MONDAY, NOVEMBER 25, 2013 RESUMPTION OF SESSION The session resumed at 4:14 p.m. THE PRIVILEGE HOUR It being a Monday, on motion of Rep. Gunigundo, there being no objection, the Chair declared a Privilege Hour and thereafter recognized Rep. Neri J. Colmenares from Party-List Bayan Muna for his privilege speech. PRIVILEGE SPEECH OF REP. COLMENARES Rep. Colmenares focused on the recent Supreme Court (SC) decision declaring as unconstitutional the Priority Development Assistance Fund (PDAF) or other similar lump-sum items, and opined that eliminating the pork barrel of the Congressmen and Senators would not stop graft and corruption and patronage politics as long as the presidential pork exists. He thereafter referred to the SC opinion of Congress invalid delegation of power because of the lump-sum items in the national budget, and pointed out that the Presidents use of his lump-sum fund would mean allowing him to exercise invalid appropriation powers and also giving him the power to legislate. He likewise emphasized that the Presidents approving the General Appropriations Act containing allocations that are not itemized would also mean violating the doctrine of presentment, as Congress has no way of determining whether the President would approve or disapprove a project with wisdom. Finally, he suggested the use of the calamity fund for the victims of Typhoon Yolanda and other similar natural disasters through an itemized supplemental budget, and asked the High Tribunal to also declare the presidential pork as unconstitutional. The Chair thereafter recognized Rep. Elpidio F. Barzaga Jr. for his interpellation. INTERPELLATION OF REP. BARZAGA After seeking affirmation from Rep. Colmenares that he was already a Member of the House that approved the national budgets for the years 2011 to 2013 which included appropriations for PDAF, Rep. Barzaga discussed with the latter the reasons why he did not object to their approval despite their alleged infirmities and unconstitutionalities, and why he, given this knowledge, still availed of said funds during the aforestated period.

11 The Members also discussed the nature and constitutionality of lump-sum appropriations such as the Disbursement Acceleration Program (DAP), Malampaya Fund and the Presidents Social Fund (PSF); the authority and power of Congress to approve or disapprove properly identified development projects; and the appropriateness of filing a motion for reconsideration to challenge SC decisions. House Resolution No. 294, on the alleged onerous acts of Maynilad Water Services, Inc. and the Manila Water Company - to the Committee on Government Enterprises and Privatization; 47. House Resolution No. 296, on the government's failure to build a single fire station in 613 municipalities countrywide, as required by a 23-year-old law - to the Committee on Public Order and Safety; 48. House Resolution No. 297, on the reported illegal activities and malpractices of the Metropolitan Waterworks and Sewerage System (MWSS) leadership - to the Committee on Government Enterprises and Privatization; 49. House Resolution No. 299, on the impact of the use of performance-based regulation adopted by the Energy Regulatory Commission on power rates being charged to consumers - to the Committee on Energy; and 50. House Resolution No. 300, on the long-term environmental and ecological impacts of continuing magnetite mining operations in

15 the Cagayan Valley Region to the Committee on Natural Resources. RESUMPTION OF THE PRIVILEGE HOUR On Rep. Gunigundos motion, there being no objection, the Body resumed the Privilege Hour. Thereupon, on further motion of Rep. Gunigundo, the Chair recognized Rep. Rodolfo G. Biazon for his interpellation of Rep. Colmenares. INTERPELLATION OF REP. BIAZON Rep. Biazons interpellation focused on: 1) the implications of the recent SC ruling on the PDAF as to the functions of the Legislature in enacting laws as well as to lump-sum budgetary allocations, such as the budget for scholarships, medicines, books and construction of bridges which their constituents need; 2) the principle of separation and distribution of powers between the Executive and Legislative branches of government; and 3) the gist of the SC ruling which disallows the allocation of lump-sum that empowers the Members to intervene in executive functions or those which need post-enactment intervention by the Members. Considering that the Presidents calamity fund is a lump-sum appropriation, Rep. Biazon urged Congress to exercise its oversight function and make the President accountable for the expenditure of said fund; propose to the President the use of line budgeting on his discretionary funds; and clarify with the Supreme Court the term contingency fund so that the Members would know when to exercise their oversight function. Thereupon, the Chair recognized Rep. Jonathan A. Dela Cruz for his interpellation. INTERPELLATION OF REP. DELA CRUZ Reps. Dela Cruz and Colmenares debate dealt with the extent and implication on the budgetary processes of the recent SC decision declaring the PDAF and other pork barrel items as unconstitutional. They agreed that Congress is not limited to merely acting and approving the proposed budget of the Executive Department inasmuch as Congress can come up with its own general appropriations bill (GAB) and similarly deliberate on the GAB in parallel to the proposed Executive budget. They further agreed on the need for Congress to fully deliberate on the SC decision, particularly its effect on the proposed 2014 GAB. They also shared the view that Congress is tasked to impose the same principles applied under the decision of the Supreme

16 Court on the use of lump-sum appropriations and discretionary funds by both the Executive Department and the Judiciary. Reps. Dela Cruz and Colmenares further discussed about congressional insertions, funding requirements, and the Presidents power to realign budgets which is only with regard to savings to augment existing projects for the current year. At this juncture, Deputy Speaker Balindong relinquished the Chair to Deputy Speaker Giorgidi B. Aggabao. Moreover, they talked about lump-sum funds such as the PSF and the Malampaya Funds which they agreed should be subject to a special audit by the Commission on Audit (COA) because off-budget accounts coming from said funds should be made transparent to the people. At this point, Deputy Speaker Aggabao relinquished the Chair to Deputy Speaker Balindong. The Chair then recognized Rep. Carlos M. Padilla upon Rep. Gunigundos motion. INTERPELLATION OF REP. PADILLA Rep. Padilla said that although the Members could better ascertain and reflect the needs and aspirations of the different districts in the country, such could be emasculated by the Presidents realignment of funds and exercise of impoundment and veto powers as well as the Constitutions ban on increasing appropriations proposed by the Executive. Rep. Colmenares suggested that they limit the power of impoundment to budget deficits and similar emergencies and only with Congress approval; set aside parochial interests and override the power of veto; and transfer some amounts of money to priority sectors and programs. Both stressed that the House had supremacy over the power of the purse. Thereafter, on motion of Rep. Gunigundo, the Chair next recognized Rep. Antonio L. Tinio for his interpellation. INTERPELLATION OF REP. TINIO Reps. Tinio and Colmenares discussed the issue of presidential lump-sum appropriations and the matter of the supplemental budget as a lump-sum appropriation to cover the calamity fund. Rep. Colmenares pointed out that the Executive Department has no reason to call for lump-sum appropriation and should instead submit a line-item budget proposal to be used for the rehabilitation of

MONDAY, NOVEMBER 25, 2013 areas devastated by the recent typhoon considering that government agencies by now should already know their roles and responsibilities in rehabilitation. For his part, Rep. Tinio cited provisions of the 1987 Administrative Code which provides for the budget procedures and mandates that the regular budgets of government agencies should contain reserves for emergencies and contingencies and that any additional funds needed should be appropriated through a supplemental budget. Finally, Rep. Colmenares agreed to having a contingency fund in the national budget for unforeseen expenses that could not be itemized, this as Rep. Tinio pointed to a 1987 Administrative Code provision for reserved funds of the Departments and deficiency appropriations for emergencies and contingencies as against the huge lump-sum appropriations under the discretion of the President. REFERRAL OF REP. COLMENARES SPEECH On motion of Rep. Gunigundo, there being no objection, the Body referred Rep. Colmenares speech and the interpellations thereon to the appropriate Committee. On further motion of Rep. Gunigundo, there being no objection, the Chair recognized Rep. Luzviminda C. Ilagan of Gabriela Party-List to deliver her privilege speech. PRIVILEGE SPEECH OF REP. ILAGAN Rep. Ilagan initially stressed that the Philippines, for the first time, joins the international community in celebrating the National Consciousness Day for the Elimination of Violence Against Women, and recalled how the movement against the state-inflicted persecution and death of two Latin American women had evolved into a global effort to end discrimination and violence against women and children. She said that after ten years, Gabrielas efforts in crafting the measure enjoining government agencies and departments in marking November 25 for said commemoration has resulted in the signing of Republic Act (RA) No. 10398. She lamented that despite efforts to protect women and children, the Philippine National Police (PNP) and some women and children advocacy groups have reported several cases of rape, attempted rape, trafficking, child pornography and cyber prostitution. She attributed these to poverty and lack of basic and social services exacerbated by the onslaught of natural and man-made disasters, as well as police and military abuse especially in the provinces. She thereafter asked her colleagues to

MONDAY, NOVEMBER 25, 2013 support Gabriela and other concerned sectors and to approve measures to protect women and children against violence and injustice. INTERPELLATION OF REP. ATIENZA Recognized by the Chair, Rep. Jose L. Atienza Jr. discussed with Rep. Ilagan the women in Metro Manila who were victims of robbery, rape and murder, and opined that these crimes proliferate because of the failure by the authorities to efficiently solve them and punish the perpetrators accordingly. Rep. Atienza expressed his concerns on the following: 1) the alarming increase of crimes aside from those which have not been reported as some victims no longer file complaints; 2) the deliberate failure of the police force to immediately respond to victims and apprehend criminals because of their extracurricular activities; and 3) the generally deteriorating peace and order situation in the urban areas of the country especially in Metro Manila. Asking for the Members commitment, he then urged the House leadership to look into and evaluate the performance of the police ranks. REFERRAL OF REP. ILAGANS PRIVILEGE SPEECH On motion of Rep.
