with any religious party or denomination. 22
The church is private, not public, though all are invited to attend the congregations meetings for their stated purposes. One 23
does not need to be part of the _________________(church name) to attend the _________________(church name). The 24
term Christian Church is used to describe the teachings and practices of the _________________(church name) are based 25
upon the Christian Faith and doctrines as found in the Bible. _________________(church name) does not have any 26
organizational ties with other Christian Church groups, but recognizes that, spiritually, all believers are part of the one 27
Church that belongs to Christ (Rom 16:16) and God (Acts 20:28; 1 Cor. 1:2; 10:3; 11:16; 15:9; 2 Cor. 1:1; Gal. 1:13; 1 28

7 MEMBERS 31
The signer(s) of this document is/are the initial covenant member(s) of the _________________(church name). Member(s) 32

primarily through men and woman by His Spirit, human decision-making power for _________________(church name) is 34

9 SCOPE OF POWERS 1

members in accordance with its Governing Documents, is authorized to conduct Church functions it determines to be 3
necessary. Such activities may include, but are not limited to: Conducting Church Services and other worship activities; 4
establishing a witness to the local neighbors and all who come to visit; educating people in Bible basics; preparing them for 5
Federation in their marriage, family, church, community, government; helping and teaching the brethren to be fruitful 6
individuals in spite of personal difficulties and limitations; serving as a repository of Bible study literature and disseminate 7
it as God makes it possible; writing the experiences of the community in word, song or other media, to be an inspiration and 8
an encouragement to others for similar communities and local church congregations; opening financial accounts such as 9
bank accounts, brokerage accounts or other investment accounts; the purchase, lease or rental of congregational meeting 10
facilities and work facilities for ministries; the purchase, lease or rental of necessary equipment, musical instruments, 11
vehicles, supplies, implements or tools, and any and all other forms of property, both real and personal; the care, 12
remuneration and/or compensation of those laboring in church service; the distribution of tangible and intangible gifts or 13
benevolent charities; as well as any other necessary and appropriate financial transactions of _________________(church 14
name), acting through its Governing Body, for the initiation, promotion, expansion and continuation of its activities. 15
