Alvarez acknowledged the presence in the Session Hall of guests of Members from Regions IV and V. Thereafter, the Chair recognized Rep. Sergio A. F. Apostol on a question of personal and collective privilege QUESTION OF PRIVILEGE OF REP. APOSTOL Rep. Apostol delved on the issue of smuggling besetting the Bureau of Customs (BOC), specifically that of the multibillion peso resin importation business, the massive technical smuggling of highend and expensive motor vehicles, oil smuggling, and rice smuggling. He said that he has the pertinent information to support his allegations, which he would present to the House in case of a committee investigation thereon.

7 He then urged the Committee on Good Government and Public Accountability to immediately conduct a thorough investigation of smuggling activities in the Bureau and summon all BOC officials and personnel involved as well as representatives of different business groups to shed light on the issues of corruption and smuggling. Thereafter, the Chair recognized Rep. Magtanggol T. Gunigundo I for his interpellation. INTERPELLATION OF REP. GUNIGUNDO Reps. Gunigundo and Apostol discussed the involvement of Mr. Robert Coyiuto in the smuggling of luxury vehicles, the procedure in which the latter operates his business and the tax assessment of the Bureau of Internal Revenue (BIR) regarding the importation of high-end luxury vehicles. Rep. Gunigundo suggested that Congress should investigate all importers of luxury vehicles to ascertain whether they have been paying the proper taxes to the government. Both Members also delved into the conflicting orders issued by the BOC and the Office of the President with respect to the organization of the Customs Tax Policy Office (CTPO) specifically on the issue of replacing senior officials of the BOC with personnel who are lesser in rank, stature and experience which they agreed was a violation of Republic Act (RA) No. 6656, protecting the security of tenure of civil servants in the reorganization of a government agency. Thereafter, the Chair recognized Rep. Andres D. Salvacion Jr. for his interpellation. INTERPELLATION OF REP. SALVACION Rep. Salvacion discussed with Rep. Apostol the veracity of allegations against personalities involved in the rampant smuggling of plastic resins, luxury vehicles, oil and rice, and the amount of government revenue losses due to the aforementioned smuggling activities. Their discussion also dealt with Rep. Salvacions concern on whether 1) the BOC has been actively pursuing the people engaged in smuggling in the ports of Cebu; 2) cases have been filed against the employees involved; 3) documents on the tax collection shortfall by the various ports throughout the country are available; and 4) there is a distinction between the real valuation and benchmarking system imposed by the Customs Commissioner.

Gonzales II informed the Body that copies of House Bill No. 2630, entitled AN ACT APPROPRIATING FUNDS FOR THE OPERATION OF THE GOVERNMENT OF THE REPUBLIC OF THE PHILIPPINES FROM JANUARY ONE TO DECEMBER THIRTY-ONE, TWO THOUSAND AND FOURTEEN, AND FOR OTHER PURPOSES, were distributed to the Members and that the House of Representatives was in receipt of a certification from President Benigno S. Aquino III certifying the necessity of the immediate enactment of the said Bill. Thereafter, Rep. Gonzales moved for the approval on Third Reading of the same. OBJECTION OF REP. TIANGCO Rep. REMARKS OF REP. GONZALES Affirmative: With the permission of the Chair, Rep. Gonzales said that the President has been certifying the urgency of the passage of the budgets in the past and that Congress as an institution has been honoring such certifications. He emphasized that as provided for in the certification of President Aquino, there is a need to immediately pass House Bill No. 2630 in order to maintain the continuous government operations following the end of the current fiscal year to expedite the funding of various programs, projects and activities for 2014 and to avoid a re-enacted budget. With 223 affirmative votes, 24 negative votes and no abstention, the Body approved on Third Reading House Bill No. 2630. EXPLANATIONS OF VOTE The following Members explained their votes: 1. Speaking in Filipino, Rep. Raneo E. Abu voted in the affirmative to House Bill No. 2630 because the Bill will prove to the people that the House of Representatives can continue to uphold and perpetuate a legislature even without the Priority Development Assistance Fund (PDAF) or the pork barrel. He expressed confidence that the implementing agencies tasked to take care and provide the necessary assistance to the poor would also do the same for his constituents. This, he said, does not mean turning his back to his sworn duties and responsibilities but making his stand as a true Representative of the people.

14 REMARKS OF REP. ATIENZA Before the Chair could recognize Rep. Walden F. Bello, Rep. Jose L. Atienza Jr. noted that the Secretariat did not mention his name during the Roll Call for explanation of vote and asked for reconsideration so he could explain his vote. The Chair replied that Rep. Atienza would be allowed to do so. EXPLANATIONS OF VOTE (Continuation) 2. Rep. Bello (W.) said that Party-List Akbayan voted yes to the 2014 General Appropriations Bill (GAB) not because it is perfect but because they have to make sure that the government does not ground to a halt for lack of funds. He reiterated Akbayans commitment to pursue the following reforms to democratize the budget process and restore the power of the purse to Congress and the people: a) push for the freedom of information legislation to insure the transparency of the budget process; and b) fight for legislative impoundment and control in the savings and augmentation legislations to regulate the Executives authority to defer, rescind and reserve expenditures already approved by Congress and prevent the unscrupulous practice of realigning the so-called savings to dubious reallocations. In conclusion, he explained that his affirmative vote means that the government can continue to serve the people, and that the government and civil society can continue strengthening the transparency and accountability mechanisms of the budget process. 3. Rep. Atienza explained his emphatic no to the 2014 GAB by citing, among others, the constitutional issue that may arise from an adverse decision of the Supreme Court on the legality of the Disbursement Acceleration Program. He likewise cited the manner in which the Members are voting on Third Reading on House Bill No. 2630, considering the practical application of the Rules wherein the Members are provided three days to review the proposed 2014 national budget before they cast their votes thereon. He claimed that copies of the measure were only provided to the Members that day, which does not allow for a comprehensive review of the contents of the Bill and an intelligent vote on the measure. He also pointed out that the explanations of vote of the Members after the final tally of the voting do not give them the chance to persuade other Members of Congress to vote against or in favor of the measure.

TUESDAY, OCTOBER 22, 2013 4. Rep. Mercedes C. Cagas voted in favor of the 2014 GAB. She also requested for a congressional inquiry into the recent conduct of automated elections specially in Davao del Sur and the P2.21-billion ghost infrastructure project in her province. 5. Rep. Neri J. Colmenares enumerated the reasons for his vote against the 2014 national budget, which included the following, among others: 1) that the proposed 2014 GAB castrates the constitutional power of Congress over the purse; 2) that the Bill provides the retention of the pork barrel fund system and numerous lump sum provisions; 3) that it does not expressly prohibit the presidential power to realign funds through the DAP; and 4) that it contains an unconstitutional provision allowing the President to impound budgetary allocations in the 2014 GAA. He further underscored that the 2014 Budget Bill is not a peoples budget. 6. Speaking in Filipino, Rep. Emmi A. De Jesus registered a no vote, explaining that the 2014 national budget is not responsive to the needs of the families of farmers and farmworkers, laborers, urban poor, indigenous peoples, and the poor and marginalized sectors. She further explained that her negative vote on the measure is premised on her objection to the Presidents use of discretionary funds which she said perpetuates deleterious patronage politics in the country. QUERY OF REP. DELA CRUZ At this point, Rep. Dela Cruz stated that since he had just recently arrived in the Session Hall he would like to register his no vote and thereafter manifested to explain his vote. The Chair informed the latter that his negative vote has been duly recorded and was given three minutes to explain his vote. EXPLANATIONS OF VOTE (Continuation) 7. In preface to the explanation of his negative vote, Rep. Dela Cruz inquired on what had happened to the proposed amendments of the Members of the Minority on the 2014 national budget considering that the Bill did not contain the same. He thereafter cited the specific proposed amendments of the Minority on House Bill No. 2630 which they submitted the previous month. Given enough time, he said that he would have a) requested the Body to take note of the import of Rep. Rene L. Relampagos speech, b) discussed the congressional power of the purse, and c) advised Congress that the government

TUESDAY, OCTOBER 22, 2013 would have no budget at all in the event that the Supreme Court finds several provisions of the budget as unconstitutional. 8. Rep. Ben P. Evardone, in casting a yes vote, said that public funds should be protected and properly used but the government could not operate in an environment where it is summarily condemned. He added that the President needed resources to address national and humanitarian crises, requests, and emergencies. He cited the governments achievements thus far: reforms in the budget process; socioeconomic projects and maintenance of peace and order; and infrastructure, agricultural, and health care projects funded by congressional allocations. To conclude, he urged his colleagues to weave a national budget that promoted economic growth and stability while taking care of the underprivileged. 9. Rep. Felix William B. Fuentebella voted no. He said that the Department of Social Welfare and Development (DSWD) and other agencies covered by the Human Development and Poverty Reduction Cabinet Cluster, did not comply with a request to submit their strategy to further protect the Conditional Cash Transfer (CCT) Program. He asked the Committee on Appropriations to address the matter. 10. Rep. Barry Gutierrez voted in the affirmative. Despite its imperfections, he said that the instant Bill was a courageous step towards achieving a more transparent, participative, responsive, and accountable budget. He added that it was the Chambers response to the public clamor against the PDAF and for a new paradigm on public spending and delivery of basic services. 11. Speaking in Filipino, Rep. Fernando Ka Pando L. Hicap voted against the Bill. He stressed that it allotted funds to programs which would not adequately address the needs of marginalized sectors, citing the Comprehensive Agrarian Reform Program (CARP) and CARP-Extension with Reforms (ER); agricultural programs; and CCT Program. He lamented the inefficiency and insufficiency in land distribution and agrarian support services, irrigation, and basic employment and housing. He remarked that the Bill also retained the pork barrel under another name. 12. In voting against the Bill, Rep. Luzviminda C. Ilagan said it perpetuated the spoils system of national budgeting, retained the PDAF in some other name, and usurped Congress power of the purse by allowing lump sum appropriations. She stressed that it was also proof of the governments antipoor policies such as public-private partnership which

15 drew away funds for socioeconomic programs for marginalized sectors. 13. Rep. Tupay T. Loong voted for the measure. He however stressed his concern about its noninclusion of a provision of the 2013 General Appropriations Act (GAA) which mandates the agencies concerned to inform the Members of the projects and services that were being implemented in their districts. 14. Rep. Edgardo R. Masongsong likewise voted for the measure as he opined that it reflected the aspiration for good governance. He cited reforms in the budgeting process such as the bottom-up budgeting; prioritization of programs to reduce poverty and expand the economy; and increase in allocations for education, infrastructure, and social programs. He commended the adoption of the performance-informed budget structure and the posting of the national budget in the website of the Department of Budget and Management (DBM), for transparency and public accountability. 15. Rep. Roy V. Seeres Jr. cast an affirmative vote. However, he asked why the Department of Labor and Employment (DOLE) and Department of Foreign Affairs (DFA) did not highlight their program areas, especially the protection of domestic and overseas workers, in their budgetary requests. He stated that he wanted the DFA and the DOLE to be very clear on their budgetary request for the protection of the overseas Filipino workers (OFWs) and the furtherance of national security and economic diplomacy; otherwise, he said he would be constrained to disapprove the proposed budgets of the two said agencies in the 2015 budget deliberations. 16. Speaking in Filipino, Rep. Tiangco opined that even though House Bill No. 2630 was certified as urgent by the President, it should not be exempted from the Rules of the House with regard to the measures distribution to the Members three days prior to its approval on Third Reading as said certification is not applicable considering that the measure does not address any public calamity or emergency. He also contradicted the statements made by Rep. Gonzales and stated that the real intention is for the Members not to carefully read and study the proposed 2014 GAA prior to its approval. Furthermore, he explained that he voted no to the Bill because it contained unconstitutional provisions in the guise of Special Provisions which hamper the fiscal autonomy of the agencies comprising the Constitutional Fiscal Autonomy Group (CFAG).

16 MANIFESTATION OF REP. TUGNA On behalf of Rep. Antonio L. Tinio, Rep. Tugna stated that the former had manifested his intent to submit a written explanation of his negative vote, which the Chair noted. EXPLANATIONS OF VOTE (Continuation) 17. In voting no to House Bill No. 2630, Rep. Arnel U. Ty expressed apprehension on the adverse effects of unsafe liquefied petroleum gas (LPG) to the consumers considering the limited funds and resources given to the Departments of Energy (DOE) and Trade and Industry (DTI) in protecting consumer rights and welfare. Also, he lamented the meager resources given to the National Housing Authority (NHA) considering that it should be augmented to provide housing reconstruction and facilities to the victims of the recent Bohol earthquake. 18. In explaining the Minority blocs no vote to House Bill No. 2630, Rep. Ronaldo B. Zamora submitted the following: a) the proposed 2014 GAA does not present an economic roadmap in achieving inclusive growth in the country and instead, concentrated its resources on the CCT Program which only creates a culture of dependence and entitlement; 2) it gives a bigger percentage to Luzon when the Visayas and Mindanao areas need a larger share thereof; 3) it does not consider off-budget sources of revenue such as the Malampaya Fund, Motor Vehicles Users Charge, PAGCOR Social Fund and the PCSO Charity Fund, and asked who allocates said funds; 4) it continues with other lump sum appropriations that completely negate the constitutional power of the purse of Congress; and 5) the P300 billion set aside as interest payment for public debt, with the government having no timetable for total loan repayment, implies a debt-ridden future for generations of Filipinos. He expressed hope that the 2014 budget would herald the removal of lump sum appropriations, and that the Committee would continuously pursue efforts to regain the Bodys power of the purse. 19. At the outset, Rep. Carlos Isagani T. Zarate recalled that in early July 2013 when he, together with six other members of the Makabayan bloc, filed a measure calling for the abolition of the pork barrel, some colleagues branded their move as futile and a waste of time and that even President Aquino did not mention anything about the issue during his fourth State of the Nation Address.

TUESDAY, OCTOBER 22, 2013 Voting against the 2014 GAB, Rep. Zarate opined that the pork barrel system is a form of institutionalized patronage that officially tolerates graft and corruption, with the present pork barrel scam proving that the system is inherently corrupt and should be abolished. He lamented that the 2014 national budget retained the lump sum appropriations under the Office of the President, but expressed confidence that although they lost the battle on the floor, the fight is not yet over because the public outrage on the scam will move the issue forward. TRANSMITTAL TO THE SENATE OF HOUSE BILL NO. 2630 On motion of Rep. Gonzales, there being no objection, the Chair directed the Secretary General to immediately transmit to the Senate House Bill No. 2630, as approved on Third Reading. SUSPENSION OF SESSION The Chair motu proprio suspended the session at 7:04 p.m. RESUMPTION OF SESSION The session resumed at 7:07 p.m. QUESTION OF PRIVILEGE OF REP. YAP (A.) Recognized by the Chair, on motion of Rep. Jorge Bolet Banal, Rep. Arthur C. Yap related how the recent earthquake that devastated his province had resulted in deaths, billion-worth of damage to properties, and psychological trauma to almost 80% of the populace. He added that the calamity, which extended up to the Central Visayas, did not spare the nations cultural treasures that were constructed during the Spanish era and were all considered as national historical landmarks. He thereafter thanked the Filipino people for sharing their time, prayers and resources in helping the Boholanos, with no less than the President himself and some Cabinet Secretaries tending to the needs of the victims, and assured that they would all rise to the challenges before them. He said that he filed a measure establishing the Bakod Central Visayas that would appropriate funds for the relief and rehabilitation of Bohol and its people, and further explained its goals and mechanisms. He then asked the Members to immediately pass the proposed budget Bill in order to help the poor victims of the affected provinces.

TUESDAY, OCTOBER 22, 2013 REFERRAL OF REP. YAPS SPEECH On motion of Rep. Tugna, there being no objection, the Body referred the speech of Rep. Yap to the appropriate Committee. Thereafter, the Chair recognized Rep. Henedina R. Abad on a question of personal and collective privilege, upon motion of Rep. Tugna. QUESTION OF PRIVILEGE OF REP. ABAD Rep. Abad rose to respond to allegations regarding the alleged involvement of several government officials, especially her family, in the PDAF scam as well as the release of the Commission on Audits (COA) special report on PDAF utilization from 2007 to 2009. She conveyed her regret that the allegations of graft and fund misuse are again casting a shadow over the integrity of various government agencies, more so of the House of Representatives. Stressing the need for reform and greater transparency, Rep. Abad emphasized the importance of engaging the Filipino citizens in meaningful dialogues and making them active partners in order to accomplish those goals. She refuted the accusations blaming the Abad family on the pork barrel issue which were reported in an article that appeared in the Philippine Daily Inquirer the basis of which, she said, were solely on the statements made by Buhay Party-List Rep. Banal, there being no objection, the Body considered House Resolution No. 413; dispensed with the reading of the text thereof without prejudice to its insertion into the Record of the House; and unanimously adopted the same, entitled: RESOLUTION PROVIDING FINANCIAL ASSISTANCE TO THE VICTIMS OF THE 15 OCTOBER 2013 EARTHQUAKE.
