CALL TO ORDER At 4:00 p.m., Monday, October 21, 2013, Speaker Feliciano Belmonte Jr. called the session to order. NATIONAL ANTHEM AND PRAYER Pursuant to Section 72, Rule XI of the Provisional Rules of the House and in commemoration of the National Childrens Month, the Zone 1 Movers Children from Tondo, Manila led the singing of the National Anthem and the doxology. SUSPENSION OF SESSION On motion of Representative Arthur R. Defensor Jr., the session was suspended at 4:06 p.m. RESUMPTION OF SESSION The session resumed at 4:16 p.m. with Deputy Speaker Giorgidi B. Aggabao presiding. DEFERMENT OF THE ROLL CALL On motion of Rep. Defensor, there being no objection, the Body deferred the calling of the Roll. APPROVAL OF THE JOURNAL Thereafter, on motion of Rep. Defensor, there being no objection, the Body approved Journal No. 22 dated October 14 and 16, 2013. THE PRIVILEGE HOUR It being a Monday, on motion of Rep. Defensor, there being no objection, the Chair declared a Privilege Hour and thereafter recognized Rep. Aurora Enerio-Cerilles from the Second District of Zamboanga del Sur to deliver her speech. PRIVILEGE SPEECH OF REP. ENERIO-CERILLES In celebration of the National Childrens Month, Rep. Enerio-Cerilles stressed the tradition of the

House Committee on Welfare of Children, together with the Child Rights Network, of celebrating the event by sharing to the Members their views and advocacies on the rights of the child, and stressed the Committees theme of pursuing inclusive governance by protecting the chids right to participation. She averred that the Philippines must act in compliance with the United Nations Convention on the Rights of the Child to recognize the right of children for freedom of expression along with their other rights, and entail their participation and influence in the decision and policy-making processes by heeding their voices and views on legislations concerning them. Rep. Enerio-Cerilles then thanked the Members of the 15th Congress for enacting Republic Act (RA) No. 10165 or the Foster Care Act which envisions to lessen, if not eradicate, the number of street children. She also expressed gratitude and appreciation to the partner agencies in the Child Rights Network for their unending support and advocacy to promote the best interest of the Filipino child. REFERRAL OF REP. ENERIO-CERILLES PRIVILEGE SPEECH On motion of Rep. Defensor, there being no objection, the Body referred the privilege speech of Rep. Enerio-Cerilles to the appropriate Committee. ACKNOWLEDGMENT OF GUESTS Thereafter, on motion of Rep. Victoria G. Noel, the Chair acknowledged the presence in the Session Hall of guests of Rep. Josephine R. Sato. Whereupon, on motion of Rep. Defensor, the Chair recognized Rep. Emmi A. De Jesus from Gabriela Party-List for her privilege speech. PRIVILEGE SPEECH OF REP. DE JESUS Speaking in Filipino, also in commemoration of the National Childrens Month, Rep. De Jesus focused on certain issues affecting the Filipino child,

2 including among others: the challenges and problems in the fight for childrens protection, rights and welfare; the lack of specific policies that would safeguard the children against poverty, forced labor, criminal syndicates and natural and man-made calamities; the absence of healthy environment and proper nutrition; the insufficient fund allocation for health services of Filipinos and for the Department of Health (DOH)-retained hospitals; and the possible eviction of the Philippine Childrens Medical Center (PCMC) from its present location by the National Housing Authority (NHA). Stressing that the bulk of the national budget should be directly allocated to address the health needs of the children, she then urged for the immediate review of the devolution of health services. She disclosed that she had filed House Resolution No. 298 seeking to rechannel the Priority Development Assistance Fund (PDAF) of the Members to social services, wage increases and other priority needs of the people, as well as House Resolution No. 332, calling for a comprehensive study on the importance of and other alternative programs to CCT.

PRIVILEGE SPEECH OF REP. RELAMPAGOS On motion of Rep. Noel, the Chair recognized Rep. Rene L. Relampagos from the First District of Bohol who spoke about the 7.2-magnitude earthquake that hit Bohol and Cebu last October 15, 2013. After stating why Bohol has become a top tourist destination due to its various man-made and natural wonders, famous Boholanos and six heritage churches, four of which stand in his district, Rep. Relampagos thereafter described the extent of damages caused by the earthquake to the province, especially to his district, in terms of infrastructure and human casualties and injuries. He said that initial government data estimated the damage to Bohol infrastructure costing billions of pesos.

8 Even as he mentioned the blessings which the Boholanos still have to be thankful for despite the disaster, Rep. Relampagos urged Congress to be the guardian of culture and heritage and to ensure that disaster preparedness and risk reduction is given highest priority in every barangay. Specifically, he requested, among others: 1) the formulation of a Bohol Recovery Program, the creation of a Bohol Rehabilitation Fund to be included in the 2014 General Appropriations Act (GAA), and the passing of a joint resolution to allow the realignment of available or unused funds in the 2013 GAA to be allocated to Bohol and other provinces affected by natural disasters, like Typhoon Santi; 2) the mandatory restoration and retrofitting of all historical and cultural sites left in the country; 3) the modernization of the Philippine Institute of Volcanology and Seismology (Philvolcs) for the purpose of updating the current Philippine geohazard map; 4) the mandatory allocation of free freight for medical supplies and relief goods of all aircrafts and shipping vessels; and 5) the review of guidelines on the use of calamity funds as far as disaster preparedness is concerned. In ending, he underscored that the earthquake that rocked Bohol only strengthened the peoples faith in God even more, made them count their blessings, and united their province and the whole nation.

MONDAY, OCTOBER 21, 2013 MOTION OF REP. DEFENSOR Rep. Defensor moved to recognize Rep. Raul V. Del Mar for his interpellation. MANIFESTATION OF REP. ATIENZA At this point, Rep. Jose L. Atienza Jr. manifested his desire to also interpellate Rep. Relampagos. REMARKS OF REP. DEFENSOR With the indulgence of Rep. Atienza, Rep. Defensor stated that the first on the list to interpellate Rep. Relampagos was Rep. Del Mar to be followed by Rep. Jonathan A. Dela Cruz. He said that he will have his turn after Rep. Dela Cruz. REMARKS OF REP. ATIENZA Rep. Atienza yielded the floor to Rep. Del Mar but signified his interest to also interpellate Rep. Relampagos. The Chair then recognized Rep. Del Mar for his interpellation. INTERPELLATION OF REP. DEL MAR While Rep. Del Mar detailed how Cebu also suffered from the earthquake, he stressed that Bohol bore the brunt of it. Rep. Relampagos affirmed that the extent of destruction, death, injury and trauma and the cost of repair and rehabilitation in his province were worse that what had been initially estimated and would even worsen with the continuing aftershocks. He stressed the need for more assistance; welcomed the postponement of barangay election in the province so as to focus on the current crisis; and thanked his colleague for suggesting that Bohols needs should take priority over those of Cebus. MOTION OF REP. DEFENSOR Rep. Defensor subsequently moved that the Chair recognize Rep. Karlo Alexei B. Nograles from the First District of Davao City on a question of personal and collective privilege.

MONDAY, OCTOBER 21, 2013 REMARKS OF REP. ATIENZA The Chair took note of Rep. Atienzas manifestation to give way to Rep. Nograles and to be allowed to interpellate Rep. Relampagos thereafter. QUESTION OF PRIVILEGE OF REP. NOGRALES Recognized by the Chair, Rep. Nograles clarified that he took the floor not to defend the Priority Development Assistance Fund (PDAF) but to give a eulogy on the same considering that it would no longer be incorporated in the proposed 2014 General Appropriations Act or GAA and that the Supreme Court would soon issue a ruling on its legality. As he discussed the surveys conducted by Pulse Asia Research showing that majority of the people still found the PDAF useful and beneficial in serving the needs of the citizenry, Rep. Nograles pointed out that the effects of the PDAF are even more pronounced in Mindanao as almost two-thirds of Mindanaoans favor its retention as they view the PDAF as an equalizer considering that Mindanao always gets the last priority in terms of government spending. Furthermore, he stated that the PDAF has augmented and supported the projects and programs that were needed to address the problems in their districts and the concerns of their constituencies. In conclusion, Rep. Nograles requested his colleagues to remember the PDAF not on its highly publicized alleged misuse but for all the benefits it has provided to many poor families, the countless scholars who were able to finish their education, the multitude of patients who were given medicines, the many lives it helped save, the grieving families it comforted, and the hungry mouths it helped fed. MOTION OF REP. DEFENSOR Thereupon, Rep. Defensor moved for the referral of Rep. Nograles speech to the appropriate Committee. MANIFESTATION OF REP. DELA CRUZ Rep. Dela Cruz then sought recognition from the Chair. SUSPENSION OF SESSION The Chair suspended the session at 6:19 p.m., upon motion of Rep. Defensor. Recognized by the Chair on motion of Rep. Defensor, Rep. Dela Cruz said that he wanted to ask Rep. Nograles whether he believes that the statistics given by Pulse Asia is accurate or has been merely misused, this as he further asked whether under the 2014 national budget, it would now be left to the Departments concerned to give the funds for scholarship, medical assistance or infrastructure programs and projects as the case may be instead of allowing the Members to participate in said undertakings through their PDAF allocations. He also inquired how the Members could approve the proposed budget measure when they do not know what would happen to the beneficiaries of their PDAFs, or the arrangements that would be available for their districts. He stressed that the foregoing were some of the questions that he would have posed to Rep. Nograles but who opted not to yield to interpellations. The Chair noted Rep. Dela Cruz manifestation. REFERRAL OF REP. NOGRALES SPEECH On motion of Rep. Defensor, there being no objection, the Body referred Rep. Nograles speech to the appropriate Committee. PARLIAMENTARY INQUIRY OF REP. ATIENZA After noting that Rep. Relampagos was not in the Session Hall, Rep. Atienza inquired whether in lieu of an interpellation, he could just make a manifestation on the formers privilege speech. The Chair sought the opinion of the Majority Leader. REMARKS OF REP. DEFENSOR Rep. Defensor stated that he would submit to the ruling of the Chair with respect to Rep. Atienzas manifestation, as he clarified that the Body was still under the Privilege Hour. This could only be interrupted by a point of order, a motion to adjourn or a question of privilege which Rep. Nograles had just availed of, he added.

10 RULING OF THE CHAIR The Chair ruled that Rep. Atienza could make his manifestation. At this point however, Rep. Walden F. Bello sought recognition from the Chair. POINT OF ORDER OF REP. BELLO (W.) Rep. Bello pointed out that a number of Members, including himself, had awaited their turn to speak on the floor but had instead given way to Rep. Relampagos. He sought for the strict enforcement of the Rules of the House and suggested that if Rep. Atienza would like to interpellate Rep. Relampagos, then he should wait for the return of the latter. MOTION OF REP. DEFENSOR Rep. Defensor moved to suspend the session. REMARKS OF THE CHAIR The Chair clarified that the parliamentary status was that Rep. Del Mar to collectively help the people of Bohol, every Member of the Minority and Independent blocs would donate P10,000 each out of their own pockets. While urging everyone to not just depend on what the Executive department could do and could not do in terms of calamity fund allocation, Rep. Atienza urged the Members to set aside differences, to know and do their responsibilities as Members of the House, and to make a collective effort in helping the needy and suffering people of Bohol. The Chair took note of Rep. Atienzas manifestation. REMARKS OF REP. DEFENSOR Rep. Defensor remarked that Reps. Dela Cruz and Rodolfo G. Biazon were supposed to interpellate Rep. Relampagos during the Privilege Hour but that it was appropriately interrupted by a question of collective privilege raised by Rep. Nograles. But due to a very urgent meeting wherein Rep. Relampagos was called in the Office of the Speaker, he would not be able to answer questions in the meantime. Rep. Defensor then moved for the deferment of the interpellation of Rep. Relampagos subject to its continuation upon his return. PARLIAMENTARY INQUIRY OF REP. DELA CRUZ Before the Chair could act on Rep. Defensors motion, Rep. Dela Cruz inquired whether the resumption of the interpellation on Rep. Relampagos speech would happen within the next three days or upon the next session of Congress after a break. Rep. Defensor replied that subject to the availability of Rep. Relampagos, the future proceedings will always have time for the interpellation of said Member. DEFERMENT OF INTERPELLATION OF REP. RELAMPAGOS On a previous motion of Rep. Defensor, there being no objection, the Chair deferred the interpellation of Rep. Relampagos at another time. MONDAY, OCTOBER 21, 2013 The Chair then recognized Rep. Bello (W.) from Party-List Akbayan to deliver his privilege speech. PRIVILEGE SPEECH OF REP. BELLO (W.) In celebration of the World Food Day and Farmers Week, Rep. Bello spoke about the reasons why genetically modified organisms (GMOs) are controversial as they are relevant; the dangers and risks posed by GMOs which compelled many countries to have them banned; and why the Court of Appeals granted a Writ of Kalikasan that stopped field trials on Bacillus thuringiensis (Bt) talong or eggplant. In the interest of consumer welfare, public health, and ecological stability, Rep. Bello proposed a moratorium on granting licenses for the import of GMO foods and crops for sale or for field testing until a viable risk assessment agency under the Department of Agriculture (DA) is created, and a ban is imposed on all field testing of all GMO crops to prevent genetic contamination. REFERRAL OF REP. BELLOS (W.) PRIVILEGE SPEECH On motion of Rep. Defensor, there being no objection, the Body referred Rep. Bellos (W.) privilege speech to the appropriate Committee. At this point, the Chair recognized Rep. Dela Cruz for a brief manifestation. MANIFESTATION OF REP. DELA CRUZ Rep. Dela Cruz lamented that Rep. Bello (W.) would not yield to a few questions considering that he has a number of issues that he would have wanted to discuss with him such as the advantages and disadvantages of genetically engineered products; the kind of frameworks, regiments and arrangements the latter is proposing; the kind of products that are already genetically engineered in the market, still organically produced and foremost being used. He also would like to ask what steps are being undertaken by the countrys universities, research organizations, and government agencies like the DA and the Department of Science and Technology (DOST), to inform the public on how to handle this kind of science which is already in place not only abroad but also in the Philippines. He said that it is unfortunate that he was not given the opportunity to ask those questions and that the people were not enlightened on the subject. He however expressed hope that at the proper time, he would be given the chance to ask them.

11 The Chair noted Rep. Dela Cruz manifestation. PRIVILEGE SPEECH OF REP. ILAGAN On motion of Rep. Defensor, the Chair recognized Rep. Luzviminda C. Ilagan from Party-List Gabriela who called the attention of the Body on the plight of indigenous women, more importantly to the continuing militarization and injustice that indigenous women are subjected to, as the country commemorates the Indigenous Peoples Month and the International Rural Womens Day. She then narrated the case of a woman and her children from the Blaan tribe who were killed during military operations as well as the human rights violations perpetuated against the Lumad or the indigenous people (IP) of Southern Mindanao, including the murder of an advocate and missionary for IPs rights. Rep. Ilagan enjoined the Members to uphold the rights and interests of women in indigenous and rural communities, to seek justice for IP victims of extrajudicial killings, to stop militarization in indigenous communities, and to protect ancestral lands from multinational mining companies and large-scale agricultural interests. The Chair thereafter recognized Rep. Atienza for his interpellation. INTERPELLATION OF REP. ATIENZA Rep. Atienza raised the issue of unresolved human rights violations particularly the extrajudicial killings committed against indigenous communities by mining companies. He underscored that this issue could only mean that there had not been a full enforcement of the law in protecting the rights of indigenous people and communities or that the Mining Act had been rendered ineffective. He inquired whether Rep. Ilagan will propose to amend the Mining Act to provide the indigenous communities with the full benefits of the law. This, as he underscored that he will support a measure that will further clarify the issue of mining and its impact on the national economy and the indigenous communities provided that there is no prejudicial treatment against mining companies and there is evidence of clear violation of the law.

12 Rep. Ilagan, in answer, cited that the Alternative Mining Act measure had already been filed to correct the prevalent and unresolved deficiencies of the law. She stated that she will welcome Rep. Atienzas participation in congressional investigations regarding violations of the Mining Act and the involvement of the military in human rights violations against indigenous communities. She underscored that she is not against mining per se and clarified that her speech aims to highlight the problems besetting IP communities, which include the ill effects of illegal mining. MANIFESTATION OF REP. DELA CRUZ Rep. Dela Cruz inquired from the Chair whether he can interpellate Rep. Ilagan. EXTENSION OF THE PRIVILEGE HOUR To accommodate Rep. Dela Cruz interpellation, on motion of Rep. Defensor, there being no objection, the Chair extended the Privilege Hour for another five minutes. INTERPELLATION OF REP. DELA CRUZ Recognized by the Chair, Reps. Dela Cruz and Ilagan debated on the matter of human rights violations in IP communities especially in areas where the government is already implementing the Payapa at Masaganang Pamayanan (Pamana) Program for indigenous communities. Rep. Ilagan said that during the recent budget deliberations, the Committee on Appropriations did not give a satisfactory explanation on the issue of budgetary allocation for the Pamana program, particularly on its nature, beneficiaries and specific areas and locations where it is being implemented. For his part, Rep. Dela Cruz expressed hope that special purpose funds such as the Pamana fund would be properly allocated so that it would redound to the benefit of the indigenous peoples. EXTENSION OF THE PRIVILEGE HOUR On motion of Rep. Defensor, there being no objection, the Body extended the Privilege Hour for another three minutes. Thereafter, the Chair recognized Rep. Edgar R. MONDAY, OCTOBER 21, 2013 INTERPELLATION OF REP. ERICE Rep. Erice initially related his experiences with the New Peoples Army and the indigenous people, as a former director of a large-scale, Filipino-owned mining company. Thereafter, he discussed with Rep. Ilagan why big mining companies avail themselves of the services of the Citizens Armed Forces Geographical Unit (CAFGU) as well as how government agencies such as the National Commission on Indigenous Peoples or NCIP abuse and manipulate the indigenous peoples. TERMINATION OF THE PRIVILEGE HOUR On motion of Rep. Defensor, there being no objection, the Body terminated the Privilege Hour subject to the inclusion in the Unfinished Business of subsequent proceedings of the continuation of the interpellation on the speeches of Reps.
