Draft Resolution 1.

1 Committee: World Trade Organization Topic Area: Trade-Related Aspects of Intellectual Property Rights (Justice and Fairness in Trade) Signatories: Afghanistan, Argentina, Brazil, Central African Republic, Chad, Denmark, Djibouti, Egypt, France, India, Iran, North Korea, Poland, Russia, Singapore, South Africa, South Korea, Recognizing the definition of Intellectual Property Rights as the rights given to people over the creation of their minds, this may include Patents, Copyrights, Plant Variety Protection, Data Protection, Competition Policies, Trademarks, Industrial Designs and Trade secrets, however nations will not be enforced to subject to this definition according to Article 2 of the Trips Agreement, Reaffirming Article 27.3 of the TRIPS agreement that states, members may also exclude from patentability; plants and animals other than micro-organisms, and essentially biological processes for the production prompting an antagonistic impact on the horticultural area especially on the agrarian economies of the planet, Acknowledging the advantages of Intellectual Property Rights such as Provision of financial security, hence leading towards employment, Incentivizing the producers to work towards the solutions of the problems we face in the current days, and consumer confidence since they are provided with authentic goods, Referring to the need for developing countries to be able to copyright their varieties of traditional products such as handicrafts

and local varieties of agro-products should be patented so that they are not subject to copy; Bearing in mind the three 'A's problem stated lack of Accessibility, Affordability, and Availability of essential pharmaceutical products for the general public, especially in the developing and underdeveloped countries, Realizing the vital part of non-governmental associations in managing the poor status of population's health in developing states, Taking into account the widespread theft and copyright infringement occurring at a mass level on the web at a worldwide scale, absence of mindfulness around the masses with respect to intellectual property rights on the web and the absence of discouragement in view of poor execution of intellectual property laws, Having reviewed the need to prevent smuggling and trade of counterfeit products and for strong border security to be implemented, Having decided to provide Iran with full membership in the World Trade Organization, Concerned about the IPR infringement and increasing piracy taking place at a mass global scale level due to lack of awareness amongst the people with regards to IPR on the web due to poor implementation of IPR protection laws, 1. Recognizes the need for implementation of robust Intellectual Property laws,

Calls upon local and regional Non-Governmental Organizations and UNDP to work in collaboration in order to bring awareness in developing countries regarding Intellectual Property Rights through: a) Online marketing campaigns; b) Print advertising in journals; c) Conferences' sponsorships; d) Awareness programs, 3. Encourages the provision of Compulsory Licensing by the developed nations to the developing nations in "emergency situations", 4. Further defines emergency situations as of which poses an immediate risk to health and life of the people or the environment of a particular country; 5. Recommends amendment of article 28.1 (b) of the TRIPS agreement by allowing process patenting for all Intellectually Produced products under which a particular method for making the product will be protected, however, the product of that innovation would not subject to protection, this will: a) Allow a lower standard of intellectual property protection and thus encourage competition which in turn serves to decrease market prices, b) Encourage competing companies to invest in R&D to adopt a method of producing the product in question, more efficiently than the current standards, c) Make sure the newly developed method is more efficient and cost-effective, because the more efficient and cheaper product would be preferred by consumers in developing countries,

d) Solve the Accessibility, Affordability and Availability issues of live-saving medicines in the developing countries; 6. Supports Differential pricing framework as to be practiced for High-yield variety seeds where different prices will be charged for the developing countries according to its population income to guarantee impartial access to life sparing prescriptions specifically targeting the affordability existent in the developing countries regarding the use of HYV seeds; 7. Takes note of the absence of openness to better seeds or the failure to enter better and more propelled agricultural routines, for each one of the countries that are confronting issues with respect to the agricultural sector; 8. Strongly supports the establishment of Border Security through the following measures; a) Emphasis on the strengthening the security of the borders by the deployment of security forces alongside government officials who will be present there to provide sufficient analysis and maintain check and balance of the products being transferred, b) Identification of "hot zones", places where smuggling of counterfeit products is suspected, c) Specific criteria will be set for curbing illicit trade by the governments judicial bodies themselves, d) Border Patrol and strong security checks in order to ensure safe passage of original products, e) Encouraging the establishment of a global fund which will act as a pool of finance for the security of the borders, where countries can contribute and maintain the global fund;

9. Instructs the solution of cyber crimes with regards to Intellectual Property laws through the following: a) Adoption of methods similar to the Madrid System to protect internationally protected property, b) Utilization of accessible symbols upon sites, for example, copyrights, trademarks and symbols which are enrolled, c) Expressing on websites through firmly worded letters that prosecution will take place if any of the IPR law is broken which goes under the support of WTO, d) Establishment of a local research team which will keep a check and balance of any illegal IPR infringement on the internet, e) Individual states will be responsible for the appointment and monitoring of the above mentioned team, f) Developed countries must share their modernized cyber piracy protection methods with the developing countries; 10. Emphasizing that the education of Intellectual Property Rights and piracy should be included in the secondary and higher education with the following steps: a) Awareness of piracy can be introduce on secondary level, b) Proper education regarding IPR and piracy should be taught in business schools, so as to prepare young entrepreneurs to establish their business with in Intellectual Property Right limits, c) Short term courses on IPR should be included in all periods of education on university level where there is a possibility of new businesses or new entrepreneurs to emerge;

11. Urges the International Community to establish a national body in their respective countries such as National Council against Piracy and Intellectual Property Crimes in Brazil, which can take necessary measures in order to counter such organizations or individuals which are involved in piracy production: a) The body will comprise Government representatives which will include: i. Judiciary representatives ii. Ministry Finance iii. Ministry External Relations iv. Ministry of Science and Technology v. Ministry of Culture vi. Ministry of Development, Industry and Foreign trade, b) The body will also comprise of representatives from Multinational corporations and Small Medium Enterprises(SMEs), c) This body will submit a report on annual basses on the assignments that are carried out against Piracy and Intellectual Property Crimes to the United Nations, d) This body will carry out investigations in order to locate the root causes of piracy upon certain goods and industries in that particular country or region, e) This body will also carry out inquiries and investigations upon those individuals or companies who are caught in piracy cases: i. The first part is to analyze the business of those captives and to check whether the business was

for self profit or according to the buying power of the population, ii. The second part will include trials on those captives in order to check whether they fall under the category of Intellectual Property Crimes, iii. The third part will include issuing penalties to those captives that are found guilty in trials and to provide safe and legal business excess to those that are not found guilty; 12. Recommends awareness programs regarding Intellectual Property Rights should be conducting through multiple channels: a) Awareness programs can be conducting with the help of Theater acts and televisions dramas, b) This can also be done through print media such as publishing brochures, newspapers and magazines, c) Awareness with importance can be carried out through publishing on the first page of every book, research paper or any valuable print document, d) Text messages and emails can play a vital role in promoting awareness on Intellectual Property Rights, e) Digital media can be utilize for conducting different talk shows on Intellectual property Rights, f) Seminars and workshops can be conducted on how to prevent from piracy and Intellectual Property Crimes and how individuals can promote Intellectual property rights amongst other individuals; 13. Encourages P2P (Peer to Peer) service should be introduce in order to stop music or movie piracy through certain measures:

a) Internet service providers can charge the customers a monthly fee in exchange for unlimited and legal access to currently illegal file-sharing, b) The customer will be blocked unless he or she purchasing with subscription and money generated from it would be given directly to the artists and labels depending on download volume, c) Collaboration between P2P Company, radio stations and music industry should be properly established so that consumers would continue to have free music and radio stations and music industries can also make their own earnings, d) If any website or P2P service illegally distributes music without paying the fees, then they would face heavy penalties from the governments; 14. Confirms that governments should have collaboration with different multinational cooperations as to overcome piracy and to maintain the prices of commodities of those particular companies as to provide original goods in accessible rates; 15. Decides to remain actively seized in this matter.
