PCT (Patent Cooperation Treaty) application costs

First of all PCT application aka International Application is not a patent. It is an

international patent application. There is no such a thing like worldwide patent or
international patent. The main point of PCT or international application is that it
works like one application for all countries and it gives a time for applicant to decide
to go or not to go in national phase. PCT application includes international search
report and preliminary examination report. When you are done with these steps it is
easier to apply for national patent in chosen countries. This step is called a national
phase.

Costs are given just for information because they depend very significantly on a
chosen country and chosen search and examination authority(ies).

First step – application itself

Costs related to an application itself is as follows:

1.1. International filling fee – 848EUR (1184USD);
1.2. International filling fee – 84.8EUR (118.4USD) if applicant is also inventor;
2. Fee per sheet over 30 – 10EUR (13USD) for each page;
3. E-filling reduction – 64EUR (89USD);
4. Transmittal fee – depends on each country separately (application receiving office).
Not more than 100EUR;
5. International patent search:
5.1. 1700 EUR if European Patent Office is chosen;
5.2. 390 USD if Russian Patent Office is chosen;
5.3. 2080 USD if US Patent and Trademark Office is chosen.

All together approximately 2000EUR if you file on your own. If you will use patent
attorney (recommended – see previous publication) it will be additional 500EUR at
least.

The next step is to wait for search report and be prepared for requesting a preliminary
examination.

Second step – preliminary examination request

1. Preliminary examination request:

1.1. 1675 EUR if European Patent Office is chosen + handling fee 121 EUR;
1.2. 200 USD if Russian Patent Office is chosen + handling fee 171 USD;
1.3. 600 USD if US Patent and Trademark Office is chosen + handling fee 171 USD.

When examination is requested and fees are paid, then you should wait for
examination report with examiners‘ opinion. Mostly examination report will include
the same previous received search report plus examiners‘ opinion.

Third step – national phase

This is the step where all major costs arise. Before that you had only application, now
you should validate it in your chosen countries. In previous discused issues (European
Patent Costs) we mentioned that for example Europen Patent validated in few
countries will cost you starting from 10000EUR (not counting annuity/renewal fees
payable every year).
