Said reason and belief is based upon the following facts and circumstances (provide narrative, using back of this affidavit or attaching additional pages and/or case report, as neede4):
On 01-25-14 at approximately 10:27pm, I, Ofc. T. Huckaby #1 047, received a dispatched call to the area of eastbound W. SH 114 near Beltline Road in reference to a DWI that was being followed by the Witness, Crystal Hermosillo. Officers located the tractorltrailer that was described to us by the caller as it was traveling northbound on N. SH 161 atW. SH 114. Officers observed that the driver began driving on the improved shoulder so they conducted a stop on N. SH 161 NB and Las Colinas BL, Irving, Dallas County, Texas, and they called for my assistance. I arrived and began speaking to the driver of the Tractor, Khong, Chien 06-16-79 aIm (California CDL #B6925490) (Defendant #1), who after providing a story that did not make any sense, provided me with consent to search the cab of the Tractor. I had the passenger exit the Tractor, who was identified as Khong, Diep 03-08-82 aIm (California CDL #D1 752532) (Defendant #2). During my search of the Tractor, I located 5 large duffle bags that contained approximately 153.2 pounds of marijuana. Mr. Chien Khong provided me with a full confession and stated that he was transporting the marijuana across the U.S. and he was going to receive $30,000 dollars for hauling the load of marijuana. Mr. Diep Khong knew that there was something illegal in the duffle bags, but he stated that he did not know what was in them. Mr. Diep Khong operated the Tractor during the trip and while knowing something was illegal in the bags, therefore, he was also charged with the same offense as Mr. Chien Khong, which is Possession of Marijuana < 2000 lbs.
